CIRCULAR
Repealing in whole or in part this regulatory legal document provides
conditions for investment and business activities issued by the Ministry of Construction.

Pursuant to the Law on Legislative Regulatory Documents dated June 22, 2015;
Pursuant to the Investment Law dated November 26, 2014;
Pursuant to Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing certain provisions and implementing measures of the Law on Legislative Regulatory Documents;
Pursuant to Decree No. 118/2015/NĐ-CP dated November 12, 2015 of the Government detailing and guiding the implementation of certain articles of the Investment Law;
Pursuant to Decree No. 62/2013/NĐ-CP dated June 25, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Construction;
At the proposal of the Director of the Legal Department;
The Minister of Construction issues a Circular to abolish entirely or partially the regulatory legal document providing conditions for investment and business activities issued by the Ministry of Construction.
Article 1. Repealing in whole legal normative documents containing provisions on conditions for business investment
Abolish Decision No. 11/2003/QĐ-BXD dated May 12, 2003 of the Minister of Construction promulgating Technical Regulation VN 297:2003 "Construction Specialized Laboratory - Recognition Standard".
Article 2. Repealing in part legal normative documents containing provisions on conditions for business investment
1. Abolish Articles 4 through 13, Article 17, Article 23, Article 25, Article 29, Appendix 1, Appendix 2, and Appendix 3 of the Regulation on Recognition and Management of Construction Specialized Laboratory issued together with Decision No. 11/2008/QĐ-BXD dated July 1, 2008 of the Minister of Construction.
2. Abolish Article 5, Article 6 (except for the form of report on capacity and operation status of laboratory at Appendix 12), Clause 3 of Article 7 of Circular No. 06/2011/TT-BXD dated June 21, 2011 of the Minister of Construction amending and supplementing certain provisions on administrative procedures in construction, architectural planning and construction implementation of Resolution No. 55/NQ-CP dated December 14, 2010 on simplifying administrative procedures within the scope of management functions of the Ministry of Construction.
3. Abolish Article 5, Article 6, and Article 7 of Circular No. 04/2014/TT-BXD dated April 22, 2014 of the Minister of Construction guiding certain contents regarding judicial appraisal in construction activities.
4. Abolish Article 4 of Circular No. 10/2015/TT-BXD dated December 30, 2015 of the Minister of Construction stipulating training and upgrading professional knowledge and skills in managing apartment building operations.
5. Abolish Article 19 (except for the content stipulating the Framework Program at Appendix 6) of Circular No. 11/2015/TT-BXD dated December 30, 2015 of the Minister of Construction stipulating issuance of real estate brokerage certificates; guiding training and upgrading professional knowledge in real estate brokerage and management of real estate trading floors.
Article 3. Effectiveness
1. This Circular takes effect from July 1, 2016.
2. Relevant agencies, organizations, and individuals shall be responsible for implementing this Circular./.
