Decree No. 246/2025/NĐ-CP amends and supplements Decree No. 68/2015/NĐ-CP dated August 18, 2015, of the Government on registration of nationality and rights to aircraft, which has been amended and supplemented by Decree No. 64/2022/NĐ-CP dated September 15, 2022, of the Government amending and supplementing certain provisions of decrees related to business activities in the civil aviation sector.

DECREE

Amending and supplementing Decree No. 68/2015/NĐ-CP dated August 18, 2015 of the Government on registration of nationality and registration of rights to aircraft which has been amended and supplemented by Decree No. 64/2022/NĐ-CP dated September 15, 2022 of the Government amending and supplementing certain articles of decrees regulating activities related to civil aviation business operations.

Pursuant to the Law on Government Organization No. 63/2025/QH15;

Pursuant to the Civil Aviation Law No. 66/2006/QH11; the Law Amending and Supplementing Certain Articles of the Civil Aviation Law No. 61/2014/QH13;

At the proposal of the Minister of Construction;

The Government promulgates this Decree amending and supplementing certain articles of Decree No. 68/2015/NĐ-CP dated August 18, 2015 of the Government on registration of nationality and registration of rights to aircraft which has been amended and supplemented by Decree No. 64/2022/NĐ-CP dated September 15, 2022 of the Government amending and supplementing certain articles of decrees regulating activities related to civil aviation business operations.

Article 1. Amending and supplementing certain articles of Decree No. 68/2015/NĐ-CP dated August 18, 2015 of the Government on registration of nationality and registration of rights to aircraft which has been amended and supplemented by Decree No. 64/2022/NĐ-CP dated September 15, 2022 of the Government amending and supplementing certain articles of decrees regulating activities related to civil aviation business operations as follows:

1. Amending Point c and adding Point d Clause 2 Article 8 as follows:

"c) At the request of the owner of the aircraft or the person requesting registration of the aircraft;"

d) At the request of the person designated in the IDERA document."

2. Adding Clause 3 Article 8 as follows:

"3. In cases where the IDERA document has been registered in accordance with this Decree, only the person designated in the IDERA document shall have the right to request cancellation of the registration of nationality of the aircraft."

3. Amending and supplementing Clause 2, Article 9 as follows:

“2. For the case of cancellation of registration provided for in Points c and d Clause 1 Article 8 and Points c and d Clause 2 Article 8 of this Decree, the person requesting cancellation of registration of nationality of the aircraft shall submit one set of documents directly or through the postal service or through the online public service system to the Vietnam Civil Aviation Authority and shall be responsible for the accuracy and truthfulness of the information recorded in the documents.”

4. Amending the name of Clause 3 Article 9 as follows:

"3. Documents for requesting cancellation of registration of nationality of the Vietnamese aircraft at the request of the owner of the aircraft or the person requesting registration of the aircraft, including:"

5. Adding Clause 3a after Clause 3 Article 9 as follows:

"3a. Documents for requesting cancellation of registration of nationality of the aircraft and certification of export flight conditions at the request of the person designated in the IDERA document, including:

a) Form No. 02a prescribed in the Appendix issued together with this Decree;

b) A copy from the original book or a photocopy from the original or a copy presented with the original for comparison or an electronic copy from the original book or an electronically certified copy from the original of the documents proving the legal status of the person requesting cancellation of registration in cases where the person requesting is a Vietnamese organization or individual.

In cases where the documents proving the legal status of the person requesting cancellation of registration are issued by a foreign authority with jurisdiction, these documents must be legalized consularly in accordance with the provisions of the law, except in cases exempted under Vietnamese law;

c) A document agreeing to cancel registration and export the aircraft from those persons with higher priority international interests who have been registered or evidence proving that the higher priority international interests have been implemented;

d) In cases where the person designated in the IDERA document is the recipient of an aircraft guarantee, the documents must also include evidence proving that the person requesting cancellation of registration has notified in writing to those persons with higher priority international interests who have been registered, the owner of the aircraft, and the person requesting registration of nationality of the aircraft about the request to cancel registration of the aircraft at least ten working days before submitting the application documents."

6. Amending and supplementing Clause 5 Article 9 as follows:

"5. Within five (05) working days from the date of receipt of complete documents in accordance with the regulations, the Vietnam Civil Aviation Authority shall issue the Certificate of Cancellation of Registration of Nationality of the Vietnamese Aircraft according to Form No. 06 prescribed in the Appendix issued together with this Decree and issue the Certificate of Export Flight Conditions according to Form No. 06a prescribed in the Appendix issued together with this Decree for cases of cancellation of registration of nationality of the aircraft at the request of the person designated in the IDERA document; recover the Certificate of Aircraft Bearing Vietnamese Nationality; in cases where issuance is not made, the Vietnam Civil Aviation Authority must reply in writing to the applicant according to Form No. 15 prescribed in the Appendix issued together with this Decree.

In cases where the documents are incomplete, within two (02) working days from the date of receipt of the documents, the Vietnam Civil Aviation Authority shall issue a document guiding the applicant to complete the documents in accordance with the regulations."

Article 2. Supplement, replace phrases, and abolish some points of Decree No. 68/2015/NĐ-CP dated August 18, 2015 of the Government on registration of nationality and registration of rights to aircraft as follows:

1. Supplement Form No. 02a, Form No. 06a, and Form No. 15 prescribed in the Appendix promulgated together with this Decree.

2. Replace the phrase "Ministry of Transport" with the phrase "Ministry of Construction" in Clause 1 and Clause 2 of Article 30.

3. Replace the phrase "Ministry of Transport" with the phrase "Ministry of Construction," and replace the phrase "MINISTRY OF TRANSPORT" with the phrase "MINISTRY OF CONSTRUCTION" in Forms No. 04, No. 05, No. 06, No. 07, No. 08, No. 09, and No. 10 prescribed in the Appendix promulgated together with Decree No. 68/2015/NĐ-CP dated August 18, 2015 of the Government on registration of nationality and registration of rights to aircraft.

4. Abolish Point c and Point d of Clause 3 of Article 9.

Article 3. Implementation Provisions

1. This Decree takes effect from November 1, 2025.

2. Applications for deregistration of nationality of aircraft submitted to the Civil Aviation Authority of Vietnam before the date this Decree takes effect shall be processed in accordance with the provisions of this Decree.

3. The Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees under central cities are responsible for implementing this Decree./.
