Pursuant to Decree No. 168/2016/NĐ-CP dated December 27, 2016, issued by the Government stipulating the management of forest land, garden areas, and water surface areas in special-use forest management boards, protective forests, and State-owned agricultural and forestry limited liability companies;

At the proposal of the Director of the Forest Management Department;

The Minister of Agriculture and Rural Development issues this Circular amending and supplementing certain articles of circulars in the forestry sector.

1. Amend and supplement Article 1 as follows:

"Article 1. Scope of Regulation

Article 1. Amending and supplementing certain articles of Circular No. 15/2019/TT-BNNPTNT dated October 30, 2019, issued by the Minister of Agriculture and Rural Development guiding certain contents on managing public investment in forestry works.

2. Amending and supplementing Article 2 as follows:

"Article 2. Applicability

This Circular stipulates the procedures for inspecting the results of certain investment activities and supporting investment in forestry works, including afforestation, non-timber forest product development, care of planted forests, nurturing planted forests, natural regeneration promotion enclosures, natural regeneration promotion enclosures with supplementary planting, nurturing natural forests, enriching natural forests, transforming natural forests; inspecting forest protection; inspecting scattered tree planting."

1. This Circular applies to organizations, households, individuals, and community groups involved in inspecting the results of certain investment activities and supporting investment in forestry works, inspecting forest protection, and inspecting scattered tree planting as specified in Article 1 of this Circular when using state budget funds.

3. Amend and supplement Article 3 as follows:

"Article 3. Explanation of Terms 

In this Circular, the following terms are understood as follows:

2. It is encouraged for organizations, households, individuals, and community groups to apply the provisions of this Circular when using non-state budget funds."

1. Inspecting investment activities in forestry works involves evaluating the results of implementing such works regarding progress, volume, and quality compared to approved designs, budgets, and signed contracts, including: inspecting individual items; inspecting annually; inspecting the completion of investment in forestry works.

2. Inspecting forest protection involves evaluating the results of implementing forest protection regarding volume and quality according to forest protection files, including: forest protection contracts and support for forest protection.

3. Inspecting scattered tree planting involves evaluating the results of scattered tree planting regarding planting locations, number of trees planted, care and protection, survival rate."

"4. Amend and supplement Chapter III as follows:

Chapter III PROVISIONS ON INSPECTION

Article 10. General Provisions

1. Inspection of the results of investment activities in forestry works

a) Inspection of individual items

Inspection time: carried out immediately after each forestry item is completed according to the inspection request of the contractor. Inspection team members include representatives from the investor or the unit using state budget funds (hereinafter referred to as the investor) or supervisory body and the contractor.

Inspection documents: design and budget approved by the competent authority as stipulated in Clause 3, Article 31; Clause 3, Clause 4, Article 32 of Decree No. 58/2024/NĐ-CP dated May 24, 2024, issued by the Government on certain investment policies in forestry (hereinafter referred to as Decree No. 58/2024/NĐ-CP); report on the implementation results of the contractor according to Model 01 Appendix IA attached hereto; other related documents (if any).

The result of inspecting individual items is recorded in the inspection record and summary table of inspected items according to Models 02 and 03 Appendix IA attached hereto.

b) Annual inspection

Inspection time: for afforestation, care of planted forests, natural regeneration promotion enclosures, natural regeneration promotion enclosures with supplementary planting, enriching natural forests, transforming natural forests, conducted before December 31 each year; for nurturing planted forests and nurturing natural forests, conducted after completing all project components.

Inspection team members include representatives from the investor, supervisory body, contractor, and People's Committee at the commune level.

Inspection documents include: design and budget approved by the competent authority as stipulated in Clause 3, Article 31; Clause 3, Clause 4, Article 32 of Decree No. 58/2024/NĐ-CP; various types of contracts: specialized contracting, construction, procurement of materials, machinery, equipment; report on the implementation results of the contractor according to Model 01 Appendix IA attached hereto; other related documents (if any).

The result of annual inspection is recorded in the inspection record according to Models 04, 05, 06, and 07 Appendix IA attached hereto.

c) Inspection upon completion of investment in forestry works

Inspection time: carried out within three months from the end of the investment period.

Inspection team members include representatives from the investor, contractor, supervisory body, manager, and user of the work (in case the investor is not the manager or user of the work), People's Committee at the commune level, and rangers working in the area.

Inspection documents include: documents stipulated in point b of this clause; project investment explanation documents (if it is an investment project).

The result of inspecting the completion of investment in forestry works is recorded in the inspection record according to Models 04, 05, 06, and 07 Appendix IA attached hereto.

d) For inspection contents that do not meet the criteria specified in Appendix IIA, the investor organizes re-inspection and additional inspection. The composition and documents for inspection follow the provisions of this clause; the time for re-inspection and additional inspection is decided by the investor and the contractor.

2. Inspection of the results of supporting investment in production forest planting and non-timber forest product development

Support for investment: conduct inspection and acceptance of afforestation and forest management before December 31 each year.

Post-investment support: after at least ten months from the date of afforestation.

b) Inspection team members include representatives from the investor, the recipient of support, rangers working in the area, and the People's Committee of the commune.

c) Inspection documents

Detailed project proposal for investment support or post-investment support for production forest planting and non-timber forest product development approved by competent authorities according to Clause 4, Article 14 of Decree No. 58/2024/ND-CP, excluding support for production forest planting and non-timber forest product development from replanting sources.

Design and budget estimate documents in accordance with Clause 3, Article 31 of Decree No. 58/2024/ND-CP.

Types of contracts: purchase of materials, seedlings, and fertilizers.

d) Inspection results: recorded in the inspection report according to Form No. 06, 07 of Appendix IA issued together with this Circular.

3. Inspection of forest protection results

a) Forest protection contract

Object: as prescribed in Decree No. 168/2016/ND-CP dated December 27, 2016 of the Government on forest, garden tree, and water surface area contracting in Specialized Forest Management Boards, Protective Forests, and State-owned Limited Liability Companies for Agriculture and Forestry (hereinafter referred to as Decree No. 168/2016/ND-CP); as prescribed in Clause 1, Article 19 of Decree No. 58/2024/ND-CP.

Inspection time: carried out in December each year.

Inspection team members include representatives from the contractor and the contractee.

Inspection documents: contract and documentation for forest protection contracting as prescribed in Decree No. 168/2016/ND-CP; inspection records and monitoring logs according to Form No. 08, 09 of Appendix IA issued together with this Circular.

Inspection results: recorded according to Form No. 06 of the Appendix accompanying Decree No. 168/2016/ND-CP.

b) Forest protection support

Object: forest protection support as prescribed in point c, Clause 1, Article 5, point d, Clause 1, Article 9, point d, Clause 1, Article 12 of Decree No. 58/2024/ND-CP.

Inspection team members include representatives from the investor; community or individual or household; rangers working in the area; and the People's Committee of the commune.

Inspection documents: design and budget estimate documents for forest protection approved by competent authorities according to Clause 3, Clause 4, Article 32 of Decree No. 58/2024/ND-CP; inspection records and monitoring logs according to Form No. 08, 09 of Appendix IA issued together with this Circular.

Inspection results: recorded in the inspection report according to Form No. 10 of Appendix IA issued together with this Circular.

4. Inspection of scattered tree planting

a) Inspection time: carried out at least one month after completion of planting.

b) Inspection team members include representatives from the investor, the recipient of seedlings, rangers working in the area, and the People's Committee of the commune.

c) Inspection documents: purchase and sale contract and list of seedling and material delivery; construction unit's implementation result report according to Form No. 01 of Appendix IA issued together with this Circular.

d) Inspection results: recorded in the inspection report according to Form No. 11 of Appendix IA issued together with this Circular.

Article 11. Inspection of afforestation, investment support for production forest planting and non-timber forest product development

1. Time, components, documents, and results of inspection

a) For afforestation investment implemented according to Clause 1, Article 10 of this Circular.

b) For investment support for production forest planting and non-timber forest product development implemented according to Clause 2, Article 10 of this Circular.

2. Inspection items for afforestation investment include: ground cover treatment; soil preparation; pit filling and fertilization (if applicable); afforestation; forest management; other items such as firebreak roads according to the approved design and budget estimate.

3. Inspection criteria: implemented according to Section I of Appendix IIA issued together with this Circular.

4. Method of inspecting area: field verification to determine boundary positions, compare with design maps or determine area through direct measurement methods or other methods as prescribed.

5. Method of inspecting quality

a) For concentrated monoculture plantations: randomly establish standard plots with a minimum area of 100 square meters along representative lines or establish standard plots according to the plantation system, the minimum number of standard plots is specified as follows:

Plantation area under 1 hectare: 3 standard plots;

Plantation area from 1 to less than 3 hectares: 10 standard plots;

Plantation area from 3 to less than 5 hectares: 15 standard plots; Plantation area 5 hectares or more: 20 standard plots.

b) For concentrated mixed plantations: randomly establish standard plots with a minimum area of 500 square meters along representative lines or establish standard plots according to the plantation system, the minimum number of standard plots is specified as follows:

Plantation area under 3 hectares: 3 standard plots;

Plantation area from 3 to less than 5 hectares: 5 standard plots;

Plantation area 5 hectares or more: 10 standard plots.

c) For mixed plantations along strips: use random sampling method to check at least 10% of the planting strips in the plantation plot; count the number of trees across all planting strips. In case the number of strips in the plot is less than 10, at least one strip must be checked.

d) For mixed plantations in patches: use random sampling method to check at least 10% of the planting patches in the plantation plot. In case the planting patch has an area under 1,000 square meters, count the number of trees across the entire patch. In case the planting patch area exceeds 1,000 square meters, establish standard plots according to point b of this clause. In case there are fewer than 10 patches in the plot, at least one patch must be checked.

Article 12. Inspection of Reforestation Forest Care

1. Time, components, documents, and results of inspection

a) For afforestation investment implemented according to Clause 1, Article 10 of this Circular.

b) For investment support for production forest planting and non-timber forest product development implemented according to Clause 2, Article 10 of this Circular.

2. Inspection items include: For reforested hills and mountains: thinning and care; hoeing around the base, fertilizing; replanting. For mangrove reforestation: resetting stakes to hold trees, erecting fallen trees; removing attached debris; treating harmful organisms; replanting.

3. Inspection criteria: as stipulated in Section II Appendix IIA issued together with this Circular.

4. Inspection method: carried out according to the provisions of Clause 4 and Clause 5, Article 11 of this Circular.

Article 13. Inspection of Reforestation Forest Cultivation

1. Time, components, inspection files, and results shall be implemented according to the provisions of Clause 1, Article 10 of this Circular.

2. Inspection items: thinning, pruning, fertilizing.

3. Inspection criteria: carried out according to the provisions of Section III Appendix IIA issued together with this Circular.

4. Inspection method

a) Regarding area: carried out according to the provisions of Clause 4, Article 11 of this Circular.

b) Regarding quality: carried out according to the provisions of Point b, Clause 4, Article 14 of this Circular.

Article 14. Inspection of Natural Regeneration Promotion Encirclement

1. Time, components, inspection files, and results shall be implemented according to the provisions of Clause 1, Article 10 of this Circular.

2. Inspection items for the affected area of natural regeneration promotion encirclement:

Thinning, pruning sprouts, forest sanitation for natural regeneration promotion on hills and mountains;

Pruning crooked and diseased trees for natural regeneration promotion on bamboo areas;

Removing weeds and other objects suppressing natural regeneration for natural regeneration promotion on saline land.

3. Inspection criteria: carried out according to the provisions of Section IV Appendix IIA issued together with this Circular.

4. Inspection method

a) Regarding area: carried out according to the provisions of Clause 4, Article 11 of this Circular.

b) Regarding quality: based on the approved technical design, establish standard plots to evaluate inspection criteria. The minimum area of each standard plot is 1,000 square meters along representative lines or within the system of the forest lot, the minimum number of standard plots is specified as follows:

Lot area under 03 hectares: 01 standard plot;

Lot area from 03 to under 05 hectares: 3 standard plots;

Lot area 05 hectares or more: 05 standard plots.

Article 15. Inspection of Natural Regeneration Promotion Encirclement with Supplementary Planting

1. Time, components, inspection files, and results shall be implemented according to the provisions of Clause 1, Article 10 of this Circular.

2. Inspection items: digging holes, planting, fertilizing; caring for supplementary planted trees; other items as stipulated in Clause 2, Article 14 of this Circular.

3. Inspection criteria: carried out according to the provisions of Section V Appendix IIA issued together with this Circular.

4. Inspection method:

a) Regarding area: carried out according to the provisions of Clause 4, Article 11 of this Circular.

b) Regarding quality: For supplementary planting along bands, follow the provisions of Point c, Clause 5, Article 11 of this Circular;

For supplementary planting in clusters, follow the provisions of Point d, Clause 5, Article 11 of this Circular;

For areas without supplementary forest planting, follow the provisions of Point b, Clause 4, Article 14 of this Circular.

Article 16. Inspection of Natural Forest Cultivation

1. Time, components, inspection files, and results shall be implemented according to the provisions of Clause 1, Article 10 of this Circular.

2. Inspection items: clearing vines, shrubs, invasive weeds, thinning, pruning branches, forest sanitation.

3. Inspection criteria: carried out according to the provisions of Section VI Appendix IIA issued together with this Circular.

4. Inspection method

a) Regarding area: carried out according to the provisions of Clause 4, Article 11 of this Circular.

b) Regarding quality: carried out according to the provisions of Point b, Clause 4, Article 14 of this Circular.

Article 17. Inspection of Natural Forest Enrichment

1. Time, components, inspection files, and results shall be implemented according to the provisions of Clause 1, Article 10 of this Circular.

2. Inspection items: creating cut and leave bands for enrichment along bands; thinning and exposing the understory for enrichment in clusters; digging holes; filling holes, applying fertilizer, planting trees; caring for enrichment planted trees.

3. Inspection criteria: carried out according to the provisions of Section VII Appendix IIA issued together with this Circular.

4. Inspection method

a) Regarding area: carried out according to the provisions of Clause 4, Article 11 of this Circular.

b) Regarding quality: carried out according to the provisions of Point c, Point d, Clause 5, Article 11 of this Circular.

Article 18. Inspection of Natural Forest Rehabilitation

1. Time, components, inspection files, and results shall be implemented according to the provisions of Clause 1, Article 10 of this Circular.

2. Inspection items: final harvesting; afforestation as prescribed in Clause 2, Article 11 of this Circular.

3. Inspection criteria: as prescribed in Section VIII of Appendix IIA attached to this Circular.

4. Inspection method: carried out according to the provisions of Clause 4 and Clause 5, Article 11 of this Circular.

Article 19. Inspection of Forest Protection

1. The time, components, documents, and results of inspection shall be carried out in accordance with the provisions of Clause 3, Article 10 of this Circular.

2. Inspection criteria: as prescribed in Section IX of Appendix IIA attached to this Circular.

3. Inspection methods

a) Regarding area: on-site inspection combined with measurement methods to determine boundary positions, comparing maps with forest protection areas according to records or contracts.

b) Regarding quality: observation and evaluation of the current state of the forest based on indicators in the contract for forest management status, condition, degree of forest destruction or fire damage, combined with evaluating inspection record books and monitoring logs.

Article 20. Inspection of Scattered Tree Planting

1. The time, components, documents, and results of inspection shall be carried out in accordance with the provisions of Clause 4, Article 10 of this Circular.

2. Inspection criteria: implemented in accordance with the provisions of Section X of Appendix IIA attached to this Circular.

3. Inspection method: randomly inspect at least 10% of planted trees to determine the species, planting standards, and survival rate of the trees.

5. Amend and supplement Article 21 as follows:

"Article 21. Responsibilities of the Forestry Department

1. Organize implementation and provide guidance on the implementation of this Circular throughout the country.

2. Advise and assist the Minister of Agriculture and Rural Development in handling difficulties and issues arising during the implementation of this Circular.

6. Amending and supplementing Article 23 as follows:

"Article 23. Responsibilities of the Department of Agriculture and Rural Development

1. Organize the implementation of this Circular within the province or city.

2. Regularly or unexpectedly inspect the implementation of inspection results for some investment activities, investment support projects, forest engineering works; forest protection inspections; scattered tree planting inspections within their authority.

3. Advise and assist the Chairman of the Provincial People's Committee, report to the Minister of Agriculture and Rural Development to handle difficulties and issues arising during the implementation of this Circular within the province.

7. Repeal Article 22, Article 25.

8. Supplement Appendix IA attached to this Circular.

9. Replace Appendix II Inspection Criteria issued together with Circular No. 15/2019/TT-BNNPTNT with Appendix IIA issued together with this Circular.

Article 2. Amend and supplement certain articles of Circular No. 25/2022/TT-BNNPTNT dated December 30, 2022, of the Minister of Agriculture and Rural Development regarding the replacement of forests when changing land use purposes from forest to other purposes, which has been amended and supplemented by Circular No. 22/2023/TT-BNNPTNT dated December 15, 2023, of the Minister of Agriculture and Rural Development.

1. Amend and supplement Clause 2, Point b Clause 3, Point b Clause 4, Point a Clause 5 of Article 2 of Circular No. 25/2022/TT-BNNPTNT, which has been amended and supplemented in Clause 1 of Article 1 of Circular No. 22/2023/TT-BNNPTNT as follows:

a) Amend and supplement Clause 2 as follows:

"2. Implementation of forest replacement planting:

"a) For provinces and centrally governed cities that can self-arrange land for forest replacement planting: carry out planting on land planned for special-use forests, protective forests; plant on land planned for production forests allocated to state-owned enterprises, forest owners as stipulated in Clauses 1, 3, and 4 of Article 8 of the Forestry Law; support planting of large timber production forests (harvested after 10 years) on land planned for production forests allocated to households and individuals;

b) For provinces and centrally governed cities that have received funding for forest replacement planting from other regions without land for forest replacement planting: carry out planting of special-use forests, protective forests, production forests on land planned for special-use forests, protective forests, production forests."

b) Amend and supplement Point b Clause 3 of Article 2 as follows:

"b) The design and budget for forest replacement planting are determined based on economic and technical norms as prescribed by the Minister of Agriculture and Rural Development; construction unit price for the budget of forest replacement planting is regulated by the provincial People's Committee where the forest replacement planting is organized. The establishment, review, approval of design and budget, and risk management during the investment phase of forest replacement planting shall be carried out in accordance with Chapter IV of Decree No. 58/2024/NĐ-CP dated May 24, 2024, of the Government on certain investment policies in forestry. Forest replacement planting shall be inspected in accordance with the guidelines on some management contents of forestry engineering works issued by the Minister of Agriculture and Rural Development;"

c) Amend and supplement Point b Clause 4 of Article 2 as follows:

"b) The management, use, and payment of forest replacement planting funds shall be conducted through the State Treasury in accordance with current regulations;

The Forest Protection and Development Fund shall supervise the expenditure of forest replacement planting funds in accordance with current laws; the payment of forest replacement planting funds through the State Treasury shall be based on transfer vouchers and payment documents of the Forest Protection and Development Fund."

d) Amend and supplement Clause 5 of Article 2 as follows:

"5. Criteria for selecting units and localities receiving funding for forest replacement planting from provinces and cities without land for forest replacement planting:

a) Possessing the area of land planned for special-use forests, protective forests, production forests as prescribed in Point b Clause 2 of this Article, determined based on approved land use plans and the current state of forests at the time of proposal; having a registration letter from the head of the unit or the Chairman of the Provincial People's Committee to receive funding for forest replacement planting according to Model 01 of Appendix I attached to this Circular.

b) In cases where multiple units or localities apply to receive funding for forest replacement planting, priority shall be given to localities with large areas of unplanned special-use forests, protective forests, production forests but unable to balance the budget for planting."

2. Amend and supplement Point c Clause 8 of Article 3 of Circular No. 25/2022/TT-BNNPTNT as follows:

"c) In case the project owner does not implement afforestation as prescribed in point b of this clause, the People's Committee of the province shall decide to organize the implementation of afforestation according to Clause 7 of Article 4 of this Circular using the funds already paid by the project owner into the Provincial Forest Protection and Development Fund; in case the amount of money paid by the project owner is lower than the unit price for afforestation of the province at the time of organizing afforestation, the Chairman of the People's Committee of the province shall issue a written notice to the project owner regarding the difference in the unit price for afforestation. Within ten days from the date of receipt of the written notice from the Chairman of the People's Committee of the province, the project owner must pay the additional amount into the Provincial Forest Protection and Development Fund;"

3. Amend and supplement point a of Clause 7 of Article 4 of Circular No. 25/2022/TT-BNNPTNT (amended and supplemented by Clause 3 of Article 1 of Circular No. 22/2023/TT-BNNPTNT).

"a) The Department of Agriculture and Rural Development shall advise the People's Committee of the province to assign units that are project owners to implement afforestation: forest owners as prescribed in Clauses 1, 3, and 4 of Article 8 of the Forestry Law; state-owned enterprise forest owners; other state agencies and organizations."

4. Replace Model No. 01 of Appendix I issued together with Circular No. 25/2022/TT-BNNPTNT (amended and supplemented by Clause 7 of Article 1 of Circular No. 22/2023/TT-BNNPTNT) with Model No. 01 of Appendix III issued together with this Circular.

Article 3. Amend the name of Article 11 of Circular No. 28/2018/TT-BNNPTNT dated November 16, 2018 of the Minister of Agriculture and Rural Development on sustainable forest management which has been amended and supplemented by Clause 5 of Article 1 of Circular No. 13/2023/TT-BNNPTNT dated November 30, 2023 of the Minister of Agriculture and Rural Development.

"Article 11. Approval or adjustment of the sustainable forest management plan of forest owners who are subordinate agencies of ministries and sectors.".

Article 4. Amend Article 15 of Circular No. 29/2018/TT-BNNPTNT dated November 16, 2018 of the Minister of Agriculture and Rural Development on forestry measures which have been amended and supplemented by Circular No. 17/2022/TT-BNNPTNT dated October 27, 2022 and Circular No. 22/2023/TT-BNNPTNT dated December 15, 2023 of the Minister of Agriculture and Rural Development on amending and supplementing certain articles of circulars in the forestry sector.

1. Amend Article 15 of Circular No. 29/2018/TT-BNNPTNT dated November 16, 2018 of the Minister of Agriculture and Rural Development on forestry measures which have been amended and supplemented by Circular No. 17/2022/TT-BNNPTNT dated October 27, 2022.

"Article 15. Responsibilities of State Management Agencies.

1. The Forest Service:

a) Organize the implementation of this Circular throughout the country;

b) Develop and promulgate technical guidelines for planting forests for major timber tree species and scattered trees;

c) Conduct inspections and evaluations of the implementation of this Circular in localities.

2. The Department of Agriculture and Rural Development:

a) Organize the implementation of this Circular within the provincial jurisdiction;

b) Inspect and guide organizations, households, individuals, and community residents during the implementation of forestry measures as prescribed in this Circular;

c) Develop and promulgate technical guidelines for planting forests for special tree species within the provincial jurisdiction according to its authority;

d) Advise the People's Committee of the province to promulgate fast-growing trees, slow-growing trees; purpose trees, non-purpose trees for protective forests and production forests within the provincial jurisdiction."

2. Repeal Article 4 of Circular No. 22/2023/TT-BNNPTNT dated December 15, 2023 of the Minister of Agriculture and Rural Development on amending and supplementing certain articles of circulars in the forestry sector.

Article 5. Effective Date

1. This Circular takes effect from January 27, 2025.

2. In case the legal normative documents or standards cited in this Circular are amended, supplemented, or replaced, they shall be implemented according to the amended, supplemented, or replacing documents.

3. During the implementation of this Circular, if there are difficulties or obstacles, the relevant agencies, organizations, and individuals are requested to promptly report them to the Ministry of Agriculture and Rural Development for consideration and resolution./.
