Circular No. 24/2024/TT-BYT amends Circular No. 16/2020/TT-BYT on standards and guidelines for awarding the Hai Thuong Lan Ong Award for traditional medicine work issued by the Minister of Health.

Amending and supplementing certain articles of Circular No. 16/2020/TT-BYT dated October 29, 2020 issued by the Minister of Health on standards and guidelines for awarding the Hai Thuong Lan Ong Award for traditional medicine work

On the basis of 奖励和表彰法 Pursuant to the Law on Forces Participating in Ensuring National Security and Public Order at the Grassroots Level dated November 28, 2023;

Decree No. 95/2022/NĐ-CP dated November 15, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;

At the proposal of the Director of the Traditional Medicine Management Department;

The Minister of Health issues this Circular amending and supplementing certain articles of Circular No. 16/2020/TT-BYT dated October 29, 2020 issued by the Minister of Health on standards and guidelines for awarding the Hai Thuong Lan Ong Award for traditional medicine work.

Article 1. Amending and supplementing certain articles in Circular No.16/2020/TT-BYT dated October 29, 2020 issued by the Minister of Health on standards and guidelines for awarding the Hai Thuong Lan Ong Award for traditional medicine work

1. AMENDING AND SUPPLEMENTING ARTICLE 3 AS FOLLOWS:

"Article 3. Principles for awarding

1. Accuracy, transparency, fairness, and timeliness.

2. Gender equality in the awarding process.

3. Emphasis on prioritizing individuals who are direct workers and have many innovations in their labor and work; achievements made under difficult conditions with wide-ranging impacts.

4. Not recommending individuals currently within the period of enforcement of disciplinary measures such as reprimand or higher, or administrative penalties related to medical examination and treatment; those involved in cases under investigation by competent authorities for disciplinary actions; currently under investigation, inspection, or verification of violations; involved in complaints or accusations being verified and processed; associated with corruption or misconduct reported by media outlets and currently under verification and clarification.

In cases where individuals have been verified by competent authorities as not being involved in disciplinary or legal violations as specified in this clause, continue to contribute and achieve outstanding results in traditional medicine work, combining traditional and modern medicine, they may be considered for the award according to regulations.

5. Individuals participating in multiple fields of work can only choose one field for nomination.

6. Individuals receiving salary and annual performance evaluation and commendation at their unit should be nominated for the award at that unit. If individuals are not receiving state budget salaries, they should be nominated through professional associations in the field of traditional medicine where they work.

7. No requirement to meet scientific and technological task standards or innovation criteria for individuals working in border areas, at sea, on islands, in particularly difficult economic and social conditions as defined by the Government, or in detention facilities, compulsory education institutions, compulsory drug rehabilitation centers, and juvenile correctional schools.

8. The Hai Thuong Lan Ong Award will be awarded once to eligible recipients according to regulations, and posthumous awards will not be considered.".

3. Amending Article 4 as follows:

"Article 4. Time for awarding

The Hai Thuong Lan Ong Award will be awarded every two years and announced on the anniversary of the death of Great Doctor Hai Thuong Lan Ong Le Huu Trac (the fifteenth day of the first lunar month) in the following year.".

4. AMENDING AND SUPPLEMENTING ARTICLE 6 AS FOLLOWS:

"Article 6. Rights and obligations of individuals receiving the award

1. Rights:

a) Receiving an award certificate (Annex 01 - Model 01);

b) Receiving an award badge (Annex 02 - Model 01);

c) Being recorded in the Golden Book of the Hai Thuong Lan Ong Award managed by the Ministry of Health (Traditional Medicine Management Department);

d) Receiving monetary or material rewards as prescribed (if applicable).

2. Obligations:

a) Maintaining awarded items; not using them in ways contrary to national customs and morals, social ethics, or negatively affecting society; not renting or lending them in any form;

b) Continuing to uphold moral character, talent, and serving as role models for colleagues and respected by the public.".

5. Amending Clause 1 of Article 7 as follows:

"1. Having worked or served in the field of traditional medicine or combined traditional and modern medicine for 20 years or more.".

6. Amending Clause 3 of Article 7 as follows:

"3. Receiving at least one commendation at the ministerial or provincial level, or at least two commendations from central professional associations in the field of traditional medicine, or at least five commendations from provincial professional associations in the field of traditional medicine, or at least five commendations from departments, sectors, or equivalent levels in the field of traditional medicine, combined traditional and modern medicine.".

7. Amending Article 8 as follows:

"Article 8. Conversion of service time

1. Service time of individuals in the field of traditional medicine or combined traditional and modern medicine in regions B, C, K; border defense wars in the southwest and north, and volunteer forces in Laos and Cambodia, or international missions shall be multiplied by 1.5 when calculating service time for award consideration.

2. Service time of individuals in the field of traditional medicine or combined traditional and modern medicine in border areas, at sea, on islands, or in particularly difficult economic and social conditions as defined by the Government shall be multiplied by 2 when calculating service time for award consideration.

3. Service time of individuals in the field of traditional medicine or combined traditional and modern medicine in detention facilities, compulsory education institutions, compulsory drug rehabilitation centers, and juvenile correctional schools shall be multiplied by 1.5 when calculating service time for award consideration.

4. In cases where individuals change positions or have interrupted periods of work in different regions, their service times can be accumulated to meet the award eligibility criteria.

5. Individuals sent by agencies for training or upgrading their qualifications in the field of traditional medicine or combined traditional and modern medicine shall still be counted towards service time for award eligibility criteria.".

8. Amending Point b Clause 1 of Article 9 as follows:

"b) Meeting one of the following criteria:

- Summarize at least one traditional medicine prescription or treatment method or technical innovation in the field of traditional medicine that has been applied in provincial healthcare facilities and recognized by the health administration agency of the provincial People's Committee (Department of Health) or the science and technology administration agency of the provincial People's Committee (Department of Science and Technology).

- Lead at least one scientific and technological task in the field of traditional medicine, combining traditional and modern medicine at the ministry or provincial level, or lead at least two scientific and technological tasks in the field of traditional medicine, combining traditional and modern medicine at the facility level, or be a key researcher in at least one scientific and technological task in the field of traditional medicine, combining traditional and modern medicine at the national level, or be a key researcher in at least two scientific and technological tasks in the field of traditional medicine, combining traditional and modern medicine at the ministry or provincial level, all of which have been accepted with evaluation results rated as satisfactory or higher.

9. Amend Point b Clause 2 Article 9 as follows:

“b) Meet one of the following criteria: Lead at least two scientific and technological tasks in the field of traditional medicine, combining traditional and modern medicine at the ministry or provincial level, or lead at least three scientific and technological tasks in the field of traditional medicine, combining traditional and modern medicine at the facility level, or be a key researcher in at least one scientific and technological task in the field of traditional medicine, combining traditional and modern medicine at the national level, all of which have been accepted with evaluation results rated as satisfactory or higher, or publish at least two research works on traditional medicine in scientific journals recognized for scoring by the Interdisciplinary Academic Council.”

10. Amend Point b Clause 3 Article 9 as follows:

"b) Meeting one of the following criteria:

- Serve as chief editor or participate in compiling at least one specialized training textbook on traditional medicine, combining traditional and modern medicine, or serve as chief editor of at least one reference book in the field of traditional medicine, combining traditional and modern medicine, or participate in compiling at least two reference books in the field of traditional medicine, combining traditional and modern medicine, or have at least two innovative teaching methods that significantly improve student learning outcomes in the field of traditional medicine, combining traditional and modern medicine, recognized by the school’s Scientific and Technological Council and implemented in teaching;

- Lead at least two scientific and technological tasks in the field of traditional medicine, combining traditional and modern medicine at the facility level, or at least two scientific and technological innovations in the field of traditional medicine, combining traditional and modern medicine, or be a key researcher in at least one scientific and technological task in the field of traditional medicine, combining traditional and modern medicine at the national, ministry, or provincial level, all of which have been accepted with evaluation results rated as satisfactory or higher.

11. Amend Point b Clause 4 Article 9 as follows:

“b) Meet one of the following criteria:

- Have at least one useful innovation in the production and processing of medicinal herbs, traditional medicines, or medicines derived from medicinal herbs, recognized by the health administration agency of the provincial People's Committee (Department of Health) or the science and technology administration agency of the province (Department of Science and Technology);

- Develop at least three production processes for traditional medicines or medicines derived from medicinal herbs that have been applied in production and received a registration certificate for circulation from the Ministry of Health;

- Lead at least one scientific and technological task at the facility level in the fields of cultivating, harvesting, processing, producing, and trading medicinal herbs, traditional medicines, or herbal medicines, or be a key researcher in at least one scientific and technological task in these fields at the national, ministry, or provincial level, all of which have been accepted with evaluation results rated as satisfactory or higher.”

12. Amend Point b Clause 5 Article 9 as follows:

"b) Meeting one of the following criteria:

- Be a key participant in formulating and implementing policies, regulatory documents aimed at developing traditional medicine, approved by competent authorities, specifically: at least one law or at least two decrees or at least three circulars regarding the development of the healthcare sector or traditional medicine, combining traditional and modern medicine; or at least one resolution, directive, program, project issued by the central authority; or at least two plans, programs, projects related to industry development issued by the ministry or sector; or at least five professional materials in the field of traditional medicine, combining traditional and modern medicine, approved by the Ministry of Health;

- Participate in formulating at least two of the following documents: programs, projects in the field of traditional medicine or combining traditional and modern medicine and effectively implement them at the local level (from district level upwards);

- Have at least two management innovations effectively applied in the field of traditional medicine, combining traditional and modern medicine, recognized by the management agency at the district level or above.”

13. Amend Point c Clause 6 Article 9 as follows:

“c) Meet one of the following criteria:

- Participate in compiling at least one teaching material, reference book, or compile at least one book on the guidance for using traditional medicine prescriptions, traditional medicine formulas, locally available medicinal plants according to the theory of traditional medicine, recognized by the health administration agency of the provincial People's Committee (Department of Health) and implemented at the local level.

- There must be at least one traditional medicine prescription or treatment method based on traditional medical theory that has been effectively applied locally and recognized by the health administration agency of the provincial People's Committee (Department of Health), or there must be a family-prescribed traditional medicine prescription or family-prescribed treatment method that has been licensed by the health administration agency of the provincial People's Committee (Department of Health) for a minimum of ten years up to the time of award consideration and has been effectively applied locally.

14. Amend Clause 7 of Article 9 as follows:

“7. An individual who is a foreigner working or serving in the field of traditional medicine, combining traditional medicine with modern medicine in Vietnam shall be considered for the nomination to receive the Hai Thuong Lan Ong Award if they meet one of the criteria set forth in Clauses 1, 2, 3, 4, 5, and Clause 6 of Article 9 of this Circular.”

15. Amend Point b of Clause 8 of Article 9 as follows:

“b) Individuals who have been conferred titles by the State such as National Medical Doctor, Outstanding Medical Doctor, National Teacher, Outstanding Teacher, and continue to achieve outstanding results and make significant contributions in the field of traditional medicine up to the time of award consideration, and are not within the period of enforcement of disciplinary measures ranging from warning upwards.”

16. Amend and supplement Article 10 as follows:

“Article 10. The Council for Awarding the Hai Thuong Lan Ong Award

The Council for Awarding the Hai Thuong Lan Ong Award is organized at two levels: the Selection Council at the grassroots level and the Awarding Council at the Ministry of Health level.

The grassroots-level Selection Council (referred to as the Grassroots Council) carries out the selection procedures, completes the dossier, and proposes to the Awarding Council at the Ministry of Health level (referred to as the Ministry-level Council) through the Standing Body of the Ministry-level Council (the Traditional Medicine Management Department) to compile, organize the selection process, report to the Chairman of the Council and the Minister of Health for consideration and decision to confer the Hai Thuong Lan Ong Award.

1. The Grassroots Council

a) The Grassroots Council is established as follows:

- At the Ministry of Health (including central agencies of professional associations in the field of traditional medicine);

- At units under the Ministry of Health;

- At health management agencies of other ministries and sectors;

- At the health administration agency of the provincial People's Committee (Department of Health) of provinces and centrally-administered cities.

The Grassroots Council is established by the Minister of Health, the Heads of units under the Ministry of Health, the Heads of health management agencies at other ministries and sectors, or the Heads of health facilities under other ministries and sectors, and the Directors of the health administration agencies of the provincial People's Committee (Department of Health) of provinces and centrally-administered cities.

b) The composition of the Grassroots Council includes seven to eleven members, including:

- The Chairperson of the Council is the leader of the agencies or units authorized to establish the Grassroots Council;

- The Vice-Chairperson of the Council is the person responsible for commendation and reward work in the agencies or units specified in Point a of Clause 1 of this Article;

- Members of the Grassroots Council established at the Ministry of Health include representatives of the leadership of the Traditional Medicine Management Department; the Cadres and Civil Servants Department; the Legal Affairs Department; the Science, Technology and Training Department; the Drug Administration Department; the Medical Examination and Treatment Management Department; representatives of the Central Association of Traditional Medicine, the Central Association of Acupuncture; and the Vietnam Medical Workers' Union. The Traditional Medicine Management Department serves as the Standing Body and Secretary of the Council;

- Members of the Grassroots Council established at units under the Ministry of Health include the leaders of the unit; representatives of the Trade Union; representatives of the heads of departments, divisions, and offices within the unit; and representatives of related units in the field of traditional medicine (if necessary);

- Members of the Grassroots Council established at health management agencies of other ministries and sectors: determined by the Chairperson of the Grassroots Council and implemented according to the regulations of the main managing ministry/sector;

- Members of the Grassroots Council belonging to the health administration agency of the provincial People's Committee (Department of Health) of provinces and centrally-administered cities include the Heads of some departments of the health administration agency of the provincial People's Committee (Department of Health); the Leaders of the Provincial Traditional Medicine Hospital; representatives of the commendation and reward organization at the same level; representatives of the Traditional Medicine Association, the Acupuncture Association; representatives of the Trade Union; and representatives of related units in the field of traditional medicine (if necessary). The unit responsible for commendation and reward work at the health administration agency of the provincial People's Committee (Department of Health) serves as the Standing Body and Secretary of the Council;

c) Tasks of the Grassroots Council

- Receive and select individuals who have made significant contributions in the field of traditional medicine, combining traditional medicine with modern medicine, worthy of being nominated for the Hai Thuong Lan Ong Award;

- Be responsible to the Ministry-level Council for proposals for individuals to be awarded; ensuring the correct target, criteria, and procedure;

- Organize information dissemination and promotion of exemplary models receiving the Hai Thuong Lan Ong Award through appropriate forms;

- The Grassroots Council of the Ministry of Health has the task of receiving dossiers, organizing the review, and issuing a document (attached with the dossier) to submit to the Ministry-level Council through the Standing Body of the Ministry-level Council (the Traditional Medicine Management Department) for individuals currently working at units under the Ministry of Health and central professional associations in the field of traditional medicine;

- The Grassroots Councils of units under the Ministry of Health have the task of receiving dossiers, organizing the review, advising the Head of the unit, and issuing a document (attached with the dossier) to submit to the Ministry-level Council through the Standing Body of the Ministry-level Council (the Traditional Medicine Management Department) for individuals under the management of the unit;

- The Grassroots Councils of health management agencies of other ministries and sectors have the task of receiving dossiers, organizing the review, and issuing a document (attached with the dossier) to submit to the Ministry-level Council through the Standing Body of the Ministry-level Council (the Traditional Medicine Management Department) for individuals currently working at health agencies and units managed by those ministries and sectors.

- The grassroots Council under the specialized agency on health care under the People's Committee of the province (Department of Health) of provinces and centrally governed cities has the duty to receive applications, organize reviews, and advise the Director of the specialized agency on health care under the People's Committee of the province (Department of Health) to submit lists and files of individuals under the management of the specialized agency on health care under the People's Committee of the province (Department of Health) and individuals belonging to professional associations in the field of traditional medicine within the provincial territory to the Ministry-level Council through the Standing Body of the Ministry-level Council (Traditional Medicine Management Department) for approval.

2. The Central Council

a) The Ministry-level Council consists of 11 to 13 members decided by the Minister of Health to establish;

b) Composition of the Council

- Chairman of the Ministry-level Council: Leader of the Ministry of Health;

- Deputy Chairmen of the Council: Director of the Traditional Medicine Management Department; Leader of the Cadre Organization Department;

- Members of the Council: representatives from the leadership of the Traditional Medicine Management Department, Cadre Organization Department, Legal Affairs Department, Science and Technology Training Department, Drug Administration Department, Medical Examination and Treatment Management Department; representatives from the Central Association of Traditional Medicine, Central Association of Acupuncture; Vietnam Medical Workers' Union; representatives from the leadership of related agencies and units and some experts in the field of traditional medicine. The Traditional Medicine Management Department serves as the Standing Body and Secretary of the Council;

c) Tasks of the Ministry-level Council

- Reviewing, examining, and evaluating files of individuals transferred from grassroots Councils, at the latest within 30 days from the date of receiving complete files;

- Ensuring the principles of awarding prizes as stipulated in Article 3 of this Circular.

3. Principles of operation of the Council

a) The Council operates based on the principle of transparency and democracy, deciding by majority;

b) Grassroots Councils only consider cases proposed by grassroots meetings;

c) The Ministry-level Council only considers cases proposed by grassroots Councils;

d) Sessions of the Council are valid when at least two-thirds of the Council members are present and vote. Absent members will be asked for their opinions by ballot and included in the voting results (if necessary);

đ) Individuals who are currently being considered for the Hai Thuong Lan Ong Award shall not participate in any level of the Council.

17. Amend and supplement Article 11 as follows:

"Article 11. Application Files for Award Consideration

Individuals proposing to be considered for the Hai Thuong Lan Ong Award must submit one set of application files directly, via postal service, or online; the files include:

1. Application form for consideration of the Hai Thuong Lan Ong Award.

2. Report on achievements: The report must clearly state compliance with Party guidelines and State laws, the practice history and tenure, professional competence and achievements in traditional medicine work, confirmed by the working unit. The individual commits to legal responsibility for the accuracy, truthfulness, and legality of the application file according to Model No. 01 prescribed in Appendix 02 issued together with this Circular (original copy).

3. Certificates or proof of meeting the criteria specified in Article 9 of this Circular (certified copies or confirmed by the accepting organization or introducing entity).

4. Introduction letter from organizations, mass organizations, political organizations, political-social organizations, social-professional organizations recommending participation in the award consideration (original copy).

5. Confirmation letter from the competent authority regarding the period of employment, professional competence, and professional ethics of the individual as stipulated in Article 8 of this Circular (original copy)."

18. Amend and supplement Clause 1 of Article 12 as follows:

"1. Before July 31 of the year of award consideration, the Traditional Medicine Management Department shall issue a notification about the Hai Thuong Lan Ong Award consideration to relevant agencies, organizations, and units; publish the notification on the Ministry of Health's electronic portal and the Traditional Medicine Management Department's website.

Provisions on the time limit for submitting files:

- Individuals proposing to be considered for the award must submit their files to the directly managing unit no later than August 15 of the year of award consideration;

- The directly managing unit must submit the files of individuals proposing to be considered for the award to the grassroots Council no later than September 30 of the year of award consideration;

- The grassroots Council must submit the files to the Standing Body of the Ministry-level Council no later than October 30 of the year of award consideration."

19. Amend Clause 1 of Article 13 as follows:

"1. Step 1. Individuals prepare application files in accordance with Article 11 of this Circular."

20. Amend and supplement Point b Clause 2 of Article 13 as follows:

"b) Organize a full meeting of civil servants, employees, and workers of the unit and conduct secret ballots.

- For units with 200 or fewer staff members: Organize a meeting of all civil servants, employees, and workers of the unit;

- For units with more than 200 staff members: Organize a meeting of civil servants, employees, and workers in the department/section/office where the individual works, with the participation of the unit's leadership, organizational cadre department, competition and reward department, and leaders, civil servants, employees, and workers of the department/section/office;

- The meeting is valid when at least 80% of civil servants, employees, and workers with a labor contract duration of 12 months or more are present and vote; the voting result is recorded in a protocol."

21. Amend Clause 1 of Article 14 as follows:

"1. The grassroots Council organizes meetings, studies files, conducts verification (if deemed necessary), and votes. Only individuals who receive at least 80% of the trust votes from the total number of grassroots Council members as decided in the establishment decision will be listed for submission to the Ministry-level Council.

In case of non-compliance, the Council will issue a notification signed by the Chairman to inform the individual proposing to be considered for the award.

Within 15 days from the date of the trust vote result, the grassroots Council must submit the results for review by the Ministry-level Council."

22. Amend Clause 1 of Article 15 as follows:

"1. Within 30 days from the date of receipt of files submitted by the grassroots Council, the Standing Body of the Council is responsible for reviewing and compiling them for the Ministry-level Council to examine."

23. Amend Clause 1 of Article 17 as follows:

“1. The budget for organizing the award presentation, awarding activities, and promotional activities shall be formed from state budget sources and other lawful financial resources.”

24. Amend and supplement Article 19 as follows:

“Article 19. Contents of expenditures to organize, promote, and present awards

1. Developing and implementing the selection plan of the Council.

2. Reviewing nomination files for award consideration.

3. Organizing Council meetings.

4. Announcing information about the selection on mass media.

5. Promotional activities related to the award.

6. Holding press conferences on the results of the selection.

7. Organizing the award ceremony.

8. Printing and photographing materials for the selection process; Certificates of Recognition; Certificate frames; Award badges.

9. Awarding monetary or tangible prizes according to regulations (if applicable) to individuals receiving the award.

10. Other activities as prescribed by law.”

25. Amend Model No. 01, Model No. 02, and Model No. 05 of Appendix 2 attached to this Circular.

Article 2. Effective Date

This Circular takes effect from December 14, 2024.

Article 3. Transitional Provisions

Nomination files for the Hai Thuong Lan Ong Award submitted before the date this Circular takes effect shall continue to be processed in accordance with Circular No. 16/2020/TT-BYT dated October 29, 2020 issued by the Minister of Health regarding standards and guidelines for presenting the Hai Thuong Lan Ong Award for traditional medicine work.

Article 4. Responsibilities for Implementation

1. Director of the Department of Traditional Medicine Management; Heads of units under and affiliated with the Ministry of Health; Heads of health sector agencies and units; Directors of specialized health agencies under provincial People's Committees directly under the central government; Professional associations in the field of traditional medicine and relevant individuals and organizations are responsible for implementing this Circular.

2. The Director of the Department of Traditional Medicine Management shall guide individuals and organizations in implementing this Circular, periodically compile and report to the Minister of Health.

3. During implementation, if there are difficulties, please reflect them to the Ministry of Health (Department of Traditional Medicine Management) for guidance or consideration and resolution.
