Decree 25/2024/NĐ-CP stipulates on awarding the title "People's Doctor" and "Outstanding Doctor".

 

DECREE

REGULATIONS ON THE CONSIDERATION FOR AWARDS OF THE TITLES

"PEOPLE'S DOCTOR", "OUTSTANDING DOCTOR"

||| Pursuant to the Law on Organization of the Government dated June 19, 2015;

Pursuant to the Law on Organization of Local Administration dated June 19, 2015;

Pursuant to the Law Amending and Supplementing Several Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Pursuant to the Law on Encouragement and Reward dated June 15, 2022;

Pursuant to the Law on Medical Examination and Treatment dated January 9, 2023;

At the proposal of the Minister of Health;

The Government promulgates this Decree to regulate the consideration for awards of the titles "People's Doctor", "Outstanding Doctor".

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Decree stipulates the subjects, principles, criteria, awarding councils, files, procedures, and formalities for considering the awards of the titles "People's Doctor", "Outstanding Doctor".

Article 2. Applicability

1. The titles "People's Doctor", "Outstanding Doctor" shall be awarded to individuals including:

a) Physicians, pharmacists, medical assistants, nurses, midwives, traditional doctors, traditional pharmacists, health management officers as specified in Clause 1, Article 65 of the Law on Competition and Rewards;

b) Medical technicians, clinical nutritionists, emergency responders, clinical psychologists, individuals with hereditary prescriptions or hereditary treatment methods as specified in Points d, e, g, h, and k of Clause 1, Article 26 of the Law on Medical Examination and Treatment 2023.

2. Agencies, organizations, and individuals related to the activities of considering the awards of the titles "People's Doctor", "Outstanding Doctor".

Article 3. Principles and requirements in considering the awards

1. To comply with the reward principles stipulated in Clauses 2 and 3, Article 5 of the Law on Competition and Rewards when considering the awards of the titles "People's Doctor", "Outstanding Doctor".

2. Not to use achievements that have been considered for national honor titles including "National Teacher", "Outstanding Teacher", "National Artist", "Outstanding Artist", "National Artisan", "Outstanding Artisan" to propose for the consideration of the awards of the titles "People's Doctor", "Outstanding Doctor".

3. Achievements proposed for the consideration of the awards of the titles "People's Doctor", "Outstanding Doctor" must be achieved during the time working in the healthcare sector. Only achievements recognized through commendation based on merit can be used as conditions and criteria for proposing the consideration of the awards of the titles "People's Doctor", "Outstanding Doctor".

4. Individuals who receive salaries and annual competition and reward evaluations at their units shall propose for the consideration of the awards of the titles "People's Doctor", "Outstanding Doctor" at those units.

5. Not to consider the awards of the titles "People's Doctor", "Outstanding Doctor" for individuals who have been disciplined with warnings or higher penalties.

6. Not to consider proposals for the awards of the titles "People's Doctor", "Outstanding Doctor" for individuals currently within the period of enforcement of reprimand disciplinary measures or involved in cases under investigation by competent authorities for disciplinary measures, or undergoing investigations, inspections, or verifications of violations of laws reported by media outlets, or related to corruption or negative practices being verified and clarified.

Article 4. Calculation of time directly engaged in medical technical work

1. When calculating the time of service for considering the awards of the titles "People's Doctor", "Outstanding Doctor", individuals working in border areas, at sea, on islands, or in regions with extremely difficult socio-economic conditions as defined by the Government shall be multiplied by a factor as specified in Clause 4, Article 65 of the Law on Competition and Rewards.

2. The time of service of individuals engaged in medical technical work in Zones B, C, K; defense wars in the southwestern border, northern border, and volunteer forces of Vietnam in Laos and Cambodia, or participating in international duties shall be multiplied by a factor of 1.5 when calculating the time of service for considering the awards of the titles "People's Doctor", "Outstanding Doctor".

3. The time of service in special fields of the healthcare sector including leprosy, tuberculosis, mental health, pathology, forensic medicine, forensic psychiatry, epidemic prevention, emergency services 115, critical care, and work at detention centers, compulsory education facilities, compulsory drug rehabilitation centers, and juvenile correctional schools shall be multiplied by a factor of 1.5 when calculating the time of service for considering the awards of the titles "People's Doctor", "Outstanding Doctor".

4. Calculation method for the time of service for individuals engaged in health management at preventive healthcare facilities, medical examination and treatment facilities, pharmaceutical production, and medical research institutions (hereinafter referred to as healthcare facilities) who still directly engage in medical technical work is as follows:

a) Heads and deputy heads of healthcare facilities shall be multiplied by a maximum factor not exceeding 0.5 for each year holding managerial positions when calculating the time of direct engagement in medical technical work and must have a written assignment for participation in professional work;

b) Heads and deputy heads of departments, offices of healthcare facilities shall be multiplied by a maximum factor not exceeding 0.5 for each year holding managerial positions when calculating the time of direct engagement in medical technical work and must have a written concurrent assignment for professional work;

c) Heads and deputy heads of departments, department chiefs, and equivalent positions in departments, offices, and centers directly involved in professional work shall be multiplied by a maximum factor not exceeding 0.7 for each year holding managerial positions when calculating the time of direct engagement in medical technical work and must have confirmation from the unit.

5. Time spent by individuals studying without being linked to concentrated medical vocational training for more than 12 months or time taken off without pay, maternity leave, sick leave, or vacation exceeding the legal limit shall be counted as time worked in the healthcare sector but shall not be counted as time directly engaged in medical technical work.

6. In cases where individuals change job positions or have interruptions in time directly engaged in medical technical work, the periods of time directly engaged in medical technical work shall be accumulated and must be confirmed by the healthcare facilities where they have worked.

7. In cases where individuals engage in clinical teaching, near-clinical teaching, epidemic prevention, and disease control at medical examination and treatment practice facilities, confirmation from the medical examination and treatment practice facility is required and the proposal for the consideration of the awards shall be made at the current workplace. In cases where individuals engage in clinical teaching, near-clinical teaching, epidemic prevention, and disease control at multiple medical examination and treatment practice facilities, the proposal for the consideration of the awards shall be made at the facility with the longest practical experience.

Article 5. Granting the title of "People's Doctor" and "Outstanding Doctor" to individuals who have changed their workplace units and retired under social insurance regulations.

1. During the process of granting the titles of "People's Doctor" and "Outstanding Doctor," if an individual changes their position, they will be evaluated based on their position at the time of submitting the application for the title of "People's Doctor" or "Outstanding Doctor" to the grassroots-level Council.

2. Individuals who have retired according to labor laws and social insurance laws for no more than three years from the date of retirement and have not engaged in medical technical activities at their previous workplace may be nominated for the grant of the title of "People's Doctor" or "Outstanding Doctor."

Article 6. Time for granting titles, announcing titles, and organizing award ceremonies.

1. The time for granting titles, announcing titles, and organizing award ceremonies shall be carried out in accordance with the provisions of Clause 5, Article 65 of the Law on Competition and Rewards.

2. Ministries, sectors, provincial People's Committees, and municipal People's Committees directly under the central government (hereinafter referred to as ministries and provinces) shall organize the granting of titles to individuals within their management authority and organize award ceremonies for "People's Doctors" and "Outstanding Doctors" decided by the President of the State to bestow.

Article 7. Rights and obligations of individuals granted titles.

1. Rights:

a) Receive Medals and Certificates of Recognition from the President of the State;

b) Enjoy benefits as prescribed by law.

2. Obligations:

a) Preserve awarded items;

b) Continue to maintain and promote their qualities, morals, talents, and serve as role models for colleagues to emulate and be respected by the people.

Chapter II

CRITERIA FOR GRANTING TITLES

"PEOPLE'S DOCTOR", "OUTSTANDING DOCTOR"

Article 8. Criteria for granting the title of "Outstanding Doctor".

1. Individuals not falling under Clause 4 of this Article must meet the criteria set forth in Points a, b, and c of Clause 3, Article 65 of the Law on Competition and Rewards, demonstrating outstanding talent in research, development of science, technology, and healthcare technology, achieving one of the following standards:

a) Principal of at least two scientific and technological tasks at the grassroots level that have been accepted and rated at least satisfactory;

b) Main researcher in at least two scientific and technological tasks at the ministry or provincial level that have been accepted and rated at least satisfactory;

c) Secretary of at least one scientific and technological task at the ministry or provincial level that have been accepted and rated at least satisfactory;

d) Main researcher in at least one national-level scientific and technological task that have been accepted and rated at least satisfactory;

đ) Principal of at least one grassroots-level scientific and technological task and main researcher in at least one ministry or provincial-level scientific and technological task that have been accepted and rated at least satisfactory;

e) Author of at least one applied innovation recognized by ministries, sectors, or provinces with wide-ranging impact and high effectiveness.

There is no requirement to meet the criteria regarding scientific and technological tasks and innovations for individuals working in border areas, on the sea, islands, regions with particularly difficult economic and social conditions as defined by the Government, or those working in fields such as leprosy, tuberculosis, mental health, pathology, forensic medicine, forensic psychiatry, epidemic prevention, emergency services 115, critical care, or in detention facilities.

2. Individuals specified in Clause 1 of this Article must have outstanding achievements in healthcare work, meeting one of the following standards:

a) Received the Labor Medal or National Defense Medal from Grade III upwards;

b) Received at least one Commendation Certificate from the Prime Minister;

c) Received at least three Commendation Certificates from ministries, sectors, or provinces;

d) Received at least twice the title of Model Worker at the ministry or provincial level and at least once a Commendation Certificate from ministries, sectors, or provinces;

đ) Received at least six times the title of Model Worker at the grassroots level and at least twice a Commendation Certificate from ministries, sectors, or provinces.

3. For individuals serving as heads or deputy heads appointed to managerial positions for over thirty-six months from the date of appointment to the submission of the application, in addition to the aforementioned criteria, if they participate in the granting of the titles of "People's Doctor" and "Outstanding Doctor," the collective managed by them must meet one of the following standards:

a) Three consecutive years prior to the year of nomination for the title were recognized as "Advanced Labor Collective" or "Advanced Unit," including at least two times being recognized as "Excellent Labor Collective" or "Victory Unit;"

b) Received commendations or awards from ministries, sectors, or provinces.

4. Individuals working in border areas, on the sea, islands, or regions with particularly difficult economic and social conditions as defined by the Government, in addition to meeting the criteria set forth in Points a, b, and c of Clause 3, Article 65 of the Law on Competition and Rewards, must also meet the following standards: having at least five years until the date of evaluation recognized as completing tasks well or better, during which period there must be at least three years recognized as completing tasks excellently and receiving at least one Commendation Certificate from ministries, sectors, or provinces.

Article 9. Criteria for awarding the title "People's Doctor"

The title "People's Doctor" shall be awarded to individuals who have been conferred the title "Outstanding Doctor" by the President and meet the following criteria:

1. The criteria stipulated in points a, b, and c of Clause 2, Article 65 of the Law on Encouragement of Competition and Reward.

2. Demonstrate outstanding talent in research, development of science, technology, and medical technology, achieving one of the following standards:

a) Being the principal investigator of at least one provincial or ministerial-level scientific and technological task that has been accepted and evaluated with a rating of satisfactory or higher;

b) Being a key researcher in at least two national-level scientific and technological tasks that have been accepted and evaluated with a rating of satisfactory or higher;

c) Being the author of at least two highly effective and widely influential innovations recognized by ministries, sectors, or provinces;

d) Being the author or co-author of at least one applied invention patent in the field of medicine certified by the Intellectual Property Office under the Ministry of Science and Technology.

3. Achieve outstanding results in healthcare work contributing to the cause of protecting, caring for, and improving public health, meeting one of the following standards:

a) Having been conferred the title "Heroic Laborer" or "Heroic Armed Forces Member";

b) Having been awarded the title "National Model Worker";

c) Having been awarded the Labor Medal or National Defense Medal from Class III upwards;

d) Having received one Commendation Certificate from the Prime Minister and at least two times being awarded the title "Model Worker" at the provincial or sectoral level.

Chapter III

THE AWARDING COUNCIL FOR THE TITLES OF "PEOPLE'S DOCTOR" AND "OUTSTANDING DOCTOR"

"PEOPLE'S PHARMACIST", "OUTSTANDING PHARMACIST"

Article 10. Duties, Principles of Operation, and Composition of the Awarding Council for the Titles of "People's Doctor" and "Outstanding Doctor"

1. The awarding council is established at three levels:

a) Basic-level Council;

b) Provincial/Municipal-level awarding council;

c) National-level Council.

2. The council consists of nine to nineteen members appointed by the head of the agency or unit responsible for its establishment.

3. The duties of the awarding council include:

a) Organizing the awarding process in accordance with the provisions of the law;

b) Announcing the results of the selection through mass media;

c) Completing the awarding dossier to submit to the competent council;

d) Considering and resolving any objections related to the awarding of the titles of "People's Doctor" and "Outstanding Doctor."

4. The awarding council for the titles of "People's Doctor" and "Outstanding Doctor" operates according to the following principles:

a) Democratic, transparent, and in compliance with the legal regulations on encouragement of competition and reward. The results of the council meetings must be publicly posted on the website of the authority responsible for establishing the council;

b) Meetings of the council are considered valid if at least 90% of the council members attend, including the Chairman or Vice-Chairman authorized by the Chairman. In case of absence, members must obtain permission from the Chairman and return their ballots. The Secretariat is responsible for collecting opinions from absent members using Ballot Forms 10 and 11 as prescribed in the Appendix accompanying this Decree;

c) The State-level council only considers dossiers submitted by provincial/municipal-level councils; provincial/municipal-level councils only consider dossiers submitted by grassroots councils in accordance with this Decree; they do not consider dossiers that do not comply with the legal regulations on encouragement of competition and reward;

d) Grassroots councils only submit dossiers to provincial/municipal-level councils; provincial/municipal-level councils only submit dossiers to the State-level council; the State-level council only submits dossiers to the State-level council; the State-level council only submits lists of individuals receiving at least 90% approval from council members to the Prime Minister;

đ) Individuals currently being considered for the titles of "People's Doctor" and "Outstanding Doctor" may not participate in any level of the council.

5. The composition of the awarding council for the titles of "People's Doctor" and "Outstanding Doctor" includes the Chairman, Vice-Chairman, and council members representing relevant agencies and organizations, along with some "People's Doctors" and "Outstanding Doctors." The specific number of council members is determined by the Chairman.

6. Each level of the awarding council uses the seal of the agency or unit headed by the Chairman. Provincial/municipal-level councils may use the seal of the Health Department upon authorization by the Chairman. The State-level council uses the seal of the Ministry of Health.

7. At each level, the awarding council for the titles of "People's Doctor" and "Outstanding Doctor" has a Secretariat, established by the Chairman. The Secretariat is responsible for receiving, reviewing, and summarizing dossiers; sending materials and dossiers for consideration to council members; organizing council meetings. The Secretariat is accountable to the council for the validity of the dossiers; compiling the results of the awarding process; completing the dossiers in accordance with this Decree.

8. Lower-level councils are responsible for resolving any complaints or letters (if any) regarding individuals proposed for awarding; informing the individual and their workplace; reporting to the higher-level council the results of resolving complaints or letters (if any).

9. The agency or organization responsible for encouraging competition and rewarding functions as the permanent office of the awarding council for the titles of "People's Doctor" and "Outstanding Doctor." For the State-level council, the Ministry of Health serves as the permanent office.

10. Grassroots councils are responsible for verifying the accuracy of individual dossiers within their jurisdiction.

Article 11. Local Council

Grassroots councils are established at healthcare facilities, agencies, or units (hereinafter referred to as units) where individuals propose to be awarded the titles of "People's Doctor" and "Outstanding Doctor," including:

1. Grassroots councils at district, city district, town, or provincial city level (hereinafter referred to as district level) to award individuals working at commune health stations, district health centers, and other healthcare facilities within the district.

a) Number of council members: Nine to eleven members;

b) The Council members include: The Chairman of the Council is the representative of the leadership of the People's Committee at the district level; The Vice-Chairman of the Council is the representative of the leadership of the District Health Center and the Chairman of the Trade Union at the district level; Council members are representatives of the leadership of the Civil Service Department, the Health Department at the district level or representatives of the leadership of units at the district level responsible for health management, some Heads of Health Stations at communes, wards, towns (hereinafter referred to collectively as commune level) and representatives of some "People's Doctors", "Outstanding Doctors" (if any);

c) The recipients for consideration for award are individuals who have been and are working at the District Health Center, Commune Health Stations, District Health Departments, Medical Professional Associations, and private healthcare facilities within the jurisdiction.

2. The Council at the grassroots level in medical units under ministries, departments, sectors; units under the Provincial Health Department; private hospitals; pharmaceutical production enterprises.

a) Number of council members: Nine to eleven members;

b) The Council members include: The Chairman of the Council is the head of the unit; The Vice-Chairman of the Council is the representative of the leadership of the unit and the Chairman of the Trade Union of the unit; Council members are representatives of the leadership of some departments, sections, divisions, workshops, parts under the unit, and representatives of some "People's Doctors", "Outstanding Doctors" (if any);

c) The recipients for consideration for award are individuals who have been and are working at medical units under ministries, sectors; units under the Provincial Health Department; private hospitals, pharmaceutical production enterprises.

3. The Council at the grassroots level in the Provincial Health Department, centrally governed city.

a) Number of council members: Nine to eleven members;

b) The Council members include: The Chairman of the Council is the Director of the Provincial Health Department; The Vice-Chairman of the Council is the Chairman of the Trade Union and the Deputy Director of the Provincial Health Department; Council members are representatives of the leadership of some departments, sections, related units, and representatives of some "People's Doctors", "Outstanding Doctors" (if any);

c) The recipients for consideration for award are individuals who have been and are working at the Provincial Health Department agency and medical units within the province, centrally governed city that do not meet the conditions to establish a grassroots-level Council.

4. The Council at the grassroots level in the Ministry of Health agency.

a) Number of council members: Nine to eleven members;

b) The Council members include: The Chairman of the Council is the representative of the leadership of the Ministry of Health; The Vice-Chairman of the Council is the leader of the Ministry Office and the Chairman of the Trade Union of the Ministry agency; Council members are representatives of the leadership of the Ministry Inspectorate, the Cadre and Civil Servant Organization Department, the Science, Technology and Training Bureau; representatives of the leadership of some Departments, Bureaus under the Ministry and some "People's Doctors", "Outstanding Doctors" (if any);

c) The recipients for consideration for award are individuals who have been and are working at the Ministry of Health agency and central agencies that do not meet the conditions to establish a Council.

5. In cases where the Council does not have the required number of members as stipulated or both the head and deputy head of the organization are candidates proposed for the title of "People's Doctor", "Outstanding Doctor", then report to the directly managing superior unit for comments on supplementing additional members to join the Council.

Article 12. The Council at the ministry and provincial levels

1. The Council at the Ministry of Health level, the composition of the Council includes:

a) The number of Council members: From 11 to 15 members;

b) The Chairman of the Council is the Minister of Health;

c) The Vice-Chairman of the Council is the Deputy Minister of Health, the Director of the Cadre and Civil Servant Organization Department, the Chairman of the Health Sector Trade Union;

d) The Council members are representatives of the leadership of the Ministry Office, the Ministry Inspectorate, the Cadre and Civil Servant Organization Department, the Science, Technology and Training Bureau, representatives of the leadership of some Departments, Bureaus, and some "People's Doctors", "Outstanding Doctors".

2. The Council at the ministry level of central ministries, departments with sectoral health (hereinafter referred to as the Council at the ministry and sector level), the composition of the Council includes:

a) The number of Council members: From 11 to 15 members;

b) The Chairman of the Council is the representative of the leadership of the ministry, department;

c) The Vice-Chairman of the Council is the representative of the leadership of the sectoral health, the Chairman of the Trade Union of the ministry, department;

d) The Council members are representatives of the leadership of the Standing Committee of the Competition and Reward Council of the ministry, department; representatives of the leadership of some functional Departments, Bureaus, sections, health facilities, and some "People's Doctors", "Outstanding Doctors".

3. In cases where central ministries, departments with sectoral health do not meet the conditions to establish a Council as stipulated in Clause 2 of this Article, the leadership of the ministry, department assigns the Standing Committee of the Competition and Reward Council to guide, compile the results of the grassroots-level Council's consideration for award to submit to the leadership of the ministry, department for proposal to the Ministry of Health for joint review at the Ministry of Health Council.

4. The Council at the provincial level, centrally governed city level, the composition of the Council includes:

a) The number of Council members: From 11 to 15 members;

b) The Chairman of the Council is the representative of the leadership of the People's Committee at the provincial, centrally governed city level;

c) The Vice-Chairman of the Council is the Deputy Chairman of the People's Committee at the provincial level, the representative of the leadership of the Provincial Health Department, the Chairman of the Health Sector Trade Union;

d) The Council members are Deputy Directors of the Provincial Health Department; representatives of the leadership of: the Provincial Civil Service Department, the Provincial Science and Technology Department, the unit responsible for competition and reward work of the Provincial Health Department, some units under/subordinate to the Provincial Health Department; representatives of professional associations on health, pharmacy and some "People's Doctors", "Outstanding Doctors".

Article 13. National Council

1. The number of Council members: From 15 to 19 members.

2. The National Council is established by the Prime Minister upon the proposal of the Minister of Health, including:

a) The Chairman of the Council is the Minister of Health;

b) The Vice-Chairman of the Council is the Deputy Minister of Health, the representative of the leadership of the Vietnam General Confederation of Labor;

c) The Council members are representatives of the Office

3. The National Council completes the dossier, reports to the Minister of Health for submission to the Prime Minister for consideration, and to the President for decision to confer the title of "People's Doctor", "Outstanding Doctor".

Chapter IV

Dossier, PROCEDURE, AND PROCEDURES FOR CONSIDERATION FOR AWARD

"PEOPLE'S DOCTOR", "OUTSTANDING DOCTOR"

Article 14. Documents for Application to be Considered for Awarding the Titles "People's Doctor" and "Outstanding Doctor"

1. The application documents for individuals applying for the title of "Outstanding Doctor" include:

a) A report on achievements for the award of the title of "Outstanding Doctor" according to Model No. 09 prescribed in the Appendix issued together with this Decree;

b) Copies of decisions awarding commendation titles or related forms of recognition;

c) Copies of certificates or decisions of competent management authorities regarding initiatives or patents (if any);

d) Copies of minutes of acceptance of scientific and technological tasks; Decisions recognizing the results of implementation of scientific and technological tasks that have been accepted and evaluated at a level of pass or higher; Certifications from competent authorities regarding the effectiveness and scope of impact of scientific and technological tasks;

đ) Confirmation of time spent directly working in technical medical professions. In cases where healthcare facilities are dissolved or merged, the immediate superior of such units shall confirm the time spent working in medical technical professions.

2. The application documents for individuals applying for the title of "People's Doctor" include:

a) A report on achievements for the award of the title of "People's Doctor" according to Model No. 08 prescribed in the Appendix issued together with this Decree;

b) Copies of the Decision and Certificate of bestowal of the title of "Outstanding Doctor";

c) Documents specified in points b, c, d, đ, e, g, and h of Clause 1 of this Article.

3. Individuals applying for the titles of "People's Doctor" and "Outstanding Doctor" shall submit one set of documents as stipulated in Clauses 1 and 2 of this Article either online, in person, or through postal services to their current workplace or former workplace before retirement, as provided by law.

4. Individuals as specified in Clause 1 of Article 2 of this Decree shall bear legal responsibility for the legality and accuracy of information declared in the documents. When requested by a competent authority, individuals shall provide original documents or materials for verification.

5. In cases where individual applications are not valid and require supplementation or correction: The agency receiving the documents shall guide individuals to complete the documents. Within seven working days from the date of returning the documents, individuals shall resubmit the completed documents to the receiving agency.

6. Lower-level Councils shall send one set of documents to higher-level Councils including:

a) A proposal for awarding the titles of "People's Doctor" and "Outstanding Doctor" according to Model No. 01 prescribed in the Appendix issued together with this Decree;

b) A list of nominees for the titles of "People's Doctor" and "Outstanding Doctor" according to Model No. 02 prescribed in the Appendix issued together with this Decree;

c) Minutes of introduction and results of soliciting opinions according to Model No. 03 prescribed in the Appendix issued together with this Decree;

d) Minutes of meetings and results of voting for awarding the titles of "People's Doctor" and "Outstanding Doctor" according to Model No. 04 prescribed in the Appendix issued together with this Decree;

đ) A list of brief achievements of individuals nominated for the title of "People's Doctor" according to Model No. 05 prescribed in the Appendix issued together with this Decree;

e) A list of brief achievements of individuals nominated for the title of "Outstanding Doctor" according to Model No. 06 prescribed in the Appendix issued together with this Decree;

g) A report on the process of awarding the titles of "People's Doctor" and "Outstanding Doctor" according to Model No. 07 prescribed in the Appendix issued together with this Decree;

h) Decision on establishment of the Council;

i) Documents of doctors as stipulated in Clauses 1 and 2 of this Article.

7. The National Council shall send one set of documents to the Ministry of Home Affairs for review before submitting to the Prime Minister for consideration and then to the President for decision, including:

a) A proposal from the Chairman of the National Council accompanied by a list of nominees;

b) A summary of individual achievements confirmed by the Chairman of the National Council;

c) Minutes and results of secret ballots of the National Council.

Article 15. Time for submitting files

1. Individuals requesting to be considered for the award shall submit their files to the grassroots Council no later than July 1st of the year of consideration.

2. The grassroots Council shall submit files to the Ministry-level or provincial Council no later than August 15th of the year of consideration.

3. The Ministry-level or provincial Council shall submit files to the State-level Council no later than October 15th of the year of consideration.

4. Paper application files (original copies) must be submitted online, directly, or through postal services to the Standing Body of the Council as stipulated in Article 15 of this Decree.

5. The Standing Bodies at all levels shall receive and check the files. In cases where the files do not comply with the provisions of Article 14 of this Decree, within ten days from receiving the files, the Standing Body must notify the individual or lower-level Council to supplement the files. Upon receiving the notification, within ten days, the individual or lower-level Council must complete the file supplementation.

Article 16. Procedures for awarding at the grassroots Council level

1. Individuals requesting to be considered for the award shall establish or authorize another individual or organization to establish the application file as prescribed in Clause 1 and Clause 2 of Article 14 of this Decree and submit the paper application file (original copy) directly, while attaching electronic files or submitting the application file via online methods or through postal services to the grassroots Council (through the Standing Body).

2. The Standing Body of the grassroots Council shall perform the following tasks:

a) Propose the competent authority to decide on establishing the grassroots Council for awarding the titles of "People's Doctor" and "Outstanding Doctor" and the Secretariat assisting the Council;

b) Verify the validity of the documents in the file; receive and compile reports on the opinions and complaints of individuals and organizations (if any) and report to the competent authority for handling;

c) Compile a list of individuals requesting to be considered for the award along with a summary of each individual's achievements;

d) Propose the head of the unit to decide on organizing a meeting of cadres, civil servants, public officials, and employees to collect ballots to determine the level of trust and respect of patients and colleagues towards the individual requesting to be considered for the award (hereinafter referred to as ballots). The meeting will only be considered valid if at least three-quarters of the cadres, civil servants, public officials, and employees with a secondary education level or higher who are summoned to attend the meeting participate, including at least two-thirds of the cadres, civil servants, and public officials with a secondary medical or pharmaceutical education level or higher who are summoned in the unit participating in the meeting. For units with 500 or more cadres, civil servants, public officials, and employees, the organization of introductions and ballot collection is decided and guided by the unit leader. The results of the opinion collection must be recorded in a protocol. The individual requesting to be considered for the award must receive at least 80% agreement from the total number of participants in the opinion collection to be proposed for consideration at the grassroots Council;

e) Compile and send the documents specified in point c of this clause to the members of the Council and organize meetings of the Council.

3. The grassroots Council shall perform the following tasks:

a) The Council shall convene a secret ballot meeting to select individuals who meet the criteria for the award of the titles of "People's Doctor" and "Outstanding Doctor". Individuals who receive at least 90% of the votes in favor from the total number of Council members as decided upon establishment shall be included in the list for submission to the higher-level Council for consideration;

b) Publicly announce the list of Council selection results by posting it at the workplace of the unit and uploading it to the unit's website within ten days;

c) In cases of complaints or suggestions, the Council shall have the responsibility to review and report to the competent authority for handling according to the law;

d) After the announcement period specified in point b of this clause has expired, the grassroots Council shall complete the award application file and submit it to the Chairman of the grassroots Council for endorsement to the Ministry-level or provincial Council for consideration.

Article 17. Procedure for awarding at the Ministry-level and Provincial Councils

1. The Ministry-level and Provincial Councils shall receive files from the Basic-level Councils.

2. The Standing Body of the Ministry-level and Provincial Councils shall receive and examine the composition and validity of the documents contained in the file submitted by the Basic-level Councils; receive, review, and report to the competent authority on any complaints related to the awarding process (if any); send the documents specified in points d, e, and g of Clause 6 of Article 14 of this Decree to the members of the Council and organize meetings of the Council.

3. The Ministry-level and Provincial Councils shall perform the following tasks:

a) Hold secret ballots to select individuals who meet the criteria for awarding the titles of "People's Doctor" and "Outstanding Doctor." Individuals who receive at least 90% of the votes in favor from the total number of Council members as decided shall be included in the list to be submitted to the higher-level Council for consideration;

b) Publicly announce the results of the selection through the information means of the ministry or province within ten days;

c) In cases of complaints or suggestions, the Council shall have the responsibility to review and report to the competent authority for handling according to the law;

d) After the announcement period specified in point b of this clause has expired, the Basic-level Council shall complete the awarding file and submit it to the Chairman of the Ministry-level and Provincial Council for signature and submission to the State Council for consideration.

4. The Standing Committee of the Provincial Party Committee, City Party Committee, and the Party Cadre Affairs Committee of ministries and sectors shall review and provide comments in writing before submitting individuals proposed for the awarding of the title of "Outstanding Doctor" under their management and individuals proposed for the awarding of the title of "People's Doctor" to the State Council.

Article 18. Procedure for awarding at the State Council

1. The State Council shall receive files from the Ministry-level and Provincial Councils.

2. The Standing Body of the State Council shall receive and examine the composition and validity of the documents contained in the file submitted by the Ministry-level and Provincial Councils; receive, review, and report to the competent authority on any complaints related to the awarding process (if any); send the documents specified in points d, e, and g of Clause 6 of Article 14 of this Decree to the members of the Council and organize meetings of the Council.

3. The State Council shall perform the following tasks:

a) Hold secret ballots to select individuals who meet the conditions and criteria for awarding the titles of "People's Doctor" and "Outstanding Doctor." Individuals who receive at least 90% of the votes in favor from the total number of Council members as decided shall be included in the list to be submitted;

b) Publicly announce the results of the selection on the Government Portal, the Ministry of Health Portal, and the Health and Life Newspaper within ten days;

c) In cases of complaints or suggestions, the Council shall have the responsibility to review and report to the competent authority for handling according to the law;

d) After the announcement period specified in point b of this clause has expired, the State Council shall complete the awarding file and submit it to the Chairman of the State Council. The Ministry of Health shall send it to the Ministry of Home Affairs for verification and submit it to the Prime Minister for consideration to the President for decision.

Chapter V

IMPLEMENTING PROVISIONS

Article 19. Responsibilities of Ministries, Sectors, Localities, and Healthcare Facilities

1. The Ministry of Health

a) Lead the organization of the awarding of the titles of "People's Doctor" and "Outstanding Doctor";

b) Issue plans and notifications to implement the awarding of the titles of "People's Doctor" and "Outstanding Doctor" before each awarding round;

c) Guide, inspect, and urge the implementation of the awarding of the titles of "People's Doctor" and "Outstanding Doctor";

d) Lead and coordinate with relevant organizations and individuals to resolve petitions, complaints, and accusations related to the awarding of the titles of "People's Doctor" and "Outstanding Doctor" (if any) for all levels of councils.

2. Ministries, sectors, and localities

a) Heads of ministries, sectors, and provincial People's Committees shall carry out the awarding according to this Decree and bear responsibility for the accuracy of the files submitted to higher-level councils;

b) Lead and coordinate with relevant organizations and individuals to resolve petitions, complaints, and accusations related to the awarding of the titles of "People's Doctor" and "Outstanding Doctor" (if any) for basic-level councils, provincial and ministerial councils within their jurisdiction;

c) Heads of ministries and sectors shall allocate funds for the activities of basic-level councils, provincial councils, and other related expenses. The Chairmen of provincial People's Committees shall submit to the provincial People's Council for approval of the budget for the activities of basic-level councils, provincial councils, and other related expenses;

d) The Ministry of Home Affairs shall coordinate and ensure the timeline for commendation to allow timely announcement and presentation of awards on the occasion of Vietnam Doctors' Day in the year of application for the award.

3. Healthcare facilities

a) Develop plans to identify, nurture, and promote exemplary models to have a team of doctors meeting the criteria for awarding the titles of "People's Doctor" and "Outstanding Doctor";

b) Healthcare facilities with individuals proposed for the awarding of the titles of "People's Doctor" and "Outstanding Doctor" shall carry out the awarding according to this Decree and bear responsibility for the accuracy of the files submitted to higher-level councils;

c) Coordinate with relevant agencies and units to resolve petitions, complaints, and accusations related to the awarding of the titles of "People's Doctor" and "Outstanding Doctor" (if any) in accordance with the law.

Article 20. Transitional Provisions

Individuals who meet the criteria for proposing the awarding of the titles of "People's Doctor" and "Outstanding Doctor," approved at the awarding councils of the 14th round in 2023, and who have not yet received a Decision from the President conferring these titles when this Decree takes effect shall continue to be considered for the awarding according to Decree No. 41/2015/NĐ-CP dated May 5, 2015 of the Government on the awarding of the titles of "People's Doctor" and "Outstanding Doctor."

Article 21. Effective Date

1. This Decree shall take effect from April 15, 2024.

2. Decree No. 41/2015/NĐ-CP dated May 5, 2015 of the Government on the awarding of the titles of "People's Doctor" and "Outstanding Doctor" shall cease to be effective from the date this Decree takes effect.
