Guidelines for Competition and Reward Work in the Transport Industry

Considering the proposal of the Director of the Department of Personnel Organization,

The Minister of the Ministry of Transport issues this Circular guiding the competition and reward work in the transport industry.

Chapter 1.

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular guides the implementation of organizing competition movements and reward work in the transport industry, including: organizing and launching competition movements, contents and forms of competition, standards for commendation titles; subjects, standards, and forms of rewards; decision-making authority; procedures for proposing recognition of commendation titles and reward forms; procedures for presenting awards; competition and reward funds.

Article 2. Applicability

This Circular applies to collectives, individuals, agencies, units under the Ministry; Vietnam Shipbuilding Industry Group, Vietnam Maritime Corporation, Vietnam Railway Corporation, Vietnam Airports Corporation (hereinafter referred to as groups and corporations); Provincial Departments of Transport under central cities; associations and unions operating in fields within the transport industry; overseas Vietnamese, foreigners, foreign organizations and international organizations in Vietnam contributing to the construction and development of the Vietnamese transport industry.

Article 3. Principles of Competition and Reward

Competition and reward work in the transport industry shall be carried out according to the principles stipulated in Article 6 of the Competition and Reward Law; Article 3 and Article 4 of Decision No. 42/2010/NĐ-CP dated April 15, 2010 of the Government detailing the implementation of certain provisions of the Competition and Reward Law and the Law Amending Certain Provisions of the Competition and Reward Law (hereinafter referred to as Decision No. 42/2010/NĐ-CP of the Government).

Article 4. Responsibilities for Organizing Competition Movements and Implementing Reward Work

1. The Minister of the Ministry of Transport launches and directs competition movements in the transport industry.

2. Heads of agencies and units throughout the transport industry are responsible for organizing and launching competition movements within their management scope, actively identifying and selecting collectives and individuals with meritorious achievements for rewards or recommending rewards; promoting and disseminating exemplary models.

3. Heads of information, press, and publishing agencies under the Ministry are responsible for proactively and collaboratively with mass media agencies in publicizing competition and reward work; popularizing and setting examples of exemplary models, good people and deeds, promoting competition and reward movements.

4. The Standing Committee of the Competition and Reward Council of the Ministry bases on specific tasks and targets of annual and long-term plans, collaborates with the Vietnam Transport Workers' Union to advise and propose policies, contents, programs, plans, and measures for competition; organizing and inspecting competition movements and reward work; advising on mid-term and final reviews of competition movements, promoting exemplary models; proposing rewards and suggesting innovations in competition and reward work within the entire industry and each specialized field.

Article 5. Reward Fund

1. Establish a competition and reward fund to organize competition movements and reward work.

2. The Competition and Commendation Fund is formed from state budget, enterprise reward funds, contributions from domestic and foreign individuals and organizations, and other lawful sources of income.

3. Strictly prohibit using the competition and reward fund for other purposes.

Chapter 2.

ORGANIZING AND LAUNCHING COMPETITION MOVEMENTS, COMPETITION TITLES, AND COMPETITION STANDARDS

Article 6. Forms and Contents of Competitions

1. Competition is organized in the following forms:

a) Regular competition is organized daily, monthly, quarterly, and annually to achieve set goals, targets, and work programs established by the Ministry or the unit.

b) Periodic competition (or thematic competition) is organized to implement key and urgent tasks at different stages and specified time periods.

2. Contents of competition include:

a) Clearly defining objectives, scope, and subjects of competition, based on which specific targets and contents of competition are formulated. Determining the contents and targets of competition must ensure scientific accuracy, suitability to the reality of the agency or unit, and feasibility;

b) Measures to organize, mobilize, and monitor the competition process and direct the competition movement;

c) Summarizing and concluding the movement, reviewing experiences, evaluating competition results, drawing lessons learned, publicly selecting outstanding collectives and individuals in the competition movement for rewards or recommending rewards.

Article 7. Registration for Commendation Titles

1. Agencies, units under the Ministry; groups, corporations 91 and provincial Departments of Transport directly under the central government shall organize for individuals and collectives to register their efforts to achieve the contents, targets, and commendation titles, and submit the registration forms to the Cadre and Civil Servant Organization Department no later than March 28 each year.

2. For campaigns with specific periods or themes aimed at implementing large programs, projects, or responding to mass movements, agencies and units shall proactively develop plans and register for commendations according to the mobilization plan issued by the Ministry of Transport.

Article 8. Awards

1. For individuals:

a) Advanced Worker;

b) Model Soldier at the Grassroots Level;

c) Outstanding Soldier of the Transport Industry;

d) National Model Soldier.

2. For groups:

a) Advanced Labor Collective;

b) Excellent Labor Collective;

c) The Excellent Flag of the Ministry of Transport;

d) State Flag.

Article 9. Standards for Commendation Titles for Individualsệfor individuals

1. Title "Advanced Worker":

a) The title "Advanced Worker" is reviewed annually during the year-end summary of the agency or unit's work and must meet the following criteria:

- Successfully completing assigned tasks with high productivity and quality;

- Adhering well to internal regulations and policies of the agency or unit, Party guidelines, and state laws; having a spirit of self-study to improve professional skills; overcoming difficulties to complete tasks; fostering teamwork and mutual assistance among colleagues; actively participating in competitive campaigns;

- Actively studying politics, culture, professional knowledge, and vocational skills;

- Having good morals and a healthy lifestyle.

b) Female workers on maternity leave as stipulated by the state and those who have bravely saved people or property, or who were injured in combat or service and require medical treatment according to the conclusion of health authorities, will still be considered for the title "Advanced Worker" during their leave period and can serve as grounds for awarding other commendation titles and rewards.

c) Individuals attending short-term training courses lasting less than one year, if they achieve satisfactory results and comply with the rules of the training institution, may be considered for the title "Advanced Worker" based on their performance at the workplace combined with their training period. Those attending longer training courses of one year or more, achieving satisfactory academic results, will be deemed equivalent to the title "Advanced Worker" for the purpose of awarding other commendation titles and rewards.

d) For individuals transferred to new positions, the new unit is responsible for reviewing and electing the title "Advanced Worker" based on the assessment opinions from the previous unit (for cases where the individual worked at the previous unit for six months or more), serving as grounds for awarding other commendation titles and rewards.

e) The title "Advanced Worker" will not be awarded to individuals who have not registered for commendation, been newly hired for less than ten months, taken leave for forty working days or more, been administratively punished, or received disciplinary action of reprimand or higher.

2. Title "Outstanding Soldier at the Grassroots Level":

The title "Outstanding Soldier at the Grassroots Level" is reviewed annually during the year-end summary of the agency or unit's work and must meet the following criteria:

a) Meeting the criteria for the title "Advanced Worker";

b) Having innovative ideas, solutions, research topics, or applying new procedures to streamline administrative procedures, increase labor productivity, and enhance the effectiveness of the agency or unit's operations, recognized by the Scientific Council (Innovation Council) at the grassroots level.

The establishment of the Scientific Council (Innovation Council) at the grassroots level is decided by the authority responsible for recognizing the title of outstanding soldier at the grassroots level.

3. Title "Outstanding Soldier of the Transport Industry":

Individuals eligible for the title "Outstanding Soldier of the Transport Industry" must meet the following criteria:

a) Having been awarded a Certificate of Merit by the Ministry, with outstanding achievements among those who have continuously achieved the title "Outstanding Soldier at the Grassroots Level" three times consecutively;

b) The individual's achievements, innovations, solutions, and research topics have significant impacts on the Ministry, industry, province, or central-level organizations, recognized by the Scientific and Innovation Councils at the Ministry, industry, provincial, or central-level organization levels.

4. Title "National Outstanding Soldier":

This title is awarded annually to individuals meeting the criteria specified in Article 15 of Decree No. 42/2010/NĐ-CP of the Government.

"National Outstanding Soldier" refers to individuals with outstanding and exemplary achievements selected from those who have continuously achieved the title "Outstanding Soldier of the Transport Industry" twice (six consecutive years of achieving the title "Outstanding Soldier at the Grassroots Level").

Example: Mr. Nguyen Van A was awarded the title "Outstanding Soldier at the Grassroots Level" in 2004, 2005, and 2006, and was eligible for the first award of the title "Outstanding Soldier of the Transport Industry" by the end of 2006 (recognized in 2007); subsequently, he achieved the title "Outstanding Soldier at the Grassroots Level" again in 2007, 2008, and 2009, and was eligible for the second award of the title "Outstanding Soldier of the Transport Industry" by the end of 2009 (recognized in 2010); the latest proposal to consider awarding him the title "National Outstanding Soldier" should be submitted no later than February 15, 2011.

The selection and promotion of outstanding soldiers must ensure typical excellence, avoiding excessive proliferation.

Article 10. Criteria for commendation titles for collectivesớfor groups

1. The title "Advanced Labor Collective":

a) The title "Advanced Labor Collective" is awarded annually; it is a distinguished collective selected from those that have completed their tasks and met the following criteria:

- Successfully completing assigned tasks and plans;

- Having ongoing, practical, and effective competition movements;

- More than 50% of individuals within the collective achieving the title "Advanced Worker" and none being disciplined with warnings or higher penalties;

- Internal unity, and good compliance with the Party's policies and state laws.

b) The title "Advanced Labor Collective" will not be awarded to collectives that have not registered for competition, newly established collectives under ten months old, or those with individuals disciplined with warnings or higher penalties.

2. Title "Outstanding Labor Collective":

Awarded annually; it is a distinguished collective selected from those that have achieved the title "Advanced Labor Collective" and meet the following criteria:

a) Being creative, overcoming difficulties to excellently complete tasks and fulfill all obligations to the State;

b) There is a regular, practical, and effective competitive movement;

c) All individuals within the collective completing their assigned tasks, of which at least 70% have achieved the title "Advanced Worker";

d) Having individuals who achieve the title of "Model Worker at the Grassroots Level" and no individuals disciplined with a warning or higher;

e) Internal unity, exemplary compliance with the Party's policies and state laws.

3. The Flag of Excellence in Competition of the Ministry of Transport:

Awarded annually based on the criteria stipulated in Article 26 of the Law on Competition and Reward and Article 16 of Decree No. 42/2010/NĐ-CP of the Government; presented to outstanding collectives that have excellently and comprehensively fulfilled their tasks, recognized as leading units in competition groups or clusters of the Ministry (awarded to grassroots units and their immediate superiors).

4. The Flag of Excellence of the Government:

Awarded annually based on the criteria stipulated in Article 25 of the Law on Competition and Reward and Article 16 of Decree No. 42/2010/NĐ-CP of the Government.

Chapter 3.

FORMS OF REWARD AND STANDARDS FOR REWARD

Article 11. Rewards

1. Regular rewards are annual forms of recognition given to collectives and individuals who have achieved outstanding results at the end of the year's or multiple years' tasks and plans.

2. Periodic rewards (or thematic rewards) are forms of recognition given to collectives and individuals who have achieved outstanding results after the completion of a competition period, program, or thematic work initiated by the President, Prime Minister, Ministers, heads of agencies, or units.

3. Immediate rewards are forms of recognition given to collectives and individuals who have achieved unexpected outstanding results in labor production; bravery in rescuing people and property of the people and the state (unexpected achievements are those made in unforeseen circumstances outside regular planned work that the collective or individual must undertake).

4. Rewards for dedication during the process are forms of recognition given to individuals who have contributed significantly through various stages of the revolution (holding leadership positions in state agencies, public institutions, political organizations, and social-political organizations) with outstanding contributions to the revolutionary cause of the Party and the nation.

5. Foreign rewards are forms of recognition given to foreign individuals, foreign agencies, organizations, and international organizations in Vietnam; collectives and individuals outside the transport sector who have made significant contributions to the construction and development of the Vietnamese transport sector.

Article 12. Forms of Reward

1. National-level reward forms:

Orders of various types, Friendship Medals, Heroic Labor Titles, Heroic People's Armed Forces Titles, National Teacher Titles, Excellent Teachers, National Medical Practitioners, Excellent Medical Practitioners, Ho Chi Minh Awards, State Awards, Certificates of Merit from the Prime Minister.

2. Forms of reward of the Ministry of Transport:

a) Commemorative Medal "For the Development of the Vietnamese Transportation Industry";

b) Certificate of Merit of the Minister of Transport;

c) Banner of the Ministry of Transport;

d) Certificate of Merit from the head of a unit under the Ministry (having legal personality, having a bank account, having its own seal), group companies, and the 91 corporations.

Article 13. Standards for State-level Awardsớspecialized agency under the People's Committee of the province/city.

1. Orders, Medals, Certificates of Merit from the Prime Minister, titles of Labor Hero, People's Armed Forces Hero shall be implemented in accordance with the provisions set forth in Chapter III of Decree No. 42/2010/NĐ-CP of the Government.

2. Titles of National Teacher, Excellent Teacher, National Doctor, Excellent Doctor

a) The criteria and conditions for granting the titles of National Teacher, Excellent Teacher, National Doctor, and Excellent Doctor shall be carried out in accordance with the provisions of Article 45 of Decree No. 42/2010/NĐ-CP of the Government.

b) Functional agencies under the Ministry responsible for education and training (for the title of Teacher) and health (for the title of Doctor) shall take the lead and coordinate with the Standing Committee of the Ministry’s Commendation and Competition Council to compile reports for the specialized council at the Ministry level to review and submit to the State-level Council for consideration and decision.

3. Ho Chi Minh Award, State Award

a) Ho Chi Minh Prize and State Prize shall be awarded to authors of one or more scientific research, technological, educational works in the Transport Industry that meet the standards stipulated in Articles 46 and 47 of Decree No. 42/2010/NĐ-CP of the Government.

b) Functional agencies assisting the Ministry-level Council in relevant fields shall take the lead and coordinate with the Standing Committee of the Ministry’s Commendation and Competition Council to compile reports for the specialized council at the Ministry level to review and submit to the State-level Council for approval and decision.

Article 14. Criteria for Ministry-level Awards

1. Commemorative Medal "For the Development of Vietnam's Transport Industry"

The criteria, procedures, and steps for granting the Commemorative Medal are implemented according to Circular No. 40/2011/TT-BGTVT dated February 18, 2011, which stipulates the procedures for granting the Commemorative Medal "For the Development of Vietnam's Transport Industry" issued by the Ministry of Transport.

2. Certificate of Merit of the Minister of Transport

A Certificate of Merit from the Minister of Transport is a form of commendation for collectives and individuals on the occasion of annual work summaries, meeting the following standards:

a) For collectives:

- Successfully completing tasks;

- Internal unity, actively participating in democratic regulations at the grassroots level, and responding positively to competition movements;

- Ensuring material and spiritual life within the collective, practicing thrift;

- Adhering to all systems and policies for all members of the collective;

- Clean and strong Party organizations and mass organizations;

- Receiving the title of "Outstanding Working Collective" consecutively for two times up to the time of commendation;

b) For individuals:

- Successfully completing tasks and fulfilling civic duties;

- Having good moral qualities, unity, and exemplary compliance with the Party's guidelines and state laws;

- Actively studying to improve professional skills;

- Receiving the title of "Model Worker at the Grassroots Level" consecutively for two times up to the time of commendation;

c) A Certificate of Merit from the Minister of Transport is also a form of commendation for collectives and individuals who have outstanding achievements or when concluding a campaign or movement initiated by the Ministry of Transport, achieving excellent results recognized or highlighted as exemplary models, having educational significance within the industry.

3. Banner of the Ministry of Transport

A Banner from the Ministry of Transport is a form of commendation for large collectives (at the grassroots or higher levels) that have been established and developed for five years or more and are awarded on the anniversaries of these units.

4. Letter of Commendation from the Head of the Unit

The criteria for commendation shall be implemented in accordance with the provisions of Article 50 of Decree No. 42/2010/NĐ-CP of the Government.

Chapter 4.

AUTHORITY, PROCEDURES AND TIME LIMITS FOR PROPOSING THE REVIEW AND RECOGNITION OF COMPETITION TITLES AND FORMS OF COMMENDATION

PART 1. AUTHORITY TO DECIDE AND BESTOW

Article 15. Authority to decide on commendation titles and reward forms at the Ministry level and subordinate units

1. The Minister of Transport decides to bestow the "Certificate of Merit from the Minister of Transport", the "Outstanding Competition Flag of the Ministry of Transport", the title "Excellent Labor Collective", the title "Model Worker of the Transport Industry", the Commemorative Medal "For the Development of Vietnam's Transport Industry", and the Banner of the Ministry of Transport to individuals and collectives of units under the Ministry.

2. Heads of units under the Ministry with legal personality, having bank accounts, and their own seals decide to bestow the title "Model Worker at the Base Level", "Advanced Worker", "Advanced Labor Collective", and Certificates of Merit. For individuals working in organizations without legal personality, these are reviewed and bestowed by the immediate superior head. Newly established enterprises must have been operational for at least one year (12 months) before being eligible for review and bestowal.

Article 16. Authority to decide on and bestow commendation titles and reward forms at the State level

1. The authority to decide on awarding and bestowing commendation titles, reward forms, State honor titles, and the Ho Chi Minh Prize and State Prize shall be implemented according to the provisions of Article 51 of Decree No. 42/2010/NĐ-CP of the Government.

2. The ceremony for bestowing State honor titles, Prizes, Orders, Medals, the Government's Competition Flag, and the Certificate of Merit from the Prime Minister shall be carried out according to the provisions of Decree No. 154/2004/NĐ-CP dated August 9, 2004 of the Government regarding State ceremonial procedures in organizing rallies and commemorative ceremonies; bestowing and receiving State honor titles, Orders, Medals, the Government's Competition Flag, and the Certificate of Merit from the Prime Minister.

3. The Standing Committee of the Ministry's Competition and Reward Council is responsible for guiding and inspecting agencies and units to organize the bestowal and reception of State honor titles, Orders, Medals, the Government's Competition Flag, and the Certificate of Merit from the Prime Minister solemnly and economically.

PART 2. PROCEDURES FOR RECOMMENDING AWARDS

Article 17. General provisions on procedures for recommending awards for commendation titles and reward forms

1. Examination of competition and commendation according to general procedures

a) Based on the competition achievements in the year, collectives and individuals may be considered for awards of commendation titles equal to or lower than those registered at the beginning of the year if they do not meet the criteria for those titles. In cases where collectives and individuals achieve competition results exceeding the criteria of the registered titles at the beginning of the year, they may be considered for higher commendation titles depending on the nature and degree of achievements made.

b) The endorsement process for State commendation titles and reward forms is carried out according to the provisions of Article 84 of the Law on Competition and Reward and according to Clause 13, 14, and 15 of Article 53 of Decree No. 42/2010/NĐ-CP of the Government.

c) For units with the obligation to pay state budget when submitting reward forms such as the Competition Flag, Excellent Labor Collective, Certificate of Merit, Model Worker at the Ministry level and State level for units and individuals who are unit heads, in the report of achievements, it must clearly declare the following contents:

- The actual amount of tax and other revenues paid in the year compared to the registration;

- The percentage of state budget payment compared to the previous year;

- A commitment to pay all types of taxes and other revenues according to the law and within the stipulated time frame.

The Ministry will assess the fulfillment of the obligation to pay the state budget (seeking opinions from the competent tax management agency).

d) Collectives and individuals prepare reports of achievements and related files according to the model attached to this Circular to submit to the agency or organization deciding on rewards within its authority or to the competent authority for rewards. When submitting to the Ministry in writing, simultaneously send electronic files to the email address [email protected] of the submitted files (in .doc format for reports, lists, and achievement reports of collectives and individuals recommended, in .pdf format for other related files) to the Standing Committee of the Ministry of Transport's Competition and Reward Council, except for documents containing state secrets. After evaluation, for files for national-level rewards, the Standing Committee of the Ministry of Transport's Competition and Reward Council sends the award files in both written and electronic formats to the Central Competition and Reward Board, while files for Ministry-level rewards will be retained by the Ministry.

2. Examination of commendation according to simplified procedures

The simplified award procedure is applied according to Article 85 of the Law on Competition and Reward.

Depending on the outstanding achievements and the scope of influence, the form of reward can be Orders, Certificates of Merit from the Prime Minister, Certificates of Merit from the Minister of Transport, or Certificates of Merit from the head of the agency or unit.

Article 18. Procedures for considering commendation titles and forms of reward

1. The level that manages organizational structure, cadres, civil servants, public officials, employees, and salary funds shall be responsible for rewarding or submitting to a higher level for rewarding the subjects under its management scope.

For companies and corporations (which have been equitized) under the Ministry, including those corporations which have transferred state capital to the State Capital Investment Corporation for management, if they were previously members of a certain unit, the Ministry shall authorize that unit to be responsible for rewarding or submitting to a higher level for rewarding.

For organizations and individuals specializing in party work and mass organizations, the procedures for recommending rewards shall be carried out according to point b, item 1, part III of Circular No. 02/2011/TT-BNV dated January 24, 2011, issued by the Ministry of Home Affairs guiding the implementation of Decree No. 42/2010/NĐ-CP dated April 15, 2010, of the Government detailing the implementation of certain provisions of the Law on Competition and Reward and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward.

2. The level that initiates competition campaigns according to specific themes, when summarizing and selecting exemplary models, shall be responsible for rewarding and submitting to a higher level for rewarding. Utilize the form of reward from the initiating level to present to collectives and individuals who achieve outstanding results; in cases where the achievements are exemplary and have a nationwide impact, recommend the Prime Minister or the President to award.

3. Agencies and units proposing to consider granting commendation titles and forms of reward at the Ministry, sector, central mass organizations, provincial People's Committees, and centrally-administered city People's Committees for collectives and individuals shall report to the Standing Committee of the Ministry's Competition and Reward Council for review and recommendation.

4. Agencies and units proposing rewards for foreign nationals shall report to the Ministry (through the Standing Committee of the Ministry's Competition and Reward Council) to coordinate with the Department of International Cooperation in handling the procedures for recommending rewards and submitting to the Ministry's leadership for review and decision.

5. In one year, do not submit two national-level reward forms for one subject (except for exceptional rewards); In cases where the criteria for awarding Orders are related to Certificates of Merit from the Prime Minister, then after being awarded a Certificate of Merit from the Prime Minister for two years, propose to consider awarding Orders.

Article 19. Procedures for Proposing Recognition of Commendation Titles

1. National Model Worker Title

Heads of agencies and units under the Ministry; groups and corporations 91 proposing rewards shall submit to the Minister through the Standing Committee of the Ministry's Competition and Reward Council. The Standing Committee of the Ministry's Competition and Reward Council shall examine the dossier, summarize the achievements, report to the Ministry's Competition and Reward Council for review and seek the opinion of the Party Cadre and Civil Servants' Council of the Ministry.

The proposal dossier consists of three copies (originals), including:

a) A submission letter accompanied by a list of proposals (must include written agreement from the same-level Party Committee).

b) Minutes and results of secret ballot voting of the Competition and Reward Council at the submitting level, and must have the approval of at least 90% of the Council members.

c) A report on achievements over six years prior to the proposal date and a summary of individual achievements proposed for the National Model Worker title; in the achievement report, clearly state the content of research topics, innovations, and effective solutions in work and management, along with extracts of confirmation opinions from the Science and Innovation Council at the Ministry, sector, central mass organizations, province, or centrally-administered city; if the innovation, solution, or topic has been certified by an authorized agency, attach a copy of the certificate instead of the confirmation opinion from the Science and Innovation Council at the Ministry, sector, central mass organizations, province, or centrally-administered city; confirm from each level from the grassroots to the submitting level. Report according to Model No. 2 in the Appendix of this Circular.

d) For units with the obligation to pay state budget, when submitting for the head of the unit to be rewarded, there must be confirmation of fulfilling the state budget payment obligation from the finance department.

e) For individuals who are heads of units, there must be an opinion from the commune or ward (where the individual resides) regarding compliance with the policies of the Party, State, and locality.

2. Ministry of Transport Model Worker Title

Heads of agencies and units under the Ministry; groups and corporations 91; Provincial Departments of Transportation of centrally-administered cities and provinces proposing rewards shall submit to the Minister through the Standing Committee of the Ministry's Competition and Reward Council. The Standing Committee of the Ministry's Competition and Reward Council shall examine the dossier, compile a list, seek written opinions from some relevant members of the Ministry's Competition and Reward Council, and submit to the Ministry's leadership for decision.

The proposal dossier consists of five copies (two originals, three photocopies), including:

a) A submission letter accompanied by a list of proposals.

b) Minutes and results of secret ballot voting of the Competition and Reward Council at the submitting level.

c) An individual achievement report over three years prior to the proposal date, confirmed by each level from the grassroots to the submitting level. Report according to Model No. 2 in the Appendix of this Circular.

In the report, clearly state the content of useful innovations, experiences, and effective solutions in management and work or research topics that bring about practical benefits, decided by the competent authority.

3. Flag of Merit of the Government

Heads of agencies and units under the Ministry; groups and corporations 91; Provincial Departments of Transportation of centrally-administered cities and provinces proposing rewards shall submit to the Minister through the Standing Committee of the Ministry's Competition and Reward Council.

The Standing Committee of the Ministry's Competition and Reward Council shall examine the dossier, summarize the achievements, and report to the Ministry's Competition and Reward Council for review.

The proposal dossier consists of three copies (originals), including:

a) A submission letter accompanied by a list of proposals.

b) Minutes and results of secret ballot voting of the Competition and Reward Council at the submitting level.

c) A report on achievements for one year and a summary of the achievements of the collective proposed to receive the Flag of Merit of the Government, confirmed by each level from the grassroots to the submitting level. Report according to Model No. 1 in the Appendix of this Circular.

d) For units with the obligation to pay the state budget, when submitting for the unit to be rewarded, there must be confirmation of fulfilling the state budget payment obligation from the finance department.

e) Opinion of the commune or ward where the unit is located regarding compliance with the policies of the Party, State, and locality.

4. The Excellent Flag of Struggle of the Ministry

Heads of agencies and units under the Ministry; groups, corporations, and companies 91; Provincial Departments of Transport directly under the central government shall submit to the Minister through the Standing Committee of the Ministry's Struggle Award Council. The Standing Committee of the Ministry's Struggle Award Council will review the file, summarize achievements, and prepare a list for reporting to the Ministry's Struggle Award Council for approval.

The application file consists of 01 set (original), including:

a) A submission letter accompanied by a list of proposals.

b) Minutes and results of secret ballot voting of the Competition and Reward Council at the submitting level.

c) A report on achievements for one year with confirmation from all levels from the grassroots to the level submitting to the Ministry. The report shall be made according to Model No. 1 in the Appendix of this Circular.

5. The Title of Outstanding Labor Collective

Heads of agencies and units under the Ministry; groups, corporations, and companies 91 shall organize the evaluation and propose commendation, submitting to the Minister through the Standing Committee of the Ministry's Struggle Award Council. The Standing Committee of the Ministry's Struggle Award Council will report to the Ministry's leadership for consideration and decision.

The application file consists of 02 sets (originals), including:

a) A submission letter accompanied by a list of proposals.

b) Minutes and results of secret ballot voting of the Competition and Reward Council at the submitting level.

c) A report on achievements according to Model No. 1 in the Appendix of this Circular (The Ministry authorizes the level submitting to the Ministry to store the file, which must include the content at point c, Clause 1, Article 17 of this Circular). The Ministry will review the commendation file and check the file if necessary.

6. For the titles "Outstanding Grassroots Struggle Soldier", "Advanced Worker", and "Advanced Labor Collective" awarded annually. Procedures and files for awarding these titles shall be specifically stipulated by agencies and units under the Ministry in accordance with Article 84 of the Law on Struggle and Commendation.

Article 20. Procedures for Proposing Forms of Commendation

1. Orders of various types

Heads of agencies and units under the Ministry; groups, corporations, and companies 91 shall propose commendation, submitting to the Minister through the Standing Committee of the Ministry's Struggle Award Council. The Standing Committee of the Ministry's Struggle Award Council will review the file, summarize achievements, prepare a list for reporting to the Ministry's Struggle Award Council for approval (except for cases proposing Independence Medals, opinions of the Party Cadre and Civil Servants' Board of the Ministry are required).

The proposal dossier consists of three copies (originals), including:

a) A submission letter accompanied by a proposed list (for cases proposing Independence Medals and higher, written agreement on the proposal from the same-level Party Committee is required).

b) Minutes and results of secret ballot voting of the Competition and Reward Council at the submitting level.

c) A report on achievements for commendation, confirmed by all levels from the grassroots to the level submitting to the Ministry and a summary of achievements.

For collectives, the report shall be made according to Model No. 1 in the Appendix of this Circular; for individuals, the report shall be made according to Model No. 2 in the Appendix of this Circular.

d) For units with the obligation to pay state budget, when submitting for collective or head of unit commendation, confirmation of fulfilling the state budget payment obligation from the financial authority is required.

e) Opinions of wards, communes (for collectives, it is the location where the unit is based, for heads of units, it is their place of residence) regarding compliance with policies of the Party, State, and locality.

2. Friendship Medal

Heads of agencies and units under the Ministry; groups, corporations, and companies 91 shall propose commendation, submitting to the Minister through the Standing Committee of the Ministry's Struggle Award Council. The Standing Committee of the Ministry's Struggle Award Council will review the file, summarize achievements, prepare a list for reporting to the Ministry's Struggle Award Council for approval.

The proposal dossier consists of three copies (originals), including:

a) A submission letter accompanied by a list of proposals.

b) A report on achievements and a list of proposed commendation for Friendship Medal (The direct proposing unit must make a report on achievements with confirmation from the level submitting according to Model No. 8 in the Appendix of this Circular).

3. Heroic Laborer, Heroic People's Armed Forces Citizen Titles

Heads of agencies and units under the Ministry; groups, corporations, and companies 91 shall propose commendation, submitting to the Minister through the Standing Committee of the Ministry's Struggle Award Council. The Standing Committee of the Ministry's Struggle Award Council will review the file, summarize achievements, prepare a list for reporting to the Ministry's Struggle Award Council for approval and seek opinions of the Party Cadre and Civil Servants' Board of the Ministry.

The application file consists of 04 sets (originals), including:

a) A submission letter accompanied by a proposed list (from the grassroots level to the level submitting to the Ministry); written agreement on the proposal from the same-level Party Committee is required.

b) A report on achievements for ten years prior to the proposal date and a summary of achievements, confirmed by all levels from the grassroots to the level submitting to the Ministry (except for reports on outstanding and exceptional achievements or other special achievements) of the proposed heroic title recipient, confirmed by the level submitting to the Ministry.

For collectives, the report shall be made according to Model No. 4 in the Appendix of this Circular; for individuals, the report shall be made according to Model No. 5 in the Appendix of this Circular.

c) Minutes and results of secret ballot voting of the Struggle Award Councils at all levels and the number of votes in agreement from members of the Struggle Award Council at the level submitting to the Ministry of 90% or more.

d) For units with the obligation to pay state budget, when submitting for collective or head of unit commendation, confirmation of fulfilling the state budget payment obligation from the financial authority is required.

e) Opinions of wards, communes (for collectives, it is the location where the unit is based, for heads of units, it is their place of residence) regarding compliance with policies of the Party, State, and locality.

4. Certificate of Merit of the Prime Minister.

Heads of agencies and units under the Ministry; groups, corporations, and companies 91 shall propose commendation, submitting to the Minister through the Standing Committee of the Ministry's Struggle Award Council. The Standing Committee of the Ministry's Struggle Award Council will review the file, summarize achievements, prepare a list for reporting to the Ministry's Struggle Award Council for approval.

The proposal dossier consists of three copies (originals), including:

a) A submission letter accompanied by a list of proposals.

b) Minutes and results of secret ballot voting of the Competition and Reward Council at the submitting level.

c) A report on achievements for three years for collectives (according to Model No. 1 in the Appendix of this Circular), five years for individuals (according to Model No. 2 in the Appendix of this Circular) and a summary of achievements for commendation, confirmed by all levels from the grassroots to the level submitting to the Ministry.

d) For units with the obligation to pay state budget, when submitting for collective or head of unit commendation, confirmation of fulfilling the state budget payment obligation from the financial authority is required.

e) Opinions of wards, communes (for collectives, it is the location where the unit is based, for heads of units, it is their place of residence) regarding compliance with policies of the Party, State, and locality.

5. National Teacher, Distinguished Teacher, National Doctor, Distinguished Doctor Titles

The procedures and files for awarding are implemented according to Article 64 of Decree No. 42/2010/ND-CP of the Government and Clause 24 of Article 1 of Decree No. 39/2012/ND-CP dated April 27, 2012 amending and supplementing some articles of Decree No. 42/2010/ND-CP dated April 15, 2010 of the Government detailing the implementation of some articles of the Law on Struggle and Commendation and the Law Amending and Supplementing Some Articles of the Law on Struggle and Commendation.

6. Ho Chi Minh Prize, State Prize

The procedures and files for awarding are implemented according to Article 65 of Decree No. 42/2010/ND-CP of the Government and Clause 26 of Article 1 of Decree No. 39/2012/ND-CP dated April 27, 2012 amending and supplementing some articles of Decree No. 42/2010/ND-CP dated April 15, 2010 of the Government detailing the implementation of some articles of the Law on Struggle and Commendation and the Law Amending and Supplementing Some Articles of the Law on Struggle and Commendation.

7. Commemorative Medal "For the Development of Vietnam's Transport Industry".

The procedures and files are stipulated in Circular No. 40/2011/TT-BGTVT dated May 18, 2011 of the Ministry of Transport.

8. Certificate of Merit of the Minister of Transport

Heads of agencies and units under the Ministry; groups, total companies 91, Transport Departments of provinces and centrally governed cities shall submit to the Minister through the Standing Committee of the Ministry’s Competition - Award Council. The Standing Committee of the Ministry’s Competition - Award Council shall review the files and report to the Ministry’s leadership for consideration and decision.

The application file consists of 01 set (original), including:

a) A submission letter accompanied by a list of proposals.

b) Minutes of the Competition - Award Council at the level submitting to the Ministry.

c) Report on achievements over two years, with confirmation from all levels from the grassroots to the level submitting to the Ministry. For collective reports, follow the provisions in Model No. 1 of the Appendix to this Circular; for individual reports, follow the provisions in Model No. 2 of the Appendix to this Circular.

9. Banner of the Ministry of Transport

Heads of agencies and units under the Ministry; groups, total companies 91, Transport Departments of provinces and centrally governed cities shall submit to the Minister through the Standing Committee of the Ministry’s Competition - Award Council. The Standing Committee of the Ministry’s Competition - Award Council shall review the files and report to the Ministry’s leadership for consideration and decision.

The application file consists of 01 set (original), including:

a) Submission letter of the agency or unit at the level submitting to the Ministry.

b) Summary report on achievements of the unit, with confirmation from all levels from the grassroots to the level submitting to the Ministry. Report according to the provisions in Model No. 1 of the Appendix to this Circular.

Article 21. Simplified award procedures

1. Heads of agencies and units under the Ministry; groups, total companies 91; Transport Departments of provinces and centrally governed cities shall submit to the Minister through the Standing Committee of the Ministry’s Competition - Award Council after individuals or collectives have achieved outstanding and exceptional results.

2. The file for simplified award procedures includes:

a) Submission letter proposing awards from the agency or unit at the level submitting to the Ministry.

b) Achievement report and summary achievement report of the directly managing agency or unit detailing actions, achievements, and merits for which the simplified award procedure is proposed, one set (original) for Ministry-level awards; three sets (originals) for State-level awards. Report according to the provisions in Models No. 6 and 7 of the Appendix to this Circular.

Article 22. Time limit for submission of files for commendation titles and award forms

1. For the Government Flag of Excellence, the Ministry of Transport Flag of Excellence, and the Commendation Certificate for the Rural Transport Development Movement - Mountainous Region, the time limit for submission of files will be based on the annual summary situation of the Ministry.

2. For Prime Minister's Commendation Certificates, Orders of Merit, and National Labor Heroes, National Defense Forces Heroes, the time limit for submission of files is before April 30 each year.

3. For People's Teacher, Outstanding Teacher, People's Doctor, Outstanding Doctor, Ho Chi Minh Prize, State Prize, the time limit for submission of files follows the guidance of relevant Ministries and sectors.

4. For other commendation titles and award forms not specified in Clauses 1, 2, and 3 of this Article, the time limit for submission of award files is before October 30 of the following year.

Article 23. Archiving of award filesinenergy

Agencies and units under the Ministry are responsible for archiving their own and grassroots-level award files to facilitate file retrieval, handling of citizen complaints, or confirming eligibility for beneficiaries when requested. File preservation regulations are implemented according to archival regulations.

Chapter 5.

COMPETITION AND AWARD COUNCIL

Article 24. The Competition and Reward Council of the Ministry of Transportin1. The Competition and Reward Council of the Ministry of Transport shall be established and its members designated by the Minister of Transport.

2. Members of the Competition and Reward Council of the Ministry of Transport include:

b) The Deputy Minister responsible for the field of competition and reward as the First Vice Chairman; some other Vice Chairmen and members appointed by the Minister;

a) The Chairman of the Board is the Minister;

c) The leader of the Personnel Organization Department responsible for the field of competition and reward as the Vice Chairman.

In case of necessity, the Competition and Reward Council of the Ministry of Transport may invite some relevant representatives to attend meetings of the Council; these invited representatives can express their opinions but have no voting rights at the Council's meetings.

3. The Competition and Reward Council of the Ministry of Transport is the advisory body for the Minister on competition and reward work in the transport industry; it examines proposals for the Minister to confer commendation titles and reward forms within his authority or proposes to the Minister to submit to competent authorities for conferring commendation titles and reward forms as prescribed. The Competition and Reward Council of the Ministry of Transport operates according to regulations issued by the Minister of Transport.

Article 25. The Competition and Reward Council at the Base Level

1. The Competition and Reward Council at the base level of units under the Ministry, groups, and the 91 General Corporations shall be established and its members designated by the head of the agency or unit. Depending on the organizational structure and the number of civil servants, officials, and employees under the management of the agency or unit, the number of members of the Competition and Reward Council at the base level may be 3, 5, 7, 9, or 11 members with the following composition of members:

a) The Chairman is the head or deputy head of the agency or unit;

b) The Vice Chairman is the person in charge of the organization assisting the head of the agency or unit in implementing competition and reward work;

c) The Members are representatives of the Party Committee, the Trade Union, and other members who are heads of subordinate specialized units selected and designated by the head of the agency or unit.

In case the Competition and Reward Council at the base level has 9 or 11 members, two or three Vice Chairmen shall be designated, including the person in charge of the organization assisting the head of the agency or unit in implementing competition and reward work as the Acting Vice Chairman; the Standing Council consists of the Chairman and the Vice Chairmen.

In case of necessity, the Competition and Reward Council at the base level may invite some relevant representatives to attend the base-level council meeting; these invited representatives can express their opinions but have no voting rights at the Council's meetings.

2. The Competition and Reward Council at the base level performs the function of advising the head of the agency or unit on competition and reward work; it operates according to the principle of democratic centralism and decides by majority.

In case the opinions of the Council members are evenly divided, the opinion of the Chairman of the Council shall prevail. The Competition and Reward Council at the base level operates according to the Regulations on Operation issued by the head of the agency or unit.

3. The Competition and Reward Council at the base level performs the following tasks:

a) Organizing the launch, directing, guiding, inspecting, urging the implementation of competition movements in the fields and tasks managed by the agency or unit, ensuring that the movement develops strongly, widely, correctly, practically, and effectively;

b) Evaluating and selecting outstanding collectives and individuals in the competition movement, proposing to the head of the agency or unit to decide to confer commendation titles and reward forms within his authority or proposing to the head of the agency or unit to submit to the Minister for higher commendation titles and reward forms as prescribed;

c) Summarizing and reviewing the competition movement of the agency or unit, thereby proposing to the head of the agency or unit about plans for organizing, launching, directing the implementation of the competition movement and promoting exemplary models and good deeds in the agency or unit.

c) Summarize and review the excellence movement within the agency or unit, thereby proposing to the head of the agency or unit plans for organizing, launching, directing the implementation of the excellence movement, and expanding exemplary models and good deeds within the agency or unit;

d) Carry out other tasks assigned by the head of the agency or unit.

Chapter 6.

FUND FOR COMPETITION AND REWARD

Article 26. Responsibilities and Principles for Establishing the Competition and Reward Fund.inenergy

1. Annually, the Standing Committee of the Competition and Reward Council of the Ministry shall base on the results of implementing the competition and reward fund of the previous year; the registered criteria for competition titles, forms of rewards, and the estimated expenses for the competition and reward work in the planned year to prepare the budget estimate for the Ministry's competition and reward fund.

2. Sources and methods for establishing and contributing to the competition and reward fund.

a) The formation sources, contribution, submission, and use of the competition and reward fund of the Ministry of Transport shall be implemented in accordance with the provisions of Article 3 of Circular No. 71/2011/TT-BTC dated May 24, 2011, issued by the Ministry of Finance, guiding the establishment, management, and use of the competition and reward fund under Decree No. 42/2010/NĐ-CP dated April 15, 2010, of the Government.

b) Annually, the Department of Finance shall allocate funds for the competition and reward work of the Ministry according to the provisions of Clause 1, Article 67 of Decree No. 42/2010/NĐ-CP of the Government and Circular No. 71/2011/TT-BTC dated May 24, 2011, of the Ministry of Finance.

c) The competition and reward fund of each level within the Ministry shall be managed by the respective competition and reward agency; the source of contributions, ratio, and amount of contributions shall be based on the budget plan; settlement shall be based on actual expenditures in accordance with established regulations and policies.

Article 27. Use of the Competition and Reward Fund

1. The Competition and Reward Fund shall be used for:

a) Printing certificates, awards, medals, commemorative plaques, badges, competition flags, award frames.

b) Awarding cash prizes or mementos to individuals and groups.

c) The Ministry of Transport shall allocate funds for printing licenses, making award frames, competition flags, and badges for honors and reward forms decided by the Minister.

d) Organizing and directing competition movements: Up to 20% of the total Competition and Reward Fund at each level may be allocated for the following tasks:

- Expenses for organizing meetings of the Competition and Reward Council;

- Expenses for building, organizing, and implementing competition movements; training costs for competition and reward business; expenses for organizing meetings to sign competition agreements; summary meetings, final meetings, experience-sharing meetings, publicity, commendation, and promotion of exemplary models;

- Expenses for launching competition movements and rewards in phases, special topics, regularly, and at peak times within the industry, field, within the scope of agencies, organizations, ministries, sectors, localities; activities of cluster and group competitions and rewards; inspection, guidance, and supervision expenses for the implementation of competition movements and rewards;

- Other expenses directly serving the organization and direction of competition movements.

2. Collectives and individuals who are awarded rewards, in addition to being recognized with competition titles, Competition Flags, State Honorary Titles, Ho Chi Minh Awards, State Awards; receiving Orders, Medals, Certificates of Merit, Commemorative Plaques, and Letters of Commendation with accompanying frames, also receive monetary awards or equivalent gifts as stipulated in Articles 71, 72, 73, 75, and 76 of Decree No. 42/2010/NĐ-CP of the Government, according to the principle:

a) Higher competition titles and reward forms result in higher monetary awards.

b) Within the same form and level of reward, the monetary award for collectives is higher than that for individuals.

c) At the same time, for the same award recipient, if they achieve different competition titles and reward forms, they will receive monetary awards (or accompanying gifts) for each title and form with the highest award amount.

Example: In 2009, Mr. Nguyen Van A was recognized as "Outstanding Worker," then in 2009, he was recognized with the title "Model Competitor at the Grassroots Level." Therefore, he only received the monetary award for the title "Model Competitor at the Grassroots Level."

d) At the same time, if an individual achieves multiple competition titles with different times to achieve these titles, they will receive monetary awards for all titles.

Example: In 2007, 2008, and 2009, Mr. Nguyen Van A was awarded the title "Model Competitor at the Grassroots Level," and at the end of 2009, he was awarded the title "Model Competitor in the Transport Industry." Thus, Mr. Nguyen Van A received the monetary award for the title "Model Competitor at the Grassroots Level" in 2009 and the monetary award for the title "Model Competitor in the Transport Industry."

e) At the same time, if an individual achieves both a competition title and a reward form, they will receive monetary awards for both the competition title and the reward form.

Example: In 2009, Mr. Nguyen Van A was awarded the title "Model Competitor at the Grassroots Level" and also received a Certificate of Merit from the Minister in the same year. Therefore, Mr. Nguyen Van A received the monetary award for the title "Model Competitor at the Grassroots Level" and the monetary award for the Certificate of Merit from the Minister.

3. Overseas Vietnamese, foreign individuals and collectives, are awarded competition titles and reward forms accompanied by commemorative gifts.

Article 28. Management of the Competition and Reward Fund

1. The Cadre and Civil Servant Organization Department shall be responsible for advising the Minister to use the Competition and Reward Fund of the Ministry for its intended purposes and target groups to organize competition movements and serve reward work.

2. The Ministry's Office shall be responsible for managing the fund and coordinating with the Cadre and Civil Servant Organization Department to disburse rewards and other expenses serving competition and reward work as prescribed.

3. Heads of agencies and units under the Ministry of Transport who issue reward decisions shall be responsible for disbursing rewards from their own agency or unit’s reward funds.

Collectives and individuals awarded by the Minister, Prime Minister, or President shall have their respective levels responsible for deducting from the Competition and Reward Fund as prescribed to cover the rewards.

4. At year-end, unused portions of the Competition and Reward Funds at all levels shall be carried over to the following year for continued use in competition and reward work.

Article 29. Amounts for Rewards and Preferential Treatment

1. Rewards accompanying commendation titles and forms of recognition shall be implemented according to the provisions of Articles 70, 71, 72, 73, 74, 75, 76, and 77 of Decree No. 42/2010/NĐ-CP of the Government.

2. Personal benefits for those honored with the title "Transport Industry Model Competitor," "National Model Competitor," awarded medals, honorary titles of the State, "Ho Chi Minh Award," "State Award" shall, in addition to being recognized according to regulations, also be given priority for early salary advancement, selected for research, study, work, and professional training both domestically and internationally as guided by the Ministry of Home Affairs.

Chapter 7.

SETTLEMENT OF VIOLATIONS AND COMPLAINTS AND REPORTS ON COMPETITION AND REWARD

Article 30. Handling Violations Related to Competition and Reward

1. Collectives and individuals committing acts violating laws on competition and reward as stipulated in Clause 1 of Articles 80 and 81 of Decree No. 42/2010/NĐ-CP of the Government detailing implementation of certain articles of the Law on Competition and Reward and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward shall, depending on the degree of fault, bear one of the forms of violation handling prescribed in Clause 2 of the aforementioned articles.

2. Competition and Reward Councils at all levels and heads of agencies and units shall be responsible for reviewing and advising the competent authority to issue decisions on handling violations or proposing relevant state authorities to review and decide on handling.

3. Heads of agencies and units shall be responsible for publishing in their agency or unit’s newsletters, magazines, and other information media about the acts of violation and the form of handling for collectives and individuals who violate laws on competition and reward to be awarded commendation titles and forms of recognition within their decision-making authority.

Article 31. Settlement of Complaints and Reports on Competition and Reward

1. The Inspectorate of the Ministry of Transport shall advise and propose to the Minister of Transport on the settlement of complaints and reports related to competition and reward work within the scope of authority prescribed by law.

2. Competition and Reward Councils at all levels and the Cadre and Civil Servant Organization Department shall be responsible for coordinating with inspection bodies at the same level in settling complaints and reports on competition and reward.

3. Procedures, formalities, deadlines, and files for settling complaints and reports on competition and reward shall be implemented according to the provisions of the law on complaints and reports.

Chapter 8.

IMPLEMENTING PROVISIONS

Article 32. Effectiveness

This Circular takes effect from September 1, 2012.

Article 33. Responsibility for Implementation

1. The Standing Office of the Ministry of Transport's Steering Committee for Competitiveness and Awards shall assist the Minister of Transport in organizing the monitoring, inspection, and urging of units under the Ministry of Transport, provincial Departments of Transport under centrally governed cities and provinces, in implementing this Circular.

2. The Director of the Department, the Inspector General of the Ministry, Heads of agencies and units under the Ministry, Directors of provincial Departments of Transport under centrally governed cities and provinces, and related organizations and individuals are responsible for implementing this Circular./.
