CIRCULAR

REGULATING THE NON-APPLICATION OF QUOTA DUTY FOR IMPORTING SUGAR FROM ASEAN COUNTRIES
WITH ORIGIN FROM ASEAN COUNTRIES

Pursuant to Decree No. 98/2017/NĐ-CP dated August 18, 2017, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

IMPLEMENTING THE COMMITMENT TO ELIMINATE QUOTA DUTY UNDER THE ASEAN TRADE IN GOODS AGREEMENT;

IMPLEMENTING RESOLUTION NO. 130/NQ-CP OF THE GOVERNMENT DATED OCTOBER 17, 2018 ON SUSPENDING THE IMPLEMENTATION OF ARTICLE 20 OF THE ASEAN TRADE IN GOODS AGREEMENT (ATIGA);

At the proposal of the Director of the Import-Export Department,

THE MINISTER OF INDUSTRY AND TRADE ISSUES THIS CIRCULARREGULATING THE NON-APPLICATION OF QUOTA DUTY FOR IMPORTING SUGAR FROM ASEAN COUNTRIES.

Article 1. General Provisions

1. QUOTA DUTY SHALL NOT BE APPLIED TO THE IMPORT OF SUGAR (HS CODE 1701) WITH ORIGIN FROM ASEAN COUNTRIES AS PROVIDED BY CURRENT LEGISLATION.

2. THE QUANTITY OF SUGAR IMPORTED FROM ASEAN COUNTRIES SHALL NOT BE INCLUDED IN THE ANNUAL QUOTA VOLUME ANNOUNCED BY THE MINISTRY OF INDUSTRY AND TRADE IN ACCORDANCE WITH THE COMMITMENTS OF THE WORLD TRADE ORGANIZATION (WTO) APPLICABLE TO WTO MEMBER COUNTRIES.

Article 2. REGULATING THE RATE OF IMPORT DUTY

THE RATE OF IMPORT DUTY ON SUGAR WITH ORIGIN FROM ASEAN COUNTRIES SHALL BE IMPLEMENTED IN ACCORDANCE WITH THE PROVISIONS OF THE GOVERNMENT.

Article 3. Effectiveness

THIS CIRCULAR SHALL TAKE EFFECT FROM JANUARY 1, 2020./.
