MINISTER OF EDUCATION AND TRAINING

Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 85/2003/NĐ-CP dated July 18, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

Pursuant to Decree No. 166/2004/NĐ-CP dated September 16, 2004 of the Government stipulating responsibilities for state management of education;

At the proposal of the Director of the Department of Early Childhood Education,

DECISION:

Article 1. Amending and supplementing certain articles of the Regulation on Recognizing Kindergartens Meeting National Standards for the period from 2002 to 2005 issued together with Decision No. 45/2001/QĐ-BGD&ĐT dated December 26, 2001 of the Minister of Education and Training as follows:

1. Clause 2, Article 2 shall be amended and supplemented as follows:

"2. The Chairman of the People's Committee at the provincial level decides to recognize rural kindergartens and urban kindergartens meeting national standards in accordance with the provisions of the Minister of Education and Training."

2. The third bullet point of Clause 2, Article 16 is amended and supplemented as follows:

"- The Department of Education and Training at the district level shall take the lead in organizing the ceremony to recognize kindergartens that have been recognized by the Chairman of the People's Committee at the provincial level as meeting national standards."

3. Point b of Clause 3, Article 17 is amended and supplemented as follows:

"b. The provincial-level Council shall review the results of the inspection conducted by the district-level Council in accordance with this Regulation and submit to the Chairman of the People's Committee at the provincial level for a decision to recognize kindergartens meeting national standards. The certificate of recognition and emblem of kindergartens meeting national standards according to the model prescribed by the Ministry of Education and Training (Annex attached)."

4. Article 18 is amended and supplemented as follows:

a) The name of Article 18, after amendment and supplementation, becomes: "Responsibilities of State Authorities at Various Levels and Departments of Education and Training."

b) Clause 1, point b and c are abolished.

c) Point d is converted into Clause 1 as follows:

"1. After each round of recognition, the competent authorities shall be responsible for responding in writing to kindergartens not yet recognized as meeting national standards regarding specific conditions and criteria so that the schools and localities can plan to continue building kindergartens meeting national standards."

d) Clause 2 is added as follows:

"2. Departments of Education and Training shall send the inspection files (Annex attached) and decisions recognizing kindergartens meeting national standards to the Ministry of Education and Training (Department of Early Childhood Education) at the same time as the Chairman of the People's Committee at the provincial level recognizes kindergartens meeting national standards."

Article 2. This Decision takes effect 15 days after its publication in the Official Gazette. Any previous regulations that conflict with this Decision are hereby abolished.

Article 3. Chairmen of People's Committees of provinces and centrally governed cities, Heads of Offices, Directors of the Department of Early Childhood Education, Heads of units related to the Ministry of Education and Training, Directors of Departments of Education and Training are responsible for implementing this Decision./.
