DECREE
Regulations on functions, tasks, powers
and organizational structure of the Ministry of Home Affairs

Pursuant to the Government Organization Law on February 18, 2025;

||| Based on the proposal of the Minister of Home Affairs;

The Government issues this Decree to stipulate the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs.

Article 1. Position and Functions

The Ministry of Home Affairs is an agency of the Government, performing state management functions over administrative organizations, public institutions; local administration; civil servants, public officials, and civil service; labor, wages, social insurance; employment; occupational safety and health; associations, social funds, charitable funds, non-governmental organizations; persons with meritorious services; youth; gender equality; state archives; commendations and rewards, and state management of public services under its jurisdiction according to the law.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

The Ministry of Home Affairs performs tasks and powers as prescribed in the Law on the Organization of the Government, the Government's regulations on the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies, and implements the following specific tasks and powers:

1. Submitting to the Government draft laws, draft resolutions of the National Assembly, draft ordinances, draft resolutions of the Standing Committee of the National Assembly, draft decrees, and resolutions of the Government according to the annual legislative program of the ministry that has been approved, and projects, programs, plans, and resolutions assigned by the Government and the Prime Minister; submitting to the Government and the Prime Minister strategies, plans, long-term, medium-term, and annual development plans, and important national projects and works within the scope of the ministry’s state management.

2. Submitting to the Prime Minister draft decisions, directives, national target programs, national programs, national action programs, and other documents concerning the fields under the ministry’s state management or as assigned.

3. Issuing circulars, decisions, directives, and other documents within the scope of the ministry’s state management.

4. Directing, guiding, and organizing the implementation of functions, tasks, regulatory legal documents, strategies, plans, national target programs, national programs, national action programs, and important national projects and works that have been issued or approved; disseminating information, promoting, popularizing, and educating the law regarding the fields under the ministry’s state management.

5. On administrative organization and public institutions:

a) Submitting to the Government proposals for the organizational structure of the Government during the term of the National Assembly; proposals for establishing new, merging, consolidating, dividing, dissolving ministries, ministerial-level agencies, and government agencies; draft decrees stipulating the organization of specialized agencies under provincial People's Councils (commonly referred to as provincial level), district-level People's Councils, townships, and cities under provinces, and cities under central municipalities (commonly referred to as district level);

b) Reviewing draft decrees of the Government stipulating the functions, tasks, powers, and organizational structures of ministries, ministerial-level agencies, and government agencies; draft decisions of the Prime Minister stipulating the functions, tasks, powers, and organizational structures of organizations under the Prime Minister's decision-making authority; proposals and draft decisions of the Prime Minister on the establishment, restructuring, and dissolution of administrative organizations, public institutions, and inter-sectoral advisory and coordination organizations submitted by ministries, ministerial-level agencies, government agencies, and provincial People's Councils to the Prime Minister;

c) Taking the lead and coordinating with the Government Office and ministries, ministerial-level agencies, and government agencies in reviewing final drafts of decrees of the Government stipulating the functions, tasks, powers, and organizational structures of ministries, ministerial-level agencies, and government agencies before submitting them to the Prime Minister for signature and issuance;

d) Guiding the review of the functions, tasks, powers, and organizational structures of ministries, ministerial-level agencies, and government agencies; compiling and reporting to the Government for decisions on adjusting the functions, tasks, powers, and organizational structures of ministries, ministerial-level agencies, and government agencies;

đ) Guiding the ranking of public institutions according to the provisions of the law.

6. On local administration:

a) Advising and assisting the Government and the Prime Minister in directing the implementation of elections for National Assembly deputies and representatives of all levels of People's Councils; guiding and urging People's Councils at all levels to implement laws and guidelines on elections issued by the National Election Council and central agencies; reporting to the Government and the Prime Minister according to the election work regulations;

b) Assisting the Government and the Prime Minister in guiding and inspecting the activities of People's Councils; directing, guiding, and inspecting the activities of People's Committees according to the law; participating in meetings of People's Councils and provincial People's Committees when necessary to discuss matters related to local administration construction and administrative boundary management;

c) Reviewing and submitting to the Prime Minister files for approval of the results of the election, appointment, and removal of Chairpersons and Vice-Chairpersons of provincial People's Committees; proposing the transfer or dismissal of Chairpersons and Vice-Chairpersons of provincial People's Committees and assigning the right to act as Chairperson of provincial People's Committees;

d) Submitting to the Government and the Prime Minister for issuance or issuing within their authority documents stipulating village-level cadres, non-professional workers at the village level, and in villages and residential wards; guiding the organization and operation of villages and residential wards;

đ) Submitting to the Prime Minister for issuance of documents stipulating criteria, conditions, procedures, and formalities for recognizing island communes, safe area communes, and safe area regions; taking the lead and coordinating with relevant ministries and agencies in reviewing and submitting to the Prime Minister for recognition of island communes, safe area communes, and safe area regions.

7. On administrative boundaries and classification of administrative units:

a) Submitting to the Government for submission to the Standing Committee of the National Assembly for issuance of documents stipulating standards for administrative units, classification of administrative units, naming, and renaming administrative units;

b) Submit to the Government for submission to the National Assembly and the Standing Committee of the National Assembly for consideration and decision on the establishment, dissolution, merger, division, adjustment of administrative unit boundaries; naming, renaming, and resolution of overlapping and unclear boundary issues among administrative units at all levels;

c) Submit to the Government and the Prime Minister for issuance or issue within their authority regulations concerning principles, files, and procedures for determining administrative unit boundaries and establishing and managing administrative boundary files at all levels;

d) Submit to the Prime Minister for decision on the establishment of a review board for files related to the establishment, dissolution, merger, division, and adjustment of provincial administrative unit boundaries; take the lead and coordinate with relevant ministries and agencies to review and submit to the Prime Minister for decision on classifying provincial administrative units;

đ) Take the lead and coordinate with relevant ministries and agencies to organize reviews of files related to the establishment, dissolution, merger, division, and adjustment of district and commune administrative unit boundaries; decide on classifying district administrative units;

8. On personnel management:

a) Submit to the Prime Minister for approval of the total number of civil service positions, civil servants working abroad for administrative agencies and associations assigned tasks by the Party and State at the central level, in accordance with the law and competent authorities;

b) Submit to the Prime Minister and competent authorities for decision on adjusting and supplementing the number of civil service positions for administrative agencies and associations in accordance with the law and competent authorities;

c) Decide on allocating, adjusting, and supplementing civil service positions for each administrative agency and association assigned tasks by the Party and State at the central level in accordance with the law and competent authorities;

d) Decide on allocating civil service positions for work abroad for ministries, agencies equivalent to ministries, and government agencies after approval by competent authorities and the Prime Minister;

đ) Review plans for the number of people working and receiving salaries from the state budget in public institutions self-financing part of their regular expenses and those fully financed by the state budget according to the law and competent authorities;

9. On cadres, civil servants, officials, and public service:

a) Submit to the Government and the Prime Minister for issuance or issuance within their authority legal normative documents, topics, projects, strategies, and guidance on implementing provisions regarding recruitment, placement, and utilization of civil servants and officials based on job positions; appointment to grades, occupational titles, organization of examinations or assessments for promotion to higher grades for civil servants, changes in occupational titles for officials; evaluation and classification of cadre, civil servant, and official quality; occupational title standards; appointment, reappointment, transfer, rotation, secondment, resignation, removal, disciplinary action, termination, and retirement of cadres, civil servants, and officials (except where specialized laws provide otherwise); creation of sources of female cadres and female ratios for appointments to positions in state agencies and other management aspects for cadres, civil servants, and officials as prescribed;

b) Submit to the Prime Minister for decisions on the structure of the number of members of the Government, dismissal, and appointment of Government members during the term of the National Assembly. Review standards, conditions, procedures, formalities, and personnel files for leadership and management positions under the Prime Minister's authority to decide or approve according to the law;

c) Specify professional and vocational standards for civil service grades and occupational title standards for specialized officials under the Ministry of Home Affairs' jurisdiction;

d) Guide the determination of the structure of civil service grades and job positions in state agencies;

đ) Organize the implementation of quality entry testing for civil servants according to the law; build, guide, and manage national data on the cadre, civil servant, and official workforce (including cadres, civil servants, and non-professional staff at the commune, village, and neighborhood levels); collect and compile national statistics on women cadre work; guide the establishment and management of cadre, civil servant, and official files; civil servant and official identity cards;

e) Build, issue, and manage training programs for knowledge and skills in state administration according to civil service grade standards; training programs according to leadership and management job position requirements; training programs according to specialized official occupational title standards in the Home Affairs sector; training programs according to specialized vocational job position requirements in the Home Affairs sector;

g) Build, issue, guide, and organize the implementation of training plans for cadres, civil servants, and officials funded by the state budget within their authority;

h) Monitor and compile results of cadre, civil servant, and official training conducted by ministries, agencies equivalent to ministries, government agencies, the Vietnam Fatherland Front Central Committee, and central-level organizations of political-social groups, and provincial People's Committees;

10. On administrative reform in the state:

a) Submit to the competent authority for decision on programs, plans, and projects on administrative reform in the state for each stage. Serve as the permanent body for administrative reform under the Government;

b) Submit to the Government and the Prime Minister for decision on policies and measures to accelerate administrative reform in the state;

c) Review pilot administrative reform projects submitted by ministries, agencies equivalent to ministries, government agencies, and provincial People's Committees to the Prime Minister;

d) Lead the implementation of organizational and administrative reform of the state machinery, public service system reform; propaganda work on administrative reform;

đ) Develop, issue, guide methods for monitoring, evaluating, and determining administrative reform indices for ministries, agencies equivalent to ministries, and provincial People's Committees; methods for measuring citizens' satisfaction with administrative services provided by state agencies;

e) Organize the implementation, determination, and publication of annual administrative reform indices for ministries, agencies equivalent to ministries, and provincial People's Committees; citizens' satisfaction indices with administrative services provided by state agencies;

g) Guide ministries, agencies at the ministerial level, government agencies, provincial People's Committees to develop, implement programs, projects, plans, and reports on administrative reform in accordance with the law.

11. In the field of labor, wages, and social insurance:

a) Assist the Government in uniformly managing state administration over labor, wages, and social insurance in accordance with the law;

b) Guide and organize the implementation of legal provisions regarding labor contracts, labor discipline, material responsibility, workplace dialogue, collective bargaining, collective labor agreements, and resolution of labor disputes;

c) Guide the implementation of legal provisions concerning female workers, underage workers, elderly workers, disabled workers, domestic workers, and other types of workers;

d) Guide the registration and state management of activities of organizations representing workers in accordance with labor laws; perform national focal point tasks in the field of labor during Vietnam's participation in international trade agreements;

đ) Guide the implementation of legal provisions regarding wage policies, allowances, living expenses, bonuses for civil servants, public officials, and employees from central to commune levels and contractual workers in state agencies and public service units;

e) Guide the implementation of legal provisions regarding minimum wage levels and wage policies for workers in enterprises, agencies, organizations, cooperatives, household businesses, and individuals who hire or employ workers as stipulated by the Labor Code;

g) Guide wage, bonus, and remuneration policies for workers and managers in state-owned enterprises and enterprises with state investment;

h) Study and advise competent authorities on implementing wage policy reforms and social insurance policies;

12. In the field of employment:

a) Guide and organize the implementation of legal provisions regarding employment; unemployment insurance; recruitment and management of Vietnamese workers; uniformly manage foreign workers working in Vietnam;

b) Guide and organize the collection, storage, compilation, analysis, forecasting, and publication of labor market information under the industry and sector they oversee, excluding national statistical system labor market information; issue regulations on the management, exploitation, use, and dissemination of labor market information;

c) Guide the implementation of legal provisions regarding the organization and operation of employment services; guide the management and use of the National Employment Fund in accordance with the law;

13. In the field of Vietnamese workers going abroad to work under contracts:

a) Guide and organize the implementation of legal provisions regarding Vietnamese workers going abroad to work under contracts;

b) Promote expansion, stabilization, and development of overseas labor markets;

c) Specify the program, content, duration of orientation education, model, and validity period of certificates of completion of orientation courses for workers before going abroad to work;

d) Decide on issuing, reissuing, adjusting information, revoking licenses for operating services sending workers abroad under contracts in accordance with the law;

đ) Organize and guide the registration of contracts, reporting on sending Vietnamese workers abroad to work by enterprises and the registration of contracts for workers going abroad under direct labor contracts; supervise the implementation of contracts by enterprises;

e) Guide the management of labor for overseas representative offices of Vietnam;

g) Manage the Overseas Employment Support Fund in accordance with the law;

14. In the field of occupational safety and health:

a) Guide and organize the implementation of legal provisions regarding occupational safety and health; working hours, rest periods; the national program on occupational safety and health; establish the national file on occupational safety and health;

b) Specify compensation and assistance for occupational accidents and occupational diseases; provide supplementary benefits in kind for workers employed under hazardous conditions;

c) Issue lists of machines, equipment, materials, and substances with strict requirements for occupational safety and health based on proposals from relevant ministries in accordance with the law; take the lead in performing state management over training activities for occupational safety and health and inspection activities for machines, equipment, and materials with strict requirements for occupational safety;

d) Take the lead in issuing lists of jobs with strict requirements for occupational safety and health; lists of occupations and jobs that are arduous, dangerous, and particularly arduous, dangerous, and harmful. Specify standards for classifying workers according to working conditions; provisions on the supply of personal protective equipment in labor;

đ) Develop national standards; issue national technical regulations on occupational safety and health within their jurisdiction;

e) Issue inspection procedures for machines, equipment, materials, and management of substances with strict requirements for occupational safety and health within their scope of management;

g) Specify and guide quality inspections of special products and goods related to occupational safety in accordance with the law;

h) Investigate occupational accidents; organize and guide the implementation of collecting, storing, compiling, providing, publishing, and evaluating information on occupational accident situations and serious technical incidents causing occupational safety and health hazards;

i) Guide and organize the implementation of the Occupational Safety and Health Action Month;

15. Regarding associations, social funds, charitable funds, and non-governmental organizations:

a) Assist the Government in uniformly managing state administration over associations, social funds, charitable funds, and domestic non-governmental organizations and Red Cross activities in accordance with the law;

b) Review and submit to the Prime Minister for approval the charters of associations under the Prime Minister's decision-making authority as stipulated by the law;

c) Resolve according to authority and legal provisions regarding procedures related to associations, social funds, charitable funds, and non-governmental organizations;

d) Guide the implementation of legal provisions concerning associations, social funds, charitable funds, and non-governmental organizations;

đ) Reward or propose competent authorities to reward organizations and individuals with achievements in organizing and operating associations, social funds, charitable funds, and non-governmental organizations;

16. In the field of persons with meritorious service:

a) Guide and organize the implementation of policies and laws on preferential treatment for persons with meritorious service to the revolution;

b) Develop systems, standards, and methods for providing assistance equipment, orthopedic devices, and functional recovery equipment for persons with meritorious service to the revolution;

c) Specify the management of memorials for martyrs, develop plans for determining memorials for martyrs within relevant planning schemes;

d) Guide and direct the reception of remains of martyrs, identification of the identities of remains of martyrs lacking information, and information about martyrs' graves.

17. In the field of youth:

a) Guide the integration of youth policy targets and objectives when formulating economic and social development policies, strategies, programs, and plans of sectors and fields;

b) Guide ministries and sectors to integrate statistical indicators on Vietnamese youth into their respective indicator systems;

c) Take the lead and coordinate with ministries, agencies at the level of ministries, government agencies, and the Central Youth Union of Ho Chi Minh Communist Youth to formulate and implement policies and laws concerning youth.

18. Regarding democratic work and mass mobilization:

a) Build and submit to competent authorities for issuance or issue according to authority and guide the implementation of grassroots democracy in accordance with legal provisions;

b) Guide the implementation of mass mobilization work of administrative state agencies and local governments in accordance with Party and legal regulations.

19. In the field of gender equality:

a) Guide and organize the implementation of policies and laws on gender equality in accordance with legal provisions;

b) Lead and coordinate with ministries, sectors, localities, political-social organizations, and related agencies to implement the Month of Action for Gender Equality and Prevention and Response to Gender-Based Violence.

20. Regarding state archival affairs:

a) Assist the Government in unified state management of archival affairs in accordance with legal provisions;

b) Manage archival materials at the central historical archives; manage the archival reserve of the State Archives of Vietnam within authority; manage archival business operations; recognize or revoke recognition of archival materials of special value within authority;

c) Construct, update, manage, and operate the database of archival materials of the State Archives of Vietnam in accordance with legal provisions; establish and manage the National Digital Archive;

d) Receive and update permanent record files and archival materials from the Defense, Public Security, and Foreign Affairs Ministries into the database of archival materials of the State Archives of Vietnam (excluding materials containing state secrets);

đ) Manage archival service activities, issuance, reissuance, and revocation of Archival Practice Certificates;

21. Regarding commendation and rewards:

a) Assist the Government in unified state management of commendation and rewards in accordance with legal provisions;

b) Guide the implementation of legal provisions on organization of commendation campaigns, titles, and criteria for commendation titles; forms, subjects, criteria for rewards; decision-making authority, awarding, procedures, and application files for rewards; rights and obligations of individuals and collectives receiving commendation titles and rewards; handling violations of commendation and rewards;

c) Organize and guide the implementation of commendation campaigns and reward policies of the Party and State;

d) Review reward application files, submit to the Prime Minister for decision or submit to the Prime Minister for recommendation to the President for decision on rewards in accordance with legal provisions;

đ) Prepare accompanying items for commendation titles and reward forms of the President, Government, and Prime Minister. Implement the issuance, exchange, and reissue of reward items according to decisions of competent authorities;

e) Mobilize funding sources and manage and use the central commendation and reward fund; direct, guide, and inspect the management of commendation and reward funds at various levels and sectors;

g) Serve as the standing member of the Central Commendation-Reward Council.

22. Regarding international cooperation:

a) Manage and organize international cooperation and integration in sectors and fields under the department's state management according to legal provisions;

b) Lead and coordinate with relevant agencies to implement cooperation with ASEAN countries in civil service and civil servant fields and other areas as prescribed;

c) Organize negotiations and signing of international treaties according to legal provisions and authorization by competent state authorities; lead and coordinate in signing and implementing international agreements on behalf of the department according to legal provisions; participate in international organizations as assigned by the Government.

23. Regarding public services:

a) Manage and organize the implementation of public service activities in sectors and fields under the department's state management; manage organizations and units engaged in public service activities under the department;

b) Guide the implementation of policies and laws and support organizations in conducting public service activities in managed sectors and fields according to legal provisions.

24. Organize training and capacity building for cadres, civil servants, and officials, and according to societal needs in sectors and fields under management as prescribed by law.

25. Organize and direct the implementation of scientific research and application of research results; information and communication; application of technology and information data; digital transformation and specialized data management to serve the department's state management functions.

26. Manage organizational structure; positions, staffing levels for civil servants, number of employees in public service units, and number of workers under labor contracts within the ministry. Implement recruitment, utilization, and management of cadres, civil servants, officials, and workers according to regulations and delegated authority.

27. Manage financial resources and assets assigned, and organize the implementation of the budget allocated according to legal provisions.

28. Compile, statistically analyze, summarize, evaluate, and report to the Government, Prime Minister, and competent authorities on the situation and results of performing state management functions and tasks of the ministry as prescribed by law, or as assigned and requested by competent authorities; establish and manage database and statistical information systems of the ministry.

29. Lead and coordinate with relevant ministries, sectors, and agencies to address recommendations from organizations and units as assigned by the Government and Prime Minister.

30. Conduct inspections and checks on the performance of functions, tasks, powers, and implementation of policies and laws in sectors and fields under the ministry's state management jurisdiction as prescribed by law. Carry out anti-corruption, anti-neglect activities; crime prevention; thrift promotion and waste reduction; citizen reception; handling complaints, denunciations, suggestions, and feedback on issues within the ministry’s state management jurisdiction as prescribed by law. Handle violations or report to competent authorities for handling violations in sectors and fields under the ministry's state management jurisdiction as prescribed by law.

31. Perform other tasks and powers delegated by the Government, Prime Minister, assigned by the Prime Minister, and as prescribed by law.

In this Article, units specified from Clause 1 to Clause 18 are administrative organizations assisting the Minister in performing state management functions; units specified from Clause 19 to Clause 22 are public service units serving the state management functions of the ministry.

The Minister of Home Affairs shall issue decisions defining the functions, tasks, powers, and organizational structures of units under the ministry; submit to the Prime Minister for issuance of decisions regarding the list of other public service units under the ministry as prescribed.

Article 4. Effective date

1. This Decree shall take effect from March 1, 2025.

2. This Decree replaces Decree No. 62/2022/NĐ-CP dated September 12, 2022 of the Government stipulating the functions, tasks, powers, and organizational structures of the Ministry of Labor, Invalids and Social Affairs; and Decree No. 63/2022/NĐ-CP dated September 12, 2022 of the Government stipulating the functions, tasks, powers, and organizational structures of the Ministry of Home Affairs.

Article 5. Responsibilities for Implementation

The Minister of Home Affairs, ministers, heads of ministerial-level agencies, heads of government agencies, Chairpersons of provincial and centrally-administered city People's Committees are responsible for implementing this Decree.
