Guidelines for implementing Decision No. 170/2008/QĐ-TTg dated December 18, 2008 of the Prime Minister on health insurance and funeral allowance for volunteer youth during the anti-French resistance period
regarding the health insurance and funeral allowance for volunteer youth during the anti-French resistance period

Pursuant to Decision No. 170/2008/QĐ-TTg dated December 18, 2008 of the Prime Minister on health insurance benefits and funeral allowances for voluntary youth forces during the anti-French resistance war;
The Ministry of Labor, War Invalids and Social Affairs guides the establishment of files and procedures to confirm eligibility to implement health insurance and funeral allowance for volunteer youth during the anti-French resistance period as follows:
Article 1. Eligible Subjects
a) Cadres, civil servants, public officials, and workers as stipulated in Article 2 of Decree No. 178/2024/NĐ-CP dated December 31, 2024 (amended and supplemented by Decree No. 67/2025/NĐ-CP dated March 15, 2025) of the Government on policies and treatment for cadres, civil servants, public officials, workers, and armed forces personnel in the process of organizational restructuring of the political system, having a total mandatory social insurance contribution period of at least 15 years when working in heavy, hazardous, or dangerous jobs or extremely heavy, hazardous, or dangerous jobs listed by the agency under the Government responsible for labor administration, or working in areas with particularly difficult socio-economic conditions including time worked in places with regional allowances of coefficient 0.7 or higher before January 1, 2021, and reaching the retirement age as specified in Appendix II issued together with Decree No. 135/2020/NĐ-CP, ceasing work immediately due to direct impact from organizational restructuring and implementation of the two-level local government model;
The subjects entitled to benefits under Article 1 of Decision No. 170/2008/QĐ-TTg dated December 18, 2008 of the Prime Minister (hereinafter referred to as Decision No. 170/2008/QĐ-TTg) are those who joined the concentrated volunteer youth force during the anti-French resistance (referred to as volunteer youth), including volunteer youth participating in post-war recovery until the end of 1958.
2. Subjects not covered
a) Voluntary youth forces who commit crimes endangering national security or other crimes punishable by life imprisonment or are currently serving a prison sentence.
b) Voluntary youth forces who fail to complete their assigned tasks.
c) Voluntary youth forces who are subject to mandatory health insurance or have been provided with health insurance by the State are not eligible for the health insurance regime stipulated in this Circular.
d) Voluntary youth forces who are entitled to funeral expenses under current regulations are not eligible for funeral allowances stipulated in this Circular.
e) Voluntary youth forces who have illegally exited the country or settled abroad illegally.
Article 2. Benefits
1. Health Insurance Regime
a) Volunteer youth shall be covered by state-provided health insurance like volunteer youth against the United States to save the country according to Decision No. 290/2005/QĐ-TTg dated November 8, 2005 of the Prime Minister.
b) The rights of beneficiaries under the health insurance regime shall be implemented in accordance with current regulations.
2. Funeral Allowance
a) In the event of the death of a voluntary youth force, the person or organization responsible for arranging the funeral shall receive a funeral allowance similar to that provided to individuals participating in mandatory social insurance as stipulated by the Social Insurance Law.
b) In cases where the subject was recognized from the date Decision No. 170/2008/QĐ-TTg took effect until the date this Circular takes effect, if they have not yet received funeral allowance, the person or organization responsible for the funeral of the subject shall be entitled to funeral assistance as stipulated in this Circular.
Article 3. Documents for Application of Health Insurance Benefits
1. The documents include:
a) Personal Declaration Form (Form No. 01) with confirmation from the People's Committee of the commune, ward, town (referred to as the commune level) where the subject resides, accompanied by the following documents:
One of the documents (certified copy) confirming the status as volunteer youth includes: membership card; certificate of completion of duty in volunteer youth; commendation during the period of participation in volunteer youth; cadre and party member history with a record of being a volunteer youth.
In cases where volunteer youth do not have the aforementioned documents, they must have a certificate (original) confirming their status as volunteer youth who completed their mission during the anti-French resistance issued by the Provincial or Municipal Youth Union where the subject resides, based on confirmation by the Association (or the Association's Liaison Board) of Former Volunteer Youth in the province or centrally governed city (referred to as provincial level) according to Model No. 02.
b) Publicly posted list.
c) Minutes of confirmation and application for health insurance benefits for volunteer youths (Form No. 03).
d) List for issuance of health insurance cards.
2. Responsibilities for preparing the documents:
a) Volunteer youths prepare the personal declaration form.
b) People's Committee at the commune level:
- Accept the personal declaration form of volunteer youths and related documents.
- Publicly post the list of subjects applying for benefits at the People's Committee office.
- After 15 days, if there are no complaints or objections from the public, the People's Committee of the commune shall issue a Confirmation Record (Model No. 3), attached with the list, file, and confirmation on the application form for health insurance benefit resolution, then transfer it to the Department of Labor, War Invalids and Social Affairs of the district (city district, town, centrally governed city), hereinafter referred to as the Department of Labor, War Invalids and Social Affairs.
c) The Department of Labor, War Invalids and Social Affairs:
- Verify the eligibility for health insurance cards.
- Prepare a list to apply for health insurance cards and transfer it to the Department of Labor, War Invalids and Social Affairs.
- Issue health insurance cards according to the list approved by the Director of the Department of Labor, War Invalids and Social Affairs.
d) The Department of Labor, War Invalids and Social Affairs:
- Review the files of volunteer youths.
- Prepare a list of individuals eligible for health insurance cards.
- Register to purchase health insurance cards and transfer them to the Department of Labor, War Invalids and Social Affairs for issuance according to the list.
Article 4. Documents for Processing Funeral Allowance Benefits
1. Documents
a) Volunteer youths receiving health insurance benefits under Decision No. 170/2008/QĐ-TTg who have died:
- Death certificate issued by the People's Committee at the commune level.
- Declaration form of the person or organization arranging funeral services for deceased volunteer youths (Form No. 04-A).
b) Volunteer youth who died from the date of Decision No. 170/2008/QĐ-TTg until the date this Circular becomes effective and volunteer youth who did not enjoy health insurance under Decision No. 170/2008/QĐ-TTg (Model No. 04-B).
- Death certificate issued by the People's Committee at the commune level.
- Declaration form of the person or organization arranging funeral services for deceased volunteer youths, accompanied by one of the documents confirming their status as volunteer youths as stipulated in point a, Clause 1, Article 3 of this Circular.
2. Responsibilities for preparing the documents:
a) Relatives prepare the declaration form of deceased volunteer youths along with the death certificate.
b) The People's Committee at the commune level confirms each individual's application form; transfers the application form along with the death certificate and one of the documents confirming the status as volunteer youth as specified in point a, Clause 1, Article 3 of this Circular to the Department of Labor, War Invalids and Social Affairs.
c) The Department of Labor, War Invalids and Social Affairs prepares a list with attached documents and transfers them to the Department of Labor, War Invalids and Social Affairs.
d) The Department of Labor, War Invalids and Social Affairs:
- Combine the file of volunteer youths currently managing health insurance cards (if applicable) with the declaration form and death certificate to complete the funeral allowance processing file.
- The Director of the Department of Labor, War Invalids and Social Affairs issues a decision on funeral allowance (Model No. 05).
State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.
1. The Department of Labor, War Invalids and Social Affairs:
- Proceed to purchase health insurance. Organize payment of funeral allowance to the person or organization arranging funeral services.
- Take the lead in coordinating with Provincial Youth Union: Association (or Volunteer Youth Service Alumni Board) to widely publicize the contents of this Circular.
2. This Circular takes effect 45 days from the date of issuance.
During the implementation process, if there are any difficulties, please report to the Ministry of Labor, War Invalids and Social Affairs for guidance on resolution./.
