CIRCULAR

REGULATIONS ON STANDARDS, CONDITIONS, CONTENT, AND FORMS OF EXAMINATION OR PROMOTION REVIEW FOR PROFESSIONAL TITLES OF SPORT SPECIALISTS

Pursuant to the Law on Public Servants No. 58/2010/QH12 dated November 15, 2010;

Pursuant to the Government Decree No. 29/2012/NĐ-CP dated April 12, 2012 on recruitment, utilization, and management of public servants;Pursuant to the Government Decree No. 79/2017/NĐ-CP dated July 17, 2017 on the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;

The Minister of Culture, Sports and Tourism issues this Circular to regulate standards, conditions, content, and forms of examination or promotion review for professional titles of sports specialists.a, Sports and Tourism;

At the proposal of the Director-General of the General Department of Physical Training and Sport;

This Circular regulates standards, conditions, content, and forms of examination or promotion review for professional titles of sports specialists. This Circular applies to sports specialists working in training positions at public service units in sports who participate in the promotion review period for professional titles and related organizations and individuals. PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

1. This Circular stipulates standards, conditions, content, and forms of examination or promotion review for professional titles of sports specialists.

2. This Circular applies to sports specialists engaged in training work at public service units in sports who participate in the promotion review period for professional titles and related organizations and individuals.

Article 2. Interpretation of Terms

In this Circular, the following terms are understood as follows:

1. The promotion review period for professional titles is the period during which public servants undergo examination or promotion review.

A direct coach who trains athletes to win medals at international sports competitions is a national team coach or youth team coach assigned to directly train and guide athletes participating in competitions to win medals at international sports competitions.

An Olympic sport is a sport included in the official competition program at the Olympic Games.

An ASIAD sport is a sport included in the official competition program at the Asian Games (ASIAD).

Article 3. Principles of Promotion Review for Professional Titles

1. The selection of public servants to participate in the promotion review period for professional titles must be based on job positions, professional title structures, and the needs of public service units in sports.

2. Public servants may only participate in the promotion review from a lower rank to an immediately higher rank within the same professional title they hold.

3. Public servants may only participate in the promotion review period for professional titles when they meet the standards and conditions for the promoted professional title as prescribed by law. In cases where the number of people meeting the standards and conditions for participation in the promotion review period exceeds the number of personnel required to maintain the professional title structure of public service units in sports approved by competent authorities, the authority with jurisdiction shall select public servants to participate in the promotion review period for professional titles based on the following basic criteria in order of priority:

a) Training achievements;

b) Outstanding performance in fulfilling duties;

c) Years held in the current professional title rank;

d) Female public servants registering to participate in the promotion review period.

4. The organization of examinations or promotion reviews for professional titles must ensure equality, transparency, objectivity, and compliance with legal regulations.

Article 4. Standards and Conditions for Participation in the Promotion Review Period for Professional Titles

1. The agency using public servants has a need to arrange public servants in promotion positions and the public servants are nominated by the competent authority to participate in the promotion review period.

2. They are evaluated by the agency using public servants to have sufficient professional ethics and morals; complete their duties well over a continuous three-year period up to the deadline for submitting registration applications; not during a disciplinary action period or have been notified about disciplinary action according to the law.

3. They meet the standards of the professional title rank they are applying for promotion to as prescribed in Joint Circular No. 13/2014/TTLT-BVHTTDL-BNV dated October 17, 2014 of the Ministry of Culture, Sports and Tourism and the Ministry of Home Affairs on the code and standards of professional titles of sports specialists (hereinafter referred to as Joint Circular No. 13/2014/TTLT-BVHTTDL-BNV).

Article 5. Determination of cases for applying examination or assessment forms for promotion to higher rank titles in the Sports Training profession

1. Staff holding the rank title of Senior Coach (Class II), code V.10.01.02, who meet the criteria and conditions stipulated in Article 4 of this Circular, may register to take the examination for promotion to the rank title of Elite Coach (Class I), code V.10.01.01. Staff holding the rank title of Coach (Class III), code V.10.01.03, who meet the criteria and conditions stipulated in Article 4 of this Circular, may register to take the examination for promotion to the rank title of Senior Coach (Class II), code V.10.01.02.

2. Staff specified in Clause 1 of this Article and who are direct coaches of athletes achieving outstanding results at international sports competitions as stipulated in Article 12 of this Circular, may register to participate in the assessment for promotion to the rank title of Elite Coach (Class I), code V.10.01.01 and Senior Coach (Class II), code V.10.01.02 without having to take the promotion examination (hereinafter referred to as special assessment for promotion).

3. Staff holding the rank title of Instructor (Class IV), code V.10.01.04, who meet the criteria and conditions stipulated in Article 4 of this Circular, may register to be assessed for promotion to the rank title of Coach (Class III), code V.10.01.03 without having to take the promotion examination.

Chapter II

EXAMINATION FOR PROMOTION

Section 1. EXAMINATION FOR PROMOTION FROM THE RANK TITLE OF SENIOR COACH (CLASS II) TO ELITE COACH (CLASS I)

Article 6. Content and form of the examination

1. General knowledge examination

a) Examination content:

- The Party's viewpoints and policies, State laws on high-performance sports and professional sports;

- Work on training athletic talents and the system of high-performance sports competitions;

- Methods for building and implementing strategies for developing national and provincial/professional sports disciplines;

- The system of state agencies; laws on civil servants relevant to the standards for the rank title of Elite Coach (Class I);

- The content of the examination on sports knowledge accounts for 60%, while political, administrative management, and civil servant laws account for 40%.

b) Examination form: Written.

c) Examination time: 180 minutes.

2. Professional knowledge and skills examination

a) Examination content: Evaluation of the level, capacity, and skills in drafting proposals, presenting, and defending the contents of proposals related to the professional duties of the rank title being applied for.

b) Examination form: Written proposal and defense.

c) Proposal defense time: Maximum 30 minutes per person.

3. Foreign language examination

a) Examination content: Reading comprehension, writing, listening, and conversation (dialogue) skills at Level 3 (B1) in one of the foreign languages English, French, Russian, German, or Chinese as registered by the staff member.

b) Examination form: Written test and conversation (dialogue).

c) Examination time: 90 minutes for the written test and 15 minutes for the conversation (dialogue) per person.

4. Information technology examination

a) Examination content: Assessment of basic information technology skills according to the standards for the rank title of Elite Coach (Class I).

b) Examination form: Multiple choice or practical computer-based testing.

c) Examination time: 45 minutes.

Article 7. Exemption from Foreign Language Examination

Civil servants are exempted from the foreign language examination if they fall under any of the following cases:

1. Civil servants who have a second bachelor's degree in a foreign language;

2. Civil servants who graduated from a university or postgraduate program abroad or graduated from a university or postgraduate program taught in a foreign language in Vietnam;

3. Civil servants who hold a foreign language certificate equivalent to level B2 or higher according to the European Framework of Reference for Languages, as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014, issued by the Ministry of Education and Training on the six-level foreign language proficiency framework for Vietnam (hereinafter referred to as Circular No. 01/2014/TT-BGDĐT), issued by domestic foreign language training institutions or international foreign language testing centers recognized by the Ministry of Education and Training.

Article 8. Exemption from Information Technology Examination

Civil servants are exempted from the information technology examination if they have graduated from a specialized secondary level or higher in information technology or information technology.

Section 2. EXAMINATION FOR PROMOTION FROM SPORTS COACH (GRADE III) TO SENIOR SPORTS COACH (GRADE II)

Article 9. Content and Form of Examination

1. General knowledge examination

a) Examination content:

- The Party’s viewpoints and policies, and State laws on physical education and sports;

- State management of high-performance sports;

- Strategic orientation for the development of the sports sector in the current phase of international integration;

- General theory on the state, administrative state, and civil servant law consistent with the standards for the position of senior sports coach (Grade II);

- The content of the examination on sports knowledge accounts for 60%, while political, administrative management, and civil servant laws account for 40%.

b) Examination form: Written.

c) Examination time: 180 minutes.

2. Professional knowledge and skills examination

a) Examination content: assessing and evaluating qualifications, capabilities, and proposing solutions to address practical issues in line with the standards for qualifications and professional capabilities of the position of senior sports coach.

b) Examination form: Written.

c) Examination duration: 120 minutes/person.

3. Foreign language examination

a) Examination content: reading comprehension, writing, listening, and interviewing (conversation) skills at level 2 (A2) as prescribed in the standards for the position of senior sports coach (Grade II), in one of the foreign languages: English, French, Russian, German, Chinese, as registered by the civil servant.

b) Examination form: Written test and conversation (dialogue).

c) Examination time: 90 minutes for the written test and 15 minutes for the conversation (dialogue) per person.

4. Information technology examination

a) Examination content: basic information technology usage skills as prescribed in the standards for the position of senior sports coach (Grade II).

b) Examination form: Multiple choice or practical computer-based testing.

c) Examination time: 45 minutes.

Article 10. Exemption from Foreign Language Examination

Civil servants are exempted from the foreign language examination if they fall under any of the following cases:

1. Civil servants who, as of the deadline for submitting application documents for the examination for promotion as announced by the competent authority, are aged 55 years or older for males and 50 years or older for females;

2. Civil servants working in ethnic minority areas, holding certificates in ethnic minority language training issued by training institutions authorized to issue such certificates;

3. Ethnic minority civil servants working in ethnic minority areas;

4. Civil servants who have a second bachelor's degree in a foreign language;

5. Civil servants who graduated from a university or postgraduate program abroad or graduated from a university or postgraduate program taught in a foreign language in Vietnam;

6. Civil servants who hold a foreign language certificate equivalent to level B1 or higher according to the European Framework of Reference for Languages, as stipulated in Circular No. 01/2014/TT-BGDĐT.

Article 11. Exemption from Information Technology Examination

Civil servants are exempted from the information technology examination if they have graduated from a specialized secondary level or higher in information technology or information technology.

Chapter III

PROMOTION REVIEW

Section 1. REVIEW FOR PROMOTION FROM SENIOR SPORTS COACH (GRADE II) TO TOP SPORTS COACH (GRADE I) AND FROM SPORTS COACH (GRADE III) TO SENIOR SPORTS COACH (GRADE II)

Article 12. Standards and Conditions for Special Promotion Examination

A civil servant may register for a special promotion examination as prescribed in Clause 2, Article 5 of this Circular when directly training athletes who achieve at least one of the following achievements:

1. For civil servants eligible for special promotion to the title of Senior Coach (Class I), code V.10.01.01:

a) Gold, silver, or bronze medals at the Olympic Games;

b) Gold, silver, or bronze medals at the Paralympic Games;

c) Gold medal at the World Championships or World Cup of Olympic sports;

d) Gold medal at the Asian Games (ASIAD);

đ) Gold medal at the Youth Olympic Games.

2. For civil servants eligible for special promotion to the title of Principal Coach (Class II), code V.10.01.02:

a) Gold, silver, or bronze medals at the Asian Games (ASIAD);

b) Gold, silver, or bronze medals at the Asian Para Games;

c) Gold medal at the Asian Championships of Olympic sports or ASIAD;

d) Gold, silver, or bronze medals at the World Championships or World Cup of ASIAD sports;

đ) Gold, silver, or bronze medals at the Youth Olympic Games.

Article 13. Forms of Special Promotion Examination

1. Civil servants are eligible for special promotion through the examination of their application files according to the standards and conditions stipulated in Article 12 of this Circular.

2. The special promotion examination shall be conducted by the Special Promotion Examination Board for Professional Titles. The Special Promotion Examination Board for Professional Titles operates in accordance with the provisions of Article 13 of Circular No. 12/2012/TT-BNV dated December 18, 2012, issued by the Ministry of Home Affairs on professional titles and changes in professional titles for civil servants (hereinafter referred to as Circular No. 12/2012/TT-BNV).

3. The Special Promotion Examination Board for Professional Titles will convene a meeting only if at least 75% of its members are present, including the Chairman of the Board or a Vice-Chairman authorized by the Chairman. Absent members' opinions will be solicited via ballots.

Article 14. Content of Special Promotion Examination

1. Scoring of application files: Meeting the standards and conditions stipulated in Article 12 of this Circular.

2. Calculation of application file scores: Application file scores are calculated on a scale of 100 points based on evaluation criteria derived from the professional title standards of the civil servant applying for special promotion, specifically as follows:

a) Group of criteria evaluating job performance capability: 10 points;

b) Group of criteria evaluating professional ethics standards: 10 points;

c) Group of criteria evaluating educational and training standards: 20 points;

d) Group of criteria evaluating professional competence and vocational standards: 60 points.

3. The scoring of the groups of evaluation criteria specified in point a and d of Clause 2 of this Article shall be reviewed through the minutes recording the assessment and evaluation of representatives from public service units in physical education and sports, specialized teams, and organizational bodies within the unit, and confirmed by the head of the authority that has the right to dispatch the civil servant for the special promotion examination.

Article 15. Determination of Successful Candidates in the Special Promotion Examination for Professional Titles and Notification of Results

1. Successful candidates in the special promotion examination must meet the following conditions:

a) Having complete application files as required;

b) The result of the application file review must reach 100 points.

2. The results of the professional title promotion examination shall be notified to individuals and units participating in the examination period no later than 15 working days from the completion date of the special promotion examination period.

3. Civil servants not successful in the special promotion examination for professional titles as stipulated in Clause 1 of this Article shall not have their results carried over to the next special promotion examination period.

4. The Chairman of the Special Promotion Examination Board reports to the competent authority for consideration and decision on recognizing the examination results.

Section 2. REVIEW FOR PROMOTION FROM GUIDANCE COUNSELOR (RANK IV) TO INSTRUCTOR (RANK III)

Article 16. Forms of Promotion Review

1. Civil servants shall be reviewed for promotion to the occupational title based on the review of their application files and through interviews assessing their knowledge and professional competence according to the standards set for the Instructor (Rank III) occupational title.

2. The review for promotion to the Instructor (Rank III) occupational title shall be conducted by the Promotion Review Board for Occupational Titles, which operates in accordance with the provisions of Article 13 of Circular No. 12/2012/TT-BNV.

3. The Promotion Review Board for Occupational Titles shall convene a meeting only if at least 75% of its members are present, including the Chairman or a Vice-Chairman authorized by the Chairman. Opinions of absent members shall be obtained through ballots.

Article 17. Content of Promotion Review

1. Scoring of application files: Meeting the criteria and conditions stipulated in Article 4 of this Circular. The method of scoring and basis for evaluating application files are regulated in Clause 2 and 3 of Article 14 of this Circular.

2. Assessment and examination according to the standards for the Instructor (Rank III) occupational title:

a) The Chairman of the Promotion Review Board decides to establish an Examination and Assessment Committee and organize the development of interview questions in accordance with regulations.

b) The Chairman of the Promotion Review Board organizes the selection of interview questions, ensuring that there are at least one extra question than the number of candidates applying for promotion to the Instructor (Rank III) occupational title for candidates to draw from.

c) The content of the interview questions must be based on the professional skills required for the Instructor (Rank III) occupational title; the structure of the interview questions must ensure accuracy and scientific validity. Each interview question is scored out of 100 points and must have detailed answers and grading scales. Interview questions must be sealed in envelopes, marked, and stored according to confidential document procedures; the handover and opening of interview questions must be recorded in accordance with regulations.

d) Each candidate participating in the interview is evaluated independently by two examiners. If the scores given by the two examiners differ by less than 10% of the maximum score, the average score is taken; if the difference exceeds 10%, the two examiners discuss to reach a consensus; if they cannot agree, the two results are reported to the Head of the Examination and Assessment Committee for the Chairman of the Promotion Review Board to consider and decide.

đ) The interview evaluation results must be compiled into a result sheet signed by the evaluators and handed over to the Head of the Examination and Assessment Committee.

3. Compilation of Selection Results

a) After organizing the assessment and examination, the Head of the Examination and Assessment Committee hands over the interview results of the candidates to the Council Member who serves as Secretary of the Selection Council.

b) The Council Member serving as Secretary of the Selection Council is responsible for compiling the selection results of the candidates based on the file scores and interview scores to report to the Selection Council.

Article 18. Determination of Successful Candidates in the Promotion Review Period and Announcement of Results

1. Successful candidates in the promotion review period must meet the following conditions:

a) Having complete application files as required;

b) The file score must be 100 points and the interview score must be 55 points or higher.

2. The results of the promotion review for the occupational title shall be notified to individuals and units participating in the review period no later than 15 working days from the completion date of the promotion review period.

3. Candidates who do not succeed in the promotion review period for the occupational title as stipulated in Clause 1 of this Article shall not retain their results for the next promotion review period.

4. The Chairman of the Promotion Review Board reports to the competent authority for consideration and decision on recognizing the results of the promotion review.

Chapter IV

IMPLEMENTING PROVISIONS

Article 19. Responsibility for Implementation

1. The Minister, Heads of Ministries equivalent to ministries, Heads of agencies under the Government, Chairmen of People's Committees of provinces and centrally-run cities, and heads of agencies and units shall, within their respective authorities, appoint civil servants to participate in the promotion review period for the occupational title based on the conditions and standards stipulated in this Circular and bear responsibility for the conditions and standards of the civil servants participating in the promotion review in accordance with the law.

2. The Minister, Heads of Ministries equivalent to ministries, Heads of agencies under the Government, Chairmen of People's Committees of provinces and centrally-run cities, within their respective authorities, shall organize the promotion review period for civil servants in the Sports and Physical Education profession in compliance with this Circular.

3. The Minister, Heads of Ministries equivalent to ministries, Heads of agencies under the Government, Chairmen of People's Committees of provinces and centrally-run cities, and heads of agencies and units, and related individuals and organizations shall be responsible for implementing this Circular.

Article 20. Effective Date

This Circular takes effect from October 15, 2018.

During implementation, if there are difficulties, individuals and organizations shall reflect them to the Ministry of Culture, Sports and Tourism (through the General Department of Sports) for consideration and resolution.
