Regulations on the maximum postage rates for postal services serving Party and State agencies at local levels

Pursuant to the Law on Posts dated June 17, 2010;

Pursuant to the Law on Prices dated June 20, 2012;

Pursuant to Decree No. 177/2013/ND-CP dated November 14, 2013 of the Government detailing and guiding the implementation of certain provisions of the Law on Prices; Decree No. 149/2016/ND-CP dated November 11, 2016 of the Government amending and supplementing certain provisions of Decree No. 177/2013/ND-CP;

Pursuant to Decree No. 17/2017/NĐ-CP dated February 17, 2017, issued by the Government, on the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;

Pursuant to Decision No. 55/2016/QĐ-TTg dated December 26, 2016 of the Prime Minister on the Postal Network Serving Party and State Agencies;

At the proposal of the Director of the Post Department;

The Minister of Information and Communications promulgates this Circular stipulating the maximum postage rates for postal services serving Party and State agencies at local levels.

Article 1. Scope of Regulation

This Circular stipulates the maximum postage rates for postal services serving Party and State agencies at local levels (hereinafter referred to as KT1 service) including:

1. Maximum postage rates for KT1 service.

2. Maximum postage rates for KT1 service according to urgency: Express, Time-specific.

3. Maximum postage rates for KT1 service according to confidentiality level: A, B, C.

Article 2. Applicability

1. The objects served by the Postal Network Serving Party and State Agencies at local levels as specified in Appendix II issued together with Decision No. 55/2016/QĐ-TTg dated December 26, 2016 of the Prime Minister on the Postal Network Serving Party and State Agencies include:

a) Provincial level: Provincial Party Committee, Municipal Party Committee and their affiliated departments; People's Council; Office of the Delegation of the National Assembly; People's Committee and its affiliated specialized agencies; People's Court; People's Procuracy; Military Command; State Bank; Public Security; Fatherland Front; Women's Union; Communist Youth Union; Trade Union;

b) District level: District Party Committee; People's Council; People's Committee; Fatherland Front.

2. Vietnam Post Corporation and Post Offices of provinces and centrally governed cities.

Article 3. Maximum postage rates for KT1 postal services

The maximum postage rates for KT1 postal services stipulated in the Appendix issued together with this Circular do not include value-added tax and do not include remote area surcharges.

Article 4. Organization of Implementation

1. The Department of Posts shall be responsible for inspecting and supervising the implementation of regulations on postage rates for KT1 postal services and proposing the Minister of Information and Communications to review and adjust the maximum postage rates for KT1 postal services when there are significant changes in factors forming the postage rates.

2. Departments of Information and Communications of provinces and centrally governed cities shall be responsible for managing state administration over KT1 postal service postage rates within their jurisdictions.

3. Vietnam Post Corporation shall be responsible for:

a) Determining the postage rates for KT1 postal services within its authority, ensuring that they do not exceed the maximum postage rates stipulated in the Appendix issued together with this Circular;

b) Reporting to the Ministry of Information and Communications about the postage rates for KT1 postal services thirty days before implementing them;

c) Publicizing the postage rates for KT1 postal services in accordance with laws on prices and postal services.

Article 5. Implementation Provisions

1. This Circular takes effect from January 1, 2018.

2. The Head of the Office, Heads of the Department of Posts, Heads of agencies and units under the Ministry of Information and Communications, General Director of Vietnam Post Corporation, and the objects served at local levels shall be responsible for implementing this Circular.

3. During the process of implementation, if any issues arise or difficulties occur, organizations and individuals shall promptly report to the Ministry of Information and Communications for consideration and amendment.

ANNEX

MAXIMUM POSTAGE RATES FOR KT1 POSTAL SERVICES SERVING PARTY AND STATE AGENCIES AT LOCAL LEVELS

1. Maximum postage rates for KT1 service

Unit of measurement: dong

* Provisions on regions for calculating postage rates

- Mountainous, island districts: Districts included in the list of areas with special geographical conditions applying special collection and delivery frequencies in providing universal postal services as prescribed by the Ministry of Information and Communications.

- Region 1 includes 29 provinces and centrally governed cities: Ha Giang, Cao Bang, Lang Son, Bac Kan, Tuyen Quang, Lao Cai, Lai Chau, Dien Bien, Son La, Yen Bai, Phu Tho, Vinh Phuc, Thai Nguyen, Hanoi, Bac Ninh, Bac Giang, Hai Duong, Quang Ninh, Hai Phong, Thai Binh, Hung Yen, Ha Nam, Hoa Binh, Nam Dinh, Ninh Binh, Thanh Hoa, Nghe An, Ha Tinh, and Quang Binh.

- Region 2 includes 11 provinces and centrally governed cities: Thua Thien-Hue, Da Nang, Quang Nam, Quang Ngai, Kon Tum, Gia Lai, Binh Dinh, Phu Yen, Dak Lak, and Dak Nong.

- Region 3 includes 23 provinces and centrally governed cities: Khanh Hoa, Ninh Thuan, Lam Dong, Binh Phuoc, Tay Ninh, Binh Duong, Dong Nai, Binh Thuan, Ba Ria-Vung Tau, Ho Chi Minh City, Long An, Dong Thap, Tien Giang, Ben Tre, Tra Vinh, Vinh Long, Hau Giang, Can Tho, An Giang, Kien Giang, Soc Trang, Bac Lieu, and Ca Mau.

2. Maximum postage rates for KT1 service according to urgency: Express, Time-specific

The maximum postage rates for KT1 service according to urgency are equal to the maximum postage rates for KT1 service stipulated in Section 1 of the Appendix plus the maximum postage rates according to urgency as follows:

3. Maximum postage rates for KT1 service according to confidentiality level: A, B, C

The maximum postage rates for KT1 service according to confidentiality level (A, B, C) are equal to the maximum postage rates for KT1 service stipulated in Section 1 of the Appendix plus the maximum postage rates according to confidentiality level as follows:

4. In cases where KT1 service is used according to urgency and confidentiality level, the maximum postage rate is the sum of the postage rate stipulated in Section 1 and the postage rates according to urgency and confidentiality level as stipulated in Sections 2 and 3 of the Appendix.
