Circular No. 23/2017/TT-NHNN amending and supplementing certain Articles of Circular No. 37/2016/TT-NHNN dated December 30, 2016, issued by the Governor of the State Bank of Vietnam on the management, operation, and use of the National Interbank Electronic Payment System.

CIRCULAR

Amending and supplementing certain Articles of Circular No. 37/2016/TT-NHNN dated December 30, 2016 of the Governor of the State Bank of Vietnam on the management, operation, and use of the National Interbank Electronic Payment System the management, operation, and use of the National Inter-bank Electronic Payment System                    

Pursuant to the Law on the State Bank of Vietnam dated June 16, 2010;

Pursuant to the Law on Credit Organizations dated June 16, 2010;

Pursuant to the Law on Electronic Transactions dated November 29, 2005;

Pursuant to Decree No. 26/2007/NĐ-CP dated February 15, 2007 of the Government detailing the implementation of the Law on Electronic Transactions regarding digital signatures and digital signature certification services; Decree No. 106/2011/NĐ-CP dated November 23, 2011 amending and supplementing certain provisions of Decree No. 26/2007/NĐ-CP; and Decree No. 170/2013/NĐ-CP dated November 13, 2013 amending and supplementing certain provisions of Decree No. 26/2007/NĐ-CP;

Pursuant to Decree No. 35/2007/NĐ-CP dated March 8, 2007, of the Government on electronic transactions in banking activities;

Pursuant to Decree No. 101/2012/NĐ-CP dated November 22, 2012 of the Government on non-cash payments and Decree No. 80/2016/NĐ-CP dated July 1, 2016 amending and supplementing certain provisions of Decree No. 101/2012/NĐ-CP;

Pursuant to Government Decree No. 16/2017/NĐ-CP dated February 17, 2017 on the functions, tasks, powers, and organizational structure of the State Bank of Vietnam;

At the proposal of the Director of the Department of Information Technology;

The Governor of the State Bank of Vietnam promulgates this Circular amending and supplementing certain Articles of Circular No. 37/2016/TT-NHNN dated December 30, 2016 of the Governor of the State Bank of Vietnam on the management, operation, and use of the National Interbank Electronic Payment System.

Article 1. Amending and supplementing certain Articles of Circular No. 37/2016/TT-NHNN dated December 30, 2016 of the Governor of the State Bank of Vietnam on the management, operation, and use of the National Interbank Electronic Payment System as follows:

Article 52 is amended and supplemented as follows:

"Article 52. Effective date

1. This Circular shall take effect from September 1, 2018.

2. From the date this Circular takes effect, the following documents shall cease to be effective:

a) Circular No. 23/2010/TT-NHNN dated November 9, 2010 of the Governor of the State Bank of Vietnam on the management, operation, and use of the Interbank Electronic Payment System;

b) Circular No. 13/2013/TT-NHNN dated June 11, 2013 of the Governor of the State Bank of Vietnam amending and supplementing certain Articles of Circular No. 23/2010/TT-NHNN dated November 9, 2010 of the Governor of the State Bank of Vietnam on the management, operation, and use of the Interbank Electronic Payment System;

c) Article 6 of Circular No. 23/2011/TT-NHNN dated August 31, 2011 of the Governor of the State Bank of Vietnam on implementing the plan to simplify administrative procedures in payment activities and other fields according to the Government's Resolution on simplifying administrative procedures within its functional scope."

Article 2. Implementation

The Director of the Office, Heads of units under the State Bank of Vietnam, Governors of the State Bank of Vietnam branches in provinces and centrally governed cities, General Directors (Directors) of members are responsible for organizing the implementation of this Circular.

Article 3. Effectiveness

This Circular shall take effect from January 14, 2018.
