JOINT CIRCULAR

Guidelines for the examination and recruitment

of civil servants as primary and preschool teachers

Implementing Decree No. 43/2000/NĐ-CP dated August 30, 2000 of the Government detailing and guiding the implementation of certain provisions of the Education Law, while implementing Directive No. 18/2001/CT-TTg dated August 27, 2001 of the Prime Minister on urgent measures to build a teaching staff for the national education system; jointly issued by the Ministryof Education and Training - Organizational Structure - Civil Service of the Government to guide the implementation of the examination and recruitment of civil servants as primary and preschool teachers as follows: I. PRINCIPLES, SCOPE, AND OBJECTS

 

1. Principles:

1.1. Based on the actual conditions of each region within their locality, the Chairman of the People's Committee of provinces and centrally governed cities (hereinafter referred to as provinces) shall decide on the recruitment of civil servants as primary and preschool teachers through the examination process and organize its implementation according to the following principles:

The organization of the examination must ensure democracy, transparency, social fairness, implement preferential policies as prescribed by the Party and State, and provide all citizens who meet the required conditions with equal opportunities to be examined for recruitment as civil servants as primary and preschool teachers. Those recruited must meet the professional standards of the position and be assigned appropriate work as stipulated.

1.1.1.2. The examination process must go through the Examination Board of the province.

2. Scope: The examination and recruitment of primary and preschool teachers shall be conducted to recruit teachers to teach at public educational institutions at the primary and preschool levels. 3. Objects: They are Vietnamese citizens; have a desire to teach at public educational institutions at the primary and preschool levels; have graduated from pedagogical departments, pedagogical schools both domestically and internationally.

II. PROCEDURE FOR EXAMINATION AND RECRUITMENT

1. Preparation work:

1.1. Based on the demand for education development in the locality and the quota of teacher positions, the source of teachers in each academic year, the Chairman of the People's Committee decides on the policy, quantity, and time to organize the examination and recruitment of civil servants as primary and preschool teachers.

The Ministry of Education and Training takes the lead together with the Organizational Structure Department of the provincial government to develop the examination plan to be submitted to the Chairman of the Provincial People's Committee for decision.

1.3. Publicly announce on mass media, clearly stating the number, criteria, conditions, time of the examination so that those who meet the conditions can register.

1.2.Science and Technology in Report No. 2. Examination Board: 2.1. Composition of the Examination Board:

The Examination Board for primary and preschool teachers is established by the Chairman of the People's Committee of the province, consisting of seven members:

The Chairman of the Board is the leader of the People's Committee of the province.

The Vice-Chairman in charge of the Board is the Director of the Department

of Education and Training of the province.

The Vice-Chairman of the Board is the Head of the Organizational Structure Department

of the provincial government. The Deputy Director of the Department of Education and Training responsible for each level of education is a member of the Examination Board for that level of education (the Deputy Director of the Department of Education and Training responsible for that level of education is a member).

The Head of the Personnel Organization Department of the Department of Education and Training of the province is a member and Secretary.

The Head of the Civil Service Department of the Organizational Structure Department of the provincial government is a member (the Head of the specialized department of the Department of Education and Training for each level of education is a member).

2. Responsibilities of the Examination Board: The Examination Board is responsible for assisting the Chairman of the People's Committee of the province in carrying out the examination and recruitment of civil servants as primary and preschool teachers. The responsibilities of the Examination Board include:

Announcing specific quotas, criteria, conditions, and objects of teacher recruitment to those who have graduated from pedagogical programs (hereinafter referred to as candidates); BGuiding, inspecting, and supervising the acceptance of application files from candidates for civil servants as primary and preschool teachers;

2.Assisting the Chairman of the People's Committee of the province in examining and recruiting civil servants as primary and preschool teachers in accordance with principles, procedures, formalities, and state policies;

Proposing and recommending to the Chairman of the People's Committee of the province the examination and recruitment of civil servants as primary and preschool teachers in line with the actual conditions of the province and general state regulations;

Summarizing the list of candidates proposed for examination and recruitment to report to the Chairman of the People's Committee of the province for decision in accordance with current state regulations;

In cases where the Chairman of the People's Committee of the province decides to recruit primary and preschool teachers through competitive examinations, the Examination Board is responsible for assisting the Chairman of the People's Committee of the province in organizing examinations on teaching abilities of candidates.

2.3. Working principles of the Examination Board:

The Examination Board for primary and preschool teachers operates based on collective principles, deciding by majority rule

All decisions of the Board during meetings are controlled by the Chairman of the Board;

The Board dissolves itself after completing the examination and recruitment of primary and preschool teachers.

2.4. Supporting the Examination Board is a Secretariat

headed by the Secretary of the Board, who is also a member; the Secretariat has from three to five supporting experts (including members from the provincial government's Organizational Structure Department) appointed by the Chairman of the Examination Board. The Secretariat's responsibilities include:

Accepting application files from candidates in accordance with the specified conditions;

Summarizing the list of candidates eligible for recruitment without competitive examinations as prescribed in Point 2 of Directive No. 18/2001/CT-TTg dated August 27, 2001 of the Prime Minister;

Summarizing the list of candidates applying for civil servant positions as primary and preschool teachers and ranking them from highest to lowest average grade throughout the course, prioritizing those eligible for preferential policies as stipulated by the state; Reporting comprehensive results of the review and examination of candidates' application files and specific difficulties encountered during the review to the Examination Board for consideration and resolution. 3. Examination Procedure: 3.1. Public announcement:

Announcing specific details about quotas, criteria, conditions, objects of recruitment, time, and location on mass media and posting at the Department

of Education and Training, the Organizational Structure Department of the provincial government, pedagogical departments, and pedagogical schools at least one month before the examination.

Compile a list of candidates for civil servant positions as primary and preschool teachers, ranking them in descending order based on their overall average academic performance throughout the course, and prioritizing those eligible under state preferential policies; report comprehensively on the results of the review and examination of the candidates' applications, along with specific difficulties encountered during the review process, for the Selection Committee to consider and resolve.

3.Selection Process:

3.1.Public Announcement:

Announce in detail the quota, criteria, conditions, target groups, time, and location through mass media and post at the Department of Education and Training, the Provincial Civil Service Commission, and teacher training departments and schools at least one month before the selection process begins. Prior to the selection process, such announcements must be made at the Department of Education and Training, the Provincial Civil Service Commission, and teacher training departments and schools.

3.2.Receiving Applications:

The Secretariat shall accept application files for recruitment within fifteen days from the date of public announcement. Recruitment of civil servants as primary and kindergarten teachers shall be conducted through mass media; the location for receiving application files must be convenient. Guide applicants to complete their application files and then inform them about the status of their application files.

3.3.Provisions on application procedures:

The application file of candidates for civil servant positions as primary and kindergarten teachers shall include: Application form for recruitment;

Curriculum vitae;

Academic records and graduation certificates that meet the requirements corresponding to the standards for each level of teaching position;

Health examination certificate issued by authorized medical facilities;

Two photographs measuring 4 x 6 centimeters.

The application file shall be enclosed in an envelope measuring 24 centimeters x 34 centimeters.

3.4.Recruitment process:

The Secretariat shall compile and categorize application files to report to the Board, clearly stating the requirements, professional characteristics, preferences, academic results, and preferential policies according to state regulations for each candidate; list of candidates who wish to work in areas where recruitment is conducted without competitive examinations as stipulated in Point 2 of Directive No. 18/2001/CT-TTg dated August 27, 2001.Based on the recruitment quota, candidates' academic performance and training at teacher training institutions (grade point average) and preferential policies according to state regulations shall be considered for recruitment.

Those selected

are those who have been recruited without competitive examinations for civil service positions as stipulated in Point 2 of Directive No. 18/2001/CT-TTg dated August 27, 2001 of Assessment the Prime Minister, individuals with an overall grade point average from their entire course of study in descending order (the grade point average includes: the average grade point from their entire course of study calculated according to the regulations of the Ministry

of Education and Training plus preferential policies according to state regulations defined by the Provincial People's Committee) and in accordance with the recruitment quota. Those not selected will be publicly announced: The Secretariat shall compile all cases of recruitment for the Board to report to the Chairman of the Provincial People's Committee for decision.

3.5.Recruitment:

Based on the recruitment decision of the Chairman of the Provincial People's Committee, the decision to recruit, take up duties, probationary period, and appointment shall be implemented according to current state regulations.

From 2002 onwards, the Ministry

III. IMPLEMENTATION

of Education and Training shall guide the teacher training departments and schools to incorporate content on administrative management of the state, industry management, and related content on education and training civil servants as stipulated in Point 1 of PartI of Circular Jointly Issued No. 18/1999/TTLT-BGDĐT-BTCCBCP dated May 5, 1999 by the Ministry of Education and Training, the Civil Service Personnel Department of the Government, into a course component of the teacher training program, which has the same value as other course components and serves as a basis for teacher training departments and schools to review and issue graduation certificates. From the 2002-2003 school year onwards, based on the staffing quota announced by the competent authority and specific conditions of each school year, the Chairman of the Provincial People's Committee shall decide on the recruitment of primary and kindergarten teachers through competitive examinations or recruitment as follows: First, implement the recruitment method for the following subjects and areas:

Public primary schools lacking staff shall be recruited without competitive examinations for civil service positions for candidates holding excellent or outstanding graduation certificates in relevant fields suitable for teaching positions.

2.1.Public schools in

areas with extremely difficult economic and social conditions, mountainous regions, islands, remote and far-flung areas lacking teachers but with insufficient sources of recruitment shall be recruited into staffing without competitive examinations for civil service positions for individuals meeting the criteria set out in Article 61 and Article 67 of the Education Law.

After implementing recruitment for the above subjects and areas, if there are still staffing quotas and sufficient sources of recruitment, the Chairman of the Provincial People's Committee shall decide on the recruitment of primary

and kindergarten teachers through competitive examinations or recruitment as appropriate. In the case of recruiting primary and kindergarten teachers through competitive examinations, the re-examination of content on administrative management of the state, industry management, and related content on education and training civil servants as stipulated in Point 1 of Part III of this Circular Jointly Issued shall not be conducted for candidates who have completed this course component in teacher training departments and schools; only the assessment of teaching ability of the candidates shall be organized by the Recruitment Board as stipulated in Point 2 of Part II of this Circular Jointly Issued. 3.Recruitment of civil servants as primary and kindergarten teachers not in accordance with regulations and failing to ensure general principles shall result in the cancellation of the recruitment decision. Individuals intentionally violating the recruitment procedure or engaging in corrupt behavior during the receipt and modification of application files during the recruitment process shall be subject to disciplinary administrative sanctions or criminal prosecution depending on the severity of the violation.

4.This Circular Jointly Issued shall take effect from the date of signature. Previous provisions contrary to this Circular Jointly Issued shall be abolished. During the implementation process, if there are any difficulties, please report to the Ministry

of Education and Training, the Civil Service Personnel Department of the Government for research and resolution./. depending on the level of administrative disciplinary action or criminal liability pursued.

This Circular takes effect from the date of signature. All previous regulations that conflict with this Circular are hereby repealed.

In case of any difficulties during the implementation process, please report to the Ministry of Education and Training, the Government's Civil Service Commission for study and resolution./.
