AMENDMENTS AND SUPPLEMENTS TO CERTAIN ARTICLES OF CIRCULAR NO. 45/2015/TT-BLDTBXH DATED NOVEMBER 11, 2015 ISSUED BY THE MINISTER OF LABOR, WAR INVALIDS AND SOCIAL AFFAIRS GUIDING THE IMPLEMENTATION OF CERTAIN PROVISIONS ON THE NATIONAL EMPLOYMENT FUND AS PROVIDED FOR IN DECREE NO. 61/2015/NĐ-CP DATED JULY 9, 2015 OF THE GOVERNMENT ON EMPLOYMENT SUPPORT POLICIES AND THE NATIONAL EMPLOYMENT FUND
Pursuant to Decree No. 14/2017/NĐ-CP dated February 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, War Invalids and Social Affairs,Director of the General Department of Vocational Education;
Pursuant to Decree No. 61/2015/NĐ-CP dated July 9, 2015 of the Government stipulating employment support policies andthe National Employment Fund;
At the proposal of the Director of the Employment Department,
The Minister of Labor, War Invalids and Social Affairs issues this Circular amending and supplementing certain articles of Circular No. 45/2015/TT-BLDTBXH dated November 11, 2015 issued by the Minister of Labor, War Invalids and Social Affairs guiding the implementation of certain provisions on the National Employment Fund as provided for in Decree No. 61/2015/NĐ-CP dated July 9, 2015 of the Government stipulating employment support policies and the National Employment Fund (hereinafter referred to as Circular No. 45/2015/TT-BLDTBXH).Article 1. Amend and supplement certain articles of Circular No. 45/2015/TT-BLDTBXH and the accompanying forms."a) For ethnic minority people residing in areas with particularly difficult socio-economic conditions, a copy of the identity card or passport or household registration book or temporary residence certificate;"
2. Amend and supplement Point b Clause 2 Article 4 as follows:
"a) Reviewing and examining files:
"b) For production and business establishments employing 30% or more of the total workforce as ethnic minority people including: list of ethnic minority workers, copies of identity cards or passports or household registration books or temporary residence certificates and copies of labor contracts or recruitment decisions of those workers listed;"
3. Amend and supplement Point c Clause 2 Article 4 as follows:
"c) For production and business establishments employing 30% or more of the total workforce as persons with disabilities and ethnic minority people including: list of workers with disabilities and ethnic minority people, copies of disability confirmation certificates of those workers with disabilities issued by the People's Committee at the commune level, copies of identity cards or passports or household registration books or temporary residence certificates of those workers who are ethnic minorities and copies of labor contracts or recruitment decisions of those workers listed."
4. Amend and supplement Form No. 01b, Form No. 02 and Form No. 03b issued together with Circular No. 45/2015/TT-BLDTBXH to become Form No. 01b, Form No. 02 and Form No. 03b issued together with this Circular.
2. Departments of Labor, War Invalids and Social Affairs and related agencies, enterprises, organizations, and individuals shall be responsible for implementing this Circular.
In the course of implementation, if there are difficulties, please report to the Ministry of Labor, War Invalids and Social Affairs for timely guidance./.
Article 2. Effectiveness and responsibility for implementation
1. This Circular takes effect from October 15, 2017.
2. The Department of Labor - Invalids and Social Affairs and related agencies, enterprises, organizations, and individuals shall be responsible for implementing this Circular.
In the course of implementation, if there are any difficulties, they are requested to report to the Ministry of Labor - Invalids and Social Affairs for timely guidance./.
