Guidelines for collecting and processing supply and demand labor information

Pursuant to Clause 1, Article 180 of the Labor Code dated June 23, 1994, amended and supplemented in 2002, 2006, and 2007 regarding: "Understanding supply and demand labor dynamics as a basis for determining national policies, planning, and human resource plans, distribution, and utilization of labor throughout society";
Pursuant to Decree No. 186/2007/NĐ-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor - War Invalids and Social Affairs;
Pursuant to Decision No. 305/2005/QD-TTg dated November 24, 2005 of the Prime Minister on issuing the National Statistical Indicators System;
Pursuant to Decision No. 111/2008/QD-TTg dated August 15, 2008 of the Prime Minister on the reporting system for comprehensive statistics applicable to Ministries and Sectors.
The Ministry of Labor - Invalids and Social Affairs guides the collection and processing of supply and demand labor information as follows:
Article 1. Scope of Regulation and Applicability

Article 2. Purpose and requirements for collecting and processing supply and demand labor information
1. Objective
- Collect basic and accurate information about the current status of labor, employment, unemployment, and changes over time and areas, serving as a basis for formulating employment policies and developing human resources in line with labor supply and demand requirements (hereinafter referred to as labor supply information).
- Collect information on the current status of labor in enterprises, organizations, and individuals using labor by profession and training level; recruitment needs, serving as a basis for determining training directions and reasonable allocation of human resources (hereinafter referred to as labor demand information).
2. Requirements
a) On the form of collecting supply and demand labor information
Information is collected in the form of recording and updating into: "Labor Supply and Demand Information Recording Book - Labor Supply" and "Labor Supply and Demand Information Recording Book - Labor Demand" (hereinafter referred to as Recording Book).
b) Ensuring the accuracy of collected information
- Recording of supply and demand labor information must ensure objectivity, truthfulness, and accuracy, not entering false or inaccurate information into the Recording Book;
- Writing and numbers when recording must be clear, legible, and easy to read;
- In case of incorrect information, carefully cross out the incorrect information by drawing two parallel lines, then enter the correct information in the appropriate position, not erasing recorded information;
- For columns without information, it is agreed to mark X to avoid additional or mistaken entries;
- Collected information must be accurately determined and fully and timely statistically recorded the number of people entering and exiting working age, the number of people within working age, and labor dynamics, employment status, and unemployment in households, as well as changes in labor according to educational and training levels in enterprises and organizations.
c) Application of information technology in data processing.
3. Responsibility for collecting supply and demand labor information
- People's Committee of communes, wards, towns (collectively referred to as commune) is responsible for collecting information from all registered households within their administrative area;
- Department of Labor - Invalids and Social Affairs of districts, counties, provincial cities, and provincial-level cities (collectively referred to as district) is responsible for recording information from all enterprises operating within their administrative area.
Article 3. Objectives of Information Collection
1. Objectives of Information Collection on Labor Supply
All individuals aged ten years and older who have registered their permanent residence at households located within the territory of the country.
2. Objectives of Information Collection on Labor Demand
All enterprises, organizations, and individuals using labor from various economic sectors that have registered and are currently operating within the provinces and cities throughout the country.
Article 4. Content of Information Collection
1. Information on Labor Supply and Demand - Labor Supply Section
- Demographics: full name, household relationship, gender, date of birth;
- Educational level and technical expertise;
- Employment status: occupation, place of work, wage employment or self-employment, type of economy;
- Unemployment status of those who have never worked, previously worked, and duration of unemployment;
- Non-economic activity status: studying, housework, illness, disability...;
- Changes in each individual within the household.
2. Information on Labor Supply and Demand - Labor Demand Section
- Type of enterprise, organization, or individual;
- Main production and business sector;
- Total number of workers in the enterprise, organization, or individual, separately listing direct labor and female labor;
- Number of workers with signed labor contracts;
- Highest level of general education;
- Highest level of technical expertise;
- Education and training field;
- Vacant job positions.
Article 5. Regulations on Record Books
1. Scope of Establishing Record Books for Labor Supply and Demand Information (hereinafter referred to as Record Book)
- For labor supply record books: Record books shall be established in all communes across the country;
- For labor demand record books: Record books shall be established in all districts across the country;
2. Format of Record Books
a) Format of Record Book for Labor Supply and Demand Information - Labor Supply Section
- The record book has a horizontal rectangular shape, measuring 20.5 cm x 29.5 cm;
- Cover page: top line records the name of the Ministry of Labor, Invalids, and Social Affairs; subsequent lines record the province/city, district/county/city, commune/ward/township, village/hamlet/residential group, and volume number. In the center of the cover page, bold letters read RECORD BOOK FOR LABOR SUPPLY AND DEMAND INFORMATION - LABOR SUPPLY SECTION. The bottom half of the cover page includes lines for the recorder's full name, contact address, and phone number.
- Internal pages of the record book include: general regulations, a list of households in the village/hamlet/residential group, and basic information of each household consisting of 16 columns:

3. Recording in the Record Book
a) Labor Supply Information
- The People's Committee of the Commune is responsible for organizing the initial recording of information, updating information quarterly, semi-annually, and annually according to village, hamlet, and ấp (collectively referred to as village), and managing the Record Book;
- Each record book for initial information covers a maximum of fifty households;
- The recording date for the record book is the first day of the first month of the quarter.
b) Labor Demand Information
- The Department of Labor, Invalids, and Social Affairs of the District is responsible for the initial recording of information, updating enterprise information quarterly, semi-annually, and annually according to the district, and managing the Record Book;
- Each record book for initial information covers a maximum of fifty enterprises;
- The recording date for the record book is the first day of the first month of the quarter.
Article 6. Processing labor supply and demand information
1. For labor supply information
- The consolidated report on labor supply shall be transferred according to the following regulations:
+ The village summary form (Form No. 1) shall be completed and transferred to the commune before the 15th day of the first month of the next quarter;
+ The commune summary form (Form No. 2) shall be completed and transferred to the district before the 20th day of the first month of the next quarter;
+ The district summary form (Form No. 3) shall be completed and transferred to the province, centrally governed city (referred to collectively as the province) before the 25th day of the first month of the next quarter;
+ The provincial summary form (Form No. 4) shall be completed and transferred to the Ministry of Labor, Invalids and Social Affairs and the People's Committee of the province before the 30th day of the first month of the next quarter;
- The consolidated reports shall be sent via postal service or through the Internet.
2. For labor demand information
- The consolidated report on labor demand shall be transferred according to the following regulations:
+ The district summary form (Form No. 5) shall be completed and transferred to the province before the 25th day of the first month of the current quarter;
+ The provincial summary form (Form No. 6) shall be completed and transferred to the Ministry of Labor, Invalids and Social Affairs and the People's Committee of the province before the 30th day of the first month of the current quarter;
- The consolidated reports shall be sent via postal service or through the Internet.
Article 7. Implementation Organization
1. Provincial People's Committees, centrally governed cities
- Direct relevant agencies to organize the recording of labor supply and demand information within their provincial jurisdiction and ensure funding for implementation;
- Inspect and supervise the implementation of record-keeping in localities.
2. Departments of Labor, Invalids and Social Affairs
- Take the lead and coordinate with related agencies to submit to the Chairman of the Provincial People's Committee for approval of the plan to implement;
- Record initial information that needs to be consistent with data collected from the 2009 Population and Housing Census;
- Provide guidance on the procedures for establishing records, methods of monitoring, updating, processing information, and preparing statistical reports;
- Inspect, supervise, and compile results on labor dynamics, employment, unemployment, and report to the Ministry of Labor, Invalids and Social Affairs, and the Provincial People's Committee in accordance with this Circular;
3. District, County, City, Town People's Committees under Provinces
- Direct relevant departments and People's Committees of communes/towns/districts to organize the establishment and maintenance of records for labor supply and demand;
- Inspect and supervise the record-keeping at managed areas, process information, compile, and prepare regular and ad hoc reports to higher-level agencies in accordance with this Circular;
4. People's Committee of communes, wards, towns
- Establish and maintain records through organizing the recording of initial information and updates on changes of each member in households registered in the management area;
- Process, compile information, and prepare regular and ad hoc reports to district-level agencies in accordance with this Circular;
5. Employment Bureau, Ministry of Labor, Invalids and Social Affairs
- Organize printing and distribution of records for labor supply and demand (labor supply and labor demand);
- Provide guidance on record-keeping, compiling, and regular reporting;
- Direct Departments of Labor, Invalids and Social Affairs to organize record-keeping, information processing, and compiling comprehensive reports at various levels;
- Supervise, evaluate activities and results of record-keeping, information compilation of localities, and report to the leadership of the Ministry quarterly and ad hoc when required;
Article 8. Implementation funds
- Initial record-keeping funding: guaranteed by local budget and supported by the National Target Program on Employment funding;
- Regular information update funding: guaranteed by the local budget;
Article 9. Implementation Provisions
This Circular takes effect forty-five days from the date of issuance.
During implementation, if there are difficulties, they should be promptly reflected to the Ministry of Labor, Invalids and Social Affairs for consideration and resolution./
