Amending and supplementing some articles of Circular No. 37/2014/TT-NHNN dated November 26, 2014 of the Governor of the State Bank of Vietnam on the design of money samples, engraving, and management of printing and minting of Vietnamese currency

Pursuant to the Law on the State Bank of Vietnam dated June 16, 2010;

Pursuant to Decree No. 40/2012/NĐ-CP dated February 2, 2012 of the Government on money issuance operations; storage and transportation of precious assets and securities within the State Bank of Vietnam system, credit institutions, and foreign bank branches; the 5 year theo Nghị định số 2012 của Chính phủ về nghiệp vụ phát hành tiền; bảo quản, vận chuyển tài sản quý và giấy tờ có giá trong hệ thống Ngân hàng Nhà nước, tổ chức tín dụng và chi nhánh ngân hàng nước ngoài;

Pursuant to Decree No. 16/2017/NĐ-CP dated February 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the State Bank of Vietnam;

At the proposal of the Director of the Issuance and Treasury Department;

The Governor of the State Bank of Vietnam promulgates this Circular "7. A flexible power plant is a thermal power plant using reciprocating internal combustion engines (RICE) or aeroderivative gas turbines (Aero-GT) with fast start-up capabilities, designed in modular form to generate electricity for balancing capacity and maintaining power system stability."amending and supplementing some articles of Circular No. 37/2014/TT-NHNN dated November 26, the 11 year 2014 of the Governor of the State Bank of Vietnam on the design of money samples, engraving, and management of printing and minting of Vietnamese currency (hereinafter referred to as Circular No. 37/2014/TT-NHNN).

Article 1. Amending and supplementing some articles of Circular No. 37/2014/TT-NHNN

1. Clause 2, Article 2 shall be amended and supplemented as follows:

"2. Domestic printing and minting facilities (hereinafter referred to as printing and minting facilities).".

2. Clause 1, 3, and 5 of Article 7 shall be amended and supplemented as follows:

"1. Based on the printing and minting tasks or the requirement to improve the quality of currency, the Issuance and Treasury Department builds and submits to the Governor for approval plans to create original printing plates and casting molds. In cases where the original printing plates and casting molds of circulating currency have deteriorated in quality or been damaged due to other reasons, the Issuance and Treasury Department submits to the Governor for approval plans to create and replace original printing plates and casting molds based on reports and proposals from the printing and minting facilities. The plan to create and replace original printing plates and casting molds must include the handling of replaced original printing plates and casting molds. The creation of original printing plates and casting molds must truthfully and fully reflect the content of the officially designed sample and meet the requirements of the approved design sample submission documents.".

"3. Based on the plans to create original printing plates and casting molds that have been approved by the Governor as stipulated in Clause 1 of this Article, the Issuance and Treasury Department signs contracts with printing and minting facilities to create original printing plates and casting molds for each type of currency. After completing the contract to create original printing plates and casting molds, the printing and minting facilities must hand over the original printing plates, casting molds, standard printing and casting samples, and design files, manufacturing files of original printing plates and casting molds to the Issuance and Treasury Department."

"5. Based on the printing and minting contracts, the Issuance and Treasury Department hands over to the printing and minting facilities for safekeeping, preservation, and use: manufacturing files of original printing plates and casting molds; one set of original printing plates; one set of casting molds; one set of multi-color standard printing samples; one set of single-color printing samples; color charts, and technical standard documents of each type of currency specified in the signed printing and minting contracts.".

3. Point b of Clause 2 of Article 8 shall be amended and supplemented as follows:

"b) For paper money: print test samples on the material to be used for printing or similar material, following the officially designed sample and the approved design sample submission documents.".

4. Clause 1 of Article 11 shall be amended and supplemented as follows:

"1. After receiving the design sample printing and casting test submission documents from the printing and minting facilities as stipulated in Article 10 of this Circular, the Issuance and Treasury Department is responsible for organizing the evaluation and examination of the printing and casting test samples and proposing acceptance of the original printing plates and casting molds based on the officially designed sample and the design sample submission documents stipulated in Clause 1 of Article 6 of this Circular. The results of the evaluation of the printing and casting test samples and the proposal for acceptance of the original printing plates and casting molds must be presented in writing. During the evaluation process, if the printing and casting test samples do not meet the requirements of the design sample submission documents stipulated in Clause 1 of Article 6 of this Circular, the Issuance and Treasury Department is responsible for requesting the printing and minting facilities to make corrections and improvements to the printing plates and casting molds based on the officially designed sample and technical and quality requirements of the currency.".

5. Clause 1 of Article 12 shall be amended and supplemented as follows:

"1. The Governor approves the single-image printing and casting test samples and accepts the original printing plates and casting molds based on the recommendations of the Issuance and Treasury Department, based on the results of the evaluation of the printing and casting test samples, the submission documents for single-image printing and casting test samples stipulated in Clause 1 of Article 10 of this Circular, and the submission documents for the design of currency samples approved by the Governor as stipulated in Clause 1 of Article 6 of this Circular.".

6. Article 13 shall be amended and supplemented as follows:

"Article 13. Engraving and printing and casting test samples for research and application
1. In cases where it is necessary to conduct research and experimental testing of technology and techniques through the creation of research and backup sample engraving and printing and casting test samples, the Issuance and Treasury Department will take the lead and coordinate with the printing and minting facilities or foreign partners to submit to the Governor for consideration and decision.
2. The process of creating and printing and casting test samples for research and backup purposes shall be carried out according to the regulations for creating and printing and casting test samples for new currency as stipulated in this Circular.
3. In cases where it is necessary to apply new developments in security technology to the creation and printing and casting of Vietnamese currency, the printing and minting facilities shall submit to the Governor (through the Issuance and Treasury Department) for approval before implementation.".

7. Clause 5 of Article 15 shall be amended and supplemented as follows:

"5. The printing and minting activities of the printing and minting facilities are subject to supervision, inspection, and audit by the State Bank in accordance with the provisions of the law.".

8. The name, Clause 2, and Clause 4 of Article 16 shall be amended and supplemented as follows:

"Article 16. Management of the quality and quantity of printed and minted currency"
"2. The supervision and inspection of the quality of printed and minted currency under contracts with the State Bank shall be based on the technical standards of currency, production technology processes, and other technical requirements.".
"4. The printing and minting facilities are responsible for the quality and quantity of printed and minted currency in the products delivered under contracts with the State Bank, including cases where the State Bank, credit institutions, and foreign bank branches discover issues during the receipt and counting process as stipulated by the State Bank regarding the receipt, storage, and transportation of cash, precious assets, and securities.".

9. Clause 5b and Clause 8 shall be added to Article 18 as follows:

"5b. Receiving, storing, and preserving items, materials, and files handed over by the printing and minting facilities as stipulated in Clause 3 of Article 7 and Clause 5 of Article 20 of this Circular."
"8. Cooperate with relevant units to supervise, inspect, and audit the printing and minting activities of printing and minting facilities in accordance with the regulations of the State Bank."

10. Article 19 is amended and supplemented as follows:

"Article 19. Responsibilities of other units under the State Bank"
"1. The Banking Inspection and Supervision Agency, the Internal Audit Department, the Finance and Accounting Department, and related units shall carry out inspections, supervision, and audits of the printing and minting activities of printing and minting facilities in accordance with their functions and duties and in compliance with the provisions of the law."
"2. The Information Technology Department shall be responsible for guiding the Issuance and Treasury Management Department to implement the retention and preservation of design files of official designs and files of original printing plates and molds in accordance with the regulations on protecting state secrets."

"11. Article 20 is amended and supplemented as follows:"

"Article 20. Responsibilities of printing and minting facilities"
"1. Develop and submit to the Governor (through the Issuance and Treasury Management Department) for promulgation the technological process for plate making, printing, and minting; the technological process for mixing ink for printing."
"2. Establish and issue regulations on quality management of plate making, quality of printed and minted money throughout the production process; management of printing plates and molds; management of the use of machinery, equipment, raw materials, supplies, parts, and components serving printing and minting activities; management of documents, files, computer systems, software, and equipment serving the design of money models, the manufacture of printing plates and molds; regulations on implementing the protection of state secrets in printing and minting activities and ensuring security and safety during the production process."
"3. Submit to the Issuance and Treasury Management Department the following documents:"
"a) Documents specified in Clause 1 and Clause 2 of this Article;"
"b) Reports on the implementation of printing and minting plans; the rate of defective products, finished goods, and semi-finished goods inventory for each type of money; inventory and usage situations of paper for printing money, ink for printing money, printing plates, metal minting blanks, and other contents related to the implementation of printing and minting plans (if any) on a quarterly basis (no later than the 18th day of the first month of the next quarter);"
"c) Reports on the results of technical standard and quality evaluation experiments of trial-printed and trial-minted products and officially printed and minted products."
"4. Carry out the destruction of defective and test printing plates and molds; defective and test-printed and minted products; raw materials and supplies for printing and minting activities that have been damaged in accordance with the provisions of the law."
"5. Hand over the items, documents, and files specified in Clause 5 of Article 7 of this Circular to the Issuance and Treasury Management Department upon completion of the printing and minting contract (except in cases where a contract for the following year is signed)."

Article 2. Responsibility for Implementation

The Head of the Office, the Director of the Issuance and Treasury Management Department, the Heads of the Internal Audit Department, the Finance and Accounting Department, the Banking Inspection and Supervision Agency, the Heads of related units under the State Bank; the Chairman of the Board of Directors; the General Manager (Director) of printing and minting facilities are responsible for organizing the implementation of this Circular.

Article 3. Implementation Provisions

This Circular takes effect from February 15, 2021.
