PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

1. This Circular stipulates the code, standards for the position titles and career qualifications, and the appointment and salary grading according to these career qualifications for high school teachers in public high schools within the national education system that offer secondary education (hereinafter referred to collectively as public high schools).

2. This Circular applies to high school teachers in public high schools within the national education system.

Article 2. Code and classification of position titles and career qualifications for high school teachers in public high schools

The position titles and career qualifications for high school teachers in public high schools within the national education system include:

1. High School Teacher Grade I - Code: V.07.05.13

2. High School Teacher Grade II - Code: V.07.05.14

3. High School Teacher Grade III - Code: V.07.05.15

Article 3. General Standards for Professional Ethics of High School Teachers

Point 1. To be conscious of cultivating ethics, to demonstrate high sense of responsibility, to maintain personal integrity, honor, and reputation as a teacher; to set a good example for students.

2. Loving, treating students fairly and respecting their personalities; protecting their legitimate rights and interests; uniting and helping colleagues.

Point 3. Other ethical standards for teachers as prescribed in the Education Law and the Civil Servant Law.

Chapter II

STANDARDS FOR THE POSITION TITLES AND CAREER QUALIFICATIONS OF HIGH SCHOOL TEACHERS HIGH SCHOOL

Article 4. High School Teacher Grade I - Code V.07.05.13 In addition to the duties of a High School Teacher Grade II, a High School Teacher Grade I must also perform the following duties:

1. Tasks

a) Participating in editing, compiling, and developing training programs and materials for high school teachers and students;

b) Participating in guiding, evaluating, and reviewing colleagues' practical experience and applied educational science research topics;

c) Guiding and evaluating high school students' scientific and technological research projects at provincial level or higher;

d) Leading the development of specialized training programs or participating in provincial-level or higher educational science research and practical experience topics;

đ) Participating in the inspection of professional and vocational skills of high school teachers at provincial level;

e) Participating in the jury of provincial-level excellent high school teacher teaching competitions or excellent high school teacher class management competitions;

g) Participating in training, setting questions, and marking in provincial-level or higher high school student excellence competitions;

h) Participating in organizing and evaluating provincial-level or higher high school student competitions.

a) Having a master's degree or equivalent in the subject taught or above; if serving as deputy principal, it can be substituted with a master's degree in educational management or above; having a certificate in high school teacher professional training if not holding a bachelor's degree in education;

2. Qualification requirements for education and training

b) Having a foreign language proficiency level of Level 3 as prescribed in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014 of the Ministry of Education and Training on the six-level foreign language proficiency framework for Vietnam or having a certificate in ethnic languages for positions requiring ethnic language usage;

For foreign language teachers, the second foreign language proficiency level must reach Level 3 as prescribed in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014 of the Ministry of Education and Training on the six-level foreign language proficiency framework for Vietnam.

c) Having computer skills reaching the basic standard for information technology use as prescribed in Circular No. 03/2014/TT-BTTTT dated March 11, 2014 of the Ministry of Information and Communications on the Standard for Information Technology Usage Skills;

d) Having a certificate in training for High School Teacher Grade I.

a) Proactively promoting and mobilizing colleagues to implement Party and State policies, laws, and regulations and requirements of the industry and locality regarding secondary education;

3. Professional Qualification Standards

b) Guiding colleagues to implement secondary education plans and programs;

c) Creatively applying and evaluating the application of educational theory and adolescent psychology knowledge in the practical education of secondary school students by colleagues;

d) Flexibly applying knowledge about domestic and international economics, culture, and society to effectively guide secondary school students' career choices;

đ) Actively and flexibly organizing and coordinating with colleagues, parents of students, and the community to improve the effectiveness of secondary school student education;

e) Having the ability to creatively apply and disseminate practical experience or applied educational science research products at provincial level or higher;

g) Having the ability to guide and evaluate secondary school students' scientific and technological research products at provincial level or higher;

h) Being recognized as a provincial-level labor model or excellent high school teacher or excellent high school teacher class manager at provincial level;

i) A civil servant promoted from the position title of High School Teacher Grade II to High School Teacher Grade I must have held the position title of High School Teacher Grade II or equivalent for at least 06 (six) years, including at least 01 (one) year in the most recent period.

i) An officer promoted from the position of secondary school teacher grade II to secondary school teacher grade I must have held the position of secondary school teacher grade II or equivalent for at least 06 (six) years, including a minimum of 01 (one) year in the most recent period holding the position of secondary school teacher grade II.

Article 5. Secondary School Teacher Grade II - Code V.07.05.14

1. Tasks

In addition to the duties of a Secondary School Teacher Grade III, a Secondary School Teacher Grade II must also perform the following tasks:

a) Serve as a lecturer or demonstrate teaching at secondary school teacher training courses or trial new models and methods;

b) Guide student teachers in practical training when assigned;

c) Effectively apply innovative ideas and experiences, participate in evaluating or guiding colleagues in writing innovative ideas and experiences, applied educational scientific research products at the school level or higher;

d) Participate in guiding or evaluating high school students' scientific and technological research products at the school level or higher;

đ) Lead content for professional development and specialized topic activities within subject departments;

e) Participate in professional inspection and supervision for secondary school teachers at the school level or higher;

g) Participate in the jury of competitions for excellent secondary school teachers or excellent secondary school class advisors at the school level or higher;

h) Participate in setting questions and grading high school students' excellence exams at the school level or higher;

i) Participate in organizing and evaluating competitions for high school students at the school level or higher.

2. Qualification requirements for education and training

a) Hold a bachelor's degree in education or a relevant field and have a certificate in secondary school teacher professional development;

b) Possess a foreign language proficiency level of Level 2 as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014, issued by the Ministry of Education and Training on the six-level foreign language proficiency framework for Vietnam, or a certificate in ethnic languages for positions requiring ethnic languages;

For foreign language teachers, the second foreign language proficiency level must reach Level 2 as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014, issued by the Ministry of Education and Training on the six-level foreign language proficiency framework for Vietnam;

d) Having a certificate in training for High School Teacher Grade I.

3. Professional Qualification Standards

a) Be well-versed in the Party and State's policies, laws, regulations, and requirements of the industry and locality regarding secondary education;

b) Effectively implement plans and curricula for secondary education;

c) Flexibly apply and guide colleagues in applying knowledge about education and age-specific psychology to the practical education of secondary school students;

đ) Actively cooperate with colleagues, parents of students, and the community to enhance the effectiveness of secondary school student education.

e) Possess the ability to effectively apply, evaluate, or guide colleagues in writing innovative experiences, products of applied educational scientific research at the school level or higher.

g) Possess the ability to guide and evaluate the scientific and technical research products of secondary school students at the school level or higher.

h) Be recognized as a model worker at the grassroots level or as an excellent secondary school teacher or excellent secondary school class teacher at the school level or higher.

i) An officer promoted from the position of secondary school teacher grade III to secondary school teacher grade II must have held the position of secondary school teacher grade III or equivalent for at least 06 (six) years, including a minimum of 01 (one) year in the most recent period holding the position of secondary school teacher grade III.

Article 6. Secondary school teacher grade III - Code V.07.05.15

1. Tasks

a) Teaching and educating students according to the secondary school education program and plan;

b) Participating in identifying, nurturing talented and excellent students, and tutoring underperforming students at the secondary school level;

c) Applying innovative ideas, experiences, and results of applied educational scientific research into practical teaching and student education, and making teaching aids and equipment for secondary schools;

d) Reforming teaching methods and evaluating learning outcomes towards promoting students' initiative, positivity, ability formation, and self-study methods at the secondary school level;

đ) Completing training programs; self-studying and self-improving moral character and enhancing professional skills; participating in professional activities;

e) Participating in psychological counseling, career guidance, and vocational training for secondary school students and their parents;

g) Coordinating with class advisors, other teachers, the Communist Youth Union, families, and related social organizations to organize and guide educational activities for secondary school students;

h) Organizing and guiding experiential and creative activities and competitions for secondary school students;

i) Perform other tasks assigned by the principal.

2. Qualification requirements for education and training

a) Having a bachelor's degree in education or a relevant field and a certificate in pedagogical training for secondary school teachers;

b) Having a foreign language proficiency level of 2 as specified in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014 issued by the Ministry of Education and Training on the six-level foreign language proficiency framework for Vietnam or a certificate in ethnic languages for positions requiring ethnic language usage;

For foreign language teachers, the second foreign language proficiency level must reach Level 2 as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014, issued by the Ministry of Education and Training on the six-level foreign language proficiency framework for Vietnam;

c) Having basic information technology skills as stipulated in Circular No. 03/2014/TT-BTTTT dated March 11, 2014 issued by the Ministry of Information and Communications on Basic Information Technology Skill Standards;

3. Professional Qualification Standards

a) Understanding the Party's policies, State laws, regulations, and requirements of the industry and locality regarding secondary school education;

b) Implementing plans and programs for secondary school education;

c) Knowing how to apply knowledge of educational theory and age-specific psychology to practical secondary school student education;

Chapter III

GUIDELINES FOR APPOINTMENT AND SALARY GRADING TEACHER OCCUPATIONAL TITLES

Article 7. Principles for appointment and salary classification according to occupational titles for civil servants

1. The appointment to the occupational title for officers specified in this Circular must be based on the job position, responsibilities, and professional qualifications currently held by the officer, and in accordance with Article 8 of this Circular.

2. When appointing from the current rank of officer to the occupational title of secondary school teacher corresponding to the current rank, it shall not be combined with an increase in salary grade or promotion of the occupational title of officer.

Article 8. Cases for Appointment to Professional Titles

Officers who have been appointed to the ranks of secondary school teachers as stipulated in Decision No. 202/TCCP-VC dated June 8, 1994 of the Minister, Head of the Organizational - Cadre Department of the Government regarding the issuance of professional standards for certain ranks of civil servants in the education and training sector (hereinafter referred to as Decision No. 202/TCCP-VC); Decision No. 61/2005/QĐ-BNV dated June 15, 2005 of the Minister of Home Affairs regarding the issuance of temporary occupational titles and code numbers for certain ranks of officers in the education and training, culture - information sectors (hereinafter referred to as Decision No. 61/2005/QĐ-BNV) are now appointed to the occupational title of secondary school teacher as stipulated in this Circular, as follows:

1. Appointment to the occupational title of secondary school teacher grade II (code number V.07.05.14) for officers currently holding the rank of senior secondary school teacher (code number 15.112).

2. Appointment to the occupational title of secondary school teacher grade III (code number V.07.04.15) for officers currently holding the rank of secondary school teacher (code number 15.113).

Article 9. Salary Grading Method

1. The occupational titles of secondary school teachers are subject to the Professional Salary Scale for cadres and officers in state-run units (Scale 3) issued together with Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the salary system for cadres, civil servants, officers, and armed forces personnel (hereinafter referred to as Decree No. 204/2004/NĐ-CP) as follows:

a) The occupational title of secondary school teacher grade I applies the salary coefficient of officer type A2, group A2.1 (from salary coefficient 4.40 to salary coefficient 6.78).

b) The occupational title of secondary school teacher grade II applies the salary coefficient of officer type A2, group A2.2 (from salary coefficient 4.00 to salary coefficient 6.38).

c) The occupational title of secondary school teacher grade III applies the salary coefficient of officer type A1 (from salary coefficient 2.34 to salary coefficient 4.98).

2. The assignment of salary to the occupational title of officer as stipulated in Clause 1 of this Article for officers who have been assigned salaries to the ranks of secondary school teachers according to Decision No. 202/TCCP-VC; Decision No. 61/2005/QĐ-BNV; Decree No. 204/2004/NĐ-CP and Clause 2 Section II of Circular Joint No. 81/2005/TTLT-BNV-BTC dated August 10, 2005 of the Ministry of Home Affairs and the Ministry of Finance guiding the implementation of the transition from old salary scales to new ones for certain newly added or changed ranks of civil servants and officers in the water resources, education and training, culture - information, health, and market management sectors, shall be carried out as follows:

A civil servant appointed to the teaching profession title of secondary school teacher with the same pay grade coefficient as the old rank shall implement the parallel grading of the pay grade and percentage (%) of seniority allowance exceeding the ceiling (if any) currently enjoyed at the old rank (including the time for the next pay grade promotion review or the seniority allowance exceeding the ceiling review if any at the old rank) into the newly appointed teaching profession title.

Example: Mr. Nguyen Van H has been graded as a secondary school teacher (code 15.113), grade 3, pay coefficient 3.00 since May 1, 2013. Now he is appointed by the competent authority to the teaching profession title of secondary school teacher class III (code V.07.04.15), then he will be graded at grade 3, pay coefficient 3.00 of the secondary school teacher class III position from the date of signing the decision; the time for the next pay grade promotion review will be calculated from May 1, 2013.

3. The promotion of the teaching profession title of secondary school teachers shall be implemented after being appointed to the teaching profession title of secondary school teachers as stipulated in this Circular and implementing the salary grading according to the guidance provided in Clause 1 Section II of Circular No. 02/2007/TT-BNV dated May 25, 2007 of the Ministry of Home Affairs guiding the salary grading when upgrading ranks, transferring ranks, and transferring types of civil servants and civil servants.

Chapter IV

IMPLEMENTING PROVISIONS

Article 10. Effective Date

1. This Circular takes effect from November 3, 2015.

2. Abolish the vocational standards of the secondary school teacher rank for the education and training sector specified in Decision No. 202/TCCP-VC dated June 8, 1994 of the Minister, Head of the Organizational - Cadre Department of the Government on issuing vocational standards for various ranks of civil servants in the education and training sector.

3. Abolish the provisions regarding the titles and codes of the secondary school teacher civil servant ranks specified in Decision No. 61/2005/QĐ-BNV dated June 15, 2005 of the Minister of the Ministry of Home Affairs on temporarily issuing titles and codes for some civil servant ranks in the education and training sector, culture - information sector.

4. Abolish the provisions regarding the list of secondary school teacher civil servant ranks included in the List of Civil Servant Ranks and Civil Servant Ranks issued together with Decision No. 78/2004/QĐ-BNV dated November 3, 2004 of the Minister of the Ministry of Home Affairs.

Article 11. Application Provisions

1. Civil servants who have been appointed to the secondary school teacher ranks according to Decision No. 202/TCCP-VC; Decision No. 61/2005/QĐ-BNV, now appointed to the teaching profession title of secondary school teachers as stipulated in this Joint Circular, the competent authority managing and using civil servants shall create conditions for civil servants to supplement the remaining criteria of the teaching profession title of secondary school teachers appointed.

2. Civil servants who have been appointed to the secondary school teacher rank not meeting the standard (code 15c.207) specified in Decision No. 61/2005/QĐ-BNV up to the date this Joint Circular takes effect and do not meet the conditions and criteria for appointment to the teaching profession title of secondary school teacher class III shall be retained and implement the systems and policies at the current rank for no more than 5 (five) years from the date this Joint Circular takes effect. For secondary school teachers currently holding the secondary school teacher rank not meeting the standard (not having a bachelor's degree) code 15c.207 up to the date this Joint Circular takes effect, under 55 years old for men and under 50 years old for women, the competent authority, unit managing and using civil servants must arrange for civil servants to study to improve their qualifications to meet the criteria of the teaching profession title of secondary school teacher class III. If the civil servant meets the criteria and conditions for the secondary school teacher class III position, the authority, unit using the civil servant shall report to the authority, unit managing the civil servant to consider and decide to appoint to the secondary school teacher class III position. In the case where the civil servant is sent to study to improve qualifications but does not participate in the study or the study results do not meet the requirements, the authority, unit using the civil servant shall report to the authority, unit managing the civil servant to consider reassigning work or implementing staff reduction.

Article 12. Implementation Organization

1. This Circular serves as the basis for implementing the recruitment, use, and management of secondary school teachers in public secondary schools within the national education system.

2. Private secondary schools may apply the provisions of this Circular to recruit, use, and manage the secondary school teacher workforce within their institutions.

3. The heads of public secondary schools directly managing and using civil servants are responsible for:

a) Reviewing job positions in the unit, developing plans to appoint the teaching profession title of secondary school teachers in secondary schools under their management authority, submitting them to the competent authority for examination and decision-making or deciding according to the delegated authority;

b) Deciding on the appointment of the teaching profession title for secondary school teachers under their management to the teaching profession title of secondary school teachers in public secondary schools according to the authority or delegated authority after the appointment plan has been approved by the competent authority.

4. Ministries, agencies equivalent to ministries, agencies under the Government, People's Committees of provinces and centrally-administered cities are responsible for:

a) Directing units under their management to implement the appointment of the teaching profession title and salary grading for civil servants who are secondary school teachers in public secondary schools;

b) Approving plans for the appointment of the teaching profession title and salary grading for civil servants who are secondary school teachers in public secondary schools under their management from the current civil servant rank corresponding to the teaching profession title of secondary school teachers as stipulated in this Joint Circular; resolving issues within their authority during the process of appointing the teaching profession title and salary grading;

c) Deciding on the appointment of the teaching profession title and salary grading for secondary school teachers under their management to the corresponding teaching profession title of secondary school teachers in public secondary schools according to their authority.

d) Report on the results of appointing occupational titles and grading salaries for civil servants who are high school teachers in public high schools under their management to be submitted to the Ministry of Education and Training and the Ministry of Home Affairs.

Article 13. Responsibility for Implementation

1. The Minister, Head of a ministerial-level agency, Head of an agency under the Government; Chairman of the People's Committee of provinces and centrally governed cities shall be responsible for implementing this Circular.
