CIRCULAR

Guidelines for Implementing the System of Additional Allowances for Concurrent Positions for Officers Holding Leadership Positions in Other Agencies or Units

Pursuant to Clause 2, Article 6 of Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the salary system for cadres, civil servants, public officials, and armed forces personnel;

To implement Clause 3, Section IV of Circular No. 78/2005/TT-BNV dated August 10, 2005 of the Ministry of Home Affairs guiding the implementation of additional allowances for concurrent positions for cadres, civil servants, and public officials holding leadership positions in other agencies or units; following the agreement of the Ministry of Home Affairs (Circular No. 194/BNV-TL dated January 19, 2007), the Ministry of Finance (Circular No. 07/BTC-V1 dated January 2, 2007), and the Ministry of Justice (Circular No. 138/BTP-PLHSHC dated January 12, 2007), the Ministry of National Defense guides the implementation of additional allowances for officers concurrently holding leadership positions in other agencies or units as follows.

I. SUBJECTS AND SCOPE OF APPLICATION

1. Officers currently holding leadership positions in one agency or unit; at the same time being elected or appointed to concurrently hold one or more leadership positions in other agencies or units where such other agencies or units have dedicated staffing for the head but operate under a concurrent position arrangement.

The aforementioned agencies or units are those established within their authority, in accordance with legal procedures, having separate payroll and operating funds, possessing seals, and having bank accounts or state treasuries.

Example 1: Comrade Deputy Chief of General Staff of the Vietnam People's Army; concurrently holds the position of Director of the Training Department - General Staff Office. The Deputy Chief of General Staff shall be entitled to additional allowances from the month when the Decision of the Minister of National Defense becomes effective.

2. Officers currently holding leadership positions in one agency or unit within the military; at the same time being authorized to concurrently hold leadership positions in agencies or units outside the military.

Example 2: Comrade Inspector General of the Central Military Procuracy; appointed by the President to concurrently hold the position of Deputy Inspector General of the Supreme People's Procuracy.

The Inspector General shall be entitled to additional allowances from the month when the President's appointment decision becomes effective.

II. LEVEL OF ADDITIONAL ALLOWANCES

1. Subjects specified in Section I of this Circular shall be entitled to additional allowances equal to 10% of the rank-based salary plus the current leadership position allowance.

2. The level of additional allowances is determined by the following formula:

Level of additional allowances for concurrent leadership positions in other agencies or units  =  Rank-based salary coefficient plus the current leadership position allowance coefficient x Minimum wage level x 10%

III. PRINCIPLES AND PAYMENT METHODS

1. Subjects specified in Section I of this Circular shall only be entitled to one level of additional allowances throughout the period they hold one or more concurrent leadership positions. When ceasing to hold a concurrent leadership position, they shall cease to receive additional allowances from the month immediately following the month they stop holding the concurrent leadership position.

2. Subjects specified in Section I of this Circular who belong to the payroll of a specific agency or unit shall have that agency or unit pay the additional allowances from the month when the competent authority's decision appointing them to a concurrent leadership position in another agency or unit becomes effective, from the agency or unit's current financial resources.

3. Additional allowances for concurrent leadership positions in other agencies or units shall be paid together with monthly salaries and shall not be used to calculate contributions or benefits under social insurance.

IV. IMPLEMENTATION

1. This Circular shall take effect fifteen days after its publication in the Official Gazette.

2. The additional allowances for concurrent leadership positions in other agencies or units stipulated in this Circular shall be calculated from October 1, 2004. In cases where concurrent leadership positions in other agencies or units were assumed after October 1, 2004, the additional allowances shall be granted according to the guidelines in this Circular from the month when the competent authority's approval of the election results or appointment decision for the concurrent leadership position becomes effective. During the implementation process, if there are any difficulties, units should report to the Ministry for study and resolution.
