CIRCULAR
Guidelines for Implementing the System of Position Allowances in the People's Police Force
Pursuant to the Decree No. 77/2009/NĐ-CP dated September 15, 2009 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;
Pursuant to Decree No. 34/2012/NĐ-CP dated April 15, 2012 of the Government on the system of position allowances;
Considering the proposal of the Director General of the General Department for Building the Police Force;
The Minister of Public Security promulgates this Circular guiding the implementation of the system of position allowances in the People's Police Force.
Article 1. Scope of Regulation
This Circular guides the implementation of the system of position allowances in the People's Police Force as prescribed in Decree No. 34/2012/NĐ-CP dated April 15, 2012 of the Government.
Subjects
a) Cadres, civil servants, public officials, and workers as stipulated in Article 2 of Decree No. 178/2024/NĐ-CP dated December 31, 2024 (amended and supplemented by Decree No. 67/2025/NĐ-CP dated March 15, 2025) of the Government on policies and treatment for cadres, civil servants, public officials, workers, and armed forces personnel in the process of organizational restructuring of the political system, having a total mandatory social insurance contribution period of at least 15 years when working in heavy, hazardous, or dangerous jobs or extremely heavy, hazardous, or dangerous jobs listed by the agency under the Government responsible for labor administration, or working in areas with particularly difficult socio-economic conditions including time worked in places with regional allowances of coefficient 0.7 or higher before January 1, 2021, and reaching the retirement age as specified in Appendix II issued together with Decree No. 135/2020/NĐ-CP, ceasing work immediately due to direct impact from organizational restructuring and implementation of the two-level local government model;
This Circular applies to officers, non-commissioned officers, soldiers, workers, staff members of the police force, and contractual employees receiving salaries and allowances from the state budget, including:
a) Officers and non-commissioned officers in specialized positions; officers and non-commissioned officers in technical positions.
b) Non-commissioned officers and soldiers serving with fixed-term contracts.
c) Workers, staff members of the police force, and contractual employees (within the quota of the Ministry) receiving salaries according to the salary scales issued together with Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the wage system for cadres, civil servants, public officials, and armed forces.
2. Subjects not covered
a) Persons currently in temporary recruitment or probationary periods at police units and localities.
b) Students receiving living expenses while studying at academies and schools within and outside the police force.
c) Officers, non-commissioned officers, cadres, workers, staff members, and contractual employees in enterprises under the police force.
d) Contractual employees not within the quota of the Ministry, or not receiving salaries from the state budget, or receiving wages based on fixed amounts or agreed-upon wages (not classified according to the wage scale set by the State).
e) Officers, non-commissioned officers, soldiers, workers, staff members of the police force, and contractual employees who have retired, been discharged from service, transferred to other sectors, resigned, or had their labor contracts terminated before May 1, 2012.
Article 3. Amounts of Allowances and Calculation Formula
1. The amount of position allowance for the subjects specified in Clause 1 of Article 2 of this Circular shall be equal to 25% of the rank-based salary level, grade-based salary level, or rank-based allowance, plus leadership position allowance and seniority allowance exceeding the ceiling (if applicable) currently received.
2. The formula for calculating the monthly position allowance is as follows:

The general minimum wage implemented according to the provisions of the State (the general minimum wage for calculating position allowances from May 1, 2012 is VND 1,050,000/month).
* When calculating the monthly position allowance for each individual, if there is a remainder of VND 50 or more, it will be rounded up to VND 100, if less than VND 50, it will be discarded.
Example 1: Comrade Nguyen Van A, Team Leader; receives a salary coefficient of 6.00 (rank-based salary level of Captain), leadership position allowance coefficient of 0.3. The monthly position allowance of Comrade A is:
(6.00 + 0.30) x VND 1,050,000 x 25% = VND 1,653,800.
Example 2: Comrade Le Thi H, Captain in technical positions; receives a salary coefficient of 5.20 (N2-SC) + 6% seniority allowance exceeding the ceiling. The monthly position allowance of Comrade H is:
(5.20 + 5.20 x 6%) x VND 1,050,000 x 25% = VND 1,446,900.
Example 3: Comrade Nguyen Van B, non-commissioned officer serving with a fixed-term contract in the People's Police Force; receives a position allowance coefficient of 0.60 (rank-based salary level of Sergeant). The monthly position allowance of Comrade B is:
0.60 x VND 1,050,000 x 25% = VND 157,500.
Example 4: Ms. Nguyen Thi T, contractual employee working as a cook; receives a salary coefficient of 2.80. The monthly position allowance of Ms. T is:
2.80 x VND 1,050,000 x 25% = VND 735,000.
Article 4. Principles and Calculation of Allowance
1. The duty allowance is paid together with monthly salary and is not included in contributions for social insurance and health insurance benefits.
2. If an individual who receives the duty allowance transfers to a position that does not qualify for such an allowance, they will cease to receive it from the following month. In cases where there is a reverse transfer, the duty allowance will be received from the month of the transfer.
3. Individuals who receive a professional preference allowance, occupational responsibility allowance (such as inspectors, full-time Party inspection staff, performing artists...), or special allowances for police officers and soldiers in the People's Public Security force, and who also fall under the category specified in Clause 1, Article 2 of this Circular, shall also receive the duty allowance as stipulated in this Circular.
4. Individuals receiving the duty allowance as specified in Clause 1, Article 2 of this Circular shall not be entitled to the duty allowance during the following periods:
a) Time spent on overseas assignments, working, or studying abroad, during which they receive 40% of their salary as stipulated in Clause 4, Article 8 of Government Decree No. 204/2004/NĐ-CP dated December 14, 2004 on salary regulations for officials, civil servants, public employees, and armed forces personnel.
b) Continuous leave for personal reasons lasting one month or longer.
c) Time off while receiving social insurance benefits as prescribed by laws on social insurance.
d) Time off awaiting retirement benefits.
đ) Time spent attending new recruit training courses for non-commissioned officers and soldiers serving on fixed-term contracts in the People's Public Security force.
e) Periods of suspension from work or detention.
Article 5. Source of Funds
The funds for paying the duty allowance as stipulated in Government Decree No. 34/2012/NĐ-CP dated April 15, 2012, and detailed in this Circular shall be guaranteed by the state budget and implemented according to the guidance of the Financial Department.
For public service units with revenue within the People's Public Security force, the funding to ensure payment of the duty allowance (if applicable) shall be carried out according to Circular No. 06/2010/TT-BCA dated January 21, 2010 of the Ministry of Public Security on financial management regulations for public service units with revenue within the People's Public Security force.
Article 6. Implementation Organization
1. This Circular takes effect from June 1, 2012.
2. The duty allowance regime stipulated in this Circular shall be implemented from May 1, 2012.
Repeal Circular No. 61/2011/TT-BCA dated August 30, 2011 of the Ministry of Public Security guiding the implementation of the duty allowance system in the People's Public Security force.
3. Heads of public security units and localities are responsible for establishing and reviewing and disbursing the duty allowance in accordance with the provisions of this Circular for individuals currently receiving salaries and allowances from their respective units and localities.
4. The Financial Department is responsible for guiding public security units and localities to prepare budgets to ensure the implementation of additional duty allowance regimes in 2012 and to compile the additional budget of the Ministry of Public Security for reporting to the leadership of the Ministry to request supplementary funding from the Ministry of Finance as prescribed. During the implementation process, if there are any difficulties, public security units and localities should report them to the Ministry (through the General Bureau for Building Police Force) for research and guidance on resolution.
