DECISION
Regulations on functions, tasks, powers, and organizational structure
of the Administrative and Public Financial Affairs Department

THE MINISTER OF FINANCE
Pursuant to Decree No. 178/2007/ND-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Pursuant to Decree No. 118/2008/ND-CP dated November 27, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Considering the proposal of the Director of the Administrative and Public Financial Affairs Department and the Director of the Cadre and Civil Servant Organization Department,
DECISION:
Article 1. Position and Functions
The Administrative and Public Financial Affairs Department is an entity under the Ministry of Finance, with the function of advising and assisting the Minister of Finance in performing state management tasks related to finance in the administrative and public sectors (excluding objects managed by Department I);
Article 2. Tasks
1. Submit to the Minister of Finance:
a) Drafts of normative legal documents, mechanisms, policies, and budget expenditure regulations for administrative agencies and public institutions (including permanent representative offices of Vietnam abroad); policies on budget expenditure support for political-social organizations, political-social-professional organizations, social organizations, and social-professional organizations;
b) Drafts of state management documents on finance for the operations of the Social Insurance Fund, Health Insurance Fund, and other funds within the administrative and public sectors according to the assignment of the Minister of Finance.
2. Organize implementation and guide, inspect, and evaluate the execution of normative legal documents, policies, systems, standards, and expenditure quotas of administrative agencies, public institutions, and other entities using state budget funds within the scope of management of the Department.
3. Participate with Ministries, ministerial-level agencies, government agencies, and other central agencies in building strategies, planning, development plans (long-term, five-year, annual), and other projects within the administrative and public sectors.
4. Coordinate in building national financial policies and other financial policies according to the assignment of the Minister of Finance.
5. On state budget management:
a) Take the lead in discussing and consolidating the annual regular budget revenue and expenditure estimates of Ministries (including the Government's Official Communications Service Board, the Government's Border Management Board, the Radio Frequency Management Bureau), ministerial-level agencies, government agencies, and political-social organizations; consolidate the budget support funding estimates for political-social-professional organizations, social organizations, and social-professional organizations at the central level within the scope of management (excluding foreign aid funding);
b) Review the allocation of annual regular budget revenue and expenditure estimates of Ministries, ministerial-level agencies, government agencies, and political-social organizations at the central level; review the allocation and transfer of budget support funding estimates for political-social-professional organizations, social organizations, and social-professional organizations at the central level within the scope of management assigned;
Review the allocation of budget support funding for political-social-professional organizations, social organizations, and social-professional organizations at the central level according to the assignment of the Minister of Finance;
c) Inspect and evaluate the implementation of annual regular budget revenue and expenditure estimates of Ministries, ministerial-level agencies, government agencies, and political-social organizations; the implementation of budget support funding for political-social-professional organizations, social organizations, and social-professional organizations at the central level within the scope of management of the Department.
d) Submit to the Minister of Finance for supplementation, adjustment, transferring annual surplus funding, advance (if necessary) the annual administrative and public sector expenditure budget estimates of Ministries, ministerial-level agencies, government agencies, and political-social organizations within the scope of management of the Department; supplement, adjust, and advance budget support funding for political-social-professional organizations, social organizations, and social-professional organizations at the central level according to regulations;
đ) Review and announce the results of reviewing the annual budget revenue and expenditure settlement of Ministries, ministerial-level agencies, government agencies, and political-social organizations at the central level within the scope of management.
Approve and announce the results of approving the settlement of support funding for political-social-professional organizations, social organizations, and social-professional organizations at the central level within the scope of management of the Department.
6. Implement financial management of national target programs and projects according to the assignment of the Minister of Finance.
7. Develop financial mechanisms to serve the transition of public service units (which have applied or not applied business financial mechanisms but still maintain the organizational model of public service units).
8. Lead and participate with relevant agencies in salary policies and pay scales for the administrative and public sectors.
9. Lead and coordinate with units under the Ministry in handling specific conclusions and recommendations regarding finance from the State Audit Agency, Inspection Agencies, and Criminal Investigation Agencies concerning objects within the scope of management of the Department.
10. Lead and coordinate with units under the Ministry to compile, assess the situation of management and use of administrative and public sector expenditure funds.
11. Carry out analytical forecasting, statistics, compilation of situations and data; analyze and evaluate the effectiveness of budget spending in the administrative and public sectors.
12. Lead or coordinate with related units to organize information dissemination, promotion, and popularization of laws in areas within the functions and tasks of the Department.
13. Coordinate with related units to organize the implementation of international cooperation tasks; receive and implement international cooperation projects and technical assistance for policy formulation and enforcement according to the assignment of the Minister of Finance.
14. Organize scientific research or cooperate in scientific research with units inside and outside the industry according to approved plans and contents.
15. Perform other tasks and powers delegated by the Minister of Finance and as prescribed by law.
Article 3. Organizational Structure
The Administrative and Public Financial Affairs Department has a Director and several Deputy Directors.
The Director of the Administrative and Public Service Financial Affairs Department is responsible before the Minister of Finance for all activities of the Department; manages civil servants and assets assigned according to regulations.
The Deputy Director of the Administrative and Public Service Financial Affairs Department is responsible before the Director for the tasks assigned.
The Administrative and Public Service Financial Affairs Department has the following divisions:
1. Administrative and Mass Organizations Division.
2. Health and Social Services Division.
3. Cultural, Scientific and Educational Services Division.
4. Economic Services Division.
Specific tasks of each Division are defined by the Director of the Administrative and Public Service Financial Affairs Department.
The Administrative and Public Service Financial Affairs Department operates through division organization combined with specialist systems. For tasks carried out under the specialist system, the Director assigns duties to staff and civil servants in accordance with their titles, standards, and professional capabilities to ensure the completion of assigned tasks.
The staffing of the Administrative and Public Service Financial Affairs Department is decided by the Minister of Finance.
Article 4. Responsibilities and authorities of the Director
1. Organizes and directs the implementation of tasks as stipulated in Article 2 of this Decision.
2. Signs memoranda approving budgets for managed entities within the scope approved by the Minister of Finance.
3. Reports to the Minister of Finance for handling or refers to competent authorities for handling management documents on administrative and public service financial affairs issued by central and local agencies that contravene state regulations and those of the Ministry of Finance.
4. Receives reports as prescribed, relevant documents, and information to perform assigned functions and tasks.
5. Signs guiding, explanatory, and response documents regarding issues within the scope of the Department's work and documents signed upon delegation or authorization from the Minister of Finance according to the Ministry’s operational regulations.
6. Has the right to refuse to review final accounts when submitted documents are incomplete; refuse to accept reports not in compliance with regulations and failing to meet the Ministry of Finance's management requirements.
7. Signs final account review notifications authorized by Ministry leadership (if applicable).
8. During final account reviews, if errors are discovered, has the right to request reviewing bodies to correct them, and simultaneously recommend to the Minister of Finance to handle violations according to the law.
Article 5. Effectiveness and Responsibility for Implementation
This Decision takes effect from the date of signing and replaces Decision No. 148/2003/QĐ/BTC dated September 12, 2003, of the Minister of Finance on the functions, responsibilities, authorities, and organizational structure of the Administrative and Public Service Financial Affairs Department.
The Director of the Administrative and Public Service Financial Affairs Department, the Director of the Cadre and Civil Servant Organization Department, the Head of the Ministry's Office, and the Heads of organizations and units under the Ministry of Finance are responsible for implementing this Decision./.
