DECISION OF THE MINISTER OF INDUSTRY
ON ISSUING REGULATIONS ON STANDARDS FOR ENTERPRISES PRODUCING AND ASSEMBLING TWO-WHEEL MOTORCYCLES
THE MINISTER OF INDUSTRY
Pursuant to Decree No. 74/ dated October 20, 2015 of dated November 1, 1995 of the Government on functions, tasks, powers, and organizational structure of the Ministry of Industry regulations;
Pursuant to Decision No. 38/2002/QĐ-TTg dated March 14, 2002 of the Prime Minister on management of production, assembly, and import of two-wheel motorcycle parts;
At the proposal of the Director of the Department of Technology Management and Product Quality,
DECISION:
Article 1. hereby promulgates these Regulations on standards for enterprises producing and assembling two-wheel motorcycles.
Article 2These Regulations shall take effect 15 days from the date of signature. The provisions issued with this Decision replace previous regulations of the Ministry of Industry on production and assembly standards for two-wheel motorcycles.
The Head of the Ministry's Office, the Inspector General of the Ministry, Heads of Departments, Heads of specialized State Management Agencies under the Ministry and enterprises producing and assembling two-wheel motorcycles are responsible for implementing this Decision./.
REGULATIONS
On standards for enterprises producing and assembling two-wheel motorcycles
(issued together with Decision No. 24/2002/QĐ-BCN dated June 10, 2002 of the Minister) AND of Industry).
1. SCOPE AND APPLICABLE OBJECTS:
These Regulations set forth standards for enterprises producing and assembling two-wheel motorcycles (hereinafter referred to as motorcycles) belonging to all economic sectors, established according to Vietnamese law (including foreign-invested enterprises).
2. INVESTMENT SCALE:
a) Enterprises producing and assembling motorcycles must independently invest in manufacturing or joint venture investment in manufacturing motorcycle components and assemblies achieving a minimum localization rate of 20% (according to Decision No. 38/2002/QĐ-TTg dated March 14, 2002 of the Prime Minister, Circular Jointly Issued No. 92/2001/TTLT-BTC-BCN-TCHQ dated November 20, 2001 of the Ministry of Finance, Industry, and General Customs Department), including those related to the production of key spare parts such as engines, frames, transmission systems.
Joint ventures producing spare parts must comply with the aforementioned Circular and additional guidance provided by the Ministry of Finance and Industry through Circular Jointly Issued No. 52/2002/TTLT-BTC-BCN dated June 4, 2002.
b) Enterprises must invest in technological equipment systems for manufacturing components and assemblies produced by the enterprise; assembly lines and quality inspection systems for motorcycles ensuring technical requirements and matching assembly capacity according to design.
c) Production and assembly workshops for motorcycles must be designed and constructed in accordance with approved economic-technical justifications, matching design capacity, and complying with current national regulations on hygiene, labor safety, fire prevention, environmental protection, and overall aesthetics; they must have appropriate waste treatment systems suitable for the specific nature of the enterprise's production.
Workshops, storage areas, administrative offices, and other auxiliary facilities of enterprises producing and assembling motorcycles must be built on land leased for at least 15 years according to local industrial development plans. Spare part production areas must be separately arranged from motorcycle assembly areas, with sufficient floor space for equipment technology assembly lines. Workshop floors must be coated with anti-slip paint, clearly marked with safe walkways and production areas.
d) For enterprises producing and assembling engines, they must follow the provisions at point a, Clause 1, Article 2 of Decision No. 38/2002/QĐ-TTg dated March 14, 2002 of the Prime Minister and point 2.1, Clause 2 of Circular Jointly Issued No. 52/2002/TTLT-BTC-BCN dated June 4, 2002, where enterprises must independently produce at least one complete component or assembly among the following: cylinder head assembly, crankcase assembly, crankshaft-piston assembly, clutch assembly, camshaft-valve assembly, generator, transmission assembly, and carburetor.
Engines produced and assembled by enterprises must be equipped with manufacturing technology, product design, or legally transferred technology.
đ) For foreign-invested enterprises, motorcycle and engine production programs must comply with economic-technical justifications, Investment Licenses, and other relevant regulations of the Vietnamese Government.
In cases where the above documents do not provide specific provisions, enterprises must implement these Regulations.
3. PRODUCT QUALITY STANDARDS:
a) Motorcycles and motorcycle spare parts produced by enterprises must have complete technical documentation on design, manufacturing processes, and quality inspection; they must not infringe upon industrial property rights; purchased spare parts for assembly must ensure legal origin.
b) Enterprises producing and assembling motorcycles must comply with current regulations on product quality; they must publish quality standards for motorcycles and spare parts produced and assembled by themselves.
c) Motorcycles and motorcycle spare parts leaving the factory must be labeled with product information and have complete technical documentation as stipulated in Circular No. 05/2001/TT-BCN dated June 18, 2001 of the Minister of Industry.
4. TECHNICAL AND TECHNOLOGICAL STANDARDS:
a) Motorcycles must be assembled on conveyor belts according to the correct manufacturing process with complete dedicated installation and inspection equipment (compressed air supply system, torque wrenches, wheel weighing devices, tire mounting equipment, ball bearing pressing machines, frame and engine installation jigs, etc.).
Motorcycles leaving the factory must undergo 100% comprehensive inspections for parameters such as wheel alignment, braking efficiency, speed, headlight beam intensity, exhaust gas emissions (CO, HC), and noise levels. Enterprises must conduct road tests on at least 1% of the motorcycles leaving the factory, covering a distance of at least 10 km per vehicle.
The results of quality inspection for vehicles leaving the factory must be systematically stored in a computer (along with the inspection time, serial number of the vehicle leaving the factory, chassis number, engine number, inspector) for a minimum period of three years.
b) Engines produced by enterprises must be subject to probabilistic inspection with a quantity not less than 1% on comprehensive criteria such as revolutions per minute, torque, power, fuel consumption rate, noise level, and exhaust gas concentration. The inspection results must be stored in a computer (along with the inspection time, engine number, inspector) for a minimum period of three years. Vehicle frames produced by enterprises must be subject to probabilistic inspection with a quantity not less than 1% on durability, meeting the technical requirements of the products leaving the factory. The inspection results must be stored in a computer (along with the inspection time, frame number, inspector) for a minimum period of three years.
5. Standards for the qualifications of technical staff and organizational management of production:
a) From January 1 2004 onwards, motorcycle manufacturing and assembly enterprises must have an ISO quality management system certification. 9001: 2000.
b) Enterprises must have sufficient managerial staff, design engineers, technological experts, and technical workers; a sales agency network, service centers, and mechanisms for monitoring product quality and post-sales services. The location and warranty conditions for products must be fully detailed in the warranty certificate provided with the sold motorcycles.
6. Implementation guidance:
a) The Ministry of Industry assigns the Department of Technology Management and Product Quality to lead in guiding enterprises, organizing practical inspections, and submitting reports to the Ministry leadership for signing confirmation documents for enterprises. For new enterprises, the Ministry of Industry will report to the Prime Minister before issuing confirmation documents.
b) Motorcycle manufacturing and assembly enterprises are responsible for reporting quarterly, semi-annually, and annually on domestic production and assembly investment, motorcycle business operations to the Ministry of Industry for tracking and compiling reports to the Prime Minister./.
