Provisions on certain contents regarding traditional flags, insignia, symbols, customs insignia, badges, rank insignia, uniforms, customs identification cards

Pursuant to Decree No. 10/2005/NĐ-CP dated January 31, 2005 of the Government on traditional flags, insignia, symbols, customs insignia, badges, rank insignia, uniforms, customs identification cards;
Pursuant to Decree No. 215/2013/NĐ-CP dated December 23, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
At the proposal of the Director of the Administrative and Public Service Financial Department;
The Minister of Finance issues this Circular providing for certain contents regarding traditional flags, insignia, symbols, customs insignia, badges, rank insignia, uniforms, customs identification cards as follows:
Article 1. Scope of application
1. Officials, civil servants, and employees (hereinafter collectively referred to as civil servants) currently working in the Customs sector.
2. For persons working under labor contracts in the Customs sector according to the provisions of Decree No. 68/2000/NĐ-CP dated November 17, 2000 of the Government, they shall be entitled to issue and use certain types of uniforms suitable as specified in Clause 3, Article 2 of this Circular.
Article 2. Standards for Customs uniforms
1. General uniform standards for Customs civil servants (per civil servant)
a) Spring and summer suit: 01 set/year (first year, 02 sets)
- Male: 01 short-sleeved shirt, 01 pair of pants;
- Female: 01 short-sleeved shirt, 01 pair of pants, 01 skirt (jupe).
b) Autumn and winter suit: 02 years/set (first year, 02 sets).
c) Formal attire: 05 years/set.
d) White shirt worn with formal attire, autumn and winter: 01 year/piece (first year, 02 pieces).
đ) Cap, soft hat: 02 years/piece.
e) Formal cap: 05 years/piece.
g) Tie (cravat): 02 years/piece.
h) Leather shoes, cloth shoes: 01 year/pair.
i) White gloves: 03 years/issue (used during solemn ceremonies).
- For units with a staff of 300 or more, 50 pairs/issue.
- For other units, 30 pairs/issue.
k) Raincoat: 03 years/piece or 1 set.
l) Socks: 01 year/2 pairs.
m) Belt: 02 years/piece.
n) Badge, rank insignia, customs insignia: Replace when damaged.
o) Woolen coat: 04 years/piece.
p) Sweater: 03 years/piece.
q) Customs nameplate: 02 pieces/initial issue; if damaged, replace. The Director of the General Department of Customs decides on the model of the Customs nameplate.
2. Additional uniform standards for Customs civil servants engaged in special tasks
a) For civil servants regularly working at border gates, islands, anti-smuggling control on the sea where cold weather affects, in addition to the uniform standards for Customs officers stipulated in Clause 1 above, they will also be provided with the following additional items:
- Blanket: 04 years/piece.
- Woolen hat: 03 years/piece.
- Mattress: 04 years/piece.
- Slippers: 03 years/pair.
- Woolen gloves: 02 years/pair.
b) For Customs civil servants regularly performing duties such as inspecting actual goods for export and import, checking means of transport for departure and arrival, guiding service dogs, operating and repairing ships, working in laboratories (belonging to the Center for Export and Import Goods Analysis and Classification)... in addition to the uniform standards for Customs officers stipulated in Clause 1 above, they will also be provided with the following additional items:
- Protective work clothing: 01 year/set.
- Protective work gloves: 01 year/pair.
- Protective work hat: 02 years/piece.
- Gilè (a type of jacket specified by the General Department of Customs): 02 years/piece.
- White lab coat: 02 years/piece.
3. Uniform standards for persons working under labor contracts (per person) according to the provisions of Decree No. 68/2000/NĐ-CP dated November 17, 2000 of the Government on implementing contractual systems for certain types of work in administrative agencies and public institutions (hereinafter referred to as Decree No. 68/2000/NĐ-CP):
a) Persons working in the Customs sector under labor contracts according to Decree No. 68/2000/NĐ-CP directly related to specialized and professional tasks equivalent to those performed by officials, civil servants, and employees, including information technology officers, export and import goods analysts, drivers, laboratory workers, sailors, ship mechanics working on anti-smuggling patrol vessels, dog trainers, security guards, will be issued annually according to the following uniform standards for Customs officers:
- Spring and summer uniform, autumn and winter uniform, formal attire (different from Customs uniforms);
- Other items: cap, soft hat, formal cap, tie, leather shoes, raincoat, socks, belt, woolen coat, sweater;
- Badge, rank insignia, customs insignia: Replace when damaged (rank insignia different from Customs officers).
b) Persons working in the Customs sector under labor contracts according to Decree No. 68/2000/NĐ-CP such as receptionists, electricians, water supply workers, sanitation workers, and other service personnel will be issued annually according to the following uniform standards for Customs officers:
- Spring and summer uniform, autumn and winter uniform, formal attire (different from Customs uniforms);
- Other items: leather shoes, raincoat, socks, belt, woolen coat, sweater.
c) For persons working in the Customs sector under labor contracts according to Decree No. 68/2000/NĐ-CP who regularly perform special tasks, in addition to the common uniform standards, they will also be provided with additional uniform standards similar to those for Customs officers engaged in similar special tasks as stipulated in Clause 2 of Article 2.
Article 3. Regulations on the manufacture, supply, use, and management of customs uniforms
1. Funding for the manufacture of customs uniforms:
The fabric and materials used to make customs uniforms must ensure durability and aesthetics. The General Department of Customs proposes specific standards for fabric and materials used in the manufacture of uniforms, which are reported to the Ministry of Finance for approval annually. In cases where domestic fabric and materials are not available, the General Department of Customs reports to the Ministry of Finance for approval to purchase and ensure suitability.
Funding for the manufacture of customs uniforms is guaranteed by the General Department of Customs within its annual budget for operational activities.
2. Methods of organizing the manufacture and supply of uniforms:
a) The General Department of Customs implements centralized manufacturing and manages the distribution and use of uniforms for the entire sector: traditional flags of customs, customs flags, customs symbols, customs insignia, rank badges, shoulder patches, spring-summer clothing, autumn-winter clothing, ceremonial attire, white shirts, peaked caps, soft hats, fur hats, raincoats, belts, ties, shoes, and other annual uniforms for units within the sector.
b) The Director of the General Department of Customs stipulates and decides on the manufacture and supply of uniforms for subordinate units for small and sporadic manufacturing batches to meet specific requirements.
c) Annual uniform distribution time: One distribution per year in April.
3. Methods of using customs uniforms:
The Director of the General Department of Customs is responsible for providing detailed guidance on the use of customs uniforms.
Article 4. Regulations on the issuance and use of customs identification cards
1. Issuance and use of customs identification cards:
The Director of the General Department of Customs organizes the issuance of customs identification cards to customs officials according to prescribed models; provides guidance on their use and management.
2. Use of customs identification cards:
a) Customs officials may use their customs identification cards while performing duties in accordance with their assigned functions, responsibilities, and authorities as provided by law. The customs identification card does not replace a letter of introduction.
b) It is strictly prohibited to forge, erase, alter, lend, or borrow customs identification cards from others.
State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.
This Circular takes effect from April 3, 2014.
The Circular No. 41/2005/TT-BTC dated May 26, 2005 of the Ministry of Finance guiding certain provisions of the Government Decree No. 10/2005/NĐ-CP dated October 31, 2005 regarding traditional flags, customs flags, symbols, customs insignia, shoulder patches, uniforms, and customs identification cards, and the Circular No. 61/2011/TT-BTC dated May 12, 2011 of the Ministry of Finance amending and supplementing the Circular No. 41/2005/TT-BTC dated May 26, 2005 of the Ministry of Finance are hereby abolished.
2. The Director of the General Department of Customs is responsible for deciding the model and style of uniforms and managing and using uniforms as specified in Clause 3, Article 2 of this Circular./.
