The Prime Minister issues this Decision to stipulate the amount of one-time allowance for individuals with achievements in the resistance war who have been awarded Commendation Certificates by the Prime Minister,

Article 1. Scope of Application and Regulatory Scope
Commendation Certificates by the Chairman of the Council of Ministers (referred to collectively as Commendation Certificates by the Prime Minister) or Commendation Certificates by Ministers, Heads of ministries equivalent to ministries, Heads of government agencies (referred to collectively as Commendation Certificates by the ministerial level), or Commendation Certificates by the Chairpersons of People's Committees of provinces and centrally governed cities (referred to collectively as Commendation Certificates by the provincial level).of the National Assembly;Article 2. Procedures, formalities, and authority for payment of allowances
1. Application dossier (one set) includes:
a) Personal declaration form (Annex) of the individual awarded a Commendation Certificate by the Prime Minister, the ministerial level, or the provincial level (collectively referred to as the individual with a Commendation Certificate);
In case the individual with a Commendation Certificate has passed away: Personal declaration form of the representative of the next-of-kin accompanied by a power of attorney (in accordance with Model UQ issued together with Circular No.
05/2013/TT-BLĐTBXHdated May 15, 2013 of the Ministry of Labor, Invalids and Social Affairs guiding procedures for establishing files, managing files, and implementing preferential policies for those who have rendered meritorious services to the revolution and their dependents).Next-of-kin of the deceased individual with a Commendation Certificate is one of the following: spouse; father, mother; biological or adopted children of the deceased.
b) A copy of one of the following documents: Commendation Certificate of
the Prime Minister, the ministerial level, the provincial level, or the award decision. 2. Procedures and formalities:
a) The individual with a Commendation Certificate or the representative of the next-of-kin shall submit the personal declaration form along with the documents specified in Clause 1 of this Article to the People's Committee of the commune where the individual with a Commendation Certificate is registered as a permanent resident (or the People's Committee of the commune where the deceased individual with a Commendation Certificate was last registered as a permanent resident).
b) The People's Committee of the commune shall, within five days from the date of receipt of complete and valid documents, be responsible for checking, confirming the personal declaration form, and compiling a list along with the documents specified in point a of this clause and send it to the Department of Labor, Invalids and Social Affairs.
c) The Department of Labor, Invalids and Social Affairs shall, within seven days from the date of receipt of complete documents, be responsible for checking, compiling a list along with the documents specified in point b of this clause and send it to the Department of Labor, Invalids and Social Affairs of the province.
d) The Department of Labor, Invalids and Social Affairs of the province shall, within ten days from the date of receipt of complete documents, be responsible for checking and issuing a one-time allowance decision.
3. Authority for payment of allowances:
Local labor, invalids, and social affairs authorities are responsible for paying the one-time allowance stipulated in this Decision.
The local Labor - Invalids and Social Affairs authority is responsible for disbursing the one-time allowance prescribed in this Decision.
Article 3. One-time allowance amount
1. Allowance amount:
a) The one-time allowance for individuals awarded a Certificate of Merit by the Prime Minister is VND 1,815,000 (in words: One million eight hundred fifteen thousand dong only).
b) The one-time allowance for individuals awarded a Certificate of Merit by a ministry or a provincial Certificate of Merit is VND 1,210,000 (in words: One million two hundred ten thousand dong only).
2. In cases where an individual who has been awarded a Certificate of Merit has passed away without having received the one-time allowance as stipulated in this Decision, their legal representative shall be entitled to receive the allowance according to the provisions of Clause 1 of this Article.
3. Individuals participating in the resistance war who have been awarded Medals or War Resistance Medals shall not be eligible for the one-time allowance as prescribed in this Decision.
Article 4. Source of Funding
1. Individuals awarded a Certificate of Merit by the Prime Minister and a ministry Certificate of Merit: The central budget shall ensure and supplement specifically for localities to pay out.
2. Individuals awarded a provincial Certificate of Merit: The local budget shall ensure funding. The central budget will provide supplementary support specifically for localities with financial difficulties according to the following mechanism:
a) Support 100% of the required funds for localities that have not yet achieved budget self-balancing and the province of Quảng Ngãi.
b) Support 50% of the required funds for localities with a ratio of revenue adjustment to the central budget below 50%.
c) Other localities: Local budgets shall ensure funding themselves.
3. Based on reports from localities, the Ministry of Finance shall submit to the competent authority for supplementary specific funding for localities to implement the one-time allowance system and payment costs as prescribed.
4. The cost for reviewing and paying out the one-time allowance as stipulated in this Decision shall be 1.7% of the total payment funds for beneficiaries.
State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.
1. The Ministry of Labor, Invalids and Social Affairs shall take the lead and coordinate with the Ministry of Home Affairs and the Ministry of Finance to direct and guide localities in conducting reviews, compiling lists, and preparing files for the one-time allowance as prescribed in this Decision.
2. Provincial People's Committees shall direct the organization of reviews and implementation of the one-time allowance as prescribed in this Decision.
3. The Ministry of Labor, Invalids and Social Affairs and the Ministry of Home Affairs shall be responsible for directing and guiding the timely resolution of any issues arising in the preparation of files, confirmation of files, review, and implementation of the one-time allowance as prescribed in this Decision.
4. The Ministry of Finance shall be responsible for ensuring the balance of funding sources to implement the one-time allowance as prescribed in this Decision.
Article 6. Effectiveness
1. This Decision takes effect from August 1, 2016.
2. Ministers, heads of ministerial-level agencies, heads of agencies under the Government, Chairpersons of provincial and centrally-run city People's Committees are responsible for implementing this Decision./
