Circular No. 23/2025/TT-BCT amends and supplements certain provisions of Circular No. 05/2018/TT-BCT dated April 3, 2018, issued by the Minister of Industry and Trade on the origin of goods and Circular No. 38/2018/TT-BCT dated October 30, 2018, issued by the Minister of Industry and Trade on the implementation of certificates of origin for goods under the Generalized System of Preferences (GSP) of the European Union, Norway, Switzerland, and Turkey.

On the basis of Pursuant to Decree No. 40/2025/NĐ-CP dated February 26, 2025 of the Government detailing the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

Decree No. 31/2018/NĐ-CP dated 08 the 3 Pursuant to Decree No. 32/2019/NĐ-CP dated April 10, 2019 of the Government on assigning tasks, procurement or tendering for the supply of products and services using state budget from regular operating expenses;18 of the Government detailing the Law on Foreign Trade Management on the origin of goods; về xuất xứ hàng hóa; ||

At the proposal of the Director of the Department of Import-Export;

The Minister of Industry and Trade promulgates Circular amending and supplementing some articles of Circular No. 05/2018/TT-BCT dated April 3, 2018 of the Minister of Industry and Trade on the origin of goods and Circular No. 38/2018/TT-BCT dated October 30, 2018 of the Minister of Industry and Trade on the implementation of certificates of origin for goods under the Generalized System of Preferences of the European Union, Norway, Switzerland, and Turkey.

Article 1. Amending and supplementing Article 11 of Circular No. 05/2018/TT-BCT dated April 3, 2018 of the Minister of Industry and Trade on the origin of goods

Amend and supplement Clause 2 of Article 11 as follows:

"2. The Department of Import-Export shall issue and organize the implementation of issuing C/Os according to current laws for types of C/O model B of Vietnam, C/O model A of the Generalized System of Preferences (GSP), C/O model GSTP of the Global System of Trade Preferences (GSTP), C/Os according to the regulations of the importing country, and CNM based on C/Os issued by the first exporting country. The Department of Import-Export and organizations issuing C/Os shall be responsible for providing detailed and clear guidance and explanations of the provisions of this Circular to traders requesting C/Os."

Article 2. Supplementing, replacing, and abolishing some articles of Circular No. 38/2018/TT-BCT dated October 30, 2018 of the Minister of Industry and Trade on the implementation of certificates of origin for goods under the Generalized System of Preferences of the European Union, Norway, Switzerland, and Turkey

1. Amending and supplementing Clause 4 of Article 3 as follows:

"4. Organization accepting registration of REX codes is the Department of Import-Export."

2. Amending and supplementing Clause 4 of Article 4 as follows:

"4. Registration of REX codes shall be conducted online on the European Commission's website at the address customs.ec.europa.eu/rex-pa-ui and the Ministry of Industry and Trade's electronic system for managing and issuing certificates of origin at the address www.ecosys.gov.vn (eCoSys system)."

3. Amending and supplementing Clause 5 of Article 6 as follows:

"5. Within three working days from the date of issuance, traders shall declare and upload certificates of origin for goods under GSP and related export shipment documents as stipulated from point c to point h of Clause 1 of Article 15 of Decree No. 31/2018/NĐ-CP on the eCoSys system."

4. Amending and supplementing Clause 1 of Article 9 as follows:

"1. Responsibilities of the Department of Import-Export:

a) Drafting and submitting to the competent authority for issuance, or issuing within its competence, documents implementing the certification of origin of goods under GSP.

b) Serving as the contact point with Norwegian and Swiss organizations to implement the certification of origin of goods under GSP.

c) Leading and coordinating with relevant agencies, organizations, and individuals to inspect the implementation of the certification of origin of goods under GSP.

d) Organizing the implementation of registration and recovery of REX codes according to this Circular and current laws; disseminating the implementation of certificates of origin for goods under GSP; urging, guiding, answering questions of traders, ensuring transparency and convenience.

đ) Proactively monitoring, supervising, and inspecting the implementation of the certification of origin of goods under GSP by business entities, organizations, and individuals.

e) Managing, preserving, and storing documents, files, and electronic data for a minimum of five years from the end of the year of issuance for certificates of origin for goods under GSP."

5. Amending and supplementing Clause 3 of Article 12 as follows:

"3. Automatic application of certificates of origin for goods under GSP does not apply when Vietnam is not granted GSP by Norway and Switzerland."

6. Replacing the phrase "European Union, Norway, Switzerland, and Turkey" with the phrase "Norway and Switzerland" in the name of the Circular, the last part of the legal basis of the Circular, Article 1, Clause 1 of Article 3, Clauses 1 and 5 of Article 4, Clauses 3 and 6 of Article 5.

7. Removing the phrases in the Appendix (Trader Origin Declaration Form) as follows:

a) Removing the phrases "European Union" and "Turkey" in Note 2.

b) Removing the phrases "- Materials of European Union origin, write "EU cumulation", "Cumul UE" or "Acumulación UE";" and "- Materials of Turkey origin, write "Turkey cumulation", "Cumul Turquie" or "Acumulación Turquía"." in Note 3.

8. Abolishing Article 10.

Article 3. Implementation Provisions

1. This Circular shall take effect from May 5, 2025.

2. In case the legal documents referred to in this Circular are amended, supplemented, or replaced, they shall be implemented according to the new amended, supplemented, or replaced documents./.
