CIRCULAR

REGULATIONS ON THE EVALUATION AND RECOGNITION OF "LEARNING COMMUNITIES" AT THE COMMUNE, DISTRICT, AND PROVINCE LEVELS

Pursuant to the Education Law dated June 14, 2019;

Pursuant to Decree No. 86/2022/NĐ-CP dated October 24, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

At the request of the Director of the Department of Continuing Education;

The Minister of Education and Training issues this Circular to regulate the evaluation and recognition of "Learning Communities" at the commune, district, and province levels. 1. This Circular regulates the evaluation and recognition of "Learning Communities" at the commune, district, and province levels, including: authority, level, criteria, conditions, procedures for evaluating and recognizing "Learning Communities" at the commune, district, and province levels, and the responsibilities of relevant agencies and organizations.

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

2. This Circular applies to communes, wards, towns (hereinafter referred to collectively as communes); districts, cities under provinces, centrally governed municipalities (hereinafter referred to collectively as districts); provinces, centrally governed municipalities (hereinafter referred to collectively as provinces), and related organizations and individuals.

Educational institutions that evaluate and recognize at the district level; educational institutions that evaluate and recognize at the provincial level; units at the district level; units at the provincial level; staff members in units; workers in units; members in units; learners

Article 2. Interpretation of Terms

In this Circular, the following terms are understood as follows:

1. are concepts defined in Clauses 1, 2, 3, 4, 5, 6, 7, and 8 of Article 2 of Circular No. 24/2023/TT-BGDĐT dated December 11, 2023, issued by the Minister of Education and Training on the evaluation and recognition of "Learning Units" at the district and provincial levels. Citizens in the commune are residents aged 15 years and above living within the commune's territory (including members in units and learners). Re-recognition

2. is the process of re-evaluating and re-recognizing a commune, district, or province after the previous recognition decision has expired. Recognition at a higher level

3. is the recognition of a commune, district, or province that has already been recognized at Level 1 and wishes to be recognized at Level 2. Commune in difficult areas

4. is a commune located in ethnic minority regions, mountainous areas, coastal areas, islands, border areas, and particularly difficult communes according to the Prime Minister's Decision. Article 3. Purpose

5. 1. To create fair learning opportunities and favorable conditions for all members of society to participate in learning, promoting lifelong learning movements, contributing to building a learning society. 2. To assist local People's Committees in self-assessing the current status of building a learning society; developing and implementing plans to build a learning society suitable for local realities.

3. To serve as a basis for evaluating and recognizing "Learning Communities" at the commune, district, and province levels.

Article 4. Principles of Evaluation and Recognition

1. Transparency, democracy, and openness; compliance with criteria, conditions, procedures, and authority stipulated in this Circular.

2. Close cooperation among relevant agencies, organizations, and individuals.

AUTHORITY, LEVEL, CRITERIA, CONDITIONS, AND PROCEDURES FOR EVALUATING AND RECOGNIZING "LEARNING COMMUNITIES" AT THE COMMUNE LEVEL

Article 5. Authority for Evaluation and Recognition, Levels, and Duration of Recognition of "Learning Communities" at the Commune Level

1. The Director of the Department of Education and Training decides to recognize a commune as achieving "Learning Community" status at the commune level.

Chapter II
2. Recognition of "Learning Communities" at the commune level is divided into two levels: Level 1 (also known as Good) and Level 2 (also known as Excellent).

3. A commune recognized at Level 1 may apply for evaluation and recognition at Level 2 after at least one year (12 months) from the date of the recognition decision.

4. The recognition result is valid for three years (36 months) following the recognition year.

2. Recognize "Community Learning" at the commune level in two levels: Level 1 (also referred to as Good), and Level 2 (also referred to as Excellent).

3. A commune recognized at Level 1 may propose an assessment for recognition at Level 2 after at least one year (12 months) from the date of the recognition decision.

4. The recognition result is valid for a period of three years (36 months) following the year of recognition.

Article 6. Criteria for evaluation and recognition of "Learning Community" at commune level, Level 1

1. Criterion 1: Leadership and guidance by the Party Committee and commune-level administration

a) Indicator 1: Implementing propaganda work to raise awareness within the community about lifelong learning and building a learning society;

b) Indicator 2: Developing annual programs and plans for building a learning society and organizing their implementation fully;

c) Indicator 3: Developing plans and implementing specific activities for Lifelong Learning Week and reporting according to regulations.

2. Criterion 2: Mobilizing resources and creating a favorable environment for building a learning society at the local level

a) Indicator 1: Allocating sufficient funds from the state budget annually in accordance with the State Budget Law to implement the construction of a learning society;

b) Indicator 2: Organizing activities to mobilize social resources to participate in building a learning society at the local level in line with the policy of socialization and achieving positive results;

c) Indicator 3: Establishing a mechanism for cooperation between the Commune Literacy Promotion Association, commune-level political and social organizations, and educational institutions and cultural facilities on the commune's territory during the process of building a learning society.

3. Criterion 3: Effectiveness of activities of the community learning center and public library at the commune level, and the commune-level cultural and sports center

a) Indicator 1: The community learning center ensures having one office equipped with desks, chairs, cabinets, and bookshelves; having a shared book cabinet; and having appropriate information technology equipment to organize lifelong learning activities for residents;

b) Indicator 2: The public library at the commune level applies information technology and digital transformation in management and organizing activities to serve lifelong learning for library users;

c) Indicator 3: The commune-level cultural and sports center has talent classes, clubs, interest groups, and regularly organizes cultural and artistic, physical and sports activities attracting residents to participate.

4. Criterion 4: Results of universal education and literacy eradication

a) Indicator 1: The commune meets the standard for universal preschool education for five-year-old children as stipulated in Decree No. 20/2014/ND-CP dated March 24, 2014 of the Government on universal education and literacy eradication (hereinafter referred to as Decree No. 20/2014/ND-CP);

b) Indicator 2: The commune meets the standard for universal primary education at Level 2 as stipulated in Decree No. 20/2014/ND-CP;

c) Indicator 3: The commune meets the standard for universal lower secondary education at Level 2 as stipulated in Decree No. 20/2014/ND-CP;

d) Indicator 4: The commune meets the standard for literacy eradication at Level 1 as stipulated in Decree No. 20/2014/ND-CP.

5. Criterion 5: Impact of building a "Learning Community" at the commune level

a) Indicator 1: At least 60% of citizens in the commune achieve the title of "Lifelong Learner" as stipulated in Decision No. 324/QD-KHVN dated October 25, 2023 of the Central Executive Board of the Vietnam Literacy Promotion Association issuing the Criteria and Guidelines for Evaluation and Recognition of the Title "Lifelong Learner" for the period 2021-2030 (hereinafter referred to as Decision No. 324/QD-KHVN);

b) Indicator 2: At least 50% of citizens in the commune have been trained in technical and vocational qualifications; among them, at least 12% of citizens in the commune have a bachelor's degree or higher. For communes in difficult areas, at least 40% of citizens in the commune have been trained in technical and vocational qualifications; among them, at least 10% of citizens in the commune have a bachelor's degree or higher.

Article 7. Criteria for evaluating and recognizing "Learning Community" at commune level, Level 2

1. Criterion 1: Leadership and guidance by the Party Committee and commune-level administration

The content of the criteria as prescribed in Clause 1 of Article 6 of this Circular.

2. Criterion 2: Mobilizing resources and creating a favorable environment for building a learning society at the local level

The content of the criteria as prescribed in Clause 2 of Article 6 of this Circular.

3. Criterion 3: Effectiveness of activities of the community learning center and public library at the commune level, and the commune-level cultural and sports center

The content of the criteria as prescribed in Clause 3 of Article 6 of this Circular.

4. Criterion 4: Results of universal education and literacy eradication

a) Indicator 1: The commune meets the standard for universal preschool education for five-year-old children as stipulated in Decree No. 20/2014/ND-CP.

b) Indicator 2: The commune meets the standard for universal primary education, Level 3 as stipulated in Decree No. 20/2014/ND-CP.

c) Indicator 3: The commune meets the standard for universal lower secondary education, Level 3 as stipulated in Decree No. 20/2014/ND-CP.

d) Indicator 4: The commune meets the standard for adult literacy, Level 2 as stipulated in Decree No. 20/2014/ND-CP.

5. Criterion 5: Impact of building a "Learning Community" at the commune level

a) Indicator 1: At least 80% of citizens in the commune achieve the title of "Learning Citizen" as stipulated in Decision No. 324/QD-KHVN.

b) Indicator 2: At least 60% of citizens in the commune have been trained to a technical vocational level; among them, at least 15% of citizens in the commune have a bachelor's degree or higher. For communes in difficult areas, at least 50% of citizens in the commune have been trained to a technical vocational level; among them, at least 12% of citizens in the commune have a bachelor's degree or higher.

Article 8. Conditions for recognition and methods of evaluation of "Learning Community" at commune level

1. Conditions for recognition of "Learning Community" at commune level

a) A commune is recognized as achieving "Learning Community" at commune level, Level 1 when it meets all the indicators prescribed in Article 6 of this Circular.

b) A commune is recognized as achieving "Learning Community" at commune level, Level 2 when it meets all the indicators prescribed in Article 7 of this Circular.

2. Methods of evaluation of "Learning Community" at commune level

a) The evaluation of "Learning Community" at commune level is based on the results achieved from the indicators prescribed in Articles 6 and 7 of this Circular.

b) An indicator is considered met when all its sub-indicators are met.

c) The results of the evaluation of indicators and sub-indicators of "Learning Community" at commune level are evaluated as either met or not met.

Article 9. Procedures for evaluating and recognizing "Learning Community" at commune level

1. The People's Committee at the commune level organizes the implementation of self-evaluation and recognition of "Learning Community" at commune level according to the following procedures:

a) The People's Committee at the commune level organizes the implementation of self-evaluation and recognition of "Learning Community" at commune level according to the indicators and sub-indicators prescribed in Articles 6 and 7 of this Circular.

b) Prepare a report on self-evaluation and recognition of "Learning Community" at commune level, a summary of the evaluation results of the indicators and sub-indicators; information and data in the self-evaluation report and the summary of the evaluation results of the indicators and sub-indicators are calculated from January 1 to December 31 of the year being evaluated.

c) Organize a meeting to review, evaluate, and unify the results of self-evaluation and recognition of "Learning Community" at commune level. The meeting is chaired by a representative of the leadership of the People's Committee at the commune level. Participants include representatives of the leadership of the Commune Association for Promoting Education; representatives of the leadership of the Vietnam Fatherland Front and other political-social organizations at the commune level.

d) Based on the results of self-evaluation, if the commune meets all the conditions for recognition of "Learning Community" at commune level at a certain level, the People's Committee at the commune level submits the application file for recognition at that level (submitted directly, online, or through postal service) to the Department of Education and Training before February 28 of the following year.

The application file for evaluation and recognition of "Learning Community" at commune level includes: Request for evaluation and recognition of "Learning Community" at commune level; report on self-evaluation and recognition of "Learning Community" at commune level; summary of the evaluation results of the indicators and sub-indicators.

2. The Department of Education and Training organizes the evaluation, examination, and decision-making for recognition of the commune as achieving "Learning Community" at commune level according to the following procedures:

a) The Department of Education and Training receives, reviews, and checks the application file for recognition of "Learning Community" at commune level.

b) The Director of the Department of Education and Training establishes the Evaluation and Recognition Board for "Learning Community" at commune level (hereinafter referred to as the County-level Evaluation Board). The County-level Evaluation Board consists of a chairman, a secretary, and members, with an odd number of members, a minimum of five people. Members of the Board include representatives of relevant departments under the People's Committee at the county level; representatives of the County Association for Promoting Education; representatives of the Vietnam Fatherland Front and other political-social organizations at the county level.

c) Organize a meeting of the County-level Evaluation Board or seek opinions in writing from members of the Board to review the application file for recognition of "Learning Community" at commune level.

d) Based on the review results, in cases where the commune does not meet the conditions for recognition of "Learning Community" at commune level, the County-level Evaluation Board reports to the Director of the Department of Education and Training to issue a reply to the People's Committee at the commune level and specify the reasons for non-recognition.

e) Based on the review results, in cases where the commune meets the conditions for recognition of "Learning Community" at commune level, the County-level Evaluation Board completes the file and submits it to the Director of the Department of Education and Training for examination and decision to recognize the commune as achieving "Learning Community" at commune level.

The submitted file includes: Request for recognition of "Learning Community" at commune level; report on the review of the County-level Evaluation Board; summary of the evaluation results of the indicators and sub-indicators of the commune reviewed by the County-level Evaluation Board; draft Decision on recognition of the commune as achieving "Learning Community" at commune level.

3. Time limit for completing the evaluation and recognition of "Learning Community" at commune level: before March 31 of the following year.

4. The re-evaluation and recognition process is carried out according to the provisions of Clauses 1 and 2 of this Article.

Chapter III
AUTHORITY, LEVEL, CRITERIA, CONDITIONS AND PROCEDURES FOR EVALUATION AND RECOGNITION OF "LEARNING COMMUNITY" AT COUNTY LEVEL

Article 10. Competence to assess, recognize, level, and duration of recognition of "Learning Community" at district level

1. The Director of the Department of Education and Training decides on recognizing a district as achieving the "Learning Community" at the district level.

2. Recognition of the "Learning Community" at the district level is divided into two levels: Level 1, Level 2.

3. A district recognized at Level 1 may request an assessment for recognition at Level 2 after at least one year (12 months) from the date of the recognition decision.

4. The recognition result is valid for a period of three years (36 months) following the year of recognition.

Article 11. Criteria for assessing and recognizing "Learning Community" at district level at Level 1

1. Criterion 1: Leadership and guidance by the Party Committee and local government at the district level

a) Indicator 1: Effectively conducting propaganda activities to raise awareness within the community about lifelong learning and building a learning society;

b) Indicator 2: Issuing programs, plans, guiding documents within their authority to implement the construction of a learning society and organizing timely implementation of these programs and plans;

c) Indicator 3: Developing plans and implementing specific activities for Lifelong Learning Week and reporting according to regulations.

2. Criterion 2: Mobilizing resources and creating a favorable environment for building a learning society at the local level

a) Indicator 1: Allocating sufficient funds from the state budget annually in accordance with the State Budget Law to implement the construction of a learning society;

b) Indicator 2: Organizing activities to mobilize social resources to participate in building a learning society at the local level in line with the policy of socialization and achieving positive results;

c) Indicator 3: Fully implementing policies promoting lifelong learning and building a learning society issued by the central and provincial authorities;

d) Indicator 4: County-level units are equipped with digital services and tools to enable members to carry out digital transformation in work and study.

3. Criterion 3: Effectiveness of operations of educational institutions responsible for assessment and recognition at the district level and public libraries, cultural and sports centers at the district level

a) Indicator 1: Educational institutions responsible for assessment and recognition at the district level implement management, teaching, and learning activities in a digital environment;

b) Indicator 2: Public libraries at the district level provide services supporting lifelong learning for library users and apply information technology and digital transformation in managing and organizing activities to support lifelong learning for library users;

c) Indicator 3: Cultural and sports centers at the district level have many cultural and sports activities connecting with communes.

4. Criterion 4: Impact of building a "Learning Community" at the district level

a) Indicator 1: At least 90% of communes are recognized as achieving the "Learning Community" at the commune level, Level 1, as stipulated in point a, Clause 1, Article 8 of this Circular;

b) Indicator 2: Average income per capita of the district increases compared to the previous year;

c) Indicator 3: The employment rate of the district increases compared to the previous year.

Article 12. Criteria for assessing and recognizing "Learning Community" at district level at Level 2

1. Criterion 1: Leadership and guidance by the Party Committee and commune-level administration

Content of criteria as prescribed in Clause 1, Article 11 of this Circular.

2. Criterion 2: Mobilizing resources and creating a favorable environment for building a learning society at the local level

Content of criteria as prescribed in Clause 2, Article 11 of this Circular.

3. Criterion 3: Effectiveness of operations of educational institutions responsible for assessment and recognition at the district level and public libraries, cultural and sports centers at the district level

Content of criteria as prescribed in Clause 3, Article 11 of this Circular.

4. Criterion 4: Impact of building a "Learning Community" at the district level

a) Indicator 1: At least 90% of communes are recognized as achieving the "Learning Community" at the commune level, Level 2, as stipulated in point b, Clause 2, Article 8 of this Circular;

b) Indicator 2: Average income per capita of the district increases compared to the previous year;

c) Indicator 3: The employment rate of the district increases compared to the previous year.

Article 13. Conditions for recognition and methods of assessing "Learning Community" at district level

1. Conditions for recognizing "Learning Community" at the district level

a) A district is recognized as achieving the "Learning Community" at the district level, Level 1, when it meets all the criteria prescribed in Article 11 of this Circular;

b) A district is recognized as achieving the "Learning Community" at the district level, Level 2, when it meets all the criteria prescribed in Article 12 of this Circular.

2. Methods of assessing "Learning Community" at the district level

a) Assessment of the "Learning Community" at the district level is based on the results achieved according to the criteria prescribed in Articles 11 and 12 of this Circular;

b) An indicator is considered met when all its sub-indicators are met.

c) The assessment results of the criteria and indicators of the "Learning Community" at the district level are evaluated as either met or not met.

Article 14. Evaluation and Recognition Process for "Learning Community" at district level

1. The People's Committee at the district level shall organize the implementation of self-evaluation and recognition of "Learning Community" at the district level according to the following procedures:

a) The People's Committee at the district level shall assign the Department of Education and Training to take the lead in organizing the self-evaluation and recognition of "Learning Community" at the district level based on the criteria and indicators stipulated in Articles 11 and 12 of this Circular;

b) The Department of Education and Training shall prepare a report on self-evaluation and recognition of "Learning Community" at the district level, a summary of the evaluation results of the criteria and indicators; information and data in the self-evaluation report and the summary of the evaluation results of the criteria and indicators shall be calculated from January 1 to December 31 of the year being evaluated;

c) Organize a meeting to review, evaluate, and unify the results of self-evaluation and recognition of "Learning Community" at the district level. The meeting shall be chaired by a representative of the leadership of the Department of Education and Training. Participants in the meeting include representatives of relevant departments under the People's Committee at the district level; representatives of the County Association for Promoting Education; representatives of the Vietnam Fatherland Front and political-social organizations at the district level;

d) Based on the results of self-evaluation, if the district meets all the conditions for recognizing "Learning Community" at the district level at a certain level, the People's Committee at the district level shall submit the application file for recognition at that level (sent directly, online, or through postal services) to the Department of Education and Training before April 30 of the following year immediately after the evaluation year.

The application file for evaluation and recognition of "Learning Community" at the district level includes: A request for evaluation and recognition of "Learning Community" at the district level; a report on self-evaluation and recognition of "Learning Community" at the district level; a summary of the evaluation results of the criteria and indicators.

2. The Department of Education and Training shall organize the evaluation, review, and decision-making process for recognizing the district as achieving "Learning Community" at the district level according to the following procedures:

a) The Department of Education and Training shall receive, review, and inspect the application file for recognition of "Learning Community" at the district level;

b) The Director of the Department of Education and Training shall establish an Evaluation and Recognition Board for "Learning Community" at the district level (hereinafter referred to as the Provincial Evaluation Board). The Provincial Evaluation Board consists of a chairman, a secretary, and members, with an odd number of members, a minimum of five people. The Provincial Evaluation Board includes representatives of relevant departments, agencies, and sectors; representatives of the Provincial Association for Promoting Education; representatives of the Vietnam Fatherland Front and political-social organizations at the provincial level;

c) Organize a meeting of the Provincial Evaluation Board or seek opinions in writing from members of the Provincial Evaluation Board to review the application file for recognition of "Learning Community" at the district level;

d) Based on the review results, in cases where the district does not meet the conditions for recognizing "Learning Community" at the district level, the Provincial Evaluation Board shall submit a report to the Director of the Department of Education and Training to reply to the People's Committee at the district level and clearly state the reasons for non-qualification;

đ) Based on the review results, in cases where the district meets the conditions for recognizing "Learning Community" at the district level, the Provincial Evaluation Board shall complete the application file and submit it to the Director of the Department of Education and Training for review and decision to recognize the district as achieving "Learning Community" at the district level.

The submitted application file includes: A request for recognition of "Learning Community" at the district level; a review report of the Provincial Evaluation Board; a summary of the evaluation results of the criteria and indicators of the district reviewed by the Provincial Evaluation Board; a draft Decision recognizing the district as achieving "Learning Community" at the district level.

3. The completion time for evaluating and recognizing "Learning Community" at the district level: before May 31 of the following year immediately after the evaluation year.

4. The re-evaluation and recognition or upgrading of the level of "Learning Community" at the district level shall be carried out according to the provisions of Clause 1 and Clause 2 of this Article.

Chapter IV
AUTHORITY, LEVEL, CRITERIA, CONDITIONS AND EVALUATION AND RECOGNITION PROCEDURES FOR "LEARNING COMMUNITY" AT THE PROVINCIAL LEVEL

Article 15. Competence to assess, recognize, level, and duration of recognition of "Learning Community" at provincial level

1. The Minister of Education and Training decides to recognize a province as achieving the "Learning Community" at provincial level.

2. Recognition of "Learning Community" at provincial level is divided into two levels: Level 1, Level 2.

3. A province recognized at Level 1 may request an assessment for recognition at Level 2 after at least one year (12 months) from the date of the recognition decision.

4. The recognition result is valid for a period of three years (36 months) following the year of recognition.

Article 16. Criteria for assessing and recognizing "Learning Community" at provincial level, Level 1

1. Criterion 1: Leadership and guidance by the Party Committee and provincial-level government

a) Indicator 1: Effectively conducting propaganda activities to raise awareness within the community about lifelong learning and building a learning society;

b) Indicator 2: Issuing programs, plans, guiding documents within their authority to implement the construction of a learning society and organizing timely implementation of these programs and plans;

c) Indicator 3: Organizing and promoting the movement to build a learning society and lifelong learning.

2. Criterion 2: Mobilizing resources and creating a favorable environment for building a learning society at the local level

a) Indicator 1: Allocating sufficient funds from the state budget annually in accordance with the State Budget Law to implement the construction of a learning society;

b) Indicator 2: Fully implementing policies to promote lifelong learning and building a learning society as issued by the central authority;

c) Indicator 3: Issuing policies suitable to the local economic and social conditions to promote lifelong learning and building a learning society;

d) Indicator 4: Organizing and promoting activities and models to enhance international cooperation in adult education, lifelong learning, and building a learning society;

đ) Indicator 5: Provincial-level units are equipped with digital services and tools for members to implement digital transformation in work and learning.

3. Criterion 3: Effectiveness of operations of educational institutions responsible for assessment and recognition at provincial level and public libraries, museums, radio and television stations at provincial level

a) Indicator 1: Provincial universities have implemented digital transformation and built digital learning materials;

b) Indicator 2: Educational institutions responsible for assessment and recognition at provincial level have implemented management, teaching, and learning activities on digital platforms;

c) Indicator 3: Public libraries at provincial level provide services supporting lifelong learning for library users and apply information technology and digital transformation in managing and organizing activities to support lifelong learning for library users;

d) Indicator 4: Provincial museums develop and implement at least four educational programs on history, culture, science, and art for the people each year;

đ) Indicator 5: Provincial radio and television stations develop themes and content for learning materials and implement at least four educational programs each year on radio and television channels, television applications, and participate in building shared digital resources and open learning materials online for people to access according to their needs.

4. Criterion 4: Impact of building "Learning Community" at provincial level

b) Indicator 2: The proportion of poor households according to the multidimensional poverty standard of the province decreases compared to the previous year;

c) Indicator 3: Gross Domestic Product (GDP) of the province increases compared to the previous year.

Article 17. Criteria for assessing and recognizing "Learning Community" at provincial level, Level 2

1. Criterion 1: Leadership and guidance by the Party Committee and commune-level administration

Content of criteria as prescribed in Clause 1, Article 16 of this Circular.

2. Criterion 2: Mobilizing resources and creating a favorable environment for building a learning society at the local level

Content of criteria as prescribed in Clause 2, Article 16 of this Circular.

3. Criterion 3: Effectiveness of operations of educational institutions responsible for assessment and recognition at provincial level and public libraries, museums, radio and television stations at provincial level

Content of criteria as prescribed in Clause 3, Article 16 of this Circular.

4. Criterion 4: Impact of building "Learning Community" at provincial level

b) Indicator 2: The proportion of poor households according to the multidimensional poverty standard of the province decreases compared to the previous year;

c) Indicator 3: Gross Domestic Product (GDP) of the province increases compared to the previous year.

Article 18. Conditions for Recognition and Method of Evaluating "Learning Community" at Provincial Level

1. Conditions for Recognizing "Learning Community" at Provincial Level

a) A province shall be recognized as achieving the "Learning Community" at provincial level at Level 1 when it meets all criteria stipulated in Article 16 of this Circular;

b) A province shall be recognized as achieving the "Learning Community" at provincial level at Level 2 when it meets all criteria stipulated in Article 17 of this Circular.

2. Method of Evaluating "Learning Community" at Provincial Level

a) The evaluation of "Learning Community" at provincial level is based on the results achieved from the criteria stipulated in Articles 16 and 17 of this Circular;

b) An indicator is considered met when all its sub-indicators are met.

c) The evaluation results of the criteria and indicators of the "Learning Community" at provincial level are assessed in the form of pass or fail.

Article 19. Procedure for Evaluation and Recognition of "Learning Community" at Provincial Level

1. The People's Committee at provincial level organizes the implementation of self-evaluation and recognition of "Learning Community" at provincial level according to the following procedure:

a) The People's Committee at provincial level assigns the Department of Education and Training to take the lead in organizing the implementation of self-evaluation and recognition of "Learning Community" at provincial level according to the criteria and indicators stipulated in Articles 16 and 17 of this Circular;

b) Prepare a report on self-evaluation and recognition of "Learning Community" at provincial level, a summary of the evaluation results of the criteria and indicators; information and data in the self-evaluation report and the summary of the evaluation results of the criteria and indicators are calculated from January 1 to December 31 of the evaluation year;

c) Organize a meeting to review, evaluate, and unify the results of self-evaluation and recognition of "Learning Community" at provincial level. The meeting is chaired by a representative of the Department of Education and Training. Participants include representatives of relevant departments, agencies, the Association for Promoting Learning in the province, the Vietnam Fatherland Front, and other political and social organizations at provincial level;

d) Based on the results of self-evaluation, if the province meets the conditions for recognition of "Learning Community" at provincial level at any level, the People's Committee at provincial level shall submit the application file for recognition at that level (directly, online, or through postal service) to the Ministry of Education and Training before July 31 of the following year after the evaluation year.

The application file for evaluation and recognition of "Learning Community" at provincial level includes: Request for evaluation and recognition of "Learning Community" at provincial level; report on self-evaluation and recognition of "Learning Community" at provincial level; summary of the evaluation results of the criteria and indicators.

2. The Ministry of Education and Training organizes the evaluation, examination, and decision-making for recognizing the province as achieving "Learning Community" at provincial level according to the following procedure:

a) The Ministry of Education and Training receives, reviews, and checks the application file for recognition of "Learning Community" at provincial level;

b) The Minister of Education and Training establishes the Evaluation and Recognition Council for "Learning Community" at provincial level (hereinafter referred to as the Ministry-level Evaluation Council). The Ministry-level Evaluation Council consists of representatives of relevant units under the Ministry of Education and Training;

c) Organize a meeting of the Ministry-level Evaluation Council or seek opinions in writing from members of the Ministry-level Evaluation Council to review the application file for recognition of "Learning Community" at provincial level;

d) Based on the review results of the Ministry-level Evaluation Council, in cases where the province does not meet the recognition conditions, the Department of Continuing Education shall prepare a response letter to the People's Committee at provincial level and clearly state the reasons for non-achievement;

đ) Based on the review results of the Ministry-level Evaluation Council, in cases where the province meets the recognition conditions, the Department of Continuing Education shall complete the file and submit it to the Minister of Education and Training for examination and decision to recognize the province as achieving "Learning Community" at provincial level.

The submitted file includes: Request for recognition of "Learning Community" at provincial level; review report of the Ministry-level Evaluation Council; summary of the evaluation results of the criteria and indicators of the province reviewed by the Ministry-level Evaluation Council; draft Decision recognizing the province as achieving "Learning Community" at provincial level.

e) Within twenty working days from the date of receipt of a complete and valid file transferred by the People's Committee at provincial level, the Minister of Education and Training shall examine and decide to recognize the province as achieving "Learning Community" at provincial level.

3. The procedure for re-evaluation, re-recognition, or recognition at a higher level of "Learning Community" at provincial level shall be implemented according to the provisions of Clause 1 and Clause 2 of this Article.

Chapter V
IMPLEMENTATION

Article 20. Responsibilities of Provincial People's Committees

1. Direct and guide the Department of Education and Training, the People's Committees at district and commune levels, and related units to implement this Circular.

2. Direct the Department of Education and Training, the People's Committees at district and commune levels to develop and implement plans for building "Learning Communities" at commune, district, and provincial levels.

3. Allocate funds to ensure the work of inspection, evaluation, and recognition of "Learning Communities" at commune, district, and provincial levels.

Article 21. Responsibilities of the Department of Education and Training

1. Advise the provincial People's Committee to direct, guide, implement, and inspect the implementation of this Circular at the local level.

2. Take the lead in coordinating with the Provincial Association for Promoting Education and other provincial departments, agencies, and political-social organizations to organize the evaluation and recognition of "Learning Communities" at the district level within their jurisdiction.

3. Report to the Ministry of Education and Training on the results of implementing this Circular at the end of each academic year.

Article 22. Responsibilities of the People's Committee at district level

1. Develop and organize the implementation of plans to build "Learning Communities" at the commune and district levels.

2. Direct the Department of Education and Training and the Commune People's Committee to implement plans to build "Learning Communities" at the commune and district levels.

Article 23. Responsibilities of the Department of Education and Training

1. Take the lead in coordinating with the District Association for Promoting Education and other specialized agencies under the District People's Committee, and political-social organizations at the district level to organize the evaluation and recognition of "Learning Communities" at the commune level within their jurisdiction.

2. Report to the Provincial People's Committee and the Department of Education and Training on the results of evaluating and recognizing "Learning Communities" at the commune and district levels within their jurisdiction.

Article 24. Responsibilities of the Commune People's Committee

1. Develop and organize the implementation of plans to build "Learning Communities" at the commune level.

2. Direct the Commune Association for Promoting Education, political-social organizations at the commune level, cultural and sports centers, public libraries, and educational institutions within the commune to implement plans to build "Learning Communities" at the commune level.

Chapter VI
IMPLEMENTING PROVISIONS

Article 25. Effective Date

1. This Circular takes effect from February 12, 2024, and replaces Circular No. 44/2014/TT-BGDĐT dated December 12, 2014, issued by the Minister of Education and Training regarding the evaluation and classification of "Learning Communities" at the commune level.

2. In cases where the referenced documents in this Circular are amended, supplemented, or replaced by other documents, they shall be implemented according to those amended, supplemented, or replacing documents.

Article 26. The Head of the Office, the Director of the Department of Continuing Education, the Heads of relevant units under the Ministry of Education and Training, the Chairmen of the People's Committees of provinces and centrally-administered cities, the Directors of Departments of Education and Training, related agencies, organizations, and individuals are responsible for enforcing this Circular./.
