Vietnamese nationality

Pursuant to the Constitution of the Socialist Republic of Vietnam in 1992 as amended and supplemented by Resolution number 51/2001/QH10;

The National Assembly enacts the Law on Vietnamese Citizenship.

Chapter I GENERAL PROVISIONS

Article 1. Vietnamese Citizenship

Vietnamese citizenship reflects the bond between an individual and the Socialist Republic of Vietnam, giving rise to the rights and obligations of Vietnamese citizens towards the State and the rights and responsibilities of the Socialist Republic of Vietnam towards its citizens.

Article 2. Rights Regarding Citizenship

1. In the Socialist Republic of Vietnam, every individual has the right to have citizenship. A Vietnamese citizen shall not be deprived of Vietnamese citizenship except in cases provided for in Article 31 of this Law.

2. The Socialist Republic of Vietnam is a unified state of ethnic groups living together on the territory of Vietnam, all members of these ethnic groups are equal in their right to Vietnamese citizenship.

Article 3. Explanation of Terms

In this Law, the following terms shall be understood as follows:

1. Foreign nationality is the nationality of another country other than Vietnamese nationality.

2. Stateless person is a person who does not have Vietnamese nationality and also does not have foreign nationality.

3. Overseas Vietnamese residents are Vietnamese citizens and persons of Vietnamese origin residing and living permanently abroad.

4. Persons of Vietnamese origin residing abroad are Vietnamese persons who once had Vietnamese nationality, whose nationality at birth was determined according to the principle of bloodline, and their children and grandchildren currently residing and living permanently abroad.

5. Foreign residents in Vietnam are foreign citizens and stateless persons residing permanently or temporarily in Vietnam.

Article 4. Principles of Citizenship

The Socialist Republic of Vietnam recognizes that Vietnamese citizens have only one nationality, which is Vietnamese nationality, except where otherwise provided for in this Law.

Article 5. Relationship Between the State and Citizens

1. A person with Vietnamese nationality is a Vietnamese citizen.

2. Vietnamese citizens are guaranteed civil rights by the Socialist Republic of Vietnam and must fulfill their civic duties to the State and society as prescribed by law.

3. The Socialist Republic of Vietnam implements policies to ensure that Vietnamese citizens residing abroad have conditions to enjoy civil rights and perform civic duties appropriate to their circumstances far from their homeland.

4. The rights and obligations of Vietnamese citizens concurrently holding foreign nationality while residing abroad are implemented in accordance with relevant laws.

Article 6. Protection for Vietnamese Citizens Abroad

The Socialist Republic of Vietnam protects the legitimate interests of Vietnamese citizens abroad.

Domestic state agencies, overseas representative offices of Vietnam have the responsibility to implement all necessary measures consistent with the laws of the host country, international law, and international customs to carry out such protection.

Article 7. Policy Towards Overseas Vietnamese Origin Residents

1. The Socialist Republic of Vietnam implements policies to encourage and create favorable conditions for overseas Vietnamese origin residents to maintain close ties with their families and homeland, contributing to building their homeland and country.

2. The State has policies to facilitate the return of Vietnamese citizenship for those who have lost Vietnamese nationality.

Article 8. Limiting Stateless Status

The Socialist Republic of Vietnam creates conditions for all children born on Vietnamese territory to have nationality and for stateless persons residing permanently in Vietnam to acquire Vietnamese nationality in accordance with this Law.

Article 9. Maintaining Nationality upon Marriage, Divorce, and Invalidating Illegal Marriages

The marriage, divorce, and invalidation of illegal marriages between Vietnamese citizens and foreigners shall not change the Vietnamese nationality of the parties involved and their minor children (if any).

Article 10. Maintaining Nationality When Spouse's Nationality Changes

The acquisition, reacquisition, or loss of Vietnamese nationality by either spouse shall not affect the nationality of the other.

Article 11. Documents Proving Vietnamese Nationality

Any of the following documents have evidentiary value to prove Vietnamese nationality:

1. Birth certificate; in cases where the birth certificate does not clearly indicate Vietnamese nationality, it must be accompanied by documents proving the Vietnamese nationality of the parents;

2. Identity card;

3. Vietnamese passport;

4. Decision on granting Vietnamese nationality, Decision on reacquiring Vietnamese nationality, Decision recognizing adoption for foreign children, Decision allowing foreigners to adopt Vietnamese children.

Article 12. Resolution of Issues Arising from the Status of Vietnamese Citizens Having Foreign Nationality Simultaneously

1. Issues arising from the status of Vietnamese citizens having foreign nationality simultaneously shall be resolved according to international treaties to which the Socialist Republic of Vietnam is a party; in the absence of such treaties, they shall be resolved according to international custom and practice.

2. Based on the provisions of this Law, the Government shall conclude or propose the conclusion of, or decide to join, international treaties to resolve issues arising from the status of Vietnamese citizens having foreign nationality simultaneously.

Chapter II HAVING VIETNAMESE NATIONALITY

Section 1 GENERAL PROVISIONS

Article 13. Persons with Vietnamese Nationality

1. Persons with Vietnamese nationality include those who have Vietnamese nationality up until the effective date of this Law and persons who acquire Vietnamese nationality under the provisions of this Law.

2. Vietnamese citizens residing abroad who have not lost Vietnamese nationality according to Vietnamese law before the effective date of this Law shall retain Vietnamese nationality and within five years from the effective date of this Law, must register with Vietnamese representative offices abroad to maintain Vietnamese nationality. The Government shall stipulate the procedures and formalities for registering to maintain Vietnamese nationality.

2. Vietnamese citizens residing abroad who have not lost Vietnamese nationality according to Vietnamese law before the effective date of this Law shall retain Vietnamese nationality and within five years from the effective date of this Law, must register with Vietnamese representative offices abroad to maintain Vietnamese nationality. The Government shall stipulate the procedures and formalities for registering to maintain Vietnamese nationality.

Article 14. Basis for Determining Persons with Vietnamese Nationality

A person is determined to have Vietnamese nationality if they meet one of the following criteria:

1. Born in accordance with Articles 15, 16, and 17 of this Law;

2. Acquired Vietnamese nationality;

3. Restored Vietnamese nationality;

4. In accordance with Articles 18, 35, and 37 of this Law;

5. In accordance with international treaties to which the Socialist Republic of Vietnam is a party.

Article 15. Nationality of Children Born When Both Parents Are Vietnamese Citizens

Children born within or outside the territory of Vietnam whose parents are both Vietnamese citizens at the time of birth shall have Vietnamese nationality.

Article 16. Nationality of Children Born When One Parent Is a Vietnamese Citizen

1. Children born within or outside the territory of Vietnam whose parent is a Vietnamese citizen while the other parent is stateless or has a mother who is a Vietnamese citizen but the father's identity is unknown shall have Vietnamese nationality.

2. Children born when one parent is a Vietnamese citizen and the other is a foreign citizen shall have Vietnamese nationality if there is a written agreement between the parents at the time of registering the child's birth. In cases where children are born on Vietnamese territory and the parents cannot agree on the selection of nationality for the child, the child shall have Vietnamese nationality.

Article 17. Citizenship of children at birth when parents are stateless persons

1. Children born on the territory of Vietnam whose parents are both stateless persons but have a place of habitual residence in Vietnam shall have Vietnamese citizenship.

2. Children born on the territory of Vietnam whose mother is a stateless person but has a place of habitual residence in Vietnam, while the father is unknown, shall have Vietnamese citizenship.

Article 18. Citizenship of abandoned newborns and children found on the territory of Vietnam

1. Abandoned newborns and children found on the territory of Vietnam where the parents are unknown shall have Vietnamese citizenship.

2. In cases provided for in Clause 1 of this Article, children under 15 years old shall lose Vietnamese citizenship in the following circumstances:

a) Finding parents who only hold foreign nationality;

b) Only finding one parent who only holds foreign nationality.

Section 2 ACQUIRING VIETNAMESE CITIZENSHIP

Article 19. Conditions for acquiring Vietnamese citizenship

1. Foreign citizens and stateless persons residing habitually in Vietnam may be granted Vietnamese citizenship if they meet the following conditions:

a) Having full civil capacity according to Vietnamese law;

b) Adhering to the Constitution and laws of Vietnam; respecting the traditions, customs, and practices of the Vietnamese people;

c) Possess sufficient knowledge of the Vietnamese language to integrate into the Vietnamese community;

d) Have resided in Vietnam for five years or more up to the time of application for Vietnamese citizenship;

đ) Being able to ensure a living standard in Vietnam.

2. Applicants for Vietnamese citizenship may be granted Vietnamese citizenship without having to meet the conditions set out in points c, d, and đ of Clause 1 of this Article, if they fall into one of the following cases:

a) Being the spouse, biological father, biological mother, or biological child of a Vietnamese citizen;

b) Having made special contributions to the cause of building and defending the Socialist Republic of Vietnam;

c) Being beneficial to the State of the Socialist Republic of Vietnam.

3. Persons acquiring Vietnamese citizenship must renounce their foreign citizenship, except those specified in Clause 2 of this Article, in exceptional cases, if permitted.

4. Applicants for Vietnamese citizenship must have a Vietnamese name. This name is chosen by the applicant and clearly recorded in the Decision granting Vietnamese citizenship.

5. Applicants for Vietnamese citizenship shall not be granted Vietnamese citizenship if it would harm the national interests of Vietnam.

6. The Government shall specify the conditions for acquiring Vietnamese citizenship.

Article 20. Documents for Application for Vietnamese Citizenship

1. The documents for application for Vietnamese citizenship include the following papers:

a) Application for Vietnamese citizenship;

b) Copy of Birth Certificate, Passport, or other equivalent documents;

c) Personal history statement;

d) Judicial record issued by the competent authority in Vietnam for the period during which the applicant for Vietnamese citizenship resides in Vietnam, and Judicial record issued by the competent authority in a foreign country for the period during which the applicant for Vietnamese citizenship resides abroad. The judicial record must be issued no more than 90 days prior to the date of submission of the application;

đ) Documents proving proficiency in the Vietnamese language;

e) Documents proving place of residence and period of habitual residence in Vietnam;

g) Documents proving means of subsistence in Vietnam.

2. Those exempted from certain conditions for acquiring Vietnamese citizenship as stipulated in Clause 2 of Article 19 of this Law shall be exempted from corresponding documents related to the conditions they are exempted from.

3. The Government shall specify the specific documents in the application for Vietnamese citizenship.

Article 21. Procedure and Formalities for Processing Applications for Vietnamese Nationality

1. Applicants for Vietnamese nationality shall submit their application to the Department of Justice at their place of residence. In cases where the application does not contain all the required documents as stipulated in Clause 1, Article 20 of this Law or is not valid, the Department of Justice shall immediately notify the applicant to supplement and complete the application.

2. Within five working days from the date of receiving a complete and valid application, the Department of Justice shall send a request to the provincial-level public security agency (hereinafter referred to as the provincial-level agency) to verify the identity of the applicant for Vietnamese nationality.

Within thirty days from the date of receipt of the request from the Department of Justice, the provincial-level public security agency shall be responsible for verifying and sending the results to the Department of Justice. During this period, the Department of Justice must review the documents in the application for Vietnamese nationality.

Within ten working days from the date of receipt of the verification results, the Department of Justice shall be responsible for completing the file and submitting it to the Chairman of the Provincial People's Committee.

Within ten working days from the date of receipt of the request from the Department of Justice, the Chairman of the Provincial People's Committee shall be responsible for reviewing, concluding, and proposing opinions to the Ministry of Justice.

3. Within twenty days from the date of receipt of the proposal from the Chairman of the Provincial People's Committee, the Ministry of Justice shall be responsible for rechecking the file. If it is found that the applicant meets the conditions for Vietnamese nationality, the Ministry of Justice shall issue a written notice to the applicant to proceed with the formalities to renounce foreign nationality, except in cases where the applicant requests to retain foreign nationality or is stateless. Within ten working days from the date of receipt of the certificate of renunciation of foreign nationality from the applicant, the Minister of Justice shall report to the Prime Minister for submission to the President for consideration and decision.

In cases where the applicant requests to retain foreign nationality or is stateless, within twenty days from the date of receipt of the proposal from the Chairman of the Provincial People's Committee, the Ministry of Justice shall be responsible for rechecking the file. If it is found that the applicant meets the conditions for Vietnamese nationality, the Ministry of Justice shall report to the Prime Minister for submission to the President for consideration and decision.

4. Within thirty days from the date of receipt of the request from

Article 22. Procedure, Formalities, and Application for Vietnamese Nationality for Stateless Persons Residing Stably in Vietnam

Stateless persons who do not have all the required documents regarding their identity but have resided stably in the territory of Vietnam for twenty years or more as of the effective date of this Law and comply with the Constitution and laws of Vietnam may be granted Vietnamese nationality according to the procedure, formalities, and application prescribed by the Government.

Section 3 RETURN TO VIETNAMESE NATIONALITY

Article 23. Cases Eligible for Return to Vietnamese Nationality

2. A person applying for re-acquisition of Vietnamese citizenship shall not be granted Vietnamese citizenship if it would harm the national interests of Vietnam.

3. In cases where a person whose Vietnamese nationality has been revoked applies to return to Vietnamese nationality, they must wait at least five years from the date of revocation before being considered for return to Vietnamese nationality.

1. A person who has lost Vietnamese nationality under Article 26 of this Law may apply to return to Vietnamese nationality if they fall into one of the following categories:

a) Requesting repatriation to Vietnam;

b) Having a spouse, parent, or child who is a Vietnamese citizen;

c) Making special contributions to the cause of building and defending the Socialist Republic of Vietnam;

d) Being beneficial to the Socialist Republic of Vietnam;

đ) Investing in Vietnam;

e) Having renounced Vietnamese nationality to acquire foreign nationality but failing to obtain foreign nationality.

4. An applicant for return to Vietnamese nationality must reclaim their former Vietnamese name, which must be clearly stated in the Decision on Returning to Vietnamese Nationality.

5. A person returning to Vietnamese nationality must renounce foreign nationality, except in special cases where they are

a) Being the spouse, biological father, biological mother, or biological child of a Vietnamese citizen;

b) Having made special contributions to the cause of building and defending the Socialist Republic of Vietnam;

c) Beneficial to the Socialist Republic of Vietnam.6. The Government shall specify the conditions for returning to Vietnamese nationality.

Article 24. Documents for Application to Reacquire Vietnamese Nationality

1. The documents for application to reacquire Vietnamese nationality include the following papers:

a) A request to reacquire Vietnamese nationality;

b) Copy of Birth Certificate, Passport, or other equivalent documents;

c) Personal history statement;

d) A criminal record issued by the competent authority in Vietnam for the period when the applicant resided in Vietnam, and a criminal record issued by the competent authority abroad for the period when the applicant resided abroad. The criminal record must be issued not more than 90 days prior to the date of submission of the application;

đ) Papers proving that the applicant previously held Vietnamese nationality;

e) Papers proving that the applicant meets the conditions to reacquire Vietnamese nationality as stipulated in Clause 1, Article 23 of this Law.

2. The Government shall specify in detail the papers included in the documents for application to reacquire Vietnamese nationality.

Article 25. Procedures and Formalities for Processing Applications to Reacquire Vietnamese Nationality

1. If residing within the country, the applicant submits the application to the Department of Justice at their place of residence; if residing abroad, the applicant submits the application to the Vietnamese representative agency in the host country. In case the application does not contain all the required papers as specified in Article 24 of this Law or is not valid, the receiving agency shall immediately notify the applicant to supplement and complete the application.

2. Within five working days from the date of receipt of a complete and valid application, the Department of Justice sends a letter requesting the provincial Public Security agency to verify the identity of the applicant seeking to reacquire Vietnamese nationality.

Within twenty days from the date of receipt of the request from the Department of Justice, the provincial Public Security agency is responsible for verifying and sending the results to the Department of Justice. During this time, the Department of Justice must review the papers in the application for reacquiring Vietnamese nationality. Within five working days from the date of receipt of the verification results, the Department of Justice is responsible for completing the application and submitting it to the Chairman of the Provincial People's Committee.

Within five working days from the date of receipt of the request from the Department of Justice, the Chairman of the Provincial People's Committee is responsible for reviewing, concluding, and proposing opinions to the Ministry of Justice.

3. Within twenty days from the date of receipt of a complete and valid application, the Vietnamese representative agency abroad is responsible for reviewing and transferring the application along with recommendations regarding the application to reacquire Vietnamese nationality to the Ministry of Foreign Affairs for forwarding to the Ministry of Justice. If necessary, the Ministry of Justice may request the Ministry of Public Security to verify the identity of the applicant seeking to reacquire Vietnamese nationality.

4. Within twenty days from the date of receipt of the recommendation letter from the Chairman of the Provincial People's Committee or the Vietnamese representative agency abroad, the Ministry of Justice is responsible for rechecking the application. If it is determined that the applicant meets the conditions to reacquire Vietnamese nationality, the Ministry of Justice will send a written notice to the applicant to proceed with the formalities to renounce foreign nationality, except in cases where the applicant seeks to retain foreign nationality or is stateless.

Within ten working days from the date of receipt of the certificate of renunciation of foreign nationality from the applicant seeking to reacquire Vietnamese nationality, the Minister of Justice reports to the Prime Minister for submission to the President for consideration and decision.

In cases where the applicant seeks to retain foreign nationality or is stateless, within fifteen days from the date of receipt of the recommendation letter from the Chairman of the Provincial People's Committee or the Vietnamese representative agency abroad, the Ministry of Justice is responsible for rechecking the application. If it is determined that the applicant meets the conditions to reacquire Vietnamese nationality, the Ministry of Justice will report to the Prime Minister for submission to the State President for consideration and decision.

5. Within twenty days from the date of receipt of the request of

Chapter III LOSS OF VIETNAMESE NATIONALITY

Section 1 GENERAL PROVISIONS

Article 26. Grounds for loss of Vietnamese nationality

1. Voluntarily renounce Vietnamese nationality.

2. Be deprived of Vietnamese nationality.

3. Fail to register to retain Vietnamese nationality as prescribed in Clause 2, Article 13 of this Law.

4. As prescribed in Clause 2, Article 18 and Article 35 of this Law.

5. In accordance with international treaties to which the Socialist Republic of Vietnam is a party.

Section 2 RENUNCIATION OF VIETNAMESE NATIONALITY

Article 27. Grounds for renunciation of Vietnamese nationality

1. A Vietnamese citizen who submits a request to renounce Vietnamese nationality to acquire foreign nationality may be permitted to renounce Vietnamese nationality.

2. Persons applying to renounce Vietnamese nationality who have not yet been granted permission to renounce Vietnamese nationality shall not be allowed to do so if they fall under any of the following circumstances:

a) Owes taxes to the State or has financial obligations to agencies, organizations, or individuals in Vietnam;

b) Those currently under criminal investigation;

c) Is serving a court judgment or decision of a Vietnamese court;

d) Is under temporary detention awaiting execution of a sentence;

đ) Is serving a decision to apply administrative measures involving placement in an educational facility, medical facility, or juvenile correctional school.

3. Persons applying to renounce Vietnamese nationality shall not be permitted to do so if such action would harm the national interests of Vietnam.

4. Civil servants, public officials, and those serving in the Vietnam People's Armed Forces are not permitted to renounce Vietnamese nationality.

5. The Government shall specify the conditions for renouncing Vietnamese nationality.

Article 28. Documents for requesting renunciation of Vietnamese nationality

1. The documents for requesting renunciation of Vietnamese nationality include:

a) Request to renounce Vietnamese nationality;

b) Personal history statement;

c) Copy of Vietnamese passport, Identity Card, or other documents as prescribed in Article 11 of this Law;

d) Criminal record certificate issued by the competent authority in Vietnam. The criminal record certificate must be issued no more than 90 days prior to the date of submission of the application;

đ) Documents confirming that the person is undergoing procedures to acquire foreign nationality, except where the laws of that country do not provide for such issuance;

e) Certificate of non-tax arrears issued by the Tax Department where the person requesting renunciation of Vietnamese nationality resides;

g) For persons who were previously civil servants, public officials, employees, or served in the Vietnam People's Armed Forces and have retired, resigned, been relieved of duty, dismissed, or discharged from service within five years, they must also submit a document from the agency, organization, or unit that issued the decision on retirement, resignation, relief of duty, dismissal, or discharge confirming that their renunciation of Vietnamese nationality will not harm the national interests of Vietnam.

2. In cases where Vietnamese citizens do not reside in Vietnam, they are not required to submit the documents specified in points d, e, and g of Clause 1 of this Article.

3. The Government shall specify the documents in the application for renunciation of Vietnamese nationality.

Article 29. Procedures and formalities for processing applications to renounce Vietnamese nationality

1. If a person requesting renunciation of Vietnamese nationality resides in Vietnam, they shall submit the application to the Department of Justice at their place of residence; if residing abroad, they shall submit it to the Vietnamese representative office in the host country. In case the application does not contain all the required documents as stipulated in Article 28 of this Law or is not valid, the receiving authority shall immediately notify the applicant to supplement and complete the application.

2. In cases where a Vietnamese citizen requesting renunciation of Vietnamese nationality resides in Vietnam, within five working days from the date of receipt of a complete and valid application, the Department of Justice shall be responsible for publishing a notice regarding the request to renounce Vietnamese nationality in a local newspaper or online news site for three consecutive issues and posting it on the Ministry of Justice’s website; in cases where a Vietnamese citizen requesting renunciation of Vietnamese nationality resides abroad, within five working days from the date of receipt of a complete and valid application, the Vietnamese representative office abroad shall be responsible for publishing a notice regarding the request to renounce Vietnamese nationality on its own website.

The notice posted on the website must be retained there for at least thirty days from the date of publication.

3. Within five working days from the date of receipt of a complete and valid application, the Department of Justice shall send a letter requesting the provincial Public Security Office to verify the identity of the person requesting renunciation of Vietnamese nationality.

Within twenty days from the date of receipt of the request from the Department of Justice, the provincial Public Security Office shall be responsible for verifying and sending the results to the Department of Justice.During this period, the Department of Justice must review the documents in the application for renunciation of Vietnamese nationality.

Within five working days from the date of receipt of the verification results, the Department of Justice shall be responsible for completing the file and submitting it to the Chairman of the Provincial People's Committee.

Within five working days from the date of receipt of the request from the Department of Justice, the Chairman of the Provincial People's Committee shall be responsible for reviewing, concluding, and proposing opinions to the Ministry of Justice.

4. Within twenty days from the date of receipt of a complete and valid application, the Vietnamese representative office abroad shall be responsible for reviewing and transferring the application along with the proposed opinion on the request to renounce Vietnamese nationality to the Ministry of Foreign Affairs to forward to the Ministry of Justice. In necessary cases, the Ministry of Justice may request the Ministry of Public Security to verify the identity of the person requesting renunciation of Vietnamese nationality.

5. Within twenty days from the date of receipt of the proposal from the Chairman of the Provincial People's Committee or the Vietnamese representative office abroad, the Ministry of Justice shall be responsible for rechecking the file; if it determines that the person requesting renunciation of Vietnamese nationality meets the conditions for renunciation of Vietnamese nationality, it shall report.

6. Within twenty days from the date of receipt of the request from

Article 30. Exemption from Verification of Personal Status

The application for renunciation of Vietnamese nationality of individuals falling under any of the following cases shall not be subject to verification of personal status:

1. Individuals under 14 years old;

2. Persons born and residing abroad;

3. Persons who have resided abroad for ten years or more;

4. Persons who have been granted exit permits for family reunification purposes.

Section 3 STRIPPING OF VIETNAMESE NATIONALITY

Article 31. Grounds for Stripping Vietnamese Nationality

1. A Vietnamese citizen residing abroad may be stripped of Vietnamese nationality if they commit acts seriously harmful to national independence, to the cause of building and defending the Socialist Republic of Vietnam, or to the reputation of the Socialist Republic of Vietnam.

2. A person who has acquired Vietnamese nationality pursuant to Article 19 of this Law, regardless of whether they reside within or outside the territory of Vietnam, may also be stripped of Vietnamese nationality if they commit acts as specified in Clause 1 of this Article.

Article 32. Procedure and Formalities for Stripping Vietnamese Nationality

1. Within fifteen days from the date of discovery or receipt of a complaint letter regarding the acts stipulated in Clause 1 of Article 31 of this Law, the People's Committee of the province or the Vietnamese representative office abroad shall be responsible for verifying, and if there is sufficient evidence, establishing a dossier to recommend. The President of the State shall strip Vietnamese nationality from the person committing such acts.

The court that has tried the accused for the acts stipulated in Clause 1 of Article 31 of this Law shall establish a dossier to recommend the President of the State to strip Vietnamese nationality from the person committing such acts.

The Government shall specify the specific documents in the dossier recommending the stripping of Vietnamese nationality.

2. The dossier recommending the stripping of Vietnamese nationality shall be sent to the Ministry of Justice. Within thirty days from the date of receipt of the recommendation dossier from the People's Committee of the province, the Vietnamese representative office abroad, or the Court, the Ministry of Justice shall be responsible for coordinating with the Ministry of Public Security, the Ministry of Foreign Affairs, and other relevant ministries and sectors to review the dossier recommending the stripping of Vietnamese nationality and report. to the Prime Minister for submission to the President for consideration and decision.

3. Within twenty days from the date of receipt of the proposal from the Prime Minister, the President of the State shall consider and decide.

Section 4 CANCELLATION OF DECISION TO GRANT VIETNAMESE NATIONALITY

Article 33. Grounds for Cancellation of Decision to Grant Vietnamese Nationality

1. A person who has acquired Vietnamese nationality pursuant to Article 19 of this Law, regardless of whether they reside within or outside the territory of Vietnam, who intentionally provides false information or forges documents when applying for Vietnamese nationality may have their decision to grant Vietnamese nationality canceled if the decision was issued less than five years ago.

2. The cancellation of the decision to grant Vietnamese nationality of a spouse shall not affect the Vietnamese nationality of the other spouse.

Article 34. Procedure and Formalities for Cancellation of Decision to Grant Vietnamese Nationality

1. Within fifteen days from the date of discovery or receipt of a complaint letter regarding the acts stipulated in Clause 1 of Article 33 of this Law, the People's Committee of the province shall be responsible for verifying, and if there is sufficient evidence, establishing a dossier to recommend. The President of the State shall cancel the decision to grant Vietnamese nationality to the person committing such acts.

Chapter IV CHANGE OF NATIONALITY OF MINORS AND ADOPTED CHILDREN

Article 35. Nationality of Minor Children When Parents Acquire, Reacquire, or Renounce Vietnamese Nationality

1. When there is a change in nationality due to acquisition, reacquisition, or renunciation of Vietnamese nationality by parents, the nationality of minor children living with their parents shall also be changed according to their nationality.

2. When only one parent acquires, reacquires, or renounces Vietnamese nationality, the minor child living with that parent shall retain or lose Vietnamese nationality if there is a written agreement between the parents. In cases where one parent acquires or reacquires Vietnamese nationality, the minor child living with that parent shall retain Vietnamese nationality if the parents do not have a written agreement regarding the retention of foreign nationality for the child.

3. Any change of nationality of a person aged 15 or older but under 18 years old, as provided for in Clauses 1 and 2 of this Article, must be agreed upon in writing by the person concerned.

Article 36. Nationality of Minor Children When Parents Have Their Vietnamese Nationality Revoked or Their Decision to Acquire Vietnamese Nationality Is Annulled

When parents or one of them have their Vietnamese nationality revoked or their decision to acquire Vietnamese nationality annulled, the nationality of minor children shall not be changed.

Article 37. Nationality of Adopted Minor Children

1. Vietnamese citizens who are adopted by foreigners shall retain Vietnamese nationality.

2. Foreign children adopted by Vietnamese citizens acquire Vietnamese citizenship from the date recognized by the competent state agency of Vietnam for adoption.

3. Foreign children adopted by parents, one of whom is a Vietnamese citizen and the other a foreigner, shall acquire Vietnamese nationality based on the application for Vietnamese nationality submitted by the adoptive parents and shall be exempt from the conditions stipulated in Clause 1 of Article 19 of this Law.

4. Any change in nationality of adopted children aged 15 or older but under 18 years old must be agreed upon in writing by the child.

Chapter V RESPONSIBILITIES OF STATE AUTHORITIES REGARDING NATIONALITY

Article 38. Duties and Authorities of the President Regarding Nationality

1. Deciding on the acquisition, reacquisition, renunciation, revocation, and annulment of decisions to acquire Vietnamese nationality.

2. Deciding on negotiations and signing international treaties on nationality in accordance with this Law and the Law on Signing, Joining, and Implementing International Treaties.

Article 39. Responsibilities of the Government Regarding Nationality

1. Uniformly managing state affairs concerning nationality.

2. Negotiating and signing international treaties or submitting them for approval.

3. Directing the dissemination and education of laws concerning nationality.

4. Prescribing fees and charges for matters related to nationality.

5. Inspecting and supervising the implementation of laws concerning nationality.

6. Implementing international cooperation on nationality.

Article 40. Responsibilities of Ministries, Agencies Equivalent to Ministries, Provincial People's Committees, and Overseas Representative Offices

1. The Ministry of Justice is responsible before the Government for managing state affairs concerning nationality, issuing forms for handling matters related to nationality, and compiling national statistics on nationality matters to report.

2. The Ministry of Foreign Affairs will coordinate with the Ministry of Justice to guide overseas representative offices in handling matters related to nationality, compile national statistics on nationality matters handled by overseas representative offices, and send them to the Ministry of Justice.

3. Ministries and agencies equivalent to ministries within their respective duties and authorities shall cooperate with the Ministry of Justice in managing state affairs concerning nationality.

4. Provincial People's Committees shall be responsible for examining and proposing opinions on applications for acquisition, reacquisition, renunciation, revocation, and annulment of decisions to acquire Vietnamese nationality as prescribed by this Law; annually compiling statistics on nationality matters resolved to report to the Ministry of Justice.

5. Overseas representative offices shall be responsible for examining and proposing opinions on applications for reacquisition, renunciation, and revocation of Vietnamese nationality; annually compiling statistics on nationality matters resolved to report to the Ministry of Foreign Affairs and the Ministry of Justice.

Article 41. Notification and Publication of Results of Matters Concerning Nationality

The Ministry of Justice shall be responsible for notifying individuals applying for acquisition, reacquisition, renunciation of Vietnamese nationality, individuals deprived of Vietnamese nationality, and individuals whose decisions on acquisition of Vietnamese nationality have been annulled about the results of matters concerning nationality related to them, and publishing such results on the Ministry of Justice's electronic information website.

The Office of the State President shall be responsible for publishing in the Official Gazette of the Socialist Republic of Vietnam decisions on acquisition, reacquisition, renunciation, deprivation of Vietnamese nationality, and annulment of decisions on acquisition of Vietnamese nationality.

Chapter VI IMPLEMENTATION PROVISIONS

Article 42. Transitional Provisions

From the date this Law takes effect, files of matters concerning nationality that were received prior to that date shall continue to be processed according to the provisions of the 1998 Vietnamese Nationality Law and detailed regulations and guidance documents for its implementation.

Article 43. Effective Date

This Law shall take effect from July 1, 2009.

This Law replaces the Vietnamese Nationality Law dated May 20, 1998.

Article 44. Detailed Provisions and Guidance for Implementation

The Government shall provide detailed provisions and guidance on the implementation of the Articles and Clauses assigned in this Law; provide necessary guidance on other contents of this Law to meet management requirements.

This Law was adopted by the National Assembly of the Socialist Republic of Vietnam, the twelfth session, fourth meeting, on November 13, 2008./.
