DECREE
Regulations on the selection and utilization of Chief Engineers and Chief Architects for science, technology, innovation, and national digital transformation
Pursuant to the Law on Government Organization No. 63/2025/QH15;
Pursuant to the Law on Cadres and Civil Servants No. 80/2025/QH15;
BASED ON THE LAW ON SCIENCE AND TECHNOLOGY AND INNOVATION NUMBER 93/2025/QH15;

The Government promulgates this Decree to regulate the selection and utilization of Chief Engineers and Chief Architects for science, technology, innovation, and national digital transformation.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
1. This Decree stipulates the selection and utilization of Chief Engineers and Chief Architects, including criteria, selection procedures, benefits, policies, work relationships, management regulations, and evaluation of their performance to achieve breakthroughs in the development of science, technology, innovation, and national digital transformation.
2. This Decree does not apply to the selection and utilization of Chief Engineers as prescribed in Decree No. 103/2025/NĐ-CP dated May 15, 2025, of the Government regarding certain policies for key defense industries and security industries and benefits and policies for workers in key defense industries and security industries.
Article 2. Applicability
1. Individuals who are Vietnamese citizens residing both within and outside Vietnam; foreigners nominated, elected, or selected to become Chief Engineers and Chief Architects according to this Decree.
2. Agencies, organizations, units of the Party, State, Vietnam Fatherland Front, political-social organizations at central and local levels; armed forces; project management boards; organizations and enterprises assigned to take the lead or cooperate in implementing programs and projects to develop science, technology, innovation, and national digital transformation.
3. The Central Steering Committee for Science, Technology, Innovation, and Digital Transformation (hereinafter referred to as the Central Steering Committee).
Article 3. Principles for the Selection and Utilization of Chief Engineers and Chief Architects
1. Adherence to and compliance with the Party's guidelines and state laws, without contravening international treaties to which Vietnam is a party.
2. Promotion of the role and responsibility of society, agencies, organizations, and individuals in implementing mechanisms and policies to create a strong driving force for rapid and sustainable development for the benefit of the nation and the people.
3. Ensuring transparency, objectivity, correctness in terms of target groups and authority; consistency, synchronization, and feasibility in all stages of selection, utilization, remuneration, and honor for Chief Engineers and Chief Architects.
4. Application of innovative and flexible policies for Chief Engineers and Chief Architects, commensurate with the quality of products and work, to motivate Chief Engineers and Chief Architects to contribute to the development of science and technology, innovation, and digital transformation.
5. Chief Engineers and Chief Architects work under labor contracts, outside the assigned establishment of agencies, organizations, or units.
6. Civil servants, public officials, civil servants, and personnel in the armed forces selected to be dedicated Chief Engineers and Chief Architects shall cease to hold positions assigned by competent authorities to perform the tasks of Chief Engineers and Chief Architects as prescribed in this Decree; the time spent as Chief Engineers and Chief Architects shall be counted as continuous service time for the purpose of enjoying benefits and policies as prescribed.
Article 4. Definitions
1. Strategic systems are comprehensive systems covering key areas of science, technology, innovation, and national digital transformation; ensuring comprehensiveness and clear measurability of practical results; creating overall value through tight connections and synchronized coordination within and between systems.
2. Special important projects include specific goal-oriented large-scale projects with breakthrough characteristics and significant impact on economic and social development, prioritized for concentrated national resources to implement decisively, effectively, and creatively to drive rapid and sustainable development.
3. National science, technology, and innovation programs are strategic, large-scale, cross-sectoral, and cross-disciplinary programs implemented over medium or long-term periods approved by the Prime Minister to develop strategic technologies, core technologies, and foundational technologies in priority fields of the country; they play a role in promoting research, building, and implementing strategic policies with wide-ranging impacts on the development of science, technology, and innovation; supporting the implementation of key national programs and projects to achieve breakthroughs in productivity, quality, efficiency, and competitiveness of the economy.
4. Chief Engineer for Science, Technology, and Innovation is the person selected and assigned by the competent authority to carry out specialized tasks, including:
a) System Chief Engineer is the person in charge of implementing strategic systems and special important projects for breakthrough development in science, technology, innovation, and national digital transformation;
b) Project Chief Engineer is the person in charge of carrying out special scientific and technological tasks and national science, technology, and innovation programs approved by the Prime Minister and other large-scale, particularly meaningful, cross-sectoral, and important scientific and technological tasks and programs for economic and social development as prescribed by the Government.
5. Chief Architect of ministries, ministerial-level agencies, government agencies, central departments (hereinafter referred to as Chief Architect at the ministry level) and of provincial People's Committees, centrally-administered city People's Committees (hereinafter referred to as Chief Architect at the provincial level), and Project Chief Architect are persons selected and assigned by the competent authority to carry out specialized tasks, including:
a) The Chief Architect at the ministry level is the person in charge of advising on the development framework to implement the key strategic tasks for breakthroughs in science, technology, innovation, and national digital transformation.
b) The Chief Architect at the provincial level is the person in charge of advising on the development framework to implement the key strategic tasks for breakthroughs in science, technology, innovation, and national digital transformation at the local level.
c) The Project Chief Architect is the person in charge of implementing projects with components related to science, technology, innovation.
Based on the scale of investment and the nature of the project with components related to science, technology, innovation, and digital transformation, the authority with decision-making power shall select and assign a dedicated or兼任的首席架构师,确保任务的有效执行,按照有权机关的指导进行。
Chapter II
CRITERIA, SELECTION PROCEDURES, DUTIES, AND LIMITS OF THE HEAD ENGINEER AND CHIEF ARCHITECT
Section 1
SELECTION CRITERIA
Article 5. General criteria
1. Possessing a relevant academic qualification suitable for the applied position. Preference will be given to those holding degrees or certificates in core technology program management, advanced technologies, and those who have been awarded national and international awards in the fields of science, technology, innovation, and digital transformation.
2. Having a desire to contribute to Vietnam's socio-economic development, with a clear record, good morals, adequate health to work, and passion for the job.
3. Having reputation, experience, outstanding capabilities, and exemplary performance in the relevant field, having practical works, inventions, products that meet the assigned task requirements.
4. Capable of solving complex technical issues across disciplines; handling technological crises; proposing innovative solutions to accelerate project implementation within limited timeframes.
5. In cases where candidates do not fully meet the specific criteria stipulated in Articles 6, 7, 8, 9, and 10 of this Decree but can immediately meet the specialized requirements and duties of the Head Engineer and Chief Architect, the competent authority may decide to select them for program, project, and task implementation and bear responsibility for such decisions.
Article 6. Selection criteria for the System Head Engineer
In addition to the general criteria set forth in Article 5 of this Decree, the System Head Engineer must also meet the following criteria:
1. At least ten consecutive years of work experience in the fields of science, technology, innovation, and digital transformation up to the selection date.
2. Capable of designing, organizing, and coordinating large-scale programs and projects with multiple components, cross-disciplinary, multi-level, innovative, and high-risk characteristics; possessing the ability to network and build domestic and international expert and scientific communities.
3. Having led at least two inter-disciplinary scientific and technological programs or projects with high impact indices in strategic areas or at least two inter-disciplinary scientific and technological products or tasks in strategic areas that have been successfully applied, transferred, commercialized, or implemented in practice.
4. Having directly managed or coordinated large-scale inter-disciplinary programs or projects in fields such as science, technology, information, finance, law, human resources, or regional areas; national infrastructure, core technology, digital transformation programs that have been successfully applied in practice; participating in the development or implementation of national or sectoral digital transformation strategies, technology strategies, or national technology maps.
Article 7. Criteria for selecting the Chief Project Engineer
In addition to the general criteria stipulated in Article 5 of this Decree, the Chief Project Engineer must meet the following criteria:
1. At least ten consecutive years of work experience in the fields of science, technology, innovation, and digital transformation up to the selection date.
2. Capable of designing, organizing, and coordinating large-scale programs and projects with multiple components, cross-disciplinary, multi-level, innovative, and high-risk characteristics; possessing the ability to network and build domestic and international expert and scientific communities.
3. Has led at least one inter-disciplinary scientific and technological program or project of strategic system scale with high impact index or at least one inter-disciplinary scientific and technological product or task that has been applied, transferred, commercialized, or successfully implemented in practice within the strategic field.
4. Has directly managed large-scale, inter-disciplinary programs or projects in fields such as science, technology, information, finance, law, human resources, or inter-regional areas; national-level infrastructure, core technology, digital transformation programs or projects that have been successfully applied in practice.
Article 8. Criteria for selecting the Ministry-level Chief Architect
In addition to the general criteria stipulated in Article 5 of this Decree, the Ministry-level Chief Architect must meet the following criteria:
1. Has at least seven consecutive years of work experience in the fields of science, technology, innovation, and digital transformation up to the time of selection.
2. Has led or significantly participated in the successful implementation of at least one program or task in science, technology, innovation, and digital transformation with industry-wide impact; has participated in building or advising on policies related to science, technology, innovation, and digital transformation.
3. Possesses the ability to develop and coordinate technological roadmaps, overall architectural programs, and projects, and organize the implementation of tasks with innovative and high-risk characteristics; has strategic thinking, systemic thinking, and the ability to lead technological vision or innovation at the industry level.
4. Has the capability to work, research, and cooperate internationally with foreign organizations in the fields of science, technology, innovation, and digital transformation.
Article 9. Criteria for selecting the Provincial-level Chief Architect
In addition to the general criteria stipulated in Article 5 of this Decree, the Provincial-level Chief Architect must meet the following criteria:
1. Has at least seven consecutive years of work experience in the fields of science, technology, innovation, and digital transformation up to the time of selection.
2. Has led or significantly participated in the successful implementation of at least one program or task in science, technology, innovation, and digital transformation with local impact; has participated in building or advising on policies related to science, technology, innovation, and digital transformation.
3. Possesses the ability to develop and coordinate technological roadmaps, overall architectural programs, and projects, and organize the implementation of tasks with innovative and high-risk characteristics; has strategic thinking, systemic thinking, and the ability to lead technological vision or innovation at the local level.
4. Has the capability to work, research, and cooperate internationally with foreign organizations in the fields of advanced science, technology, innovation, and digital transformation.
Article 10. Criteria for selecting the Project Chief Architect
In addition to the general criteria stipulated in Article 5 of this Decree, the Project Chief Architect must meet the following criteria:
1. Has at least five consecutive years of work experience in the fields of science, technology, innovation, and digital transformation up to the time of selection.
2. Has successfully led the implementation of at least one program or task in science, technology, innovation, and digital transformation with project-level impact.
3. Possesses the ability to implement the overall architecture of programs and projects and organize the implementation of tasks with components of science, technology, innovation, and digital transformation of the program or project.
4. Has the capability to work, research, and cooperate internationally with foreign organizations in the fields of advanced science, technology, innovation, and digital transformation.
Section 2
DUTIES, LIMITATIONS AND OBLIGATIONS
Article 11. Tasks of the Chief System Engineer
1. Establish strategic system orientation and overall architecture
a) Lead the design, update, and completion of the strategic system's architecture;
b) Propose long-term vision for the system, integrate strategic systems, ensure consistency, feasibility, and adaptability to technological changes;
c) Develop standards, operational principles, and unified deployment procedures throughout the assigned strategic system;
d) Propose adjustments to the strategic system and resolve technical and inter-sectoral issues in line with global trends in science, technology, innovation, and digital transformation.
2. Coordinate and direct technical and technological matters
a) Organize and coordinate expert groups, research teams, and implementing units for the strategic system;
b) Direct and guide leading scientific and technological fields, overall technical design, ensuring technical standards and product quality;
c) Provide professional and technical guidance; resolve complex technical issues, adjust major designs;
d) Propose changes to technological solutions and implementation plans when optimizing progress, efficiency, or mitigating risks is necessary;
đ) Approve major technical design changes within the system according to the requirements of the competent authority;
e) Chair meetings of the Chief Architects' network and experts within the assigned strategic system;
3. Participate in reviewing and evaluating proposals, tasks, and components within the system;
4. Control progress and quality
a) Establish and operate a technical monitoring system and independent oversight mechanism to control progress, quality, and synchronization of the entire system;
b) Monitor, identify, propose solutions, and plans to address delays and technical deviations to ensure progress, quality, and compliance with the overall architectural map of the system;
c) Regularly assess risks and propose measures to enhance security and technology protection across the entire system;
5. Introduce Project Chief Engineers and Chief Architects
a) Introduce or propose a list of candidates meeting the criteria for Project Chief Engineers and Chief Architects based on consultations with domestic and international expert networks, research institutes, universities, and technology enterprises;
b) Participate in the review and selection of Project Chief Engineers;
6. Propose cooperation mechanisms and resources for implementation
a) Propose the competent authority to allocate experts, businesses, and organizations, both domestic and foreign, to participate in programs and projects;
b) Propose special policies and coordination mechanisms for cross-regional and cross-sectoral programs and projects;
c) Recommend financial mechanisms to ensure the implementation of programs and projects;
d) Propose and implement international scientific and technological cooperation activities;
đ) Propose a roadmap for commercializing scientific and technological products and connecting businesses to access such products;
Article 12. Tasks of the Project Chief Engineer
1. Develop, approve, and be responsible for the overall architecture, scientific and technological roadmap, innovation, and digital transformation of programs and projects;
2. Develop an overall program and project plan ensuring consistency with the system architecture as guided by the Chief System Engineer for application within the management scope;
3. Approve major design changes or propose adjustments and updates to the program and project design and resolve technical issues in line with scientific and technological development trends, innovation, and digital transformation;
4. Coordinate and direct technical and technological matters
a) Organize and coordinate expert groups, research teams, and implementing units for programs and projects;
b) Design the technical aspects of programs and projects, ensuring technical standards and product quality;
c) Provide professional and technical guidance; resolve complex technical issues of programs and projects;
d) Propose changes to technological solutions and implementation plans when optimizing progress, efficiency, or mitigating risks is necessary;
đ) Chair expert meetings of assigned programs and projects;
5. Participate in reviewing and evaluating proposals, tasks, and components within programs and projects;
6. Control progress and quality
a) Decide on strategic technical and technological issues;
b) Technically monitor, control progress, quality, and synchronization of programs and projects;
c) Monitor, identify, propose solutions to resolve complex technical issues and plans to address delays and technical deviations to ensure progress, quality, and compliance with the overall architecture of programs and projects;
d) Regularly assess risks and propose measures to enhance security and technology protection across the entire project;
7. Introduce Chief Architects
a) Introduce or propose a list of candidates meeting the criteria for Chief Architects based on consultations with domestic and international expert networks, research institutes, universities, and technology enterprises;
b) Participate in the review and selection of Chief Architects;
8. Propose cooperation mechanisms and resources for implementation
a) Propose the competent authority to allocate experts, businesses, and organizations, both domestic and foreign, to participate in programs and projects;
b) Propose special policies and coordination mechanisms within the industry and field for programs and projects;
c) Recommend financial mechanisms to ensure the implementation of programs and projects;
d) Propose and implement international scientific and technological cooperation activities;
đ) Propose a roadmap for commercializing scientific and technological products and connecting businesses to access such products;
Article 13. Tasks of the Chief Architect at the Ministry Level and Provincial Level
1. Develop detailed action plans to implement programs and tasks that are appropriate to the specific fields and strengths of the ministry, sector, or locality.
2. Design the system architecture of the ministry, sector, or locality to ensure consistency with the system architecture guidelines issued by the Chief System Engineer, for application within the scope of management.
3. Propose adjustments and updates to program and task designs, and resolve technical issues in line with scientific and technological development trends, innovation, and digital transformation.
4. Coordinate and direct technical and technological matters
a) Organize and coordinate expert groups, research teams, and units implementing programs and tasks;
b) Design technical aspects of programs and tasks, ensuring technical standards and product quality;
c) Provide professional and technical guidance; resolve complex technical issues;
d) Propose changes to technological solutions and implementation plans when optimizing progress, efficiency, or mitigating risks is necessary;
d) Chair expert meetings of assigned projects.
5. Control progress and quality
a) Technically monitor, control progress, quality, and synchronization of projects;
b) Regularly assess risks and propose measures to enhance technology security and confidentiality throughout programs and tasks.
6. Propose cooperation mechanisms and resources for implementation
a) Propose competent authorities to arrange experts, businesses, and organizations, both domestic and foreign, to participate in programs and tasks;
b) Propose special policies and special coordination mechanisms within sectors and fields for programs and tasks;
c) Recommend financial mechanisms to ensure implementation of programs and tasks.
d) Propose and implement international scientific and technological cooperation activities;
đ) Propose a roadmap for commercializing scientific and technological products and connecting businesses to access such products;
Article 14. Tasks of the Project Chief Architect
1. Lead the detailed design of the project's science, technology, innovation, and digital transformation components, ensuring consistency with the system architecture.
2. Develop technical documentation for the project.
3. Defend technical and technological solutions of the component before the competent authority managing the project, the Chief Architect at the Ministry Level and Provincial Level.
4. Recommend financial mechanisms to ensure project implementation.
5. Implement the project's science, technology, innovation, and digital transformation components.
6. Technically monitor, control progress, quality, and synchronization of the project.
Article 15. Authorities and Responsibilities of the Chief System Engineer
1. Rights
a) Propose core technical and technological issues, including technology selection, deployment solutions, and professional evaluation criteria;
b) Maintain professional opinions and be reported in writing or directly propose to the Central Steering Committee when differing opinions affect the implementation results;
c) Access all relevant strategic system documents, data, research results, and professional reports;
d) Request the Project Chief Engineer, Chief Architect, agencies, organizations, units, and experts to explain and report professionally and technically regularly or urgently;
e) Request the agency or organization responsible for implementing the task to temporarily halt or adjust the technical component of the program or project if it violates the overall system architecture or approved standards;
f) Propose personnel, units, organizations, and experts to participate in implementing the strategic system; select and utilize support staff;
g) Participate in building policies, strategies, and planning related to the field of expertise;
h) Participate in Central Steering Committee meetings; join the council to determine prototype products;
i) Enjoy benefits and policies as prescribed.
2. Responsibilities
a) Be responsible to the Central Steering Committee for the quality and effectiveness of the strategic system assigned to implement;
b) Report to the Central Steering Committee on the results of the task implementation;
c) Protect documents and information, ensure cybersecurity, and control data sharing within the system according to the law;
d) Fully and timely perform tasks according to contracts and requirements of the contracting agency, ensuring quality;
e) Bear personal responsibility if violating contractual obligations causes financial loss, asset waste, product damage, or disclosure of confidential information and documents.
Article 16. Powers and responsibilities of the Project Chief Engineer
1. Rights
a) Propose technical issues, core technologies, including technology selection, implementation solutions, professional evaluation standards; participate in reviewing and evaluating proposals, programs, projects related to these matters;
b) Reserve professional opinions and be reported in writing or directly propose to the competent authority managing the program or project when there are differing opinions that affect the implementation results or significant differences;
c) Be entitled to request the Chief Architect, agencies, organizations, units, experts to explain and report on professional and technical matters regularly or urgently;
d) Have access to all relevant documents, data, research results, and professional reports of parties involved in implementing the program or project;
đ) Request the agency or organization responsible for implementing the task to temporarily halt or adjust the technical component of the program or project when it violates the overall architecture or standards approved by the competent authority;
e) Propose personnel, units, organizations, and experts to participate in implementing assigned tasks; select and utilize support staff;
g) Enjoy benefits and policies as prescribed;
2. Responsibilities
a) Be responsible before the Prime Minister, head of the agency or organization assigned to lead the program or project, and the System Chief Engineer for the technical, technological, quality, and effectiveness results of the assigned program or project;
b) Report to members of the Central Steering Committee, government leadership, head of the agency or organization assigned to direct or lead the implementation of the project, and the System Chief Engineer on the results of the assigned task;
c) Safeguard documents, information, ensure cybersecurity, and control data sharing within the project according to legal regulations;
d) Fully and timely perform tasks according to contracts and requirements of the contracting agency, ensuring quality;
e) Bear personal responsibility if violating contractual obligations causes financial loss, asset waste, product damage, or disclosure of confidential information and documents.
Article 17. Powers and responsibilities of the Ministry-level Chief Architect
1. Rights
a) Propose technical issues, technologies, and implementation solutions for the framework architecture of the ministry, sector, or field;
b) Reserve professional opinions and be reported in writing or directly propose to the head of the ministry-level agency or the System Chief Engineer when there are differing opinions that affect the implementation results;
c) Have access to all relevant documents, data, research results, and professional reports of parties related to assigned functions and tasks;
d) Be entitled to request agencies, organizations, units, and experts to explain and report on professional and technical matters regularly or urgently;
đ) Request the agency or organization responsible for implementing the task to temporarily halt or adjust the technical component of the program or project when it violates the overall architecture or standards approved by the competent authority;
e) Propose personnel, units, organizations, and experts to participate in implementing the program or task; select and utilize support staff;
g) Participate in building policies, strategies, and planning related to the field of expertise;
h) Participate in the product sample determination council;
i) Enjoy benefits and policies as prescribed.
2. Responsibilities
a) Be responsible before the head of the ministry-level agency for the quality and effectiveness of implementing the assigned program or task;

c) Safeguard documents, information, ensure cybersecurity, and control data sharing within the assigned task according to legal regulations;
d) Fully and timely perform tasks according to contracts and requirements of the contracting agency, ensuring quality;
e) Bear personal responsibility if violating contractual obligations causes financial loss, asset waste, product damage, or disclosure of confidential information and documents.
Article 18. Powers and responsibilities of the Provincial Chief Architect
1. Rights
a) Propose technical issues, technologies, and solutions for implementing the provincial architectural framework;
b) Maintain professional opinions and report in writing or directly propose to the Chairman of the Provincial People's Committee, the System Project Manager when there are differing opinions that affect the implementation results;
c) Have access to all relevant documents, data, research results, and professional reports related to their functions and tasks;
d) Be entitled to request agencies, organizations, units, and experts to explain and report on professional and technical matters regularly or urgently;
đ) Request the agency or organization responsible for implementing the task to temporarily halt or adjust the technical component of the program or project when it violates the overall architecture or standards approved by the competent authority;
e) Propose the allocation and mobilization of personnel, units, organizations, and experts to participate in the project; select and utilize support staff;
g) Participate in building policies, strategies, and planning related to the field of expertise;
h) Participate in the product sample determination council;
i) Enjoy benefits and policies as prescribed.
2. Responsibilities
a) Be responsible to the Chairman of the Provincial People's Committee for the quality, results, and effectiveness of the assigned tasks;
b) Report to the Chairman of the Provincial People's Committee on the results of the assigned tasks;
c) Safeguard documents, information, ensure cybersecurity, and control data sharing within the assigned task according to legal regulations;
d) Fully and timely perform tasks according to contracts and requirements of the contracting agency, ensuring quality;
e) Bear personal responsibility if violating contractual obligations causes financial loss, asset waste, product damage, or disclosure of confidential information and documents.
Article 19. Powers and responsibilities of the Project Chief Architect
1. Rights
a) Propose technical issues, technologies, and solutions for implementing the scientific, technological, innovation, and digital transformation components of the project;
b) Maintain professional opinions and report in writing or directly propose to the project management authority when there are differing opinions that affect the implementation results;
c) Have access to all relevant documents, data, research results, and professional reports related to their functions and tasks;
d) Request the agency or organization responsible for the task to temporarily halt or adjust the technical component of the project if it violates the overall architecture or standards approved by the competent authority;
e) Propose the allocation and mobilization of personnel, units, organizations, and experts to participate in the project;
f) Enjoy benefits and policies as prescribed;
2. Responsibilities
a) Be responsible to the project management authority and the head of the agency responsible for the project for the quality, results, and effectiveness of the assigned project;
b) Report to the project management authority and the head of the agency responsible for the project on the results of the assigned tasks;
c) Safeguard documents, information, ensure cybersecurity, and control data sharing within the project according to legal regulations;
d) Fully and timely perform tasks according to contracts and requirements of the contracting agency, ensuring quality;
e) Bear personal responsibility if violating contractual obligations causes financial loss, asset waste, product damage, or disclosure of confidential information and documents.
Section 3
PROCEDURE AND AUTHORITY FOR SELECTION
Article 20. Procedure and authority for selecting the System Project Manager
1. The Central Steering Committee's Standing Office publicly announces the list of strategic systems, tasks, projects, and the need to select the System Project Manager, including criteria, requirements, and deadlines for receiving applications.
2. The selection of the System Project Manager shall be conducted through nomination and self-nomination as follows:
a) Individuals meeting the criteria set forth in this Decree may self-nominate;
b) Nominees include: civil servants, public officials, employees in the armed forces, domestic and foreign experts nominated by ministries, sectors, localities, reputable economic groups, and businesses both domestically and internationally, as well as experts and scientists;
c) Nominees working at reputable international agencies, organizations, universities, and research institutes are nominated by the Ministry of Foreign Affairs, diplomatic missions abroad, and overseas Vietnamese communities.
3. The nomination and self-nomination dossier for the System Project Manager includes:
a) Nomination and self-nomination letter;
b) Candidate's scientific curriculum vitae;
c) Report describing professional capabilities, coordination experience, outstanding scientific and technological achievements;
d) Implementation plan for the strategic system, including design ideas for the strategic system architecture, selected technology options, resource, financial, technical conditions, and cooperation arrangements.
Based on the list of nominees, the Central Steering Committee's Standing Office sends invitations to candidates to apply for the position of System Project Manager.
4. The Central Steering Committee's Working Group receives applications, checks their validity; compiles a list of nominees and submits it to the Central Steering Committee's Standing Office. If necessary, the Central Steering Committee's Standing Office decides to establish an Advisory Board to select the System Project Manager. The composition and operation method of the Advisory Board are determined by the Central Steering Committee's Standing Office.
5. Authority to decide on the selection of the System Project Manager
a) Based on the recommendation of the Central Steering Committee's Standing Office, the Central Steering Committee issues a decision on appointing the System Project Manager.
b) According to the Central Steering Committee's decision as stipulated in point a of this clause, the Central Steering Committee's Standing Office signs a fixed-term or indefinite-term labor contract with the System Project Manager.
c) The signed contract must clearly state the duties, powers, responsibilities, benefits, and policies of the System Project Manager according to the model contract issued together with this Decree.
Article 21. Procedure and authority for selecting the Chief Project Engineer
1. The head of the agency responsible for implementing the project shall direct the specialized agencies under their management authority to publicly announce the list of projects, tasks, and requirements for selecting the Chief Project Engineer, including criteria, requirements, and deadlines for receiving applications.
2. The selection process and application procedures for nominating and electing the Chief Project Engineer shall be carried out in accordance with Articles 2 and 3 of Clause 20 of this Decree.
3. Based on the list of candidates nominated and elected, the head of the agency responsible for implementing the project shall invite candidates to participate in the selection process for the Chief Project Engineer; assign specialized agencies to receive applications, verify their validity, compile a list of candidates, and submit it to the Prime Minister. In necessary cases, the Prime Minister may decide to establish an Advisory Board to select the Chief Project Engineer upon the proposal of the head of the agency responsible for implementing the project. The composition of the Advisory Board and its operational methods shall be decided by the Prime Minister.
4. Authority to decide on the selection of the Chief Project Engineer
a) On the basis of the proposal from the head of the agency responsible for implementing the project, the Prime Minister shall issue a document regarding the decision to select the Chief Project Engineer.
b) Based on the document issued by the Prime Minister as stipulated in point a of this clause, the head of the agency responsible for implementing the project shall sign a fixed-term or indefinite-term labor contract with the Chief Project Engineer.
c) The signed contract must clearly state the duties, powers, responsibilities, benefits, and policies of the Chief Project Engineer according to the model contract issued together with this Decree.
Article 22. Procedure and authority for selecting the Chief Architect at the central level, provincial level, and project level
1. Central-level agencies, Provincial People's Committees, and Project Management Boards shall publicly announce the list of tasks, projects, and requirements for selecting the Chief Architect at the central level, provincial level, and project level, including criteria, requirements, and deadlines for receiving applications.
2. The selection process and application procedures for nominating and electing the Chief Architect at the central level, provincial level, and project level shall be carried out in accordance with Articles 2 and 3 of Clause 20 of this Decree.
3. Based on the list of candidates nominated and elected, the central-level agencies, Provincial People's Committees, and Project Management Boards shall invite candidates to participate in the selection process for the Chief Architect at the central level, provincial level, and project level; assign specialized agencies to receive applications, verify their validity, compile a list of candidates, and submit it to the head of the central-level agency, Provincial People's Committee, or Project Management Board. In necessary cases, the head of the central-level agency, Provincial People's Committee, or Project Management Board may decide to establish an Advisory Board to select the Chief Architect at the central level or project level upon the proposal of the unit providing advice on organizational and personnel work, or to select the Chief Architect at the provincial level or project level upon the proposal of the Director of the Provincial Department of Science and Technology. The composition of the Advisory Board and its operational methods shall be decided by the head of the central-level agency, Chairman of the Provincial People's Committee, or Project Management Board.
4. Authority to decide on the selection of the Chief Architect at the central level, provincial level, and project level
a) On the basis of the proposal from the specialized agency or Advisory Board, the head of the central-level agency, Provincial People's Committee, or Project Management Board shall decide to choose and sign a fixed-term or indefinite-term labor contract with the Chief Architect at the central level, provincial level, or project level.
b) The signed contract must clearly state the duties, powers, responsibilities, benefits, and policies of the Chief Architect at the central level, provincial level, or project level according to the model contract issued together with this Decree.
5. In cases where officials, civil servants, public employees, or personnel in the armed forces are nominated and selected to serve as the Chief Architect at the central level, provincial level, or project level on a part-time basis, they are not required to follow the selection procedures specified in this Article and do not need to sign a labor contract.
The head of the central-level agency, Provincial People's Committee, or Project Management Board shall be responsible for issuing a decision to select and assign tasks to the Chief Architect at the central level, provincial level, or project level serving on a part-time basis. The Chief Architect at the central level, provincial level, or project level serving on a part-time basis shall receive an additional 50% of their current monthly salary and enjoy other policies for the Chief Architect as stipulated in this Decree if such policies are more favorable than their current benefits and policies.
Article 23. Termination of Contract for Chief Engineer and Chief Architect
1. The contract shall be terminated in the following cases:
a) Upon expiration of the contract term without renewal or signing of a new contract by the parties;
b) Completion of tasks under the contract (with a quality assessment report or product acceptance record);
c) By mutual agreement between the parties;
d) Unilateral termination of the contract by either party in accordance with the provisions of the law;
đ) The individual who signed the contract no longer meets the conditions and standards stipulated in this Decree;
e) Due to changes in mechanisms, policies, or requirements that make it impossible to continue implementing the contract;
g) Other cases as prescribed by law.
2. Rights and responsibilities of the parties when terminating the contract
a) The Chief Engineer and Chief Architect shall not disclose state secrets, work-related secrets, and other information within the scope of confidentiality commitments accessed during the performance of their tasks after the contract is terminated;
b) Products, research results, innovations, technical solutions, professional materials, and other intellectual property created by the Chief Engineer and Chief Architect during the contract period belong to the agency, organization, or unit that signed the contract, except where otherwise agreed in writing;
c) Relevant agencies, organizations, and units have the responsibility to protect the rights and legitimate interests of the Chief Engineer and Chief Architect regarding products, scientific works, innovations, and technical solutions according to the provisions of the Intellectual Property Law, if these rights are established through agreements in the contract or relevant laws;
d) The parties are responsible for fully settling outstanding debts, finalizing financial accounts (if applicable), returning assets, files, and related documents as prescribed;
đ) In case one party unilaterally terminates the contract in violation of regulations, they must compensate for losses (if any) in accordance with the law and the agreement in the contract.
3. Procedures for Terminating the Contract
The termination of the contract must be documented in writing in accordance with the law, specifying the reasons for termination, the termination date, and the responsibilities of each party after the contract is terminated.
Chapter III
REGIME AND POLICIES FOR THE CHIEF ENGINEER AND CHIEF ARCHITECT
Article 24. Regime and Policies for the System Chief Engineer
1. Regarding Salary
The Central Steering Committee's Permanent Office will consider the salary and income received by the person selected as the System Chief Engineer to agree on the salary and income level in the labor contract for the System Chief Engineer, ensuring parity with the assigned tasks and alignment with the industry, profession, and field wage levels corresponding to the market.
2. Regarding Bonuses
Based on the nature and complexity of the assigned tasks, the head of the System Chief Engineer management agency decides on the bonus amount:
a) Up to five months' salary in the evaluation year if the tasks are completed satisfactorily;
b) Up to three months' salary in the evaluation year if the tasks are completed.
3. Initial Support of One Month's Salary According to the Contract for Stable Housing, Relocation, and Essential Purchases.
4. Ensuring Resources
a) Selecting personnel for the System Chief Engineer's support team not exceeding ten people and proposing salary levels, regimes, and policies for the Central Steering Committee's Permanent Office to decide on labor contracts with each individual;
b) Proposing competent authorities to prepare budget estimates to proactively implement assigned tasks;
c) Receiving funding for domestic and international surveys and scientific research; participating in international cooperation activities on science, technology, innovation, and digital transformation.
5. Regarding Housing and Transportation, Working Conditions
Being provided with official housing (if official housing cannot be arranged, rental assistance is provided), transportation means, and working conditions according to the standards for senior experts at grade 3.
6. Regarding Honors and Awards
a) Being honored upon officially accepting the task and upon completing the task according to the contract;
b) Meeting with high-level leaders of the Party and State, being commended, and hearing reports and proposals; participating in forums to exchange experiences on science, technology, innovation, and digital transformation;
c) Being awarded according to the Law on Encouragement and Reward; receiving national and international awards in science, technology, innovation, and digital transformation in accordance with Vietnamese law.
7. Medical Care, Vacation, and Annual Leave
a) Being provided with a voluntary health care package annually for the individual not exceeding 1% of the total annual salary according to the labor contract;
b) Enjoying seven days of vacation domestically and receiving vacation support funds (up to one month's salary according to the contract) for themselves and family members (including spouse or partner, children under 18 years old);
c) Taking leave according to the law, being reimbursed for round-trip airfare once a year for foreign System Chief Engineers and their family members (including spouse or partner, children under 18 years old) returning home.
8. Policies for Family Members (including spouse or partner, children) Living in Vietnam with the System Chief Engineer
a) Being provided with a voluntary health care package annually for the family not exceeding 1% of the total annual salary according to the contract agreement;
b) Being assisted in finding schools and supporting tuition fees for children under 18 years old in public educational institutions;
c) Being supported in job introduction and creating access to suitable employment opportunities in accordance with the Labor Code and other relevant laws;
d) Being exempted or issued multiple-entry visas and temporary residence cards in accordance with the law, corresponding to the duration of the System Chief Engineer's work (if applicable).
9. Policies After Completing the System Chief Engineer Task
a) Foreign System Chief Engineers, if willing, may be prioritized for Vietnamese citizenship.
b) In case the person is an officer, civil servant, public official, or employee receiving salary in the armed forces and has been evaluated by the competent authority as having satisfactorily completed their tasks during the period serving as the Chief System Engineer, they shall be considered for placement in a higher position than the one held prior to assuming the role of Chief System Engineer.
c) The Chief System Engineer who does not fall under the provisions of point a of this clause, holds Vietnamese citizenship, and has the need but does not yet meet all the criteria and conditions shall be considered and decided upon by the competent authority for placement in a job position and appointment to leadership and management positions within state agencies, organizations, and units.
Article 25. Remuneration and Policies for the Chief Project Engineer
1. Regarding Salary
The head of the agency primarily responsible for implementing the project shall consider the salary and income received by the person selected as the Chief Project Engineer to negotiate the salary and income in the labor contract, ensuring it is commensurate with the assigned tasks and consistent with the prevailing wage levels in the relevant industry, profession, and field of work on the market.
2. Regarding bonuses, initial support, honors, awards, healthcare, annual leave, policies for family members, and post-completion policies shall be implemented according to the provisions of Clauses 2, 3, 6, 7, 8, and 9 of Article 24 of this Decree.
3. Ensuring Resources
a) Select personnel for the Chief Project Engineer's office not exceeding ten people and propose salaries and policies for the head of the agency primarily responsible for implementing the project to decide on signing labor contracts with each individual.
b) Decide on the use of allocated funds and resources, including funds for directly purchasing necessary foreign technology, products, and equipment at agreed prices, and directly purchasing foreign technological secrets at agreed prices as stipulated in the contract.
c) Receiving funding for domestic and international surveys and scientific research; participating in international cooperation activities on science, technology, innovation, and digital transformation.
4. Housing and Transportation, Working Conditions
Be provided with official housing (if official housing cannot be arranged, rental assistance will be provided), transportation means, and working conditions according to the standards for senior experts of level 2.
Article 26. Remuneration and Policies for the Chief Architect of Ministries
1. Regarding Salary
The head of the ministry shall consider the salary and income received by the person selected as the Chief Architect of the Ministry to negotiate the salary and income in the labor contract, ensuring it is commensurate with the assigned tasks and consistent with the prevailing wage levels in the relevant industry, profession, and field of work on the market.
2. Regarding bonuses, initial support, honors, awards, healthcare, annual leave, policies for family members, and post-completion policies shall be implemented according to the provisions of Clauses 2, 3, 6, 7, 8, and 9 of Article 24 of this Decree.
3. Ensuring Resources
a) Select personnel for the Chief Architect of the Ministry's office not exceeding five people and propose salaries and policies for the head of the ministry to negotiate signing labor contracts with each individual.
b) Proposing competent authorities to prepare budget estimates to proactively implement assigned tasks;
c) Receiving funding for domestic and international surveys and scientific research; participating in international cooperation activities on science, technology, innovation, and digital transformation.
4. Housing and Transportation, Working Conditions
a) Be provided with official housing in accordance with the law on housing; if official housing cannot be arranged, rental assistance will be provided, along with transportation means and working conditions equivalent to those of senior experts of level 1.
b) In case the person is a Vietnamese citizen residing abroad or a foreigner eligible for preferential policies on exit and entry, multiple-entry visas or temporary residence permits corresponding to the duration of the program or mission shall be issued.
Article 27. Remuneration and policies for Provincial Chief Architects
1. Regarding Salary
The head of the provincial agency shall consider the salary and income received by the person selected to be the Provincial Chief Architect to negotiate the salary and income in the labor contract, ensuring that it is commensurate with the assigned tasks and consistent with the prevailing wage levels in the relevant industry, profession, and field of work on the market.
2. Regarding bonuses, initial support, honors, awards, healthcare, annual leave, policies for family members, and post-completion policies shall be implemented according to the provisions of Clauses 2, 3, 6, 7, 8, and 9 of Article 24 of this Decree.
3. Ensuring resources
a) Selecting personnel for the Provincial Chief Architect's office not exceeding three people and proposing salaries, benefits, and policies for the Chairman of the Provincial People's Committee to decide on signing labor contracts with each individual;
b) Proposing competent authorities to prepare budget estimates to proactively implement assigned tasks;
c) Receiving funding for domestic and international surveys and scientific research; participating in international cooperation activities on science, technology, innovation, and digital transformation.
4. Housing and Transportation, Working Conditions
a) Being provided with official accommodation according to the laws on housing; if official accommodation cannot be arranged, then being supported with rental housing expenses, means of transportation, and working conditions equivalent to those of a Deputy Chairman of the Provincial People's Committee;
b) In case the person is a Vietnamese citizen residing abroad or a foreigner eligible for preferential policies on exit and entry, multiple-entry visas or temporary residence permits corresponding to the duration of the program or mission shall be issued.
Article 28. Remuneration and policies for Project Chief Architects
1. Regarding Salary
The head of the agency responsible for implementing the project shall consider the salary and income received by the person selected to be the Project Chief Architect to negotiate the salary and income in the labor contract, ensuring that it is commensurate with the assigned tasks and consistent with the prevailing wage levels in the relevant industry, profession, and field of work on the market.
2. Regarding bonuses, initial support, honors, awards, healthcare, annual leave, policies for family members, and post-completion policies shall be implemented according to the provisions of Clauses 2, 3, 6, 7, 8, and 9 of Article 24 of this Decree.
3. Regarding housing and means of transportation, working conditions
a) Being provided with official accommodation according to the laws on housing; if official accommodation cannot be arranged, then being supported with rental housing expenses, means of transportation, and working conditions equivalent to those of a Department Director under a ministry or a Provincial Department Director;
b) In case they are overseas Vietnamese or foreigners, they shall enjoy preferential policies regarding exit and entry; being issued multiple-entry visas or temporary residence cards corresponding to the duration of the project implementation.
Chapter IV
RELATIONSHIPS OF WORK OF THE CHIEF ENGINEERS AND PROVINCIAL CHIEF ARCHITECTS
Article 29. Relationships of work of System Chief Engineers
1. System Chief Engineer
a) Being responsible before the Central Steering Committee for implementing system strategies and particularly important projects; proposing solutions to the Central Steering Committee to address inter-departmental, inter-system, and inter-field issues during the implementation process requiring cooperation from many ministries, sectors, and localities;
b) Directing, guiding, supervising professionally and technically, participating in evaluating the results of the implementation of tasks for Project Chief Engineers, Ministry-level Chief Architects, Provincial Chief Architects, and projects within the system strategy and particularly important projects;
c) Cooperating with other System Chief Engineers in implementing system strategies and particularly important projects, ensuring synchronization, connectivity, and consistency in the national overall architecture;
d) Cooperating with central agencies and provincial people's committees in sharing data, human resources, infrastructure to implement system strategies and particularly important projects at central agencies and localities.
2. Project Chief Engineer
a) Being fully responsible before members of the Steering Committee, government leaders, heads of directing or leading agencies implementing programs and projects, and being professionally and technically responsible before the System Chief Engineer about the implementation of programs and projects;
b) Cooperating with other Project Chief Engineers, Ministry-level Chief Architects, Provincial Chief Architects, and related projects in implementing programs and projects, ensuring synchronization, connectivity, and consistency of the program and project system;
c) Cooperating with central agencies and provincial people's committees in sharing data, human resources, infrastructure to implement programs and projects.
Article 30. Work Relationship of Chief Architects at the Ministry Level, Provincial Level, and Project Level
1. Shall be responsible to the head of the ministry-level agency, the Chairman of the People's Committee at the provincial level for implementing duties and responsibilities; proposing solutions to inter-departmental, inter-system, and inter-field issues during the implementation process that require coordination among multiple agencies.
2. Shall be responsible to the Chief System Engineer, the Chief Project Engineer regarding the quality of architecture, technical direction, technology, ensuring consistency in the overall architectural design of the system.
3. Shall cooperate with other Chief Architects at the ministry level, provincial level, and project level in implementing projects, ensuring synchronization, connectivity, and consistency in the overall architectural design of the ministry, sector, and locality.
4. Shall cooperate with the project management agency and relevant agencies of the ministry, sector, and locality in sharing data, human resources, infrastructure to implement within the overall architectural framework of the ministry, sector, and locality.
Chapter V
ASSESSMENT OF TASK IMPLEMENTATION RESULTS, MANAGEMENT REGULATIONS FOR CHIEF SYSTEM ENGINEERS AND CHIEF ARCHITECTS
Article 31. Evaluation Criteria
1. Progress in implementing tasks according to the approved plan.
2. Quality of output products according to the contract and the approved plan.
3. Proposals, initiatives, applications of innovative technologies, leading scientific and technological development within the system.
4. Coordination, connection, and resolution capabilities for issues arising during the implementation process.
5. Sense of responsibility, dedication, cooperation, and coordination in work.
Article 32. Methods of Evaluation
The effectiveness of task implementation shall be evaluated through the following methods:
1. Annual periodic evaluation.
2. Evaluation after each phase of task implementation.
Article 33. Authority to Evaluate
1. The Central Steering Committee shall conduct evaluations of the Chief System Engineer.
2. The head of the agency leading the program or task shall conduct evaluations of the Chief Project Engineer.
3. The head of the ministry-level agency, the People's Committee at the provincial level, and the Project Management Board shall conduct evaluations of the Chief Architect.
Article 34. Levels of Evaluation Classification
1. Successfully completed the task.
2. Completed the task.
3. Failed to complete the task.
The evaluation results will serve as the basis for implementing systems, policies, or terminating contracts for the Chief System Engineer and Chief Architect.
Article 35. Management Regulations
1. The selection, utilization, evaluation, management, and implementation of systems and policies for the Chief System Engineer shall be carried out in accordance with this Decree and regulations issued by the Central Steering Committee.
2. The selection, utilization, evaluation, management, and implementation of systems and policies for the Chief Project Engineer shall be carried out in accordance with this Decree and regulations issued by the Ministry of Science and Technology.
3. The selection, utilization, evaluation, management, and implementation of systems and policies for the Chief Architect shall be carried out in accordance with this Decree and regulations issued by the ministry-level agency, the People's Committee at the provincial level, and the Project Management Board.
Chapter VI
IMPLEMENTATION
Article 36. Implementation Funding
The funding for implementing this Decree shall be guaranteed by the state budget and allocated within the fields of science, technology, innovation, and digital transformation.
Article 37. Application to other subjects
1. Party agencies, state agencies, Vietnam Fatherland Front, central-level political-social organizations shall apply the provisions on selecting and using Chief Engineers and Chief Architects set forth in this Decree to perform tasks and programs/projects within their management scope.
2. In cases where Chief Engineers and Chief Architects fall under the application of regulations stipulated in other documents with lower policies and benefits than those provided for in this Decree, they shall be entitled to apply the policies and benefits stipulated in this Decree to reach an agreement that is appropriate.
3. Where a Chief Engineer or Chief Architect meets the conditions to enjoy multiple policies and benefits stipulated in different documents, he/she shall only be entitled to the highest policy or benefit.
Article 38. Responsibilities for Implementation
1. Ministries, central-level agencies, People's Committees of provinces have the responsibility to:
a) Develop and propose scientific and technological programs, projects, science and technology tasks, innovation and digital transformation tasks requiring the selection of Chief Engineers and Chief Architects;
b) Provide complete data, files, and information related to tasks, programs, and projects; allocate resources and personnel, and create favorable conditions for Chief Engineers and Chief Architects to carry out their tasks; coordinate to resolve technical, legal, and financial issues proposed by Chief Engineers and Chief Architects;
c) Inspect, supervise tasks, programs, and projects utilizing Chief Architects; report periodically to the Government, Prime Minister, Ministry of Science and Technology on the implementation status and results of Chief Architects' tasks within their respective fields and localities before November 15 each year, while sending reports to the Ministry of Home Affairs for monitoring.
2. The Ministry of Science and Technology is responsible for:
a) Propose competent authorities to issue lists of scientific and technological programs, projects, innovation and digital transformation tasks utilizing Chief Engineers and Chief Architects;
b) Issue guidelines on criteria and procedures for determining components of science and technology, innovation, and digital transformation in investment programs and projects in economic and social sectors.
3. The Ministry of Finance has the responsibility to balance the national budget annually for the fields of science and technology, innovation, and digital transformation, and public investment according to laws on the state budget and sectoral management.
4. The Ministry of Public Security has the responsibility to:
a) Lead, inspect, and supervise the protection of state secrets, cybersecurity, and information security during the implementation of programs and tasks utilizing important data, core technologies, and confidential information; train and guide technical security procedures, document classification, and handling cyber incidents for units participating in particularly important science and technology tasks; implement measures to ensure personal safety and security for Chief Engineers and Chief Architects;
b) Lead research, propose, and submit to competent authorities for approval amendments and supplements to regulations and administrative procedures regarding entry-exit, visa issuance, and residence to facilitate Chief Architects who are overseas Vietnamese, foreigners, and their families returning to work and live in Vietnam.
5. The Ministry of National Defense checks compliance with technical security regulations, integrated defense technology systems, military data, cryptographic platforms, satellites, and secure communication.
6. The Ministry of Foreign Affairs is responsible for directing subordinate agencies under its jurisdiction to develop programs to seek, attract, and support experts and scientists who are overseas Vietnamese, foreigners, to introduce them to work and research in Vietnam, and propose amendments and supplements to regulations on preferential visa issuance for foreign Chief Architects and their families returning to work and live in Vietnam.
7. The Ministry of Justice leads and coordinates with the Ministry of Foreign Affairs to examine and report to competent authorities on granting Vietnamese citizenship to foreign Chief Engineers and Chief Architects who have made significant contributions during the implementation of tasks.
8. The Ministry of Construction leads research and proposes to competent authorities for amendments and supplements to the subject of Chief Architects eligible for official housing benefits.
9. The Ministry of Home Affairs has the responsibility to:
a) Lead and coordinate with the Ministry of Science and Technology to guide and inspect the implementation of policies on selecting and using Chief Engineers and Chief Architects in national science and technology, innovation, and digital transformation;
b) Guide the simplification of work permit procedures; commend, honor, and reward Chief Engineers, Chief Architects, experts, enterprises, organizations, and individuals with outstanding achievements in recruiting and using Chief Engineers and Chief Architects.
Article 39. Effective date
This Decree takes effect from the date of issuance.
The provisions of this Decree concerning Chief Engineers as stipulated in Article 53 of the Law on Science and Technology and Innovation 2025 shall be implemented from October 1, 2025.
Article 40. Responsibility for Implementation
Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairmen of provincial and centrally-administered city People's Committees, and relevant organizations and individuals are responsible for implementing this Decree.
