Decree No. 238/2026/ND-CP amends and supplements certain articles of Decree No. 168/2024/ND-CP dated December 26, 2024, of the Government on administrative penalties for violations related to traffic order and safety in the field of road traffic; deduction and restoration of points on driving licenses.

Amending and supplementing some Articles of Decree No. 168/2024/NĐ-CP dated December 26, 2024 of the Government on administrative penalties for violations related to traffic order and safety in the field of road traffic; deducting points, restoring points on driving licenses

 

Pursuant to the Law on Government Organization No. 63/2025/QH15;

Pursuant to the Law on Local Administration Organization No. 72/2025/QH15;

On the basis of the Law on Handling Administrative Violations No. 15/2012/QH13 amended and supplemented by Law No. 54/2014/QH13, Law No. 18/2017/QH14, Law No. 67/2020/QH14, Law No. 09/2022/QH15, Law No. 11/2022/QH15, Law No. 56/2025/QH15, Law No. 88/2025/QH15, Law No. 116/2025/QH15, Law No. 120/2025/QH15;

On the basis of the Law on Traffic Order and Safety on Road No. 36/2024/QH15 amended and supplemented by Law No. 118/2025/QH15;

The Government promulgates this Decree on regulations regarding entry, exit, and residence policies for foreigners at the International Financial Center in Vietnam.

The Government promulgates this Decree amending and supplementing some Articles of Decree No. 168/2024/NĐ-CP dated December 26, 2024 of the Government on administrative penalties for violations related to traffic order and safety in the field of road traffic; deducting points, restoring points on driving licenses.

PART I

AMENDING AND SUPPLEMENTING SOME ARTICLES OF DECREE NO. 168/2024/NĐ-CP DATED DECEMBER 26, 2024 OF THE GOVERNMENT ON ADMINISTRATIVE PENALTIES FOR VIOLATIONS RELATED TO TRAFFIC ORDER AND SAFETY IN THE FIELD OF ROAD TRAFFIC; DEDUCTING POINTS, RESTORING POINTS ON DRIVING LICENSES

Article 1. Amending and supplementing some Points of Clause 3, Article 3

1. Amending and supplementing Point i as follows:

"i) Compel the installation of vehicle tracking devices, devices recording images of the driver, devices recording images of the passenger compartment, seat belts, seats for preschool children and primary school students, specialized equipment for rescue and emergency assistance on the vehicle in accordance with regulations;"

2. Amending and supplementing Point l as follows:

"l) Compel the provision, updating, transmission, storage, and management of information and data from vehicle tracking devices, devices recording images of the driver, devices recording images of the passenger compartment installed on the automobile in accordance with regulations;"

Article 2. Amending and supplementing some Points and Clauses of Article 6

1. Supplementing Clause 1a before Clause 1 as follows:

"1a. Warning penalty shall be imposed on the person operating an automobile who carries children under ten years old and less than 1.35 meters tall without using appropriate safety equipment for children in accordance with regulations (except for commercial passenger transport vehicles)."

2. Amending and supplementing Point m of Clause 3 as follows:

"m) Carrying children under ten years old and less than 1.35 meters tall in an automobile sitting in the same row as the driver (except for automobiles with only one row of seats);"

Article 3. Amending and supplementing Point b of Clause 8, Article 13

"b) Operating a vehicle without sufficient license plates or with license plates not in the correct position or not in the correct format according to regulations; license plates that are unclear in letters and numbers or painted or stuck over letters and numbers of the license plate; license plates bent, covered, or altered in letters, numbers, colors (of letters, numbers, background of the license plate), shape, size of the license plate; using materials, substances, or equipment changing the ability to recognize license plate information of the vehicle, technical equipment (including trailers and semi-trailers)."

Article 4. Amending and supplementing Point b of Clause 3, Article 14

"b) Operating a vehicle with license plates not in the correct position or not in the correct format according to regulations; license plates that are unclear in letters and numbers or painted or stuck over letters and numbers of the license plate; license plates bent, covered, or altered in letters, numbers, colors (of letters, numbers, background of the license plate), shape, size of the license plate; using materials, substances, or equipment changing the ability to recognize license plate information of the vehicle, technical equipment."

Article 5. Amend and supplement Point a Clause 2 Article 17

"a) Transporting construction materials, rocks, waste, bulk goods without covering; causing goods, construction materials, rocks, waste, mud, bulk goods to fall onto the road; transporting goods or waste that causes water to flow onto the road;"

Article 6. Amend and supplement Point a Clause 4 Article 18

"a) A person aged from 16 years old to under 18 years old driving a motorcycle or similar vehicles;"

Article 7. Amend and supplement some Points and Clauses of Article 20

1. Amend and supplement some Points of Clause 5 as follows:

a) Amend and supplement Point đ as follows:

"đ) Operating passenger transport vehicles using paper-based contracts without having a transportation contract and passenger list as required; having a transportation contract but not in accordance with regulations; picking up passengers or carrying people not listed in the signed passenger list;"

b) Amend and supplement Point g as follows:

"g) Operating passenger transport vehicles according to contracts by picking up or dropping off passengers at the main office, branch office, representative office, or other fixed locations rented or cooperatively operated on streets; picking up or dropping off passengers, officials, civil servants, employees, workers not in accordance with the location specified in the signed transportation contract, except for violations stipulated in Clause 8 of this Article; transporting passengers not in accordance with the prescribed category (applicable to passenger transport vehicles operating children in kindergarten, students, employees, officials, workers);"

c) Amend and supplement Point l, Point m as follows:

"l) Operating commercial passenger transport vehicles or internal transport vehicles without installing image recording devices for drivers or having such devices installed but they are not operational during traffic participation as required or tampering with the data of the driver image recording device installed on the vehicle;

d) Add Point n after Point m as follows:

"n) Operating passenger transport vehicles for commercial purposes with eight seats or more (excluding the driver's seat) without installing image recording devices for the passenger compartment or having such devices installed but they are not operational during traffic participation as required or tampering with the data of the passenger compartment image recording device installed on the vehicle."

2. Amend and supplement Point đ Clause 6 as follows:

"đ) Operating commercial passenger transport vehicles or internal transport vehicles without installing vehicle tracking devices as required or having such devices installed but they are not operational as required or tampering with the data of the vehicle tracking device installed on the vehicle;"

3. Add Clause 8a after Clause 8 as follows:

"8a. Imposing a fine of VND 12,000,000 to VND 14,000,000 on individuals who drive non-commercial passenger transport vehicles but allow persons to collect fees or sign contracts, make reservations to carry passengers on the vehicle."

4. Amend and supplement Point c Clause 10 as follows:

"c) Committing violations stipulated in Clauses 8 and 8a of this Article shall result in a deduction of six points from the driving license."

"c) Committing acts violating the provisions of Clause 8, Clause 8a of this Article shall result in a deduction of six points from the driving license."

Article 8. Amend and supplement some points and clauses of Article 21

1. Amend and supplement point b clause 2 as follows:

"b) Transporting goods on top of the cargo box; transporting goods exceeding the width of the cargo box (including the width of the trailer and semi-trailer); transporting goods extending more than 10% beyond the front or rear of the cargo box (including the trailer and semi-trailer) according to the overall length recorded in the vehicle safety technical inspection and environmental protection certificate, except for violations stipulated in point d clause 8 of this Decree."

Article 8. Responsibilities for Implementation

"b) Operating commercial passenger vehicles, tractor units, internal transport vehicles without installing equipment to record driver images or with such equipment installed but not functioning during traffic participation as prescribed or tampering with the data of the driver image recording equipment installed on the vehicle."

3. Amend and supplement point c clause 5 as follows:

c) Operating commercial passenger vehicles, tractor units, internal transport vehicles without installing trip monitoring devices or with such devices installed but not functioning during traffic participation as prescribed or tampering with the data of the trip monitoring device installed on the vehicle;"

4. Amend and supplement clause 8 as follows:

a) Amend and supplement point d, point đ as follows:

"d) Transporting equipment with box shape or container-like shape (not container) exceeding the overall length recorded in the safety technical inspection and environmental protection certificate of the trailer or semi-trailer; transporting goods not matching the information recorded in the safety technical inspection and environmental protection certificate of the trailer or semi-trailer;

đ) Transporting goods on the vehicle without securing or with securing but not ensuring safety, except for violations stipulated in clause 10 of this Article; transporting loose materials or construction materials on the vehicle without a cargo box;"

b) Supplement point e after point đ as follows:

"e) Operating non-commercial passenger vehicles but carrying goods on the vehicle for payment."

Article 9. Amend and supplement some points and clauses of Article 26

1. Amend and supplement some points of clause 7 as follows:

a) Amend and supplement point e as follows:

"e) Using commercial passenger vehicles for contractual transportation without having a transportation contract, passenger list on the vehicle; without equipment to access electronic contract content, passenger list as prescribed; having a contract but not in accordance with regulations; arbitrarily changing information of the signed electronic contract, passenger list; picking up passengers, carrying people not listed in the signed passenger list; picking up and dropping off passengers at the main office, branch office, representative office or at another fixed location rented or cooperatively operated by the transportation business unit on streets; transporting not in accordance with regulations (applicable to contractual transportation of preschool children, students, employees, civil servants, workers);"

b) Supplement point k, point l after point i as follows:

"k) Using passenger vehicles for commercial transportation from 08 seats and above (excluding the driver's seat) without installing equipment to record passenger cabin images as prescribed or with such equipment installed but unable to record or store data on the vehicle during traffic participation as prescribed or tampering with the data of the passenger cabin image recording equipment on the vehicle;

l) Not providing, updating, transmitting, storing, managing information, data collected from the passenger cabin image recording equipment installed on the vehicle as prescribed."

2. Supplement point d after point c clause 8 as follows:

"d) Using passenger vehicles for contractual transportation and confirming reservations for individual passengers outside the signed contract or selling tickets, collecting payments outside the signed contract; setting fixed routes and schedules to serve multiple passengers or different rental transportation clients."

3. Amend and supplement point c, point d clause 13 as follows:

"c) Implementing the acts stipulated in point đ, point e clause 4; point c, point g, point k clause 7 of this Decree shall be required to install trip monitoring devices, driver image recording equipment, passenger cabin image recording equipment, seat belts, seats for preschool children and primary school students on the vehicle in accordance with regulations;

d) Implementing the acts stipulated in point a, point h, point l clause 7; clause 11 of this Decree shall be required to provide, update, transmit, store, manage information, data collected from trip monitoring devices, driver image recording equipment, passenger cabin image recording equipment installed on the vehicle in accordance with regulations;"

Article 10. Amend and supplement some points and clauses of Article 29

1. Add Clause 3a following Clause 3 as follows:

"3a. Imposing a fine from VND 5,000,000 to VND 10,000,000 for any of the following acts:

a) Operating a road traffic rescue vehicle carrying a rescued vehicle exceeding the permissible load capacity of the rescue vehicle; towing a rescued vehicle exceeding the permissible towing capacity of the rescue vehicle as recorded in the safety technical inspection and environmental protection certificate of the vehicle;

b) Operating a road traffic rescue vehicle towing a vehicle not in accordance with the rescue object as prescribed in Clause 1, Article 54 of the Road Traffic Safety Law."

2. Amend and supplement Clause 4 as follows:

"4. In addition to being subject to administrative sanctions, the driver who commits the act prescribed in Clauses 3 and 3a of this Article shall have two demerit points deducted from their driving license."

Article 11. Amend and supplement some points and clauses of Article 32

1. Add Clause 9a following Clause 9 as follows:

"9a. Imposing a fine from VND 5,000,000 to VND 6,000,000 for individuals, and from VND 10,000,000 to VND 12,000,000 for organizations that are the owners of tractor-trailers or internal transport vehicles committing any of the following violations:

a) Putting into operation a vehicle without an on-board monitoring device installed, or with an installed on-board monitoring device but not functioning, not conforming to the prescribed standards, or tampering with the data of the on-board monitoring device of the vehicle;

b) Putting into operation a vehicle without a driver image recording device installed, or with an installed driver image recording device but unable to record or store data as prescribed, or tampering with the data of the driver image recording device installed on the vehicle."

2. Add Point e following Point d Clause 11 as follows:

"e) Handing over the vehicle or allowing employees, drivers to commit violations as prescribed in Clause 8a, Article 20 of this Decree."

3. Add Point e following Point d Clause 13 as follows:

"e) Handing over the vehicle or allowing employees, representatives to operate the vehicle to commit violations as prescribed in Points c, d, e Clause 8, Article 21 of this Decree, or directly operating the vehicle to commit violations as prescribed in Points c, d, e Clause 8, Article 21 of this Decree."

4. Amend and supplement Point l Clause 19 as follows:

"l) Committing violations as prescribed in Point o Clause 7, Clause 9a of this Article, requiring the installation of specialized equipment for rescue and support, on-board monitoring devices, driver image recording devices on the vehicle in accordance with regulations."

5. Amend and supplement Point c Clause 21 as follows:

"c) Committing acts as prescribed in Points a, b, đ, e Clause 13; Points a, b, c, d Clause 14; Point a Clause 16 of this Article, if the owner of the vehicle is also the direct operator of the vehicle, they shall be additionally penalized with four demerit points deducted from their driving license;"

Article 12. Amend and supplement some points and clauses of Article 41

1. Amend and supplement Point d Clause 2 as follows:

"d) Points a, b, c, d, e Clause 1; Point a Clause 2; Points a, b, c, g, h, i, k Clause 3; Points b, d, i, k Clause 4; Points đ, e, g, h, i, k Clause 5; Clause 7; Clause 8 Article 39."

2. Add Point k1 following Point k Clause 4 as follows:

"k1) Points a, b Clause 3; Points b, c, d, h Clause 7; Points a, c, d Clause 8 Article 32;"

3. Amend and supplement Clause 5 as follows:

"5. The Director of the Vietnam Highway Administration, the Head of the Inspection Team established by the Minister of Construction, the Director of the Department of Construction, the Head of the Inspection Team established by the Director of the Vietnam Highway Administration, the Director of the Area Management Units under the Vietnam Highway Administration have the authority to impose penalties at the points, clauses, articles of this Decree as follows:

a) Clause 1; Points a, b, c, d, e Clause 2; Clause 3; Clause 4; Clause 5; Point a Clause 6; Points a, d, e, g, h, i Clause 7; Points a, b, d Clause 8 Article 26; Point a Clause 2; Points i, l Clause 7; Point b Clause 8; Points a, d Clause 9; Clause 9a; Point e Clause 11; Point i Clause 14; Point c Clause 16; Points a, b Clause 17 Article 32 when conducting inspections at transportation units, bus stations, parking lots, rest stops, service support transport units;

b) Clause 1; Clause 2; Points a, b, c, d, đ, e Clause 3; Points a, b, c, d, đ, e, g, h Clause 4; Points a, b, c, d Clause 5; Clause 6 Article 39; Article 40."

Article 13. Amending and supplementing Article 42

"Article 42. The authority to impose fines of the Chairpersons of People's Committees at all levels

1. The Chairperson of the People's Committee at the commune level has the right to:

a) To issue warnings;

b) Imposing a fine up to VND 37,500,000;

c) To suspend the use of licenses or certificates for a period of time or to suspend operations for a period of time;

d) Confiscate contraband and means of administrative violation;

d) Applying measures to remedy consequences as prescribed in Clause 3, Article 3 of this Decree.

2. The Chairman of the People's Committee of a provincial-level city has the right:

a) To issue warnings;

b) Impose a fine up to seventy-five million dong;

c) To suspend the use of licenses or certificates for a period of time or to suspend operations for a period of time;

d) Confiscate contraband and means of administrative violation;

d) Applying measures to remedy consequences as prescribed in Clause 3, Article 3 of this Decree."

Article 14. Amending and supplementing Article 43

"Article 43. The authority to impose fines of the People's Public Security

1. Public security officers performing their duties have the authority to:

a) To issue warnings;

b) Impose fines up to 7,500,000 VND;

c) Seizing objects, means of transport violating administrative regulations with a value not exceeding VND 15,000,000.

2. The head of the Mobile Police Company has the right:

a) To issue warnings;

b) Impose fines up to 15,000,000 VND;

c) Seizing objects, means of transport violating administrative regulations with a value not exceeding VND 30,000,000;

d) Applying measures to remedy consequences as prescribed in Clause 3, Article 3 (except Point c, Clause 3, Article 3) of this Decree.

3. The Head of Police Station, the head of the Mobile Police Company at battalion level, the Head of Station, the Team Leader have the right:

a) To issue warnings;

b) Imposing a fine up to VND 22,500,000;

c) To suspend the use of licenses or certificates for a period of time or to suspend operations for a period of time;

d) Seizing objects, means of transport violating administrative regulations with a value not exceeding VND 45,000,000;

đ) Applying measures to remedy consequences as prescribed in Clause 3, Article 3 (except Point c, Clause 3, Article 3) of this Decree.

4. The Head of Public Security at commune level has the right:

a) To issue warnings;

b) Imposing a fine up to VND 37,500,000;

c) To suspend the use of licenses or certificates for a period of time or to suspend operations for a period of time;

d) Confiscate contraband and means of administrative violation;

d) Applying measures to remedy consequences as prescribed in Clause 3, Article 3 of this Decree.

5. The Heads of specialized departments under the Traffic Police Inspectorate including: the Head of Guidance, Propaganda, Investigation, and Accident Resolution Department, the Head of Guidance, Registration, and Inspection Department of Means of Transport, the Head of Guidance, Training, Examination, and Management Department of Drivers' Licenses, the Head of Guidance, Patrol, and Control Department of Road Traffic and Railways, the Head of Traffic Control and Escort Department, the Head of Management, Operation, Processing, and Digital Transformation Department; the Heads of specialized departments under the Administrative Management Inspectorate for Social Order including: the Head of Guidance and Management Department of Weapons, Explosives, Supporting Tools, and Fireworks, the Head of Guidance and Management Department of Industries and Trades with Conditions on National Security and Social Order and Stamps, the Director of the National Population Data Center; the head of the Mobile Police Battalion; the Heads of specialized departments under the Provincial Public Security including: the Head of Administrative Management Inspectorate for Social Order, the Head of Traffic Police Inspectorate, the Head of Mobile Police Inspectorate have the right:

a) To issue warnings;

b) Imposing a fine up to VND 60,000,000;

c) To suspend the use of licenses or certificates for a period of time or to suspend operations for a period of time;

d) Confiscate contraband and means of administrative violation;

d) Applying measures to remedy consequences as prescribed in Clause 3, Article 3 of this Decree.

6. The provincial public security director have the right to:

a) To issue warnings;

b) Impose a fine up to seventy-five million dong;

c) To suspend the use of licenses or certificates for a period of time or to suspend operations for a period of time;

d) Confiscate contraband and means of administrative violation;

đ) Applying measures to remedy consequences as prescribed in Clause 3, Article 3 of this Decree.

7. The Directors of the Traffic Police Inspectorate, the Administrative Management Inspectorate for Social Order, and the Commander of the Mobile Police Force have the right:

a) To issue warnings;

b) Impose a fine up to seventy-five million dong;

c) To suspend the use of licenses or certificates for a period of time or to suspend operations for a period of time;

d) Confiscate contraband and means of administrative violation;

đ) Applying measures to remedy consequences as prescribed in Clause 3, Article 3 of this Decree."

Article 15. Amending and supplementing Article 44

"Article 44. The authority to impose fines of the Director of the Vietnam Highway Administration, the Head of the Inspection Team established by the Minister of Construction, the Director of the Construction Department, the Head of the Inspection Team established by the Director of the Vietnam Highway Administration, and the Director of the Highway Management Zone under the Vietnam Highway Administration

1. The Director of the Highway Management Zone under the Vietnam Highway Administration has the right:

a) To issue warnings;

b) Imposing a fine up to VND 37,500,000;

c) Revoking the right to use time-limited permits or suspending operations for a time-limited period;

d) Applying measures to remedy consequences as prescribed in Clause 3, Article 3 of this Decree.

2. The Director of the Construction Department, the Head of the Inspection Team established by the Director of the Vietnam Highway Administration have the right:

a) To issue warnings;

b) Imposing a fine up to VND 60,000,000;

c) Revoking the right to use time-limited permits or suspending operations for a time-limited period;

d) Applying measures to remedy consequences as prescribed in Clause 3, Article 3 of this Decree.

3. The Director of the Vietnam Highway Administration, the Head of the Inspection Team established by the Minister of Construction have the right:

a) To issue warnings;

b) Impose a fine up to seventy-five million dong;

c) Revoking the right to use time-limited permits or suspending operations for a time-limited period;

d) Applying measures to remedy consequences as prescribed in Clause 3, Article 3 of this Decree."

Article 16. Amending and supplementing Clause 2 of Article 46

"2. Civil servants and officials performing public duties or tasks with the authority to issue administrative violation records for violations."

Article 17. Amending and supplementing some Points and Clauses of Article 50

1. Amending and supplementing Point d of Clause 1 as follows:

"d) Not deducting points from a driving license when that driving license is currently within the period during which the right to use the driving license or international driving license has been revoked."

2. Amending and supplementing the second part of Point a of Clause 3 as follows:

"In cases where the Chairman of the People's Committee of a commune, the Chairman of the People's Committee of a province issues a decision on administrative penalties for violations involving deduction of points from a driving license, the Head of the Traffic Police Department of the provincial police force shall be responsible for updating the data on point deductions from driving licenses into the database on handling administrative violations related to traffic order and safety on roads;"

Article 18. Supplementing Clause 3, Clause 4 after Clause 2 of Article 53

"3. Provisions on administrative penalties related to equipment recording images of drivers for passenger-carrying commercial vehicles under eight seats (excluding driver's seat), commercial cargo vehicles (except tractor units), internal transport vehicles as stipulated at Point l Clause 5 Article 20, Point b Clause 3 Article 21, Point b Clause 9a Article 32 of this Decree shall take effect from January 1, 2028.

4. Provisions on administrative penalties related to equipment recording images of passenger compartments as stipulated at Point n Clause 5 Article 20; Point k, Point l Clause 7 Article 26 of this Decree shall take effect from January 1, 2029 and according to the regulations on equipment recording images of passenger compartments on road transport vehicles."

Article 19. Supplementing, replacing, and abolishing some phrases, Points, Clauses, Articles

1. Supplementing the phrase ", except for violations prescribed in Point b Clause 3a Article 29 of this Decree" after the phrase "vehicles being towed when towing each other" at Point h Clause 3 Article 6.

2. Supplementing the phrase "or changing lanes without ensuring a safe distance from the vehicle ahead, behind, or beside" after the phrase "only allowed to change to an adjacent lane" at Point a Clause 2, Point g Clause 5 Article 6; Point e Clause 1 Article 7; Point h Clause 6 Article 8.

3. Supplementing the phrase "or there is a prohibition by the competent authority regarding the type of vehicle being controlled" after the phrase "regarding the type of vehicle being controlled" at Point i Clause 5 Article 6, Point b Clause 6 Article 7, Point d Clause 6 Article 8 of this Decree.

4. Supplementing the phrase "or emergency stopping lane" after the phrase "emergency stopping lane" at Point c Clause 7 Article 6, Point b Clause 6 Article 8.

5. Supplementing the phrase "Clause 1; Point d," before the phrase "Point đ" at Point a Clause 6 Article 14.

6. Supplementing the phrase ", internal transport vehicles" after the phrase "commercial vehicles" at Point d Clause 6 Article 20, Point b Clause 5 Article 21.

7. Supplementing the phrase ", Point l" after the phrase "Point h" at Clause 11 Article 26.

8. Supplementing the phrase "Article 20 (Point l Clause 5, Point đ Clause 6), Article 21 (Point b Clause 3, Point c Clause 5)," before the phrase "Article 29", the phrase "; Clause 9a" after the phrase "Point n Clause 7" at Point h Clause 3 Article 47.

9. Supplementing the phrase ", Clause 3, Clause 4" after the phrase "Clause 2" at Clause 1 Article 53.

10. Replacing the phrase "carrying people on top of the vehicle; allowing people to hang onto doors or outside the sides of the vehicle while it is moving" with the phrase "allowing people to lie down, sit, or hang onto the vehicle from outside while it is moving" at Point p Clause 5 Article 6.

11. Replacing the phrase "certificate of technical inspection" with the phrase "inspection certificate" at Point q, Point r Clause 3 Article 3; Point d Clause 3, Point b Clause 4 Article 13; Point c Clause 3 Article 18; Point a, Point d Clause 2, Point a, Point d Clause 5, Point a, Point b Clause 6, Point a, Point b Clause 7, Point a, Point b Clause 8 Article 21; Point a Clause 1, Clause 3, Clause 5 Article 26; Point b Clause 1, Point d Clause 11, Point h Clause 14, Point c, Point d Clause 18, Point đ, Point g Clause 19, Clause 20 Article 32; Point a Clause 4 Article 40; Clause 3 Article 48.

12. Removing the phrase "certificate of technical inspection and environmental protection" at Point b, Point d Clause 7 Article 32, the phrase "Point e, Point g Clause 7;" at Point đ Clause 18 Article 32.

13. Removing the phrase "at the place where the violation was discovered" at Point c Clause 5 Article 47.

14. Removing the phrase "Point g Clause 5;" at Point a Clause 1 Article 48.

15. Removing the phrase "Point m Clause 3 Article 6," at Clause 2 Article 53.

16. Removing the phrase "under central administration" at Article 55.

17. Abolishing Point d, Point đ, Point e, Point g Clause 17 Article 32.

Chapter II

IMPLEMENTING PROVISIONS

Article 20. Effective Date

1. This Decree takes effect from August 15, 2026.

2. Ministers, Heads of ministerial-level agencies, Chairmen of provincial People's Committees, and relevant organizations and individuals are responsible for implementing this Decree.

3. The Ministry of Public Security shall take the lead and coordinate with relevant ministries and sectors to guide and organize the implementation of this Decree.

Article 21. Transitional Provisions

In cases where administrative violations concerning traffic order and safety in the field of road traffic

occur and end before the date this Decree takes effect but are subsequently discovered or are under consideration for resolution, the then-effective decree shall be applied to impose penalties.
