DECREE

Detailed regulations on some provisions of the Law on Prevention and Control of Harmful Effects of Alcohol and Beer

||| Pursuant to the Law on Organization of the Government dated June 19, 2015;

BASED ON THE LAW ON PREVENTION AND CONTROL OF HARM CAUSED BY ALCOHOL AND BEER dated June 14, 2019;

At the proposal of the Minister of Health,

The Government promulgates this Decree to provide detailed regulations on some provisions of the Law on Prevention and Control of Harmful Effects of Alcohol and Beer.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Decree provides detailed regulations on some provisions of the Law on Prevention and Control of Harmful Effects of Alcohol and Beer regarding certain measures to reduce consumption levels and manage the supply of alcohol and beer, including public places where drinking alcohol and beer is not allowed; restrictions on using images of actors consuming alcohol and beer in film, theater, and television works; management of advertising for alcohol with an alcohol content below 15 degrees and beer; implementation of measures to prevent individuals under 18 years old from accessing, searching for, and purchasing alcohol and beer in commercial electronic transactions; contents and funding levels for activities to prevent and control harmful effects of alcohol and beer; responsibilities for information dissemination, education, communication, and state management in preventing and controlling harmful effects of alcohol and beer.

Article 2. Applicability

This Decree applies to agencies, organizations, and individuals related to activities to prevent and control harmful effects of alcohol and beer.

Chapter II

CERTAIN MEASURES TO REDUCE CONSUMPTION LEVELS AND MANAGE THE SUPPLY OF ALCOHOL AND BEER

AND THE MANAGEMENT OF ALCOHOL AND BEER SUPPLY

Article 3. Public Places Where Drinking Alcohol and Beer Is Not Allowed

In addition to the locations specified in Clauses 1, 2, 3, 4, 5, and Clause 6, Article 10 of the Law on Prevention and Control of Harmful Effects of Alcohol and Beer, public places where drinking alcohol and beer is not allowed include:

1. Parks, except for restaurants within the park premises that have been granted permission to operate before the effective date of this Decree.

2. Bus stops.

3. Cinemas, theaters, cultural and sports facilities during the time they organize activities according to their main functions, tasks, and usage purposes, except for food festivals, cultural events that use alcohol and beer.

Article 4. Restrictions on Images of Actors Consuming Alcohol and Beer in Film, Theater, and Television Works

1. The use of images of actors consuming alcohol and beer in film, theater, and television works must comply with the following requirements:

a) Not depicting prohibited acts as stipulated in Article 5, drinking alcohol and beer at locations specified in Article 10, selling alcohol and beer at locations specified in Article 19 of the Law on Prevention and Control of Harmful Effects of Alcohol and Beer, or drinking alcohol and beer in stage, film, and television works intended for persons under 18 years old, except when such depictions are aimed at criticizing or condemning these behaviors;

b) Not praising organizations or individuals who have succeeded through the production or sale of alcohol and beer;

c) The use of images of actors consuming alcohol and beer for artistic purposes may only be carried out when necessary to portray historical characters or to recreate a specific historical period, or to criticize or condemn the act of drinking alcohol and beer;

d) The use of images of actors consuming alcohol and beer for artistic purposes outside the cases specified in point c of this clause must be approved by the competent authority based on the recommendation of the Film Review Board in accordance with the Cinema Law, or by the competent authority granting permission for artistic performances in accordance with Decree No. 15/2016/NĐ-CP dated March 15, 2016, of the Government amending and supplementing certain articles of Decree No. 79/2012/NĐ-CP dated October 5, 2012, of the Government on artistic performances, fashion shows; beauty pageants and modeling; circulation and business of audio and video recordings of music, dance, and theater. Approval of images of actors consuming alcohol and beer for artistic purposes shall be integrated into the process of reviewing, licensing, and approving film, stage, and television works in accordance with the law and ensuring no additional administrative procedures are created.

2. The degree of appearance of scenes depicting actors consuming alcohol and beer in the cases specified in points c and d of Clause 1 of this Article serves as a criterion for classifying films for age-appropriate distribution, which is incorporated into the film classification criteria according to the guidelines of the Minister of Culture, Sports and Tourism.

Article 5. Certain management measures for advertising alcohol with an alcohol content below 15 degrees and beer

1. In addition to the cases prescribed in point c, Clause 3, Article 12 of the Law on Prevention and Control of Harmful Effects of Alcohol and Beer, advertising alcohol and beer with an alcohol content below 5.5 degrees on radio and television programs from 18:00 to 21:00 daily includes advertising alcohol and beer sponsored by units at the location of sports congresses, regional, continental, or world-scale sports competitions held in Vietnam and broadcast live on radio and television.

2. Advertising alcohol and beer with an alcohol content below 5.5 degrees on outdoor advertising media must comply with the following provisions:

a) The size of the advertising sign shall be implemented according to the national technical standards for advertising media.

b) Ensuring a minimum distance of 200 meters from the placement point of the advertising medium to the nearest boundary of the kindergarten education facility, general education facility, care, nurturing, and entertainment area for persons under 18 years old; a minimum of 100 meters from the placement point of the advertising medium to the nearest boundary of the vocational education facility, higher education institution, except for the signboard of the business establishment selling alcohol and beer. In cases where alcohol and beer advertisements have been placed on outdoor advertising media within the above-mentioned distance range before this Decree takes effect, they may continue to be implemented until the advertising contract expires and shall not be renewed.

3. Advertising alcohol with an alcohol content below 15 degrees and beer must include warnings to prevent and control harmful effects of alcohol and beer, ensuring the following provisions:

a) One of the following warning contents: "drinking alcohol and beer can cause traffic accidents," "drinking alcohol and beer can affect the health of the fetus," "persons under 18 years old are not allowed to drink alcohol and beer."

b) Advertising alcohol and beer on radio, television, and recorded audio and video products must clearly read out the warning content as stipulated in point a of this clause at a reading speed equivalent to that of other contents in the same advertisement.

c) Advertising alcohol and beer on television, online newspapers, information websites, social networks, radio with images, electronic devices, terminal equipment, and other telecommunications equipment with images, recorded video products must display the warning content as stipulated in point a of this clause in contrasting colors with the background, ensuring visibility and occupying at least 10% of the advertisement area. In cases of advertising alcohol and beer on television, the warning content in writing must be displayed across the full width of the screen.

d) Advertising at alcohol and beer sales locations must include the warning content as stipulated in point a of this clause in clear and legible writing or recorded audio and video advertisements meeting the requirements specified in points b and c of this clause.

đ) Other advertising alcohol and beer outside the cases prescribed in points b, c, and d of this clause must include the warning content as stipulated in point a of this clause in clear and legible writing.

4. Advertising alcohol and beer on online newspapers, information websites, social networks, electronic devices, terminal equipment, and other telecommunications equipment must have a technological system for filtering and age control software to prevent persons under 18 years old from accessing, searching for information about alcohol and beer, ensuring the following requirements:

a) Not displaying advertisements before the user reports their age when accessing or searching for information.

b) Advertisements shall not be linked or promoted to user accounts under 18 years old; pages, channels, and other information media on the internet dedicated to persons under 18 years old or predominantly used and accessed by persons under 18 years old.

c) In cases where alcohol and beer advertisements were implemented before this Decree took effect and did not meet the requirements specified in points a and b of this clause, they may continue to be implemented until the advertising contract expires and shall not be renewed.

Article 6. Implement preventive measures to prevent persons under 18 years old from accessing, searching for information, and purchasing alcohol in commercial electronic transactions.

Organizations and individuals selling alcohol through commercial electronic transactions; organizations and individuals providing electronic commerce services for other merchants, organizations, and individuals selling alcohol must implement preventive measures to ensure that persons under 18 years old cannot access, search for information, and purchase alcohol, meeting the following requirements:

1. Have an application for users to declare their name and age before they access and search for information; declare information about the buyer's name, residential address, payment details via bank accounts, credit cards, or other non-cash payment methods when conducting transactions to purchase alcohol.

2. Information about alcoholic products on the electronic commerce websites of organizations and individuals selling alcohol shall not be linked or promoted to user accounts under 18 years old; pages, channels, and means of communication on the internet specifically targeting persons under 18 years old or predominantly used and accessed by those under 18 years old.

3. Organizations and individuals selling alcohol have the responsibility to check the age of the recipient in cases where there is doubt about the recipient's age, ensuring that the recipient must be at least 18 years old when delivering the goods.

4. By no later than June 30, 2020, organizations and individuals selling alcohol through commercial electronic transactions that were operating prior to the effective date of this Decree shall be responsible for implementing the provisions of Clauses 1, 2, and Clause 3 of this Article.

Chapter III

CONTENT AND AMOUNT OF EXPENSES

FOR ACTIVITIES TO PREVENT AND CONTROL THE HARM CAUSED BY ALCOHOL

Article 7. Content of expenses for activities to prevent and control the harm caused by alcohol

1. The content of expenses for activities to prevent and control the harm caused by alcohol includes:

a) Building, disseminating, and organizing the implementation of policies, laws, and plans regarding the prevention and control of the harm caused by alcohol;

b) Organizing the implementation of measures to prevent and control the harm caused by alcohol;

c) Information, education, and communication activities about the prevention and control of the harm caused by alcohol within communities, agencies, and organizations;

d) Organizing contests and initiatives to understand and prevent the harm caused by alcohol;

đ) Activities to provide advice on the harm caused by alcohol, early screening and detection of risk factors for health among alcohol drinkers, interventions to reduce harm for people with health risks at primary healthcare facilities and in the community; early screening, counseling, prevention, and treatment interventions, and functional recovery for people suffering from diseases and functional disorders related to alcohol consumption, preventing addiction, relapse, and caring for the health of alcoholics at medical examination and treatment facilities;

e) Community health models limiting the use of alcohol;

g) Statistics, collection, and analysis of information and data related to the production, business operations, and consumption of alcohol; the current situation of alcohol use and its impact on health, society, and the economy due to alcohol consumption, conducted every five years and annually as a basis for building and perfecting policies and laws on the prevention and control of the harm caused by alcohol, health care for the people, ensuring security, social order, and other social issues;

h) Training, capacity building, and training on the prevention and control of the harm caused by alcohol;

i) Scientific research and international cooperation on the prevention and control of the harm caused by alcohol;

k) Awarding collectives and individuals who have made achievements in the prevention and control of the harm caused by alcohol;

l) Prevention and handling of counterfeit alcohol, alcohol not meeting quality and food safety standards, and illegal imported alcohol of unknown origin;

m) Inspection, supervision, handling of violations of the law, and resolution of complaints and denunciations in the prevention and control of the harm caused by alcohol;

n) Summarizing and concluding the implementation of work to prevent and control the harm caused by alcohol.

2. The content and amount of expenses for special activities specified in Points c, d, đ, and e of Clause 1 of this Article shall be implemented according to Articles 8, 9, 10, 11, 12, and Article 13 of this Decree. The content and amount of expenses for other activities specified in Clause 1 of this Article shall be implemented according to the current expenditure regulations of state agencies, public service units, and relevant laws.

3. Based on the local budget balance capability and actual conditions, the People's Councils of provinces and centrally-administered cities may consider and decide within their authority to set higher expense levels than those stipulated in this Decree.

4. The content and amount of expenses for activities to prevent and control the harm caused by alcohol funded from sponsor funds or other lawful sources shall be implemented according to the regulations of the sponsoring unit and relevant laws.

Article 8. Content and expenditure levels for information, education, and communication activities about preventing the harmful effects of alcohol at the community, agency, and organization level.

1. The content and expenditure levels for remuneration for building newsletters, reports, and roundtable discussions on preventing the harmful effects of alcohol shall be implemented according to the provisions of Government Decree No. 18/2014/NĐ-CP dated March 14, 2014, which stipulates remuneration systems in the field of journalism and publishing, and related documents.

2. Expenditure for organizing meetings, rallies, and promotional events on preventing the harmful effects of alcohol:

a) Expenditure for drinking water for participants: VND 20,000/person/session; expenditure for participant fees: VND 50,000/person/session;

b) Expenditure for speakers: VND 200,000/person/session;

c) Expenditure for materials: up to VND 15,000/person;

d) Expenditure for renting conference halls, backdrops, tents, tables, chairs, and audio equipment (if applicable): The expenditure level shall be carried out according to contracts, receipt vouchers, or financial invoices (in cases of service rental);

đ) Expenditure for radio broadcasting (production, editing, broadcasting): Production and editing expenditure level is VND 100,000/page of 350 words; allowance for broadcasters is VND 20,000/per session;

e) Expenditure for producing and printing communication materials shall be based on local market prices and legal regulations.

3. Expenditure for supporting artistic performances and skits in the community on preventing the harmful effects of alcohol:

a) Allowance for rehearsing new programs: The maximum allowance for one session of rehearsing a new program is VND 70,000/person/session. The maximum number of rehearsal sessions for a new program is 10 sessions;

b) Maximum allowance during performance programs is VND 150,000/person/session.

4. Expenditure for hosting programs and artistic performances at rallies and communication campaigns on preventing the harmful effects of alcohol:

a) Hosting programs: VND 2,000,000/person/session;

b) Artistic performances: VND 300,000/person/session. The total number of rehearsal and performance sessions for one artistic program is a maximum of 10 sessions.

5. Expenditure for supporting the activities of mobile propaganda teams during community-wide awareness campaigns at agencies, units, and organizations:

a) Expenditure for those directly participating in mobile propaganda teams on preventing the harmful effects of alcohol in the community: allowance for participation in propaganda sessions is VND 100,000/person/session; allowance for training propaganda is VND 50,000/person/session;

b) Expenditure for fuel, vehicle rental, photographing reference materials, propaganda equipment, and other activities based on actual expenses, invoices, local market prices, and legal regulations.

6. Remuneration for collaborators participating in propaganda work on preventing the harmful effects of alcohol according to the Ministry of Health's guidelines for propaganda collaborators: VND 150,000/person/month.

Article 9. Only organize contests to understand and innovate on preventing the harmful effects of alcohol.

1. Compiling test questions and answers (if any): Maximum expenditure is VND 1,000,000/test question.

2. Allowance for marking tests, contest judges, and reviewing test results: Maximum expenditure is VND 500,000/person/session.

3. Allowance for members of the organizing committee and secretaries of the contest: Maximum expenditure is VND 350,000/person/session.

4. Prize expenditures:

a) For central-level contests: Group prize maximum is VND 20,000,000/prize; individual prize maximum is VND 15,000,000/prize;

b) For provincial-level contests: Group prize maximum is VND 10,000,000/prize; individual prize maximum is VND 5,000,000/prize;

c) For district-level contests: Group prize maximum is VND 5,000,000/prize; individual prize maximum is VND 2,000,000/prize;

d) For grassroots-level contests: Group prize maximum is VND 2,000,000/prize; individual prize maximum is VND 1,000,000/prize.

5. Expenditure for compiling and reporting contest results: Maximum expenditure is VND 1,000,000/report.

6. Expenditure for supporting food, accommodation, and travel for members of the organizing committee and examination board during the contest period, implemented according to current regulations of the Ministry of Finance regarding travel allowances for state officials, civil servants, and public employees.

7. Expenditure for supporting food, accommodation, and travel for contestants during the contest (including practice and exam days, a maximum of 10 days), applied according to the current regulations of the Ministry of Finance regarding allowances for non-salaried delegates at conferences and travel expenses. Those who have received such support shall not be reimbursed travel expenses from their agencies.

8. Collecting information, materials, and establishing a database for electronic information (for online contests) shall be carried out according to legal regulations.

9. Renting hosts: VND 2,000,000/person/session.

10. Renting conference halls and equipment for stage competitions: Expenditure level based on actual expenses according to invoices and receipts.

11. Renting performers for artistic performances: VND 300,000/person/session. The total number of rehearsal and performance sessions for one program is a maximum of 10 sessions.

12. Other expenditures serving the contest shall be implemented according to current state regulations. In cases where there are no specified expenditure levels, the head of the contest organizing agency shall decide the expenditure level within the allocated state budget estimate.

13. Depending on the scale of the contest organization (central, provincial, district, grassroots), the competent authority shall decide the specific expenditure level and shall not exceed the maximum expenditure level stipulated in this article.

Article 10. Content and expenditure levels for alcohol and beer addiction counseling activities

1. Expenditure to establish counseling rooms and units: telephones, computers, equipment, materials in accordance with laws on bidding and state budget.

2. Expenditure level for building and printing materials serving alcohol and beer addiction counseling activities based on actual needs and in line with the content of counseling.

3. Expenditure for remuneration of those conducting alcohol and beer addiction counseling:

a) Expenditure for alcohol and beer addiction counselors under labor contracts. The wage rate and allowances of workers are paid according to agreements based on productivity, quality, and effectiveness of work and relevant laws on salary and wage systems;

b) Expenditure for medical staff participating in alcohol and beer addiction counseling working overtime and night shifts in accordance with the Labor Code and guidance documents on payment for night work and overtime for civil servants, public officials, and employees.

4. Expenditure for electricity, water, office supplies, and photocopying materials to maintain operations: The expenditure level is based on actual needs but not exceeding 5,000,000 VND/month/per facility.

5. Expenditure for the hotline providing alcohol and beer addiction counseling based on actual needs and in line with the content and duration of counseling.

Article 11. Expenditure for screening and early detection of risk factors affecting the health of alcohol and beer drinkers; individuals suffering from diseases and functional disorders due to alcohol and beer consumption; and individuals addicted to alcohol and beer

1. Expenditure for purchasing equipment, materials, documents, and office supplies in accordance with laws on the state budget and bidding.

2. Expenditure for building and printing materials serving screening and early detection activities based on actual needs and in line with the specialized content.

3. Expenditure for remuneration of those conducting screening:

a) Expenditure for staff under labor contracts: The wage rate and allowances of workers are paid according to agreements based on productivity, quality, and effectiveness of work and relevant laws on salary and wage systems;

b) Supplementary expenditure for medical staff and volunteers participating in screening activities: 20,000 VND/per person/per session;

c) Supplementary expenditure for medical staff participating in screening activities working night shifts and overtime in accordance with the Labor Code and guidance documents on payment for night work and overtime for civil servants, public officials, and employees.

4. Expenditure for implementing clinical techniques according to the Ministry of Health's procedures for individuals with health insurance cards covered by health insurance payments as stipulated by the Minister of Health.

Article 12. Expenditure for developing and implementing community health initiatives and models limiting alcohol and beer consumption

1. Expenditure for researching and developing community health initiatives and models limiting alcohol and beer consumption carried out in accordance with laws on the content and expenditure levels for research, investigation, survey, and evaluation activities.

2. Expenditure for drafting proposals and projects for community health initiatives and models limiting alcohol and beer consumption: Maximum expenditure of 20,000,000 VND/proposal, project.

3. Expenditure for volunteers participating in implementing initiatives and models: Expenditure based on actual days of participation, 100,000 VND/day or fixed monthly expenditure of 2,000,000 VND/month.

4. Other expenditures are implemented based on actual needs, supported by invoices and receipts, and in accordance with relevant laws.

Article 13. Funding for the Operation of the Steering Committee for Preventing and Combating the Harms of Alcohol

The level of funding for organizing meetings, conferences, travel expenses when conducting supervision and inspection of alcohol harm prevention and control work according to the assigned tasks of the Steering Committee, and other lawful expenditures shall be implemented in accordance with the laws on the state budget and the laws on the activities of inter-sectoral coordination organizations.

Chapter IV

RESPONSIBILITIES FOR IMPLEMENTING INFORMATION, EDUCATION, AND COMMUNICATION AND THE RESPONSIBILITIES OF STATE MANAGEMENT IN PREVENTING AND COMBATING THE HARMS OF ALCOHOL

AND THE RESPONSIBILITY FOR STATE MANAGEMENT IN PREVENTING AND COMBATING

THE HARM CAUSED BY ALCOHOL AND BEER

Article 14. Responsibilities for Implementing Information, Education, and Communication on Preventing and Combating the Harms of Alcohol

1. Ministries, ministerial-level agencies, provincial People's Committees, and municipal People's Committees under the central government shall organize information, education, and communication on preventing and combating the harms of alcohol in accordance with their functions, tasks, sectors, and areas of management.

2. Heads of agencies and organizations shall proactively organize and participate in implementing information, education, and communication on preventing and combating the harms of alcohol in accordance with their functions, tasks, sectors, and areas of management:

a) Organize information, education, and communication on preventing and combating the harms of alcohol to meet the objectives, requirements, and contents stipulated in the Law on Preventing and Combating the Harms of Alcohol through appropriate forms suitable for the target audience and actual conditions of the locality.

b) Incorporate activities related to information, education, and communication on preventing and combating the harms of alcohol into annual activity plans of the agency or unit.

c) Create favorable conditions and encourage individuals and units within the organization to actively participate in campaigns and communication activities on preventing and combating the harms of alcohol.

3. Educational institutions shall organize information, education, and communication on the harms of alcohol and preventing and combating the harms of alcohol in accordance with the age group of students and trainees.

4. Healthcare facilities shall organize information, education, and communication on the harms of alcohol and preventing and combating the harms of alcohol for patients, patient families, and people seeking medical care and using services in accordance with the specialized field and service recipients of the healthcare facility.

5. Individuals and families shall participate and respond to activities related to information, education, and communication on preventing and combating the harms of alcohol.

Article 15. General Responsibilities of Ministries, Ministerial-Level Agencies, and Government Agencies in State Management of Preventing and Combating the Harms of Alcohol

1. Issue or submit to competent authorities for issuance and implementation of policies, plans, and normative legal documents on preventing and combating the harms of alcohol within their authority.

2. Organize training, instruction, and professional development on preventing and combating the harms of alcohol within their assigned management sectors.

3. Organize information dissemination, publicity, and legal education on preventing and combating the harms of alcohol.

4. Conduct inspections, commendations, and handle violations of laws on preventing and combating the harms of alcohol within their assigned management functions, tasks, and sectors.

5. Report regularly and promptly on work related to preventing and combating the harms of alcohol within their assigned management sectors.

Article 16. Responsibilities of the Ministry of Health for State Management

1. Submit to the Government and the Prime Minister for issuance, and issue within its authority, legal normative documents and policies on preventing and combating the harmful effects of alcohol and beer.

2. Develop and guide the implementation of programs, plans, and activities on preventing and combating the harmful effects of alcohol and beer.

3. Take the lead and coordinate with other ministries, sectors, provincial People's Committees in organizing information, education, and communication on preventing and combating the harmful effects of alcohol and beer; serve as the focal point for building the content of model and standard materials on preventing and combating the harmful effects of alcohol and beer for informational, educational, and communicative purposes; develop proposals for organizing communication campaigns on preventing and combating the harmful effects of alcohol and beer to be submitted to the Prime Minister for issuance and guidance on their nationwide implementation; organize the provision of scientific information and recommendations to the public and community about the harmful effects of alcohol and beer, levels of risk associated with drinking, individuals, diseases, and health conditions that should not consume alcohol and beer, measures to reduce the harmful effects of alcohol and beer.

4. Provide professional guidance on screening, early detection, prevention, intervention treatment, functional recovery, addiction prevention, relapse prevention, and healthcare for alcohol and beer addicts.

5. Organize the establishment and maintenance of a system for collecting and analyzing information and data on the current status of alcohol and beer consumption and their impact on health, society, and economy, including drinking rates, hazardous drinking rates, risk factor rates, alcohol and beer-related disorders among drinkers, and other necessary indicators every five years as a basis for developing and improving policies and laws on preventing and combating the harmful effects of alcohol and beer.

6. Inspect and urge the implementation of activities on preventing and combating the harmful effects of alcohol and beer by ministries, sectors, and localities; compile and report to the Government on the results of work on preventing and combating the harmful effects of alcohol and beer.

Article 17. Responsibilities of the Ministry of Industry and Trade for State Management

1. Submit to the Government and the Prime Minister for issuance, and issue within its authority, legal normative documents on managing the business of alcohol and beer and preventing and combating the harmful effects of alcohol and beer in production and business; issue national technical standards, food safety limits for alcohol and beer, and organize their implementation.

2. Manage business conditions for alcohol and beer; food safety; promotions and sponsorships; product labeling; locations, subjects, and methods prohibited from selling alcohol and beer; prevent and handle illegal imports, counterfeit, substandard, and unsafe alcohol and beer; ensure compliance with distance requirements when opening new premises for on-site consumption of alcohol and beer as stipulated in Clause 7, Article 32 of the Law on Preventing and Combating the Harmful Effects of Alcohol and Beer.

3. Aggregate statistical data on homemade alcohol not for commercial purposes; direct, guide, and urge the implementation of measures to strengthen management over the production of homemade alcohol nationwide.

4. Organize information, education, and communication on preventing and combating the harmful effects of alcohol and beer in the field of managing the business of alcohol and beer; guide households and individuals producing homemade alcohol to ensure food safety according to the law; promote, mobilize, and guide households and individuals producing homemade alcohol to apply for production licenses and register with commune-level People's Committees for selling homemade alcohol to licensed production establishments for further processing; declare the production of homemade alcohol not for commercial purposes.

5. Organize the establishment and maintenance of a system for collecting and analyzing information and data related to the production and business of alcohol and beer as a basis for developing and improving policies and laws on preventing and combating the harmful effects of alcohol and beer.

Article 18. Responsibilities of the Ministry of Public Security for State Management

1. Organize the implementation of state management functions regarding the prevention and control of the harmful effects of alcohol and beer within its jurisdiction and measures for state management to prevent traffic accidents related to the consumption of alcohol and beer; direct the strengthening of patrol and supervision measures, and handling of violations concerning blood alcohol concentration and breath alcohol content of motor vehicle drivers.

2. Organize information dissemination, propaganda, popularization, and education for the public on knowledge and laws related to blood alcohol concentration and breath alcohol content of motor vehicle drivers, penalties for violations, and encourage the public to comply with legal regulations.

Article 19. Responsibilities of the Ministry of Education and Training for State Management

1. Develop content and organize information dissemination, education, and communication about the harmful effects and prevention of the harmful effects of alcohol and beer suitable for the age group of students and trainees.

2. Guide counseling skills and methods to identify children, students, and trainees at educational institutions affected by the harmful effects of alcohol and beer.

3. Coordinate with relevant agencies and organizations to implement care, support, and protection for children, students, and trainees to prevent and reduce the harmful effects of alcohol and beer.

4. Direct, inspect, and supervise the prohibition of drinking and selling alcohol and beer in educational institutions as stipulated by law.

Article 20. Responsibilities of the Ministry of Labor, Invalids and Social Affairs for State Management

1. Take the lead and coordinate with relevant agencies and organizations to guide and organize the implementation of measures to prevent and control the harmful effects of alcohol and beer for children and the elderly.

2. Develop content and organize information dissemination, education, and communication about the harmful effects and prevention of the harmful effects of alcohol and beer suitable for the age group of learners in vocational education institutions; organize information dissemination, education, and communication for workers on the harmful effects of alcohol and beer, not to drink alcohol and beer immediately before, during working hours and study sessions, and during breaks, and not to operate machinery after consuming alcohol and beer.

3. Direct, inspect, and supervise the prohibition of drinking and selling alcohol and beer in vocational education institutions and the prohibition of using labor from individuals under 18 years old directly involved in the production, purchase, and sale of alcohol and beer.

Article 21. Responsibilities of the Ministry of Culture, Sports and Tourism for State Management

1. Implement measures for controlling advertisements for alcohol and beer within its jurisdiction.

2. Incorporate information dissemination, education, and communication on preventing and controlling the harmful effects of alcohol and beer and measures to limit their use into cultural, sports, tourism activities, and family life; guide and mobilize communities to limit or refrain from drinking alcohol and beer at funerals, weddings, and festivals; guide and inspect the implementation of restrictions on images of drinking alcohol and beer in film, stage, and television products.

Article 22. Responsibilities of the Ministry of Information and Communications for State Management

1. Implement measures for controlling advertisements within its jurisdiction; direct the strengthening of measures to detect and handle violations concerning alcohol and beer advertising on online platforms.

2. Organize the implementation of measures for information dissemination, education, and communication on preventing and controlling the harmful effects of alcohol and beer; direct media and press agencies to carry out propaganda and dissemination on preventing and controlling the harmful effects of alcohol and beer.

Article 23. Responsibilities of the Ministry of Transport in State Management

1. Organizing the implementation of preventive measures against traffic accidents related to the use of alcohol within its area of management.

2. Developing content and organizing training on preventing and combating the harmful effects of alcohol in the driver's license training program.

Article 24. Responsibilities of the Ministry of Finance in State Management

Responsible for state management over the allocation and use of funds for work to prevent and combat the harmful effects of alcohol in accordance with the State Budget Law.

Article 25. Responsibilities of People's Committees at all levels in State Management

1. The People's Committee of provinces and centrally governed cities (hereinafter referred to as provincial level) shall be responsible for state management in preventing and combating the harmful effects of alcohol according to their functions, tasks, and areas of management as follows:

a) Issuing or submitting to competent authorities for issuance of guiding documents and measures to implement laws on preventing and combating the harmful effects of alcohol;

b) Developing plans and allocating funds for annual work to prevent and combat the harmful effects of alcohol;

c) Organizing the implementation of measures to strengthen management of traditional alcohol production; reviewing and compiling statistics on the number of households, organizations, and individuals producing traditional alcohol, production volume of traditional alcohol throughout the province, sending to the Ministry of Industry and Trade for consolidation and reporting to the Government annually; mobilizing and creating favorable conditions regarding procedures and documents for households and individuals producing traditional alcohol without licenses to apply for licensing procedures in accordance with regulations or registering with the People's Committee of communes, wards, towns (hereinafter referred to as commune level) to sell alcohol to licensed alcohol production establishments for further processing; households, organizations, and individuals producing traditional alcohol not for business purposes self-declaring information about production volume, usage scope, and commitment not to sell alcohol to the market according to the model prescribed by the Minister of Industry and Trade; guiding households, organizations, and individuals producing traditional alcohol not for business purposes to ensure food safety regulations; inspecting the quality of traditional alcohol produced and circulated in the locality; preventing and combating counterfeit, smuggled, substandard alcohol and other activities related to preventing and combating the harmful effects of alcohol;

d) Directing and organizing information dissemination, education, and communication on preventing and combating the harmful effects of alcohol; guiding and organizing the implementation of communication campaigns on preventing and combating the harmful effects of alcohol;

đ) Directing and organizing inspections and supervision of activities to prevent and combat the harmful effects of alcohol, handling complaints and reports, and dealing with violations of laws on preventing and combating the harmful effects of alcohol;

e) Reporting annually to the Ministry of Health on the results of preventing and combating the harmful effects of alcohol within the managed area for consolidation and reporting to the Government.

2. The People's Committee of districts, urban districts, towns under provinces, centrally governed cities, and equivalent administrative units (hereinafter referred to as district level) shall be responsible for state management in preventing and combating the harmful effects of alcohol according to their functions, tasks, and areas of management as follows:

a) Directing and organizing information dissemination, education, and communication on preventing and combating the harmful effects of alcohol; organizing the implementation of communication campaigns on preventing and combating the harmful effects of alcohol;

b) Organizing the implementation of measures to strengthen management and ensure food safety for traditional alcohol production within the managed area according to the division of labor by the provincial People's Committee; guiding households, organizations, and individuals producing traditional alcohol not for business purposes to ensure food safety regulations; inspecting the quality of traditional alcohol produced and circulated within the managed area;

c) Directing and organizing the implementation, inspection, and supervision of activities to prevent and combat the harmful effects of alcohol, handling complaints and reports, and dealing with violations of laws on preventing and combating the harmful effects of alcohol;

d) Reporting annually to the provincial People's Committee on the results of preventing and combating the harmful effects of alcohol within the managed area.

3. The People's Committee at the commune level shall be responsible for state management in preventing and combating the harmful effects of alcohol according to their functions, tasks, and areas of management as follows:

a) Organizing information dissemination, education, and communication on preventing and combating the harmful effects of alcohol; organizing the implementation of communication campaigns on preventing and combating the harmful effects of alcohol;

b) Organizing the implementation of measures to strengthen management and ensure food safety for traditional alcohol production within the managed area according to the division of labor by the district People's Committee; mobilizing and organizing households, organizations, and individuals to register selling alcohol to licensed alcohol production establishments for further processing; households, organizations, and individuals producing traditional alcohol not for business purposes self-declaring information about production volume, usage scope, and commitment not to sell alcohol to the market according to the model prescribed by the Minister of Industry and Trade;

c) Applying preventive, support, and timely intervention measures for children whose parents are addicted to alcohol according to the law on preventing and combating domestic violence;

d) Directing and organizing the implementation, inspection, and supervision of activities to prevent and combat the harmful effects of alcohol, handling complaints and reports, and dealing with violations of laws on preventing and combating the harmful effects of alcohol;

đ) Organizing, mobilizing, guiding, and promoting the role of residential groups, community clusters, villages, hamlets, ấp, bản, phum, sóc, local associations, and mass organizations in participating in activities to prevent and combat the harmful effects of alcohol;

e) Reporting annually to the district People's Committee on the results of preventing and combating the harmful effects of alcohol within the managed area.

Chapter V

IMPLEMENTING PROVISIONS

Article 26. Effective date

This Decree takes effect from February 24, 2020.

Article 27. Implementation organization and responsibility for enforcement

1. The Ministry of Health shall take the lead and coordinate with ministries and ministerial-level agencies to organize the implementation of this Decree.

2. Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial and centrally-administered city People's Committees are responsible for implementing this Decree./.
