Pursuant to Clause 2, Article 37 of the Law on Residence dated November 13, 2020;

Pursuant to Decree No. January 27, 2021 of the Government on multidimensional poverty standards for the period 2021-2025.   On the basis of Decree No. /2025/NĐ-CP dated  Month 02 Year 2025 of the Government amending and supplementing some articles of Decree No.

Decree No. 07/2021/NĐ-CP

The Prime Minister promulgates this Decision to regulate the annual review process for poor households and near-poor households and the identification process for agricultural, forestry, fishery, and salt production households with moderate living standards for the period 2022-2025.

Article 1. Scope of Regulation and Applicability

1. Scope of Regulation This Decision regulates the annual review process for poor households and near-poor households and the identification process for agricultural, forestry, fishery, and salt production households with moderate living standards for the period 2022-2025.

a) Households throughout the country.

b) Agencies, units, organizations, and individuals participating in the review of poor households and near-poor households and the identification of agricultural, forestry, fishery, and salt production households with moderate living standards.

Article 2. Methods of Review and Criteria for Multidimensional Poverty Measurement

1. The method of reviewing poor households and near-poor households involves surveying household information to estimate income and determine the level of deficiency in basic social services of poor and near-poor households in accordance with the multidimensional poverty standard prescribed in Article 3 of Decree No. 07/2021/NĐ-CP dated January 27, 2021 of the Government on the multidimensional poverty standard for the period 2021-2025.

2. The method of identifying agricultural, forestry, fishery, and salt production households with moderate living standards involves determining the income of households over a 12-month period prior to the review date, excluding social assistance from the state budget from household income.

Article 3. Timeframe for Review and Identification

1. The annual review timeframe for poor households and near-poor households is as follows:

a) Annually once every year: carried out from September 1 to December 14 of each year.

b) Continuously annually: once a month, carried out from the 15th day of each month.

2. The timeframe for identifying agricultural, forestry, fishery, and salt production households with moderate living standards is carried out from the 15th day of each month.

Article 4. Annual Periodic Review Process for Poor and Near-Poor Households

1. Compiling Lists of Households to be Reviewed The Village Review Steering Committee shall take the lead and coordinate with village, neighborhood, commune, ward, and hamlet (referred to as village) representatives and reviewers to compile lists of households to be reviewed, including:

a) Households listed as poor and near-poor households managed by the People's Committee at the commune level at the time of review.

b) Households with Application Forms for Review of Poor and Near-Poor Households according to Form No. 01 attached to this Decision.

2. Organizing Reviews and Classifying Households The Village Review Steering Committee shall take the lead and coordinate with village chiefs and reviewers to collect household information, score, aggregate, and classify households.

3. Holding Public Meetings to Unify Review Results

a) Participants in the meeting: Village Review Steering Committee, commune-level poverty reduction task force staff, village chief (chairing the meeting), village Communist Party Branch Secretary, mass organizations, reviewers, and some representatives of reviewed households and other households; invite representatives of the Vietnam Fatherland Front at the commune level to supervise.

b) Meeting Content: Solicit agreement from at least 50% of the total number of participants regarding the evaluation and scoring results of reviewed households (mainly focusing on newly identified poor and near-poor households and those who have escaped poverty and near-poverty). In cases where agreement is less than 50%, re-review shall be conducted according to Clause 2 and Points a and b of Clause 3 of this Article.

c) Meeting results are recorded in two minutes, signed by the chairperson, secretary of the meeting, and representatives of the households (one copy kept in the village, one copy sent to the Village Review Steering Committee).

4. Publicizing and Notifying Results

a) Publicize the review results of poor and near-poor households at the communal house or community center and the People's Committee office; notify through the commune radio station (if available) for three working days.

b) During the publicizing and notifying period, if there are complaints from residents, the Village Review Steering Committee shall organize a re-examination of the review results according to the review procedure within seven working days from the receipt of the complaint; publicize the re-examination results at the communal house or community center and the People's Committee office for three working days.

c) After the publicizing and re-examination period (if applicable), the Village Review Steering Committee shall compile and report to the Chairman of the People's Committee on the list of poor and near-poor households and the list of households that have escaped poverty and near-poverty (after the review).

5. Reporting and Seeking Opinions of the Chairman of the People's Committee at the District Level

a) The Chairman of the People's Committee at the commune level shall submit a written report to the Chairman of the People's Committee at the district level about the review results of poor and near-poor households in the area.

b) Within five working days from the receipt of the report from the Chairman of the People's Committee at the commune level, the Chairman of the People's Committee at the district level shall provide a written response.

6. Recognizing Poor and Near-Poor Households and Households That Have Escaped Poverty and Near-Poverty The Chairman of the People's Committee at the commune level shall adopt the opinions of the Chairman of the People's Committee at the district level, decide to recognize the list of poor and near-poor households and the list of households that have escaped poverty and near-poverty in the area according to Form No. 02 and issue Certificates to poor and near-poor households according to Form No. 03 attached to this Decision.

Article 5. Annual Continuous Poverty Households Review Process

1. Households wishing to review their status as poor or near-poor households or requesting recognition as non-poor or non-near-poor households shall submit Application Form No. 04 attached hereto directly or via postal service to the Chairman of the People's Committee at the commune level.

2. The Chairman of the People's Committee at the commune level shall direct the Commune-level Review Steering Board to conduct continuous reviews of poor and near-poor households according to the procedures stipulated in Clauses 2, 3, and 4 of Article 4 of this Decision; decide on recognizing households as poor, near-poor, non-poor, or non-near-poor; issue Certificates of Poor and Near-Poor Households within fifteen days from the start date of the review as specified in Point b, Clause 1, Article 3 of this Decision. In cases where conditions are not met, the Chairman of the People's Committee at the commune level shall respond in writing and specify the reasons.

Article 6. Procedure for Identifying Agricultural, Forestry, Fishery, and Salt Industry Households with Average Living Standards

1. Households engaged in agricultural, forestry, fishery, and salt industry activities as stipulated in Clause 2 of Article 37 of the Law on Household Registration shall submit Application Form No. 01 attached hereto directly or via postal service to the Chairman of the People's Committee at the commune level to request confirmation of average living standards.

2. The Chairman of the People's Committee at the commune level shall direct the Commune-level Review Steering Board to organize the determination of household income; publicly post and announce the results at the commune office for five working days, organize rechecks during three working days (if there are complaints), and decide on recognizing households engaged in agricultural, forestry, fishery, and salt industry activities with average living standards according to Application Form No. 02 attached hereto within fifteen days from the start date of the review as specified in Clause 2 of Article 3 of this Decision. In cases where conditions are not met, the Chairman of the People's Committee at the commune level shall respond in writing and specify the reasons.

Article 7. Reporting System

1. On the fifth day of each month (from February to September), the Chairman of the People's Committee at the commune level shall compile and report to the Chairman of the People's Committee at the district level the results of annual continuous reviews of poor and near-poor households in the locality (if applicable). The Chairman of the People's Committee at the district level shall compile and report to the Chairman of the People's Committee at the provincial level.

2. Before November 15th each year, the Department of Labor, Invalids, and Social Affairs shall report preliminary results of annual periodic reviews of poor and near-poor households in the locality to the Ministry of Labor, Invalids, and Social Affairs.

3. Before December 20th each year, the Chairman of the People's Committee at the provincial level shall officially report the results of annual periodic reviews of poor and near-poor households in the locality to the Ministry of Labor, Invalids, and Social Affairs.

Article 8. Implementation funds

Annual costs for reviewing poor and near-poor households and identifying agricultural, forestry, fishery, and salt industry households with average living standards for the period 2022-2025 shall be guaranteed by the state budget in accordance with laws on the state budget.

Article 9. Responsibilities of Central Ministries and Agencies

1. Ministry of Labor, Invalids and Social Affairs

a) Issuing guiding documents according to simplified procedures regarding methods for reviewing and classifying poor and near-poor households; determining the income of agricultural, forestry, fishery, and salt industry households with average living standards, and forms and reports.

b) Directing, training, and guiding localities in organizing the implementation of annual poverty and near-poverty household review processes and the identification process of agricultural, forestry, fishery, and salt industry households with average living standards for the period 2022-2025.

c) Compiling and announcing the results of annual reviews of poor and near-poor households nationwide.

d) Building a database on poor and near-poor households; training, guiding, and transferring to localities for implementation.

2. The Ministry of Finance shall direct and guide localities in ensuring funding for the implementation of poverty and near-poverty household review work and the identification of agricultural, forestry, fishery, and salt industry households with average living standards.

3. The Ministry of Health shall take the lead and coordinate with the Ministry of Agriculture and Rural Development to direct and guide localities in compiling and reporting on agricultural, forestry, fishery, and salt industry households with average living standards.

4. Relevant ministries and agencies shall coordinate with the Ministry of Labor, Invalids, and Social Affairs to direct and guide localities in implementing this Decision.

5. Requesting the Vietnam Fatherland Front Central Committee to direct and guide the Vietnam Fatherland Front Committees at all levels and member organizations to organize propaganda, dissemination, and supervision of the implementation of annual poverty and near-poverty household review processes and the identification process of agricultural, forestry, fishery, and salt industry households with average living standards for the period 2022-2025.

Article 10. Responsibilities of People's Committees at all levels

1. Responsibilities of the Provincial People's Committee:

a) Establish the Provincial Steering Committee for Poverty Assessment and Near-Poverty Assessment, chaired by the leader of the Provincial People's Committee, with the Director of the Department of Labor, Invalids and Social Affairs serving as Deputy Chair, and members including leaders from the Departments of Finance, Planning and Investment, Health, Education and Training, Construction, Information and Communications, Agriculture and Rural Development, the Statistics Office, the State Bank of Vietnam, and related agencies.

The Provincial Steering Committee for Poverty Assessment and Near-Poverty Assessment assists the Chairman of the Provincial People's Committee:

- To develop plans to organize annual poverty and near-poverty assessments on the local territory.

- To organize training on the procedures and tools for annual poverty and near-poverty assessments and the process for identifying households engaged in agriculture, forestry, fisheries, and salt production with a moderate standard of living on the local territory.

- To direct, organize annual poverty and near-poverty assessments and identify households engaged in agriculture, forestry, fisheries, and salt production with a moderate standard of living on the local territory; monitor, inspect, guide, and urge implementation.

b) To issue and direct the implementation of annual poverty and near-poverty assessment plans on the local territory.

c) To direct the People's Committee at the district level to implement the poverty and near-poverty assessment plans on the local territory.

d) To compile, approve the results of annual poverty and near-poverty assessments on the local territory, and report to the Ministry of Labor, Invalids and Social Affairs as stipulated in Article 7 of this Decision.

đ) To apply information technology in the assessment, management of poor and near-poor households, and households with a moderate standard of living on the local territory.

2. Responsibilities of the District People's Committee

a) Establish the District Steering Committee for Poverty Assessment and Near-Poverty Assessment, chaired by the Chairman of the District People's Committee, with the leader of the Labor, Invalids and Social Affairs agency serving as Deputy Chair, and members including leaders from the units of Finance, Planning and Investment, Health, Education, Construction, Information and Communications, Agriculture and Rural Development, the Statistics Division, the District Branch of the State Bank of Vietnam, and related agencies.

The District Steering Committee for Poverty Assessment and Near-Poverty Assessment assists the Chairman of the District People's Committee:

- To develop plans for annual poverty and near-poverty assessments on the local territory.

- To organize training on the procedures and tools for annual poverty and near-poverty assessments and the process for identifying households engaged in agriculture, forestry, fisheries, and salt production with a moderate standard of living on the local territory.

- To direct the organization of annual poverty and near-poverty assessments and identification of households engaged in agriculture, forestry, fisheries, and salt production with a moderate standard of living on the local territory; monitor, inspect, guide, and urge implementation.

b) To issue and direct the implementation of annual poverty and near-poverty assessment plans on the local territory.

c) To direct the Chairman of the Commune People's Committee to organize poverty and near-poverty assessments on the local territory.

d) To provide comments on the reports of annual poverty and near-poverty assessments submitted by the Chairman of the Commune People's Committee; to compile, approve the results of annual poverty and near-poverty assessments on the local territory, and report to the Chairman of the Provincial People's Committee as stipulated in Article 7 of this Decision.

đ) To apply information technology in the assessment, management of poor and near-poor households, and households with a moderate standard of living on the local territory.

3. Responsibilities of the Commune People's Committee

a) Establish the Commune Steering Committee for Poverty Assessment and Near-Poverty Assessment, chaired by the Chairman of the Commune People's Committee, with the commune-level staff assigned poverty reduction tasks serving as Deputy Chair, and members including commune-level staff assigned financial, health, education, construction, information and communications, agriculture and rural development tasks, village chiefs within the territory, and social policy bank staff assigned to oversee the commune.

The Commune Steering Committee for Poverty Assessment and Near-Poverty Assessment assists the Chairman of the Commune People's Committee:

- To develop and implement plans for poverty and near-poverty assessments on the local territory.

- To disseminate and promote the purpose, significance, and requirements of annual poverty and near-poverty assessments through various media; to proactively identify households facing difficulties and risks during the year to guide them in registering for assessments.

- To organize poverty and near-poverty assessment teams to carry out assessments on the local territory.

- To conduct annual poverty and near-poverty assessments and identify households engaged in agriculture, forestry, fisheries, and salt production with a moderate standard of living on the local territory as prescribed.

b) The Chairman of the Commune People's Committee decides to recognize lists of poor and near-poor households; lists of households that have escaped poverty and near-poverty, and issue certificates for poor and near-poor households; to recognize households engaged in agriculture, forestry, fisheries, and salt production with a moderate standard of living.

c) The Chairman of the Commune People's Committee compiles and reports to the Chairman of the District People's Committee on the results of recognizing poor and near-poor households and households that have escaped poverty and near-poverty on the local territory as stipulated in Article 7 of this Decision.

d) To organize the identification of households engaged in agriculture, forestry, fisheries, and salt production with a moderate standard of living upon receiving household applications.

đ) To apply information technology in the assessment, management of poor and near-poor households, and households with a moderate standard of living on the local territory.

Article 11. Effective Date

1. This Decision takes effect from September 1, 2021.

2. Ministers, Heads of Ministries equivalent to ministries, Heads of government agencies, Chairmen of People's Committees of provinces and centrally governed cities shall be responsible for implementing this Decision./.
