Regulations on certain preferential policies for officers, professional military personnel, non-commissioned officers, soldiers,

civil servants, and defense workers under the Vietnam Coast Guard Force

 

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Ordinance on the Vietnam Coast Guard Force issued in 2008;

Pursuant to Decree No. 86/2009/NĐ-CP dated October 19, 2009 of the Government detailing and guiding the implementation of certain provisions of the Ordinance on the Vietnam Coast Guard Force;

"Based on the proposal of the Minister of National Defense;"

The Prime Minister promulgates this Decision on certain preferential policies for officers, professional military personnel, non-commissioned officers, soldiers, civil servants, and defense workers under the Vietnam Coast Guard Force,

Article 1. Scope of Regulation and Applicability

1. This Decision stipulates the allowance for long-term service on islands; special allowances for sea duty during direct participation in exercises, training, search and rescue operations at sea for officers, professional military personnel, non-commissioned officers, soldiers, civil servants, and defense workers under the Vietnam Coast Guard Force.

2. The subjects specified in Clause 1 of Article 1 of this Decision who are currently receiving the allowance for long-term service in difficult economic and social conditions pursuant to Decree No. 116/2010/NĐ-CP dated December 24, 2010 of the Government regarding policies for cadres, civil servants, public officials, and those receiving salaries in the armed forces working in areas with particularly difficult economic and social conditions shall not be entitled to the allowance for long-term service on islands prescribed in this Decision.

Article 2. Preferential Policies

1. Allowance for Long-Term Service on Islands The subjects specified in Clause 1 of Article 1 of this Decision shall receive the allowance for long-term service on islands monthly, calculated based on a coefficient relative to the minimum wage and actual time served on remote islands. Specifically:

a) Performing duties on remote islands in Vietnam's maritime zones:

- From five years up to less than ten years, the rate is 0.2;

- From ten years up to less than fifteen years, the rate is 0.3;

- Fifteen years or more, the rate is 0.4.

b) Performing duties for five years or more on near-shore islands, including the islands: Cái Bầu, Đình Vũ, Cồn Đen, Cồn Lục, Cồn Vành, Đảo Ne, Đảo Ngư, Đảo Sơn Dương, Hòn La, Hòn Tre, and Bình Ba, shall receive a rate of 0.1;

c) The period of service for calculating the allowance for long-term service on islands for the subjects specified in Points a and b of this Clause is the total actual time served on islands, if there are interruptions, they will be accumulated.

2. Special Allowance for Sea Duty

The subjects specified in Clause 1 of Article 1 of this Decision, during their direct participation in exercises, training, search and rescue operations at sea, shall receive the special allowance for sea duty at a rate of 150,000 VND per person per day actually spent at sea.

2. Industrial emission testing must ensure timeliness, accuracy, objectivity, compliance with procedures, and adherence to legal provisions.

1. The subjects entitled to the special allowance for sea duty prescribed in this Decision, while simultaneously receiving the special allowance for sea duty prescribed in other regulatory legal documents, may choose the highest rate.

2. The allowance for long-term service on islands only applies to subjects working on the islands specified in Points a and b of Clause 1 of Article 2 of this Decision.

3. The benefits prescribed in this Decision shall be paid together with the monthly salary and shall not be used to calculate contributions or benefits under social insurance and health insurance.

Article 4. Source of Funding

The funds for implementing the preferential policies prescribed in this Decision shall be guaranteed by the state budget according to the regulations of the law on the state budget.

Article 5. Effective Date

This Decision takes effect from August 1, 2012.

Article 6. Responsibility for Implementation

1. The Ministry of National Defense is responsible for guiding the implementation of this Decision.

2. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairmen of provincial People's Committees directly under the central government are responsible for implementing this Decision./ .
