PROVISIONS ON PLANTING REPLACEMENT FORESTS WHEN TRANSFERRING THE PURPOSE OF FOREST USE TO ANOTHER PURPOSE

THIS CIRCULAR REGULATES THE ORGANIZATION OF PLANTING REPLACEMENT FORESTS WHEN TRANSFERRING THE PURPOSE OF FOREST USE TO ANOTHER PURPOSE; RECEIVING AND USING FUNDS FOR REPLACEMENT FOREST PLANTING SUBMITTED BY INVESTORS TO THE FOREST PROTECTION AND DEVELOPMENT FUND; POST-INVESTMENT MANAGEMENT OF REPLACEMENT FOREST PLANTING; HANDLING RISKS IN REPLACEMENT FOREST PLANTING.From 100 million VND to less than 300 million VNDAt the proposal of the Director of the Plant Protection Department, the General Director of the Fisheries General Department, and the Director of the Livestock Production Department;

At the proposal of the Director of the General Bureau of Meteorology and Hydrology, the Head of the Science and Technology Department, and the Head of the Legal Department;, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CPThe Minister of Agriculture and Rural Development issues this Circular regulating methods for valuing forests; framework prices for forests.

ORGANIZATIONS, HOUSEHOLDS, INDIVIDUALS, AND COMMUNITIES OF VILLAGE WITH ACTIVITIES RELATED TO REPLACEMENT FOREST PLANTING WHEN TRANSFERRING THE PURPOSE OF FOREST USE TO ANOTHER PURPOSE.iARTICLE 2. PRINCIPLES OF MANAGEMENT AND IMPLEMENTATION OF RESPONSIBILITIES FOR REPLACEMENT FOREST PLANTING

Article 1. Scope of Regulation and Applicability

Thông tư này quy định chi tiết khoản 4 Điều 38 Luật Thủy sản số 18/2017/QH14 đã được sửa đổi, bổ sung tại điểm c khoản 21 Điều 14 Luật số 146/2025/QH15.

1. STRICTLY COMPLY WITH THE LAWS ON FOREST PROTECTION AND DEVELOPMENT.

Thông tư này áp dụng đối với tổ chức, cá nhân có liên quan đến hoạt động kinh doanh đối tượng thủy sản nuôi chủ lực trên lãnh thổ Việt Nam.

2. HAVE A REPLACEMENT FOREST PLANTING PLAN APPROVED BY THE AUTHORIZED BODY WITH AN AREA OF AT LEAST EQUAL TO THE AREA OF FOREST TRANSFERRED TO ANOTHER PURPOSE; OR EVIDENCE OF PAYMENT FOR REPLACEMENT FOREST PLANTING.

3. THE PROJECT INVESTOR MUST ORGANIZE REPLACEMENT FOREST PLANTING THEMSELVES OR COMPLETE THE OBLIGATION TO PAY FOR REPLACEMENT FOREST PLANTING AS PROVIDED IN THIS CIRCULAR AND CURRENT NATIONAL LAWS.

4. THE PROJECT INVESTOR WHO ORGANIZES REPLACEMENT FOREST PLANTING MUST HAVE UNFORESTED LAND ASSIGNED OR LEASED BY THE STATE TO PLANT FORESTS IN ACCORDANCE WITH THE LAWS.

5. THE COST OF REPLACEMENT FOREST PLANTING IS DETERMINED IN THE TOTAL PROJECT INVESTMENT; THE UNIT PRICE OF REPLACEMENT FOREST PLANTING IS DETERMINED BY THE PROVINCE PEOPLE'S COMMITTEE.

ARTICLE 3. PROJECT INVESTOR ORGANIZING REPLACEMENT FOREST PLANTING

1. PREPARING THE REPLACEMENT FOREST PLANTING PLAN

a) THE PROJECT INVESTOR TRANSFERRING THE PURPOSE OF FOREST USE TO ANOTHER PURPOSE (HEREINAFTER REFERRED TO AS THE INVESTOR) SHALL PREPARE THE REPLACEMENT FOREST PLANTING PLAN ACCORDING TO THE MODEL ATTACHED IN ANNEX I OF THIS CIRCULAR AND SUBMIT IT TO THE PROVINCE PEOPLE'S COMMITTEE FOR APPROVAL. IN CASE THE AREA OF FOREST TRANSFERRED TO ANOTHER PURPOSE IS LOCATED IN MULTIPLE PROVINCES, THE INVESTOR SHALL PREPARE SEPARATE PLANS FOR EACH PROVINCE.

b) THE APPLICATION DOCUMENTS FOR APPROVING THE REPLACEMENT FOREST PLANTING PLAN INCLUDE: THE REPLACEMENT FOREST PLANTING PLAN ACCORDING TO THE MODEL ATTACHED IN ANNEX I OF THIS CIRCULAR; THE APPLICATION FOR APPROVAL ACCORDING TO THE MODEL ATTACHED IN ANNEX II; THE INVESTMENT PROJECT TRANSFERRING THE PURPOSE OF FOREST USE TO ANOTHER PURPOSE; OTHER RELATED DOCUMENTS.

2. REVIEWING AND APPROVING THE REPLACEMENT FOREST PLANTING PLAN

a) THE INVESTOR SHALL SUBMIT ONE SET OF APPLICATION DOCUMENTS FOR APPROVING THE REPLACEMENT FOREST PLANTING PLAN DIRECTLY OR THROUGH THE POST TO THE DEPARTMENT OF AGRICULTURE AND RURAL DEVELOPMENT WHERE THE REPLACEMENT FOREST PLANTING AREA IS LOCATED.

b) WITHIN 20 WORKING DAYS FROM THE DATE OF RECEIVING COMPLETE AND LEGAL DOCUMENTS, THE DEPARTMENT OF AGRICULTURE AND RURAL DEVELOPMENT SHALL ORGANIZE A REVIEW. IF FIELD VERIFICATION IS REQUIRED, THE REVIEW PERIOD CAN BE EXTENDED BY UP TO 15 ADDITIONAL WORKING DAYS.

THE REVIEW BOARD SHALL INCLUDE REPRESENTATIVES FROM THE DEPARTMENT OF AGRICULTURE AND RURAL DEVELOPMENT, THE DEPARTMENT OF NATURAL RESOURCES AND ENVIRONMENT, THE DEPARTMENT OF PLANNING AND INVESTMENT, THE DISTRICT PEOPLE'S COMMITTEE WHERE THE REPLACEMENT FOREST PLANTING AREA IS LOCATED, AND RELEVANT SCIENTIFIC ORGANIZATIONS. THE NUMBER OF REVIEW BOARD MEMBERS SHALL BE AT LEAST FIVE, INCLUDING ONE LEADER OF THE DEPARTMENT OF AGRICULTURE AND RURAL DEVELOPMENT AS THE CHAIRMAN. IF THE TOTAL REPLACEMENT FOREST PLANTING AREA IS LESS THAN 10 HA, THE DEPARTMENT HEAD MAY DECIDE ON THE REVIEW BOARD MEMBERSHIP WITH FEWER MEMBERS.

c) IF THE DOCUMENTS ARE NOT LEGAL, THE DEPARTMENT OF AGRICULTURE AND RURAL DEVELOPMENT SHALL NOTIFY THE INVESTOR OF THE REASONS WITHIN THREE WORKING DAYS FROM THE DATE OF RECEIVING THE DOCUMENTS.

d) WITHIN THREE WORKING DAYS FROM THE DATE OF THE REVIEW BOARD MEETING, THE DEPARTMENT OF AGRICULTURE AND RURAL DEVELOPMENT SHALL SUBMIT THE PLAN FOR APPROVAL TO THE PROVINCE PEOPLE'S COMMITTEE FOR CONSIDERATION AND APPROVAL. IF THE DEPARTMENT DOES NOT SUBMIT THE PLAN FOR APPROVAL, IT SHALL NOTIFY THE INVESTOR OF THE REASONS.

e) WITHIN TEN WORKING DAYS FROM THE DATE OF RECEIVING THE PLAN APPROVAL APPLICATION FROM THE DEPARTMENT OF AGRICULTURE AND RURAL DEVELOPMENT, THE PROVINCE PEOPLE'S COMMITTEE SHALL APPROVE THE REPLACEMENT FOREST PLANTING PLAN. IF THE PLAN IS NOT APPROVED, THE PROVINCE PEOPLE'S COMMITTEE SHALL NOTIFY THE REASONS TO THE DEPARTMENT OF AGRICULTURE AND RURAL DEVELOPMENT AND THE INVESTOR.

3. AFTER THE REPLACEMENT FOREST PLANTING PLAN IS APPROVED BY THE PROVINCE PEOPLE'S COMMITTEE, THE INVESTOR SHALL ORGANIZE THE DESIGN AND BUDGET FOR REPLACEMENT FOREST PLANTING; SUBMIT THEM FOR APPROVAL BY THE AUTHORIZED BODY (EXCEPT WHERE LAWS PROVIDE OTHERWISE); AND IMPLEMENT THE REPLACEMENT FOREST PLANTING.

4. THE PREPARATION AND SUBMISSION FOR APPROVAL OF THE DESIGN AND BUDGET FOR REPLACEMENT FOREST PLANTING SHALL BE CONDUCTED IN ACCORDANCE WITH CIRCULAR NO. 23/2016/TT-BNNPTNT OF JUNE 30, 2016, GUIDING CERTAIN CONTENTS OF FORESTRY ENGINEERING MANAGEMENT ISSUED BY THE MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT (HEREINAFTER REFERRED TO AS CIRCULAR NO. 23/2016/TT-BNNPTNT).

5. THE PROVINCE PEOPLE'S COMMITTEE SHALL DETERMINE THE NUMBER OF YEARS FOR PLANTING, CULTIVATING, AND PROTECTING REPLACEMENT FORESTS SUITABLE TO LOCAL CONDITIONS TO ENSURE ENOUGH TIME FOR THE PLANTED FOREST TO MEET THE CRITERIA FOR BECOMING A FOREST.

6. THE INVESTOR SHALL COMPLETE THE OBLIGATION OF REPLACEMENT FOREST PLANTING WHEN THE AREA OF PLANTED FOREST MEETS THE CRITERIA FOR BECOMING A FOREST AS PROVIDED IN DECISION NO. 46/2007/QĐ-BNN OF MAY 28, 2007, ISSUED BY THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT, REGULATING THE DETERMINATION OF PLANTED FORESTS AND ENCLOSURE FORESTS BECOMING FORESTS.

4. The establishment and submission for approval of the design and budget for replanting forests shall be carried out in accordance with the provisions of Circular No. 23/2016/TT-BNNPTNT dated June 30, 2016, issued by the Ministry of Agriculture and Rural Development guiding certain aspects of managing forestry works (hereinafter referred to as Circular No. 23/2016/TT-BNNPTNT).

5. The People's Committee of the province shall decide on the number of years for planting, caring for, and protecting replanted forests in accordance with the actual conditions of the locality, ensuring sufficient time for the planted forest to meet the criteria for becoming a forest.

6. The project investor fulfills the obligation of replanting forests when the area of planted forests meets the criteria for becoming a forest as stipulated in Decision No. 46/2007/QĐ-BNN dated May 28, 2007, issued by the Minister of Agriculture and Rural Development regarding the determination of planted forests and encircled-nurtured forests becoming forests.

Article 4. The investor shall not plant substitute forests themselves

1. The investor requests the Provincial People's Committee to approve the plan for paying money instead of planting substitute forests

a) Documents include: A document from the investor requesting the Provincial People's Committee to approve the plan for paying money instead of planting substitute forests; a detailed project investment report that includes the change of forest land use purpose.

b) Quantity and method of submitting documents: One set, submitted directly or via postal service.

2. In case the Provincial People's Committee arranges land for planting substitute forests within its jurisdiction

a) Within fifteen working days from the date of receiving the investor's documents, the Provincial People's Committee will examine and resolve the matter and notify the investor in writing.

b) The Provincial People's Committee decides on the unit price for planting substitute forests, the total amount of money, and the time frame for the investor to pay for planting substitute forests. The unit price for planting substitute forests is calculated based on the average budget estimate for planting forests in the province at the time the investor pays, including surveying, designing, planting, and management costs until the forest is established.

c) The Forest Protection and Development Fund of the province or the Department of Agriculture and Rural Development (for areas where the Forest Protection and Development Fund has not been established) receives the money for planting substitute forests according to the Decision approving the plan by the Provincial People's Committee to organize the planting of substitute forests.

3. In case the locality no longer has land available for planting substitute forests:

a) Within five working days from the date of receiving the complete documents of the investor as stipulated in Clause 1 of this Article, the Provincial People's Committee will issue a document requesting the Ministry of Agriculture and Rural Development to approve the plan for paying money instead of planting substitute forests by the investor;

b) Documents include: A document from the Provincial People's Committee requesting the Ministry of Agriculture and Rural Development attached with a list of projects implementing the obligation to pay money for planting substitute forests according to the model in Appendix III issued together with this Circular;

c) Quantity and method of submitting documents: One set, submitted directly or via postal service;

d) Within twenty working days from the date of receiving the documents from the Provincial People's Committee, the Ministry of Agriculture and Rural Development will examine and arrange for planting substitute forests in other provinces or cities; notify in writing the relevant Provincial People's Committees, the Vietnam Forest Protection and Development Fund, and the investor to implement;

đ) The unit price for planting substitute forests is determined by the Provincial People's Committee based on the average budget estimate for planting forests at the planting location at the time the investor pays, including surveying, designing, constructing the forest, and management costs until the forest is established;

e) The Vietnam Forest Protection and Development Fund receives, manages, and disburses the money for planting substitute forests to organize the planting of substitute forests according to the provisions of the law.

4. The investor fulfills the obligation to plant substitute forests when notified by the Forest Protection and Development Fund or the Department of Agriculture and Rural Development (for areas where the Forest Protection and Development Fund has not been established) that the obligation to pay money for planting substitute forests has been fulfilled.

5. Receiving and using money for planting substitute forests

a) The Forest Protection and Development Funds at all levels, or the Department of Agriculture and Rural Development (for areas where the Forest Protection and Development Fund has not been established) open accounts at the State Treasury according to Clause 2, Article 1 of Circular No. 85/2012/TT-BTC dated May 25, 2012, of the Ministry of Finance guiding financial management regulations for the Forest Protection and Development Fund to receive, manage, and disburse money for planting substitute forests.

b) Organizations and units assigned the task of organizing the planting of substitute forests open accounts at the State Treasury to receive, manage, and control the expenditure of money for planting substitute forests.

c) Money for planting substitute forests paid by investors is used to plant protective forests and special-use forests according to the guidance in Clause 6 of this Article.

d) In case the locality does not have enough land for planting protective forests and special-use forests as guided in point c of this clause, the Provincial People's Committee decides to support the planting of production forests according to the guidance in Clause 7 of this Article.

đ) Management expenses of the Forest Protection and Development Fund are included in the unit price and budget estimate for planting substitute forests approved by the competent authority for management activities; participating in monitoring, inspecting, supervising, and accepting the planting of substitute forests.

e) The source of money for planting substitute forests is managed, used, settled, and controlled through the State Treasury according to current state regulations.

6. Planting special-use forests and protective forests

a) The Department of Agriculture and Rural Development or the Forest Protection and Development Fund of the province advises the Provincial People's Committee to assign tasks and allocate funds to the Forest Management Board or organizations with the appropriate functions to plant substitute forests on planned areas for protective forests, special-use forests, and production forests from the funds paid by investors as stipulated in Clause 2 of this Article.

b) The General Department of Forestry and the Vietnam Forest Protection and Development Fund advise the Ministry of Agriculture and Rural Development to assign tasks and allocate funds to units and localities to plant substitute forests on planned areas for protective forests and special-use forests from the funds paid by investors as stipulated in Clause 3 of this Article.

c) The Forest Management Board or organizations assigned the task of planting substitute forests establish and submit for approval the design and budget estimates; organize the planting of forests according to Circular No. 23/2016/TT-BNNPTNT and current state regulations.

7. Supporting the planting of production forests

a) Recipients of support: Ethnic minority households, poor Han households living stably in communes with difficult socio-economic conditions (Zone II and Zone III) as prescribed in Article 2 of Decree No. 75/2015/NĐ-CP dated September 9, 2015, of the Government on mechanisms and policies for forest protection and development, linked to rapid and sustainable poverty reduction policies and support for ethnic minorities during the period 2015-2020 (hereinafter referred to as Decree No. 75/2015/NĐ-CP).

b) Content and level of support: Implemented according to Article 5 of Decree No. 75/2015/NĐ-CP.

c) The compilation of lists of recipients, area, and demand for support in planting production forests is carried out according to the guidance in Appendix IV of this Circular.

Article 5. Management and utilization of substitute planted forests after investment

1. With respect to the forest area formed from afforestation carried out by the Investor as stipulated in Article 3 of this Circular, the Investor shall continue to manage, protect, develop, and utilize the forest; enjoy benefits and fulfill obligations under the law regarding special-use forests, protective forests, and production forests.

2. With respect to the special-use forest and protective forest areas formed from afforestation funds paid by Investors into the Forest Protection and Development Fund or the Department of Agriculture and Rural Development (for localities that have not established the Forest Protection and Development Fund), the Forest Management Board and relevant agencies shall continue to manage, protect, and develop the forest in accordance with the law on special-use forests and protective forests.

3. With respect to the production forest area for households supported in afforestation from afforestation funds, households shall be responsible for managing, protecting, developing, and utilizing the forest; enjoy benefits and fulfill obligations under the law on production forests.

Article 6. Handling Risks Due to Natural Disasters for Replacement Plantation Forests

1. For production forest areas damaged by natural disasters, support shall be provided according to the provisions of Decree No. 02/2017/ND-CP dated January 9, 2017 of the Government on mechanisms and policies to support agricultural production to restore production in areas affected by natural disasters and epidemics.

2. For protective forest and special-use forest areas damaged by natural disasters, liquidation shall be carried out according to the provisions of Circular No. 18/2013/TT-BTC dated February 20, 2013 of the Ministry of Finance guiding the procedures and formalities for liquidating plantation forests and managing and using the proceeds from the liquidation of plantation forests that failed to become forests or had no potential to become forests.

3. The statistics, assessment, and reporting of damage caused by natural disasters shall be conducted in accordance with Joint Circular No. 43/2015/TTLT-BNNPTNT-BKHĐT dated November 23, 2015 of the Ministry of Agriculture and Rural Development and the Ministry of Planning and Investment.

4. The process of providing financial support shall be applied according to the provisions of Decision No. 01/2016/QĐ-TTg dated January 19, 2016 of the Prime Minister on mechanisms and procedures for providing financial support to localities to address the consequences of natural disasters.

Article 7. Transitional Provisions and Implementation Clauses

1. Transitional Provisions

a) For replacement afforestation plans currently being implemented according to Circular No. 24/2013/TT-BNNPTNT dated May 6, 2013 of the Ministry of Agriculture and Rural Development on replacement afforestation when changing the purpose of forest land use to other purposes and Circular No. 26/2015/TT-BNNPTNT dated July 29, 2015 of the Ministry of Agriculture and Rural Development amending and supplementing certain articles of Circular No. 24/2013/TT-BNNPTNT, they shall continue to be implemented according to the approved plan.

b) For projects funded by the state budget that changed the purpose of forest land use to other purposes before the effective date of this Circular and have not yet determined the afforestation fund within the total project investment, the Department of Agriculture and Rural Development shall compile a list of projects, the area of forest to be replanted, and report to the provincial People's Committee to include it in the annual replanting plan of the province.

2. Implementation Clauses

a) This Circular takes effect from January 1, 2018;

b) Circular No. 24/2013/TT-BNNPTNT dated May 6, 2013 of the Ministry of Agriculture and Rural Development on replacement afforestation when changing the purpose of forest land use to other purposes; Circular No. 26/2015/TT-BNNPTNT dated July 29, 2015 of the Ministry of Agriculture and Rural Development amending and supplementing certain articles of Circular No. 24/2013/TT-BNNPTNT shall cease to be effective from the date this Circular takes effect.
