Guidelines for certain provisions on the professional standards of inspectors, inspector identification cards, and inspection uniforms for Diplomatic Inspection

Based on Decree No. 15/2008/NĐ-CP dated February 4, 2008 of the Government regarding the functions, tasks, powers, and organizational structure of the Ministry of Foreign Affairs;
Based on Decree No. 157/2006/NĐ-CP dated December 27, 2006 of the Government regarding the organization and operation of Diplomatic Inspection;
Based on Decree No. 100/2007/NĐ-CP dated June 13, 2007 of the Government regarding inspectors and inspection associates;
Based on Circular No. 150/2007/TTLT-BTC-TTCP dated December 14, 2007 jointly issued by the Ministry of Finance and the Government Inspectorate guiding the management and issuance of uniforms for inspectors and staff of state inspection agencies;
Based on Decision No. 04/2008/QĐ-BNV dated November 17, 2008 of the Ministry of Home Affairs promulgating the professional standards for various ranks of civil servants in the inspection sector;
To strengthen the organization, enhance specialized diplomatic inspection activities, and meet the requirements for unified state management in foreign affairs work;
After receiving the unified opinions of the Government Inspectorate and the Ministry of Home Affairs, the Ministry of Foreign Affairs guides certain provisions applicable to Diplomatic Inspection as follows:
This technical regulation sets out technical requirements, testing methods, sampling procedures; management requirements; responsibilities of organizations and individuals producing, trading, and importing cigarettes.
This Circular applies to units under the Ministry of Education and Training; departments of education and training, education and training divisions; preschool education institutions, general education institutions, regular education institutions, teacher training colleges, college of education, universities, universities, academies, other educational institutions, and related organizations and individuals (hereinafter referred to collectively as agencies and units).
a) This Circular provides specific guidelines on the professional standards of inspectors under Diplomatic Inspection, issuance of inspector identification cards, and uniforms applicable to inspectors and staff engaged in inspection work at state inspection agencies within the Foreign Affairs sector;
b) This Circular applies to inspectors and staff engaged in inspection work at state inspection agencies within the Foreign Affairs sector (hereinafter referred to as Diplomatic Inspection), including: Inspection Department of the Ministry, Inspection Departments of General Directorates under the Ministry, Inspection Departments of Provincial Departments of Foreign Affairs, and other inspection agencies as prescribed by law;
2. General Principles
a) The appointment, removal, and dismissal of inspectors shall be carried out in accordance with the Inspector Law, Decree No. 100/2007/NĐ-CP dated June 13, 2007 of the Government regarding inspectors and inspection associates, and other relevant legal documents;
b) Inspectors and staff engaged in inspection work at Diplomatic Inspection agencies must wear uniforms as prescribed by this Circular when performing official duties;
Inspectors and staff engaged in inspection work at Diplomatic Inspection may wear civilian clothes when working in offices;
c) Inspectors of Diplomatic Inspection are entitled to salary, allowances, and other benefits as stipulated by law;
d) In cases where inspectors and staff engaged in inspection work at Diplomatic Inspection agencies cease to perform inspection duties (transfer to other positions, go on overseas assignments, retire, or are disciplined with termination of employment), they must return their inspector identification cards and equipment provided to the Diplomatic Inspection agency;
II. PROFESSIONAL STANDARDS FOR RANKS OF DIPLOMATIC INSPECTORS
1. Ranks of Diplomatic Inspectors include
- Inspector
- Senior Inspector.
- Senior Inspector (High Rank).
2. Common Duties and Powers of Ranks of Diplomatic Inspectors
a) Inspectors of Diplomatic Inspection under these ranks have duties and powers as prescribed by the Civil Servant Law and other relevant legal documents;
b) During inspections, inspectors of Diplomatic Inspection under these ranks have duties and powers as prescribed by the Inspector Law, Decree No. 157/2006/NĐ-CP dated December 27, 2006 on the organization and operation of Diplomatic Inspection, Decision No. 04/2008/QĐ-BNV dated November 17, 2008 of the Ministry of Home Affairs promulgating the professional standards for various ranks of civil servants in the inspection sector, and other relevant legal documents;
c) Inspectors and staff engaged in inspection work at Diplomatic Inspection agencies under these ranks may use tools, technical means, and support equipment as prescribed by law to serve inspection work;
3. Professional Standards for the Rank of Diplomatic Inspector
The appointment of Inspectors, Senior Inspectors, and Senior Inspectors (High Rank) of Diplomatic Inspection must comply with general standards prescribed in Article 31 of the Inspector Law and other relevant legal documents, including specialized standards as follows:
- Graduated from a university in one of the following majors: Diplomacy, Foreign Languages, Law, Economics, Finance, Accounting.
- Hold a certificate of training for Inspectors, Senior Inspectors, and Senior Inspectors (High Rank) from the Inspector Cadre School.
- Possess a national or international language proficiency certificate.
- Hold a computer office skills certificate.
- Have legal knowledge, a deep and broad understanding of domestic and international economic and social conditions, and Party and State foreign policy; thoroughly understand and effectively apply state regulations in managing state affairs related to foreign relations, economy, culture, and society.
III. INSPECTOR IDENTIFICATION CARDS AND ISSUANCE AND RECOVERY OF DIPLOMATIC INSPECTION IDENTIFICATION CARDS
1. Inspector Identification Card
The Inspector Identification Card is used to confirm the legal status of inspectors when performing inspection and supervision duties as prescribed by Vietnamese law and international treaties to which Vietnam is a party.
Civil servants appointed to the ranks of Diplomatic Inspectors (Inspectors, Senior Inspectors, Senior Inspectors (High Rank)) will be issued Inspector Identification Cards.
2. Authority to Issue Inspector Identification Cards
The Minister of Foreign Affairs issues Inspector Identification Cards to Inspectors under the Inspection Department of the Ministry, Inspection Departments of General Directorates under the Ministry, and Inspection Departments of the Ho Chi Minh City Department of Foreign Affairs.
The Chairman of the People's Committee of provinces and centrally governed cities issues Inspector Identification Cards to Inspectors under the Inspection Departments of provincial Departments of Foreign Affairs.
3. Sample Inspector Identification Card
The sample Inspector Identification Card and its management and use shall be implemented according to Circular No. 2313/2007/TT-TTCP dated October 26, 2007 of the Government Inspectorate.
4. Use of Inspector Identification Card
Inspectors of the Diplomatic Inspection belonging to various ranks are responsible for preserving and using the inspector identification card while performing their duties. Strictly prohibited from using the inspector identification card for personal purposes. In case an inspector uses the inspector identification card to commit acts contrary to the law, they will be subject to disciplinary action or criminal liability depending on the nature and severity of the violation.
IV. PROVISIONS ON THE UNIFORM OF DIPLOMATIC INSPECTION
1. Quantity of uniforms
The quantity of uniforms issued to inspectors and staff under the Diplomatic Inspection agencies shall be implemented according to Circular Joint Circular No. 150/2007/TTLT-BTC-TTCP dated December 14, 2007 of the Ministry of Finance and the Government Inspectorate, specifically as follows:

For southern provinces, based on specific conditions and within the budget allocation for uniform procurement, the heads of state inspection agencies (or the management agencies of such inspection bodies) may consider deciding to convert the overcoat into spring and summer clothing to suit the weather conditions.
2. Provisions on the style and design of the uniform for inspectors and staff engaged in Diplomatic Inspection work
- Autumn and winter clothing: A black navy blue suit with a two-button collar, featuring two hidden pockets below and one hidden pocket above the front flap.
- Spring and summer clothing:
+ For men: Short-sleeved white shirt with a stiff collar and cuffs, black navy blue trousers (suitable for all seasons).
+ For women: Short-sleeved white shirt with a feminine style, stiff collar and cuffs, black navy blue trousers or office-style skirts.
- Long-sleeved white shirt: White cotton fabric.
+ For men: Long-sleeved white shirt with a stiff collar.
+ For women: Long-sleeved white shirt with a feminine style and a stiff collar.
- Black necktie, black leather belt; low-cut black leather shoes; dark-colored socks.
3. Principles for issuing uniforms
The principles for issuing uniforms and the procedures for budgeting, managing, and settling accounts for uniform procurement expenses shall be implemented according to Circular Joint Circular No. 150/2007/TTLT-BTC-TTCP dated December 14, 2007 of the Ministry of Finance and the Government Inspectorate.
V. EFFECTIVE DATE
1. This Circular shall take effect fifteen days from the date of publication in the Official Gazette.
2. The Chief Inspector of the Ministry shall lead, coordinate with the Director of the Cadre and Civil Service Department and the heads of relevant agencies and units to guide, inspect the implementation of this Circular, and report periodically to the Minister.
3. Any issues arising during implementation should be promptly reported to the Ministry of Foreign Affairs (through the Ministry Inspectorate) for necessary amendments and supplements to ensure compliance./.
