Guidelines for Procuring Educational Teaching Equipment to Support the Reform of General Education Programs

Pursuant to Resolution No. 40/2000/QH10 dated December 9, 2000 of the National Assembly and Directive No. 14/2001/CT-TTg dated June 11, 2001 of the Prime Minister on reforming general education programs to enhance material infrastructure and teaching equipment to improve educational quality, the Ministry of Education and Training provides specific guidelines for procuring educational teaching equipment to support the reform of general education programs as follows:
I. NECESSARY EQUIPMENT AND REQUIREMENTS FOR PROCUREMENT
1. Necessary equipment to be procured:
Procure educational teaching equipment that is currently not available at schools according to the minimum list of educational teaching equipment issued by the Ministry of Education and Training.
Supplement educational teaching equipment for grade 1 and grade 6.
Educational teaching equipment for grade 2 and grade 7.
Educational teaching equipment for subsequent grades.
2. Requirements to be met when purchasing educational teaching equipment:
Ensure quality and quantity as prescribed in the approved minimum educational teaching equipment models, and equip each class with the following average quantities:
Supplement educational equipment for grade 1 and procure equipment for grade 2: Ensure each class has at least one set of minimum educational teaching equipment.
Supplement educational equipment for grade 6 and procure equipment for grade 7: Ensure the number of items in the minimum educational teaching equipment list is calculated for schools with 1 to 3 classes, double for schools with 4 to 8 classes, and triple for schools with 9 or more classes (replacing point 3.5 "Reform of textbook content" in Section 3 Part II of Circular No. 2256/KHTC dated March 19, 2003 of the Ministry of Education and Training).
For subsequent grades, annual supplementary guidance will be provided.
Departments of Education and Training need to plan the construction of subject classrooms and laboratories at primary and secondary schools to effectively use and maintain the equipment.
Prioritize providing teaching materials for mountainous areas, rural areas, remote areas, and economically disadvantaged regions to ensure availability at the start of the school year. At the same time, organize the mobilization of various social resources to participate in contributing to the construction and upgrading of school facilities and teaching equipment.
II. RESPONSIBILITIES OF DIFFERENT LEVELS IN THE PROCUREMENT OF EDUCATIONAL TEACHING EQUIPMENT
1. For the Ministry of Education and Training:
Direct Departments of Education and Training to strictly comply with the provisions of this Circular and other guiding documents on equipment work issued by the Ministry of Education and Training.
Based on the equipment lists already defined in Decision No. 12/2003/QĐ-BGDĐT and Decision No. 13/2003/QĐ-BGDĐT dated March 24, 2003 of the Ministry of Education and Training, and decisions approving adjustments and supplements for grades 2 and 7, and decisions approving the minimum equipment lists for subsequent grades, the Ministry of Education and Training organizes the examination and approval of sample educational teaching equipment produced by manufacturing and trading units before production and supply to schools. For self-made equipment, using images from textbooks or equipment belonging to other specialties (physical education, health care...), or commonly sold goods on the domestic market, the Ministry of Education and Training does not organize sample examinations.
Notify Departments of Education and Training and manufacturing and trading units of the sample educational teaching equipment approved by the Ministry for production, supply, and procurement contracts.
Organize inspection teams to check Departments of Education and Training on the organization and direction of educational teaching equipment procurement in localities.
Coordinate with the Ministry of Finance and the Ministry of Planning and Investment to prepare annual budgets, prioritizing state budget allocation and timely disbursement to ensure funding for reform general secondary education program.
2. For the People's Committees of provinces and centrally governed cities.
Focus on directing and creating conditions for the local education-training sector to ensure the progress and quality of implementing the reform of the general secondary education program, including purchasing teaching equipment to improve educational quality.
Balance the local budget, exploit and mobilize additional central government funds outside the budget to ensure funding for purchasing teaching equipment and learning materials according to the minimum list issued by the Ministry of Education and Training.
Mobilize parents of students and the entire community to understand the goals of the general secondary education program reform to create favorable conditions for schools in providing and managing the use of teaching equipment.
Supervise and inspect the process of purchasing teaching equipment organized by the Department of Education and Training at the local level.
3. For the Departments of Education and Training:
Direct schools to review existing equipment (firstly grades 1, 6, 2, and 7), compare with the minimum list of teaching equipment prescribed by the Ministry, and promptly develop plans for purchasing, preserving, and utilizing equipment for the 2003-2004 academic year and subsequent years to serve the implementation of new programs and textbooks.
Direct primary and secondary schools to collect, encourage teachers to organize the production of teaching and learning equipment, and purchase some equipment to strengthen the current inventory of teaching equipment.
Be responsible for organizing bidding or directing units authorized to bid for purchasing teaching equipment and ensuring strict inspection, supervision, and acceptance of product quality during the procurement process for schools; while ensuring sufficient provision of teaching equipment at the beginning of the new academic year (September each year).
Organize for classroom teachers to participate in training sessions on using teaching equipment and trial teaching with such equipment before widespread use.
Prioritize purchasing equipment to serve training classes for mass training of teachers according to new programs and textbooks.
III. REGULATIONS ON PURCHASING TEACHING EQUIPMENT
1. Purchasing of equipment must be carried out in accordance with regulations on asset and goods procurement as stipulated in the Tendering Regulation issued together with Decree No. 88/1999/ND-CP dated September 1, 1999, Decree No. 14/2000/ND-CP dated May 5, 2000 amending and supplementing certain articles of the Tendering Regulation issued together with Decree No. 88/1999/ND-CP dated September 1, 1999, and Circular No. 121/2000/TT-BTC dated December 29, 2000 guiding tendering procedures issued by the Ministry of Finance.
2. Equipment provided to schools must be labeled with the place of manufacture and a label (if imported from abroad) in accordance with Circular No. 50/2000/TT-BGDĐT dated December 29, 2000 of the Ministry of Education and Training guiding the implementation of Decision No. 178/1999/QĐ-TTg dated August 30, 1999 of the Prime Minister regarding the regulation on labeling domestic circulating goods and import-export goods. 16 ||| The Prime Minister's Decision No. 178/1999/QĐ-TTg dated August 30, 1999 concerning the regulation on labeling domestic circulating goods and import-export goods.
3. All production and business units supplying equipment must provide samples approved by the Ministry of Education and Training when bidding; these samples must be kept at the Ministry of Education and Training and the Department of Education and Training where companies and production units have signed contracts for producing and supplying teaching equipment with the Department of Education and Training for monitoring, checking, comparing, supervising, and accepting during the delivery process.
IV. SOURCES OF FUNDS AND MANAGEMENT OF FUNDS FOR PURCHASING TEACHING EQUIPMENT
1. Sources of funds for purchasing teaching equipment
From state support funds for the textbook and teaching equipment reform program.
Regular expenses under Joint Circular No. 30/TTLB issued by the Ministry of Finance and the Ministry of Education and Training dated July 26, 1990.
A portion from the target program to enhance infrastructure.
Funds raised from society and other lawful sources to meet the requirements of the general secondary education program reform.
2. Management of funds for purchasing teaching equipment
The management of funds for purchasing teaching equipment must be carried out in accordance with Decision No. 999/QĐ-BTC dated November 2, 1996 of the Minister of Finance on managing capital for administrative and public service units.
Strengthen educational oversight on purchasing, preservation, and utilization of teaching equipment to ensure serious, high-quality, and effective implementation of the general secondary education program reform and new teaching methods.
Strictly implement Decision No. 225/1998/QĐ-TTg dated November 20, 1998 of the Prime Minister on issuing financial transparency regulations and Circular No. 83/1999/TT-BTC dated July 1, 1999 of the Ministry of Finance guiding the implementation of the above regulations for state budget units.
V. IMPLEMENTATION PROVISIONS
This Circular shall take effect fifteen days after its publication in the Official Gazette.
During the implementation, if there are difficulties or obstacles, localities are requested to report them promptly to the Ministry of Education and Training for appropriate solutions.
