Pursuant to Decree No. 106/2012/NĐ-CP dated December 20, 2012, of the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids, and Social Affairs;

Pursuant to Decision No. 34/2014/QĐ-TTg dated May 30, 2014 of the Prime Minister promulgating the Standards for Communes, Wards, and Towns Suitable for Children.

At the proposal of the Director of the Department of Child Protection and Care:

The Minister of Labor, Invalids and Social Affairs issues this Circular guiding the procedures and formalities for evaluating and recognizing communes, wards, and towns suitable for children.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

Article 1. This Circular guides the procedures and formalities for evaluating and recognizing communes, wards, and towns suitable for children.

Article 2. This Circular applies to communes, wards, and towns (hereinafter referred to as commune level), districts, counties, provincial cities (hereinafter referred to as district level), provinces, centrally governed municipalities (hereinafter referred to as provincial level); agencies, organizations, and individuals related to the procedures and formalities for evaluating and recognizing communes, wards, and towns suitable for children.

Article 2. Implementation Principles

The organization of evaluation and recognition of communes, wards, and towns suitable for children must ensure the following principles:

Clause 1. Must ensure democracy, fairness, transparency, and compliance with regulations.

Clause 2. The collection of data on the criteria for communes, wards, and towns suitable for children shall be carried out by civil servants at the commune level and they shall be responsible before the Chairman of the People's Committee at the commune level.

Clause 3. The evaluation and recognition of communes, wards, and towns meeting the standards for communes, wards, and towns suitable for children shall be conducted once a year in November.

Article 3. Certificate of Recognition for Communes, Wards, and Towns Suitable for Children

The Certificate of Recognition for Communes, Wards, and Towns Suitable for Children shall be uniformly used nationwide (Model No. 9 - A4 landscape size: length 29.7 cm, width 21 cm).

Chapter II

PROCEDURES AND FORMALITIES FOR EVALUATING AND RECOGNIZING COMMUNES, WARDS, AND TOWNS SUITABLE FOR CHILDREN

Article 4. Process and dossier for evaluating communes, wards, and towns suitable for children at the commune level

Clause 1. Process

Point a) The specialized civil servant of Culture-Society or the person assigned to oversee child protection and care work (hereinafter referred to as the specialized civil servant of Culture-Society) shall submit to the Chairman of the People's Committee at the commune level a proposal to establish the Evaluation Council for Communes, Wards, and Towns Suitable for Children (Model No. 1).

Point b) The Chairman of the People's Committee at the commune level shall decide on the establishment of the Evaluation Council for Communes, Wards, and Towns Suitable for Children based on the proposal of the specialized civil servant of Culture-Society (Model No. 2). The composition of the Evaluation Council for Communes, Wards, and Towns Suitable for Children shall be in accordance with Clause 3 of Article 4 of Decision No. 34/2014/QĐ-TTg.

Point c) The specialized civil servant of Culture-Society shall submit to the Chairman of the People's Committee at the commune level specific tasks for civil servants from various departments to report on the implementation of the criteria stipulated in Article 2 of Decision No. 34/2014/QĐ-TTg according to their respective functions:

- The civil servant of Justice-Household Registration shall report on the implementation of Criterion 2.

- The Head of the Health Station shall report on the implementation of Criteria 8, 9, and 10.

- The Principal of the Kindergarten shall report on the implementation of Criterion 11.

- The Principal of the Junior High School shall report on the implementation of Criterion 12.

- The Chief of the Commune Police Station shall report on the implementation of Criteria 4 and 5.

- The specialized civil servant of Culture-Society shall be responsible for:

+ Reporting on the implementation of Criteria 1, 3, 6, 7, 13, 14, and 15 according to the function of the department;

+ Summarizing and reporting on the assessment of the implementation of the Standards for Communes, Wards, and Towns Suitable for Children (Model No. 3).

Point d) Departments shall collect data and report on the implementation of relevant criteria based on the decision of the Chairman of the People's Committee at the commune level and send them in writing to the specialized civil servant of Culture-Society for consolidation and submission to the Chairman of the Council prior to convening the Evaluation Council for Communes, Wards, and Towns Suitable for Children.

Point đ) Meeting of the Evaluation Council for Communes, Wards, and Towns Suitable for Children: The meeting of the Evaluation Council for Communes, Wards, and Towns Suitable for Children must be recorded in minutes, with a conclusion by the Chairman of the Council regarding whether the commune, ward, or town meets the standards for communes, wards, and towns suitable for children (Model No. 4).

2. Documents

Point a) Letter requesting the Chairman of the People's Committee at the district level to recognize the commune, ward, or town as meeting the standards for communes, wards, and towns suitable for children.

Point b) Minutes of the meeting of the Evaluation Council on assessing communes, wards, and towns suitable for children.

Point c) Report on the assessment of the implementation of the Standards for Communes, Wards, and Towns Suitable for Children.

Point d) Related verification documents (Resolutions, programs, plans specifically for child protection, care, and education; results of implementing the criteria, models of child protection and care).

The Chairman of the People's Committee at the commune level shall approve the dossier based on the Council's conclusion and send it to the Chairman of the People's Committee at the district level for consideration and issuance of a decision recognizing the commune, ward, or town as meeting the standards for communes, wards, and towns suitable for children before November 15 each year.

Article 5. Procedure and dossier for recognizing communes, wards, towns meeting the criteria for child-friendly communes, wards, and towns at the district level

Clause 1. Process

a) Receiving and examining the dossier: The Labor, Invalids, and Social Affairs Office is the main unit responsible for receiving and examining the entire dossier submitted by the People's Committees of communes, wards, and towns (Form No. 5).

b) The Labor, Invalids, and Social Affairs Office prepares a report to request the Chairman of the District People's Committee to establish the Examination Board (Form No. 6).

c) The Chairman of the District People's Committee, based on the report from the Labor, Invalids, and Social Affairs Office, signs the decision to establish the Examination Board for child-friendly communes, wards, and towns (Form No. 7, composition of the Board according to Clause 1 of Article 5 of Decision No. 34/2014/QĐ-TTg).

d) Meeting of the Examination Board for child-friendly communes, wards, and towns: The meeting of the Examination Board must be recorded in minutes and have a conclusion by the Chairman of the Board clearly stating whether the commune, ward, or town meets the criteria for child-friendly communes, wards, and towns (Form No. 8).

đ) Recognizing communes, wards, and towns meeting the criteria for child-friendly communes, wards, and towns: If the commune, ward, or town achieves the required points according to the criteria for child-friendly communes, wards, and towns, the Examination Board prepares a report requesting the Chairman of the District People's Committee to sign the decision recognizing the commune, ward, or town as child-friendly. The recognition process must be completed before November 30 each year.

e) Awarding certificates for recognizing communes, wards, and towns meeting the criteria for child-friendly communes, wards, and towns: The Labor, Invalids, and Social Affairs Office is responsible for organizing the awarding of certificates for recognizing communes, wards, and towns meeting the criteria for child-friendly communes, wards, and towns to those communes, wards, and towns that meet the criteria in December each year.

Article 6. Reporting System

1. At the district level

Before November 30 each year, the Labor, Invalids, and Social Affairs Office compiles and reports to the Provincial Department of Labor, Invalids, and Social Affairs on the implementation of the Standards for Child-Friendly Communes, Wards, and Towns.

2. At the provincial level

Before December 10 each year, the Provincial People's Committee is requested to compile the situation of implementing the Standards for Child-Friendly Communes, Wards, and Towns (Form No. 10) and report to the Ministry of Labor, Invalids, and Social Affairs for compilation and reporting to the Prime Minister.

Article 7. Awards

The Labor, Invalids, and Social Affairs Office is responsible for:

- Compiling a list of communes, wards, and towns meeting the criteria for child-friendly communes, wards, and towns for three consecutive years to submit to the Chairman of the District People's Committee for consideration and commendation.

- Compiling a list of communes, wards, and towns meeting the criteria for child-friendly communes, wards, and towns for five consecutive years to send to the Provincial Department of Labor, Invalids, and Social Affairs for submission to the Chairman of the Provincial People's Committee for consideration and commendation.

Chapter III

IMPLEMENTING PROVISIONS

Article 8. Responsibility for Implementation

1. People's Committees at all levels are responsible for directing the implementation of this Circular and allocating funds for implementation in accordance with Decision No. 34/2014/QĐ-TTg.

2. Departments of Labor, Invalids, and Social Affairs of provinces and centrally governed cities are responsible for monitoring, inspecting, supervising, and reporting on the implementation of child-friendly communes, wards, and towns in their localities.

Article 9. Implementation Provisions

1. This Circular takes effect from October 22, 2014.

2. This Circular replaces Circular No. 22/2010/TT-LĐTBXH dated August 12, 2010, issued by the Minister of Labor, Invalids, and Social Affairs regarding the standards for child-friendly communes and wards.

3. During the implementation process, if there are arising issues, difficulties, or obstacles, they should be promptly reported to the Ministry of Labor, Invalids, and Social Affairs for research and resolution./.
