CIRCULAR

Regulations on Measurement for Group 2 Measuring Instruments

Pursuant to the Law on Measurement dated November 11, 2011;

Pursuant to Decree No. 20/2013/NĐ-CP dated February 26, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;

At the request of the Director General of the Standardization, Measurement, and Quality Control Department,

The Minister of Science and Technology issues this Circular to regulate measurement for Group 2 measuring instruments.

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation

1. This Circular regulates measurement for Group 2 measuring instruments (hereinafter referred to as measuring instruments), including: List of measuring instruments, measures to control measurement and calibration cycles of measuring instruments; approval of samples; calibration of measuring instruments.

2. This Circular does not apply to radiation measuring instruments, nuclear measuring instruments, measuring instruments that are goods eligible for preferential treatment or exemption from customs procedures, temporarily imported-reexported goods, goods in transit, goods for transshipment, goods stored in bonded warehouses, goods serving urgent needs, and goods directly serving special measurement activities in the fields of national defense and security.

Article 2. Applicability

1. Organizations and individuals (hereinafter referred to as entities) producing, importing, trading, and using measuring instruments.

2. Calibration and testing organizations designated to inspect measuring instruments.

3. State management agencies on measurement, other organizations and individuals related to the matter.

Article 3. Explanation of Terms

In this Circular, the following terms are understood as follows:

1. Metrological technical requirements is a set of technical measurement characteristics of measuring instruments specified in current Vietnamese Technical Measurement Documents (VTD).

2. Group 2 measuring instruments are measuring instruments used to measure quantities of goods and services in trade, payment, ensuring safety, protecting public health, protecting the environment, in inspections, examinations, judicial appraisals, and other official activities subject to technical measurement requirements specified in current Vietnamese Technical Measurement Documents.

3. Approval of samples is a measurement control measure implemented by the General Department of Standardization, Metrology, and Quality Control to evaluate and confirm that a sample of measuring instruments or a type sample (hereinafter referred to as sample) meets technical measurement requirements.

4. Calibration is a measurement control measure implemented by designated calibration organizations to evaluate and confirm that measuring instruments meet technical measurement requirements.

5. Entity producing measuring instruments is an organization or individual implementing one or more activities such as technology transfer, manufacturing, assembly, improvement, and modification of measuring instruments in Vietnam.

6. Entity importing measuring instruments is an organization or individual importing or entrusting the importation of original measuring instruments.

7. Entity trading measuring instruments is an organization or individual wholesaling, retailing, or acting as agents for the sale of measuring instruments in Vietnam.

8. Other terms shall be understood according to Article 3 of the Law on Measurement dated November 11, 2011.

Chapter II
LIST OF MEASURING INSTRUMENTS, MEASUREMENT CONTROL MEASURES AND CALIBRATION CYCLES

OF MEASURING INSTRUMENTS

Article 4. List of measuring instruments, measurement control measures and calibration cycles of measuring instruments

The list of measuring instruments, measurement control measures and calibration cycles of measuring instruments includes:

Where:

- Symbol "x": Measure must be carried out for measuring instruments;

- Symbol: Measure does not need to be carried out for measuring instruments.

2. Measuring instruments not specified in Clause 1 of this Article, when used for inspection, examination, judicial appraisal, and other official activities of the State, must be calibrated and verified when required by competent state management authorities but do not require sample approval.

Article 5. Amending and Supplementing the List of Measuring Instruments, Measurement Control Measures, and Calibration Cycle of Measuring Instruments

Annually, based on the proposals of ministries, ministerial-level agencies, and management requirements for measurement, the General Department of Standardization, Metrology and Quality (hereinafter referred to as the General Department) will compile and submit to the Ministry of Science and Technology for consideration and decision on amending and supplementing the List of Measuring Instruments, measurement control measures for measuring instruments, and calibration cycle of measuring instruments as stipulated in Article 4 of this Circular.

Chapter III
APPROVAL OF SAMPLES

Section 1
PROCEDURES AND REQUIREMENTS FOR APPROVING SAMPLES

Article 6. Requirements for Sample Approval

1. The sample approval process includes: application for sample approval; testing and evaluating the sample; deciding on sample approval.

2. Sample testing must be conducted by testing organizations listed in the Directory of Testing Organizations designated by the General Department.

The Directory of Designated Testing Organizations is published on the General Department's electronic portal.

3. The sample must have a structure and technical features that prevent impacts from altering its primary measurement characteristics during use; it must be tested, evaluated, and concluded as meeting the specified measurement technical requirements.

4. Producers and importers of measuring instruments approved by samples must ensure that the produced or imported measuring instruments comply with the approved samples.

The applicant shall prepare one (01) set of application documents for sample approval and submit them directly at the office or via postal service to the General Department. The set of documents includes:

1. Application form for approval of measurement instrument model according to Form 1. DM at Appendix issued together with this Circular.

2. Technical documentation of the sample. Documentation must clearly state: operating principle, schematic structural diagram, usage instructions; important structures affecting the primary measurement characteristics of the sample; positions for setting and adjusting primary measurement parameters; locations for affixing seals, inspection stamps, and sealing, and other features if present on the sample; mechanisms or technical features preventing impacts from altering the primary measurement characteristics during use (in Vietnamese or English or both languages).

3. Color photographs of the sample and a CD containing these photographs. The photographs include: One (01) overall photograph of the sample; front (displaying measurement results), back, top, bottom (if applicable), right side, left side views of the sample; separate photographs showing information about identification marks, type, and primary measurement characteristics; electronic circuit boards (if applicable), operation keys; product label location, seal and inspection stamp locations; sealing locations; parts directly affecting the primary measurement characteristics.

The photographs must be the same size, minimum 100 mm x 150 mm but not larger than 210 mm x 297 mm, attached or printed on A4 paper bound in a booklet. Photographs must clearly show the primary measurement characteristics and meet comparison, verification, and compliance checking requirements for produced or imported measuring instruments against the approved sample.

4. Commitment document regarding the software program of the measuring instrument according to Model 2. CKPM attached to this Circular (applicable for measuring instruments operated and controlled by software programs).

5. Set of test and evaluation result documents for the sample as prescribed in Article 12 of this Circular.

In cases where the applicant requests exemption or reduction in sample testing in the application for sample approval of measuring instruments, the set of documents shall include relevant materials concerning the exemption or reduction in testing as stipulated in Article 10 of this Circular.

6. List of documents on the development and implementation of management and technical measures to ensure that produced or imported measuring instruments comply with the approved sample.

Article 8. Processing registration approval sample files

1. Within seven (07) working days from the date of receipt of the file, if the file is incomplete or invalid, the General Department shall notify in writing to the entity the contents that need to be amended or supplemented.

2. In case the file requests exemption or reduction of sample testing but lacks sufficient grounds for such exemption or reduction, the General Department shall notify in writing to the entity about the necessity to test the sample and/or supplement and complete the registration approval sample file.

3. Within twenty (20) working days from the date of receiving the notification from the General Department, if the entity does not have sufficient files to supplement, the entity must send a written notice to the General Department detailing the reasons and completion time. The processing of the file can only continue once the file is complete and valid.

4. Within ten (10) working days from the date of receiving the valid file, the General Department shall issue a decision to approve the sample in accordance with Article 13 of this Circular.

Article 9. Sample Testing

1. Sample testing shall be conducted by the entity registering for sample approval, selected and implemented according to an agreement with the designated testing organization.

2. The number of samples tested and the procedures for sample testing shall be carried out according to the corresponding testing process issued by the General Department.

3. In cases where there is no testing process for the sample, the General Department shall designate a testing organization to develop, submit to the General Department for approval of a temporary testing process, and proceed with sample testing.

The basis for developing a temporary testing process includes recommendations from the International Legal Metrology Organization (OIML), standards from the International Electrotechnical Commission (IEC), standards from the International Organization for Standardization (ISO), national standards (TCVN), basic standards (TCCS), foreign standards, and relevant technical regulations related to the sample.

Article 10. Exemption and Reduction of Sample Testing

1. Exemption from sample testing applies to one of the following situations:

a) Imported measuring instruments with an international metrological organization's certificate of conformity or with a sample approval certificate from a competent authority of another country recognized by the General Department regarding the sample testing results of those measuring instruments;

b) Measuring instruments produced or imported based on a sample approved for another entity and permitted in writing by that entity;

c) Imported measuring instruments within equipment or synchronized production lines approved by a competent state management agency.

2. Reduction of sample testing may be considered and applied in one of the following situations:

a) Measuring instruments modified or improved from a sample already approved for the registering entity but which changes one or more key metrological characteristics compared to the approved sample;

b) Measuring instruments of the same type as the sample already approved for the registering entity.

The General Department will consider and decide on the reduction and degree of reduction of sample testing.

Article 11. Sample Evaluation

1. The evaluation of tested samples shall be carried out by the testing organization conducting the sample testing.

In cases where the sample is exempted from testing, the General Department shall designate an organization to conduct the sample evaluation.

2. Content of sample evaluation:

a) The conformity of the sample testing results with the corresponding metrological technical requirements;

b) The conformity of the structure and technical features of the sample with the requirements to prevent impacts that change the key metrological characteristics of the measuring instruments produced or imported based on the approved sample during use;

c) The conformity of the images of the sample with the requirements to ensure comparison, verification, and checking the conformity of the measuring instruments produced or imported with the approved sample;

d) The conformity of the management and technical measures established and applied by the entity with the requirements stipulated in Clause 4 of Article 6 of this Circular.

3. Methods of evaluation:

a) Reviewing the registration file and related documents;

b) Discussing with technical experts about relevant information;

c) On-site inspection at the entity (in cases where methods of evaluation specified in points a and b of Clause 3 of this Article have been implemented but lack sufficient grounds for conclusion).

Article 12. Documents of testing and evaluation results

Upon completion of the testing and evaluation process, the organization conducting the testing and evaluation shall prepare one (01) set of documents to submit to the General Department. The documents include:

1. A consolidated report on the testing and evaluation results of measuring instruments according to Model 3. BCPDM in the Appendix issued together with this Circular.

2. Test certificates and test result minutes according to the prescribed model in the corresponding testing procedure (for samples that must be tested as required).

Article 13. Decision Approving Sample

1. Based on the valid registration approval sample documents and testing and evaluation result documents, the General Department will review and decide to approve the sample for the entity.

In case the entity's documents do not meet the requirements, the General Department will issue a document rejecting the sample approval and clearly state the reasons.

2. The decision approving the sample includes the following main contents:

a) Name and main office address of the entity;

b) Manufacturer name and country of production (for imported samples);

c) Sample code and type;

d) Main metrological characteristics of the sample;

đ) Sample approval code;

e) Validity period.

a) The validity period of the sample approval decision and extension decision is ten (10) years from the date of signing;

b) The validity period of the adjustment decision follows the most recent approved sample approval decision prior to it.

4. The sample approval code is specified in Model 4. KHPDM in the Appendix issued together with this Circular.

5. The sample approval decision is sent to the entity and the local Standard Measurement Quality Control Sub-Department where the entity has registered its main office.

6. The decision and image of the approved sample are published on the General Department’s electronic information portal.

Article 14. Retention of Approved Sample Documents

1. The set of documents of an approved sample includes: the sample approval decision, the registration approval sample documents stipulated in Article 7, and the testing and evaluation result documents stipulated in Article 12 of this Circular.

2. One (01) set of documents is retained at the General Department. The entity is responsible for preparing one (01) set of documents of the approved sample and retaining them at the entity.

3. The retention period is five (05) years after the sample approval decisions, adjustment decisions, and extension decisions have expired.

Section 2
EXTENSION OF EFFECTIVENESS, AMENDMENT OF CONTENTS, SUSPENSION,

REVOCATION OF THE APPROVAL DECISION

1. The effectiveness extension can only be implemented once for each approval decision.

a) An application for extending the effectiveness of the measuring instrument approval decision according to Model 5. ĐNGHPDM in the Appendix issued together with this Circular;

b) A copy (certified true copy by the entity) of the approval decision.

3. Based on the application documents, the General Department will review and decide to extend the effectiveness of the approval decision (hereinafter referred to as the extension decision) according to Article 13 of this Circular.

4. The extension decision and the application documents for extending effectiveness are retained according to Article 14 of this Circular.

1. In case of requesting to change the name or address of the main office of the entity with the approved sample

a) The entity shall prepare one (01) set of application documents for amendment and submit directly at the headquarters or through postal service to the General Department. The set of documents includes:

- A letter requesting amendment;

- Relevant documents related to the content of the request for amendment.

- The letter clearly states the content of the request for amendment;

- Relevant documents related to the content of the request for amendment.

b) Within seven (07) working days from the date of receiving valid documents, the General Department shall examine and issue guidance documents for the entity to implement the approval of a new sample or issue the decision on amendment in accordance with the provisions of Article 13 of this Circular regarding the content of the amendment.

3. The decision on amendment and the application documents for amendment shall be kept in accordance with the provisions of Article 14 of this Circular.

Article 17. Suspension of Effectiveness of the Approval Decision

1. Partial or full suspension of effectiveness of the approval decision applies to the following cases:

a) The entity fails to fulfill its obligations as stipulated in Article 23 of this Circular causing serious consequences;

b) The entity has a document requesting the suspension of effectiveness of the approval decision.

2. Depending on specific circumstances, the General Department shall examine and issue the decision on partial or full suspension of effectiveness of the approval decision (referred to as the suspension decision). The suspension period shall not exceed six (06) months from the effective date of the suspension decision.

3. The suspension decision shall be sent to the entity, the local Standard Measurement Quality Control Branch where the entity registers its main office, and published on the General Department's electronic information portal.

4. During the suspension period specified in Clause 2 of this Article, after completing the rectification of consequences due to non-compliance with obligations as stipulated in this Circular, the suspended entity may prepare one (01) set of documents to request the cancellation of the suspension decision and submit it via postal service or directly at the General Department's headquarters. The set of documents includes:

a) A letter requesting the cancellation of the suspension decision;

b) Documents and records proving the completion of rectifying the consequences.

5. Depending on specific circumstances, the General Department shall decide whether to review the documents or conduct an on-site inspection regarding the rectified consequences.

6. Within seven (07) working days from the date of receiving the documents, if the documents do not comply with regulations, the General Department shall notify the entity of the required supplements or amendments.

7. Within seven (07) working days from the date of receiving complete valid documents, the General Department shall issue the decision to cancel the suspension decision (referred to as the cancellation decision).

8. Retention of the suspension decision and documents, and the documents requesting the cancellation of the suspension effect shall be carried out in accordance with the provisions of Article 14 of this Circular.

Article 18. Revocation of Effectiveness of the Approval Decision

1. Revocation of effectiveness of the approval decision applies to the following cases:

a) The entity with the approved sample goes bankrupt, dissolves, or seriously violates the law;

b) The entity has a suspension decision that exceeds the suspension period but does not complete the rectification of consequences;

c) The entity has a document requesting to cease production or importation of measuring instruments according to the approved sample.

2. The General Department shall issue the decision to revoke the effectiveness of the approval decision (referred to as the revocation decision).

3. The revocation decision shall be sent to the entity, the local Standard Measurement Quality Control Branch where the entity registers its main office, and published on the General Department's electronic information portal.

Chapter IV
Serial

Section 1
GENERAL REQUIREMENTS FOR VERIFICATION

Article 19. Calibration Regimes

1. Initial calibration is the first calibration of measuring instruments before they are put into use.

2. Periodic calibration is the calibration carried out according to the cycle specified in Clause 4 of this Circular for measuring instruments during their use.

Comparative calibration is a form of periodic calibration conducted in accordance with the requirements stipulated in Section 2 Chapter IV of this Circular.

3. Post-repair calibration is the calibration of measuring instruments in any of the following cases:

a) Measuring instruments have been repaired due to not meeting technical measurement requirements;

b) The calibration certificate (calibration mark, calibration label, calibration certification paper) of the measuring instrument is lost, damaged, or otherwise impaired but the structure and technical measurement characteristics of the measuring instrument remain unchanged from the approved model;

c) Based on the conclusion of inspections or checks by competent authorities;

d) Users of measuring instruments discover signs indicating that the measuring instruments may not meet technical measurement requirements and request re-calibration.

Article 20. Requirements for Calibration Implementation

1. Calibration shall be selected and carried out by the entity owning the measuring instrument through an agreement with a designated calibration organization having an appropriate scope of calibration listed in the Directory of Designated Calibration Organizations.

The Directory of Designated Calibration Organizations is published on the website of the General Department.

2. Calibration shall be performed by metrology inspectors of the designated calibration organization. Metrology inspectors must be certified and issued a card in accordance with regulations.

3. Calibration shall be conducted in accordance with the procedures and formalities prescribed in the corresponding measuring instrument calibration process issued by the General Department.

4. In case there is no calibration process for a measuring instrument, the General Department shall designate an organization to develop, submit to the General Department for approval a temporary calibration process and proceed with calibration.

The basis for developing a temporary calibration process includes recommendations from the International Legal Metrology Organization (OIML), standards from the International Electrotechnical Commission (IEC), standards from the International Organization for Standardization (ISO), national standards (TCVN), basic standards (TCCS), foreign standards, and relevant technical specifications related to the model.

5. Calibration certificates shall be made according to a unified template nationwide.

6. Calibration certificates must be printed, manufactured, distributed, managed, and used in accordance with regulations. Calibration certificates issued to measuring instruments that meet requirements are valid throughout the country.

7. The validity period of calibration certificates will terminate upon occurrence of any of the following circumstances:

a) The calibration cycle has expired;

b) There has been a change or improvement that alters the technical measurement characteristics of the measuring instrument;

c) The measuring instrument is damaged or does not meet technical measurement requirements;

d) Calibration certificates are lost, damaged, or otherwise impaired.

Section 2
REQUIREMENTS FOR COMPARATIVE CALIBRATION

Article 21. Measuring Instruments Subject to Comparative Calibration

1. Measuring instruments subject to comparative calibration include:

a) Electric meters;

b) Cold water meters.

2. According to management requirements at different stages, the General Department proposes to the Ministry of Science and Technology to amend and supplement the list of measuring instruments subject to comparative calibration under Clause 1 of this Article.

Article 22. Requirements for Comparative Testing

1. The organization entrusted to carry out comparative testing (hereinafter referred to as the comparative testing organization) must meet the following requirements:

a) The comparative testing organization must be included in the List of organizations authorized for testing as prescribed in Clause 1, Article 20 of this Circular by the General Department.

b) In terms of quantity: not less than two (02) organizations for one (01) type of measuring instrument must be subject to comparative testing within the territory of one (01) province or centrally governed city.

2. The number of measuring instruments tested at each comparative testing organization shall be determined based on the total number of measuring instruments required to undergo comparative testing within one (01) year in the territory of one (01) province or centrally governed city and the management requirements of the local authority regarding measurement.

3. The determination and announcement of the specific number and names of comparative testing organizations, and the number of measuring instruments required to undergo comparative testing at each comparative testing organization within the local area shall be carried out by the General Department after consulting the opinions of the Provincial or City Standardization, Measurement, and Quality Control Agency.

4. Comparative testing shall be conducted in accordance with the provisions of Clauses 2, 3, 4, 5, 6, and 7 of Article 20 of this Circular.

Chapter V
RESPONSIBILITIES OF STATE AUTHORITIES IN ORGANIZING AND IMPLEMENTING MEASURES

ON MEASUREMENT,ORGANIZATIONS AND INDIVIDUALS

Article 23. Responsibilities of Producers and Importers of Measuring Instruments

1. Implement the regulations on approval of measuring instrument models as stipulated in Chapters II and III of this Circular when producing or importing measuring instruments.

2. Produce or import measuring instruments according to the approved model.

3. Implement measures to prevent and combat interference that alters the primary metrological characteristics of measuring instruments during use.

4. Conduct initial verification of measuring instruments in accordance with the provisions of Chapter IV of this Circular.

5. Comply with inspection and supervision activities related to measurement by competent state agencies as prescribed by law.

6. Implement the provisions of this Circular and other relevant laws.

7. Annually before March 31 or upon request for management purposes, prepare a report on the situation of production and importation of measuring instruments and submit it to the General Department.

Article 24. Responsibilities of Businesses Trading in Measuring Instruments

1. Trade in measuring instruments whose models have been approved as prescribed.

2. Provide customers with information about the metrological technical characteristics of measuring instruments.

3. Comply with inspection and supervision activities related to measurement by competent state agencies as prescribed by law.

Article 25. Responsibilities of Users of Measuring Instruments

1. Ensure storage and usage conditions for measuring instruments in accordance with the manufacturer's specifications and technical requirements of the competent state agency for measurement.

2. Carry out periodic verification and post-repair verification of measuring instruments during use in accordance with the provisions of Chapter IV of this Circular.

3. Adhere to the professional qualifications, expertise, and work experience requirements for personnel using measuring instruments when conducting group measurements as prescribed by the competent state agency for measurement.

4. Ensure conditions as prescribed for persons with rights and obligations to monitor and inspect the implementation of measurements, measurement methods, measuring instruments, and quantities of goods.

5. Comply with inspection and supervision activities related to measurement by competent state agencies as prescribed by law.

Article 26. Responsibilities of organizations designated for verification and testing of measuring instruments

1. Carry out verification and testing of measuring instruments in accordance with the provisions of this Circular.

2. Fulfill customer requests for verification and testing of measuring instruments except in cases of force majeure.

3. Implement the production and management of use of verification and testing certificates in accordance with the regulations.

4. Manage the activities of verification and testing of measuring instruments by metrology verifiers and testing staff.

5. Comply with inspection and supervision activities related to measurement by competent state agencies as prescribed by law.

6. Annually before March 31 or at any time upon request for state management, prepare reports on verification and testing activities and submit them to the General Department and the local Standard Metrology Quality Control Agency where the verification and testing organization has its main office.

Article 27. Responsibilities of the General Department of Standard Metrology Quality Control

1. Issue technical measurement documents of Vietnam regarding measurement technical requirements, verification procedures, and testing procedures for measuring instruments.

2. Approve samples of measuring instruments.

3. Designate organizations for verification and testing of measuring instruments in accordance with the regulations.

4. Annually before June 30 or at any time upon request for state management, notify in writing the local Standard Metrology Quality Control Agency and related organizations and individuals about the number of measuring instruments that must be verified and the organizations designated to conduct comparative verification in the locality.

5. Inspect and supervise the implementation of this Circular in accordance with the law.

Article 28. Responsibilities of Provincial Departments of Science and Technology under Central Cities

1. Direct the local Standard Metrology Quality Control Agency to implement state supervision over measurement for measuring instruments within the scope of responsibility specified in Clause 3, Article 13 of Decree No. 86/2012/ND-CP dated October 19, 2012 of the Government detailing and guiding the implementation of certain provisions of the Law on Measurement.

2. Direct the Department Inspectorate to inspect and supervise compliance with laws on measurement in the locality, handle complaints and denunciations, and deal with violations of measurement according to the law.

Article 29. Responsibilities of Provincial Standard Metrology Quality Control Agencies under Central Cities

1. Provide information, promote, and guide relevant organizations and individuals to implement the provisions of this Circular.

2. Conduct state supervision over measurement for measuring instruments in the locality within the scope of responsibility specified in Clause 3, Article 13 of Decree No. 86/2012/ND-CP dated October 19, 2012 of the Government detailing and guiding the implementation of certain provisions of the Law on Measurement.

3. Annually before May 30 or at any time upon request for state management, prepare reports on the implementation of comparative verification, propose the number of measuring instruments that must be verified, the organizations designated to conduct comparative verification in the locality, and submit them to the General Department and the local Department of Science and Technology.

Chapter VI
IMPLEMENTING PROVISIONS

Article 30. Effective Date

1. This Circular takes effect from November 15, 2013.

2. Repeal the effectiveness of the following documents:

a) Decision No. 1073/QĐ-BKHCNMT dated May 17, 2002 of the Minister of Science, Technology and Environment (now the Ministry of Science and Technology) on issuing the Verification Procedure for Measuring Instruments;

b) Decision No. 65/2002/QĐ-BKHCNMT dated August 19, 2002 of the Minister of Science, Technology and Environment (now the Ministry of Science and Technology) on issuing the "List of Measuring Instruments Required for Verification and Registration for Verification";

c) Decision No. 22/2006/QĐ-BKHCN dated November 10, 2006 of the Minister of Science and Technology on approving samples of measuring instruments;

d) Decision No. 13/2007/QĐ-BKHCN dated July 6, 2007 of the Minister of Science and Technology on issuing the "List of Measuring Instruments Required for Verification";

Article 31. Transitional Provisions

1. Measuring instruments that were in use prior to the effective date of this Circular but have not been approved according to the regulations shall have their users establish registration files for sample approval in accordance with Clauses 1, 2, 3, and 4 of Article 7 of this Circular and submit them to the General Department.

Based on the quantity and types of measuring instruments proposed for approval, the General Department will examine and decide whether to review the registration files or conduct on-site inspections and evaluations to approve the samples for the user. The cost of on-site evaluation shall be borne by the user.

2. Manufacturers and importers of measuring instruments with valid sample approval certificates issued pursuant to Decision No. 22/2006/QĐ-BKHCN dated November 10, 2006 of the Minister of Science and Technology may continue to produce and import measuring instruments consistent with the approved samples and in accordance with the provisions of this Circular until the expiration of the validity period of the sample approval certificate issued to them.

Article 32. Implementation Organization

1. The General Department of Standard Metrology Quality Control guides and organizes the implementation of this Circular.

2. Relevant state agencies, organizations, and individuals are responsible for implementing this Circular.

3. During the implementation process, if difficulties or obstacles arise, they should be reported to the Ministry of Science and Technology for consideration and resolution./.

1. THE APPROVAL SAMPLE MARK MUST BE LOCATED WHERE IT CAN BE EASILY SEEN AND READ, AND NOT DAMAGED DURING USE, TRANSPORTATION, AND STORAGE OF THE MEASUREMENT EQUIPMENT.

2. THE APPROVAL SAMPLE MARK CONSISTS OF THREE GROUPS OF LETTERS AND NUMBERS:

a) THE FIRST GROUP CONSISTS OF THE THREE LETTERS PDM;

b) THE SECOND GROUP IS THE SERIAL NUMBER OF THE APPROVED SAMPLE IN THE YEAR;

c) THE THIRD GROUP CONSISTS OF FOUR DIGITS INDICATING THE APPROVAL YEAR.

THERE IS A SPACE BETWEEN THE FIRST GROUP AND THE SECOND GROUP. THERE IS A DASH BETWEEN THE SECOND GROUP AND THE THIRD GROUP.
