Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to Directive No. 37/2004/CT-TTg dated November 8, 2004 of the Prime Minister on continuing to implement Resolution No. 09/1998/NQ-CP regarding the National Program on Crime Prevention and Control until 2010;
Pursuant to Plan No. 01/2005/KH-BCĐ138/CP dated March 18, 2005 of the National Steering Committee for Crime Prevention and Control under the Government;
Considering the proposal of the Ministry of Public Security at Circular No. 102/BCA (V26) dated August 2, 2007, Circular No. 70/2008/BCA (V26) dated January 11, 2008; the opinion of the Ministry of Labor, Invalids and Social Affairs at Circular No. 3801/BLĐTBXH-TCDN dated October 18, 2007; the opinion of the Ministry of Planning and Investment at Circular No. 7839/BKH-QPAN dated October 24, 2007; the opinion of the Ministry of Finance at Circular No. 13450/BTC-VI dated October 8, 2007,
DECISION:
Article 1. Approves the Project to Enhance Educational and Vocational Training Capacity for Prisoners in Detention Centers with the following contents:
1. Name of the Project: Enhancing Educational and Vocational Training Capacity for Prisoners in Detention Centers.
2. Managing Authority: Ministry of Public Security.
3. Lead Agency: Cục V26 - Ministry of Public Security
4. Implementing Agencies: detention centers directly subordinate to Cục V26 - Ministry of Public Security (with attached annexes)
5. Objectives of the Project
To improve the quality and effectiveness of vocational training for prisoners in detention centers, thereby creating positive changes, enhancing the quality of correctional work, contributing to better performance of the tasks of detention centers, and preventing recidivism.
6. Contents of the Project: including two component projects.
a) Project No. 1: Investment in basic construction and provision of equipment and tools for vocational training for prisoners in detention centers.
- Objectives of the Project:
+ Investment in basic construction in vocational training centers, including items such as building theoretical classrooms, center offices, practical workshops, finished product warehouses; constructing and renovating ancillary facilities: internal courtyards, roads, fences, outdoor electrical systems, lightning protection systems...;
+ Provision of equipment and tools for vocational training.
- Scale of investment:
+ Construction of the Center Office Building, project grade: Grade III, construction area: 9,509 square meters2;
+ Construction of the Theoretical Classroom Building, project grade: Grade III, construction area: 11,593 square meters2;
+ Construction of the Practical Workshop Building, project grade: Grade III, construction area: 39,127 square meters2;
+ Construction of the Finished Product Warehouse, project grade: Grade III, construction area: 11,640 square meters2;
+ Construction and renovation of ancillary facilities: internal courtyards, roads, auxiliary buildings, fences, greenery, outdoor electricity and water supply, lightning protection system, communication system;
+ Provision of equipment and tools for vocational training in various trades: civil construction; carpentry; welding, blacksmithing, forging, turning; motor, motorcycle, car repair; household and industrial electrical repair, electronics, industrial sewing, hand sewing, office computing; weaving mats, knitting...
b) Project No. 2: Organizing education and vocational training for prisoners in detention centers.
- Objectives of the Project.
Organizing education and vocational training to equip prisoners with knowledge and skills in their professions, fostering labor awareness and habits, fundamentally changing correctional work, contributing to better performance of the tasks of detention centers, and preventing recidivism.
- Scale of investment.
+ Costs for hiring teachers;
+ Costs for preparing curricula and lesson plans;
+ Costs for organizing graduation exams, issuing certificates and vocational diplomas;
+ Costs for purchasing study materials and office supplies.
7. Trades and Training Programs
- The trades trained in this project are those listed in the current vocational training directory, meeting social needs.
- The vocational training programs are short-term programs (less than one year) issued according to current regulations.
8. Total investment amount is 446,676,213,000 VND
(Four hundred forty-six billion, six hundred seventy-six million, two hundred thirteen thousand VND).

a) Project on investment in basic construction and provision of equipment and tools for vocational training for prisoners in detention centers: 430,548,903,000 VND, including:
- Construction costs: 189,809,600,000 VND
- Vocational training equipment: 178,148,150,000 VND
- Office machines and tools: 6,432,600,000 VND
- Other costs (5% of construction and equipment costs): 18,719,518,000 VND
- Contingency fees (10% of construction and equipment costs): 37,439,035,000 VND
b) Project on organizing education and vocational training for prisoners in detention centers: 15,458,300,000 VND, including:
- Costs for hiring teachers: 10,863,000,000 VND
- Costs for preparing programs and lesson plans: 720,000,000 VND
- Costs for organizing vocational exams, issuing certificates, and diplomas: 1,430,000,000 VND
- Costs for learning materials and office supplies: 429,000,000 VND
- Other costs (5%): 672,100,000 VND
- Contingency fees (10%): 1,344,200,000 VND
c) Costs for developing the Proposal (0.15%): 669,010,000 VND
9. Implementation period
- Phase I from 2008 to 2010: total investment amount: 183,106,802,000 VND.
- Phase II from 2011 to 2015: total investment amount: 263,569,411,000 VND.
10. Sources of Investment Capital
Central budget funds according to the National Target Program on Crime Prevention and Control.
11. Implementation Form
The investor directly manages and implements the Proposal.
12. Implementation Method
Tendering and direct contracting in accordance with current laws.
Article 2. Implementing organization.
1. The Minister of Public Security shall take the lead and coordinate with relevant ministries and sectors to review and approve component projects of the Proposal in accordance with State regulations; organize the implementation of the Proposal; evaluate the annual results and report to the Prime Minister.
2. The Ministry of Planning and Investment shall be responsible for allocating the annual budget to ensure the progress of the Proposal and project implementation; supervise the investment process of the Proposal in accordance with its functions and tasks.
3. The Ministry of Finance shall ensure sufficient and timely state budget funds for implementing the Proposal; take the lead and coordinate with the Ministry of Public Security to develop and issue mechanisms and policies for labor reform combined with vocational training for prisoners in detention centers; guide and inspect the use and settlement of expenses for the Proposal and project in accordance with the provisions of the State Budget Law.
4. The Ministry of Labor, Invalids and Social Affairs, as the state management agency for vocational training, shall be responsible for coordinating with the Ministry of Public Security to guide the organization of vocational training activities for prisoners and the policies and benefits for management staff, trainers, and trainees in detention centers; support the development and transfer of vocational training programs and curricula and the training of prisoner instructors.
5. Localities shall be responsible for creating conditions for detention centers to organize production and provide employment opportunities for prisoners; assist prisoners returning to their localities after release in finding jobs and quickly reintegrating into society.
6. The Ministry of Public Security shall take the lead and coordinate with the Ministry of Planning and Investment, the Ministry of Finance, and the Ministry of Labor, Invalids and Social Affairs to direct and inspect the implementation of the Proposal and project in accordance with current laws, ensuring efficiency, economy, and prevention of waste and loss.
Article 3. This Decision shall take effect from the date of signing.
Article 4. The Ministers of the Ministries of Public Security, Planning and Investment, Finance, Labor - Invalids and Social Affairs, and the Chairmen of the People's Committees of provinces and centrally-administered cities are responsible for enforcing this Decision./.
