GRADUATION EXAMINATIONS FOR COMPLEMENTARY CULTURAL EDUCATION AT THE UPPER SECONDARY LEVEL

Article 1. Now hereby promulgates the regulations on graduation examinations for complementary cultural education at the upper secondary level (annexed to this Decision).
Article 2. The Heads of the Office, Directors of the Department of Complementary Cultural Education, the Department of Organization and Cadres of the Ministry of Education, the Chairmen of the Administrative Committees of the provinces, municipalities directly under the Central Government, the Directors of Departments of Education and the Chiefs of Education Bureaus are responsible for implementing this Decision.
REGULATIONS
GRADUATION EXAMINATIONS FOR COMPLEMENTARY CULTURAL EDUCATION AT THE UPPER SECONDARY LEVEL

PART I
OBJECTIVES AND GENERAL PRINCIPLES
Article 1. The purpose of the graduation examination for complementary cultural education at the upper secondary level is:
- To assess and confirm the general knowledge level of students in complementary cultural education to ensure their rights and policies;
- To contribute to evaluating the implementation of the curriculum by schools, the teaching results of teachers, and the learning outcomes of students to promote the "Two Goods" competition movement in the field of complementary cultural education;
- To help educational levels draw lessons from leadership guidance to improve the quality of learning in complementary cultural education schools.
Article 2. Annually, there will be one graduation examination organized at the end of the academic year for all students in concentrated, part-time complementary cultural education schools, and self-study candidates.
For vocational general education schools (complementary cultural education for cadres), if necessary, a second graduation examination may be organized at the end of the Gregorian calendar year.
Article 3. Under the direction of the Ministry of Education and the leadership of the Administrative Committee of the province, city directly under the Central Government, the Departments and Bureaus of Education have the responsibility to organize and manage the examinations.
Article 4. Complementary cultural education schools are responsible for preparing files for their students (including students who have attended previous courses) to submit to the Departments and Bureaus of Education within the prescribed time limit.
Self-study candidates must register to take the exam and submit their files to the Departments and Bureaus of Education where they work and produce.
Article 5. When entering the examination room, candidates must present their identification card or identity certificate issued by the police authority.
Chapter II
ELIGIBILITY FOR EXAMINATION
Article 6. Candidates for graduation examinations for complementary cultural education at the upper secondary level must complete the upper secondary curriculum issued by the Ministry of Education.
Students who have completed grade 10 of general education, participated in labor at production units, or been recruited into state agencies, and are currently studying at training schools or vocational schools can also take the graduation examination for complementary cultural education at the upper secondary level.
Those who are disciplined with "no examination" shall not be allowed to take the examination.
Article 7. Only those students meeting the admission criteria for concentrated schools specified by the State (including current and former students of previous courses) are eligible to take the graduation examination for the concentrated system of complementary cultural education at the upper secondary level.
Article 8. The examination file of candidates includes:
- An application form for the examination certified by the management authority;
- A genuine transcript issued by the school;
- A certificate of successful completion of lower secondary education or a diploma of intermediate vocational education.
Article 9. Self-study candidates must submit:
- An application form for the examination certified by the management authority;
- A certificate of successful completion of lower secondary education or a diploma of intermediate vocational education;
- A statement of self-study activities at the upper secondary level confirmed by the management authority. This statement is only valid for each examination period and does not serve as proof of educational qualifications issued by educational authorities.
In addition to the files listed in point 8, former students of general education schools must also submit a certificate of eligibility to take the examination as stipulated in Article 6.
Candidates who are war invalids or ethnic minorities must provide a copy of their war invalid certificate or a certificate confirming their status as an ethnic minority issued by the management authority or administrative committee at the district level or higher.
Chapter III
CHAPTER TEST PROGRAM, SUBJECTS AND EXAM QUESTIONS
Article 10. The test program is the current secondary supplementary education curriculum applied according to each type of examinee and each type of school.
Article 11. Subjects for the examination are stipulated by the Ministry of Education and will be announced at the beginning of April each year.
Article 12. The Examination Question Board of the Ministry of Education will prepare questions, answer keys, grading scales, and uniform guidelines for all examination boards.
Chapter IV
EXAMINATION SUPERVISION AND MARKING BOARDS
Article 13. Depending on the specific circumstances of each examination period, each province or centrally governed city shall establish one or more examination supervision boards but only one marking board.
Article 14. The composition of the examination supervision and marking boards includes:
- One chairman,
- One or two vice chairmen,
- One or two secretaries,
- A number of invigilators, ensuring that each examination room has two teachers,
- A number of markers, ensuring that each exam paper must be marked by at least two teachers.
Article 15. The provincial administrative committee or centrally governed city committee shall issue a decision to establish the examination supervision and marking boards for secondary supplementary education graduation examinations within their respective provinces or cities in accordance with the regulations of the Ministry of Education.
Article 16. The establishment of examination supervision and marking boards must ensure the following principles:
2. At least half of the leadership and invigilators in an examination supervision committee must be individuals without candidates from their own schools. In a pair of invigilators, two teachers from the same school should not be assigned.
1. The chairman and vice chairmen of the board must be education sector officials with expertise in their field and knowledge of examination procedures.
2. Individuals who have students from their own schools or units participating in the examination shall not be assigned to the board.
In places where there is only one or two examination supervision boards, at least half of the invigilators must not have students from their own boards participating in the examination.
In a pair of invigilators, it is not allowed to assign two teachers from the same school.
3. If the examination supervision board is located at a school, then that school shall appoint its principal or deputy principal to participate in the board as vice chairman responsible for material resources and security during the examination period.
The Chairperson is a leader of the Supplementary Education Department of the Department or Bureau or the Principal of a centralized supplementary education school in the province or city.
1. The chairman of the Examination Board shall be the Deputy Director of the Department or Deputy Head of the Education Bureau responsible for supplementary education; in special cases, a department head of supplementary education from the Department or Bureau may be appointed instead.
2. Markers must be secondary school teachers in the relevant subject. In a pair of markers, it is not allowed to assign two teachers from the same school.
Article 17. - The Chairperson leads all work within the examination committee they oversee.
a) Examination supervision and marking boards must operate impartially in accordance with established principles and within the scope of authority defined in the examination regulations.
- Resolve complaints filed by candidates.
b) The chairman of the examination supervision and marking board leads all activities of the examination period under his/her responsibility.
- Vice chairmen lead the board within the scope delegated by the chairman.
- The secretary assists the leadership in preparing documents, records, files, and minutes of meetings.
- Invigilators and markers are responsible for strictly supervising and marking exams in accordance with the prescribed rules.
Article 18. The file of the examination supervision board includes:
- All candidate files as stipulated in Articles 4, 8, and 9;
- A list of candidates with registration numbers arranged alphabetically (A, B, C, etc.) and must be posted at the examination venue one day before the examination;
- Two call sheets for candidates to sign when taking each subject (according to the specified format);
- Candidates' answer papers;
- Minutes and files of disciplinary violations or unexpected incidents occurring during the examination;
- Minutes of the examination supervision board.
Article 19. The marking council's file includes:
- All files of the examination supervision board as stipulated in Article 18;
- Two lists of candidates with scores for each subject;
- Two lists of successful candidates: those who pass directly, those recommended for re-evaluation, and those recommended for special consideration (if applicable);
- Minutes of subject marking sessions accompanied by score statistics;
- Minutes of the marking board and a report summarizing the examination results.
Chapter V
ELIGIBILITY FOR ADMISSION
Article 20. Candidates recognized as directly admitted are:
- Those who take all subjects in one examination period, achieving an average score of five points or higher, with no subject scoring zero;
- Achieving satisfactory results in all subjects (five points or higher) in two consecutive examination periods.
Article 21. The recommendation for re-evaluation applies only to students from centralized schools and part-time schools with good discipline if they meet the following criteria:
- Taking all subjects in one examination period;
- Total scores falling short of the required average by two points as stated in Article 20, but scores below five points in any subject must have a final class total score of five points or higher;
- Academic performance rated as average for the entire year, moral character, work, and labor rated as good or better.
Article 22. Students from centralized or part-time supplementary education schools who have completed the curriculum, have a good attitude towards study, good moral character, a final class total score of five points or higher in all subjects, and have met the conditions for the examination but were mobilized for military service, long-term volunteer service, or public works B, C (with a mobilization decision from an authorized agency at the county level or above) on the examination date shall be considered for special admission.
Article 23. Candidates who are war invalids shall be granted an additional point to their total examination score for evaluation purposes.
Candidates who are ethnic minorities shall be granted an additional point to their literature subject score for evaluation purposes.
Chapter VI
REVIEW AND RECOGNITION OF RESULTS
Article 24. Directors of Departments and Heads of Education Bureaus are responsible for reviewing the results of secondary supplementary education graduation examinations of the marking boards under their jurisdiction.
The Director of the Supplementary Education Division of the Ministry of Education is responsible for reviewing and issuing graduation certificates to candidates from some schools not under the jurisdiction of provincial or municipal marking boards.
Article 25. Responsibilities and authorities of the reviewer:
- Reviewing all files of the examination supervision and marking boards in their respective provinces or cities;
- If necessary, requesting the marking board to re-examine the scoring or establishing a review panel to re-mark the papers;
- Approving the list of successful candidates, deciding on the recognition of examination results, and issuing graduation certificates to successful candidates;
- Revoking the results of individual candidates and recommending to the Ministry of Education to revoke the results of the entire examination board if serious violations of examination regulations are found.
Each year, the Ministry of Education will issue a decision to establish an examination review board. The review board has the responsibilities and authorities:
Article 26. - To inspect the implementation of examination regulations in localities;
- To recommend the Ministry of Education to revoke the results of individual candidates, of individual examination boards, or of entire localities if serious violations of examination regulations are found.
The report on examination results submitted to the Ministry of Education includes:
Article 27. 1. Comprehensive reports on the entire examination period from Departments and Bureaus of Education;
2. Decisions to establish examination supervision and marking boards.
Decision to establish the Examination Supervision Board and Marking Board;
3. Report from the Department Director or Education Bureau Chief on the examination approval results accompanied by a list of successful candidates;
4. Examination marking records of each subject accompanied by statistics of examination scores for that subject;
5. Examination results statistics (in accordance with the prescribed form);
6. Examination papers, three highest scoring, three average scoring, and three lowest scoring papers for each subject;
7. Report on rewards and disciplinary actions (if applicable).
Article 28. The examination results must be announced no later than thirty days after the examination, along with individual subject scores for each candidate.
Article 29. All examination files shall be managed and stored by the Departments and Education Bureaus for at least three years; specifically, grade sheets, lists, admission decisions, diplomas issuance registers, and examination summary reports shall be stored permanently.
Chapter VII
REWARD AND DISCIPLINE
A - REGARDING THE EXAMINATION BOARD
Article 30. During their work, members of the examination board who make significant efforts and show initiative will be recommended for commendation by the Departments and Education Bureaus, Provincial or Municipal Administrative Committees.
Members of the examination board who supervise or mark examinations and violate examination regulations during their duties or subsequently discovered will face appropriate disciplinary measures by the Departments and Education Bureaus, Provincial or Municipal Administrative Committees, or the Ministry of Education depending on the severity of the offense. In serious cases, they may be prosecuted under the law.
B - REGARDING THE CANDIDATES
Article 31. The examination marking board reviews and recommends commendations to the Departments and Education Bureaus for candidates achieving excellent results.
For candidates who cheat during the examination, depending on the severity of the offense, the examination board will decide and record disciplinary actions such as reprimand, warning, expulsion from the examination room, disqualification from continuing the examination, non-scoring of examination papers, non-approval of examination results, or recommendation to the Departments and Education Bureaus not to allow them to take the examination for one or two periods.
Candidates who cheat and are discovered later will be subject to disciplinary actions such as cancellation of examination results, revocation of graduation certificates.
C - REGARDING OTHER PERSONS
Article 32. Other persons who violate examination regulations, such as providing conditions for candidates to cheat, taking the examination on behalf of candidates, leaking examination questions to candidates, disrupting examination order... will face appropriate disciplinary measures recommended by the examination boards or Departments and Education Bureaus to the directly managing authorities depending on the severity of the offense. In serious cases, they may be prosecuted under the law.
Chapter VIII
IMPLEMENTING PROVISIONS
Article 33. This regulation takes effect from the date of issuance. Previous provisions contrary to this regulation are hereby abolished.
Article 34. The Director of the Supplementary Education Department is responsible for guiding the implementation of this regulation.
