Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Law on Cultural Heritage dated June 29, 2001;

Considering the proposal of the People's Committee of Nam Dinh Province (Document No. 209/VP5 dated June 17, 2005) and the opinion of the Ministry of Planning and Investment (Document No. 5548/BKH-LĐVX dated August 16, 2005),

DECISION:

Article 1. Approves the "Master Plan for the Conservation, Restoration, and Enhancement of the Value of Historical and Cultural Relics from the Tran Dynasty in Nam Dinh Province" with the following main contents:

1. Name of the Plan: "Master Plan for the Conservation, Restoration, and Enhancement of the Value of Historical and Cultural Relics from the Tran Dynasty in Nam Dinh Province until 2015".

2. Objectives:

a) Determining the legal bases for managing, conserving, and enhancing the values of the cluster of historical and cultural relics from the Tran Dynasty in Nam Dinh Province according to the Law on Cultural Heritage.

b) Protecting, discovering, clarifying, and enriching the tangible and intangible cultural values of the relic area, creating a basis for proposing the recognition of the cluster of historical and cultural relics from the Tran Dynasty in Nam Dinh Province as a world cultural heritage.

c) Serving as a basis for developing detailed plans, projects, programs for the reasonable and effective conservation, restoration, and enhancement of the value of the relic area; serving as a foundation for establishing, reviewing, approving investment projects, and implementing plans, calling for investment, mobilizing various sources of capital.

d) Conserving, restoring, and enhancing the value of historical relics, natural landscapes, and ecological environments within the development planning area of the historical and cultural relics from the Tran Dynasty in Nam Dinh Province.

đ) Coordinating with the overall socio-economic development plan of the province, specialized planning, urban planning within the provincial territory, ensuring sustainable development of the region.

3. Scope of Planning and Zoning:

The historical and cultural relic area from the Tran Dynasty in Nam Dinh includes the relic area and buffer zone in the communes of Loc Vuong, My Trung, My Phuc in My Luc district and Nam Dinh city, with a total natural area of approximately 1,984 hectares.

4. Functional Zones:

a) Special conservation zone with an area of 669 hectares including:

- Historical relics: Tran Temple, Phu Minh Pagoda, Hau Boi Temple, Loc Quy Temple, Bao Loc Temple, Liu Pho Temple, Ruins of Tran Thuong Temple, Fourth Temple, First Temple, Second Temple, Third Temple.

Some related relics: Coi Son Pagoda, Confucius Temple, Lieu Nha Communal House, Van Hung Temple, Communal House and Village of Tuc Mac, Dam Thanh Pagoda.

- Landscape protection of the relic area and facilities for festivals: Tran Cultural Park; Dong A Square for festivals; festival route and landscape connecting from the central area to the relics; Tao Dan Flower Garden; dredging the Vinh Giang River, restoring the Ao Ben and Ben Ding Lake; digging to connect the Vinh Giang River, Ben Ding Lake, and Ao Ben around the palace area; Renowned Person Garden; service area for festivals and tourism.

b) Separate conservation zone with an area of 1,315 hectares including:

- Historical relics: Lan Hoa Temple, Phuong Bong Communal House, Mai Huong Pagoda, Hop Pagoda, La Pagoda, Ca Pagoda, Tran Hung Dao Monument, Vong Cuong, Nam Dinh Flagpole, Traditional Lake.

- Conservation and exploitation planning of historical relics in the separate conservation zone: expanding land around each relic for protective corridors; repairing and restoring relics; constructing utility facilities within the relic areas; upgrading and building new roads connecting to relics within the zone and linking with roads in the special conservation zone.

5. Groups of Projects:

a) Group of Projects for the Conservation and Restoration of the Cluster of Historical and Cultural Relics from the Tran Dynasty in Nam Dinh.

b) Group of Projects for Constructing the Landscape Protection of the Relic Area and Facilities for Festivals as stipulated at point a Clause 4 of this Decision.

Project for Building Technical Infrastructure (including renovation and upgrading projects) and Building New Roads, Parking Lots, and River Dredging.

6. Objects of Conservation:

The main objects of conservation in the plan are the "historical and cultural Tran relic area," including temples, pagodas, ancient architectural works, folk culture, traditional festivals, traditional handicrafts.

7. Sources of Investment Capital:

a) Central budget funds allocated annually;

b) Local budget funds;

c) Funds raised from contributions of domestic and foreign organizations and individuals.

d) Other lawful sources of funds.

8. Investment Phases:

a) Phase I: 2006 - 2010;

b) Phase II: 2011 - 2015.

Article 2. The People's Committee of Nam Dinh Province shall be responsible for leading and coordinating with the Ministry of Culture, Sports and Tourism and relevant agencies to perform the following tasks:

1. Continuing to implement research, collect materials, and conduct archaeological excavations to determine and supplement scientific bases to clarify the classification of relics, delineate protected zones for relics, assess the true value of relics and related structures. Measures must be taken to promptly prevent and address violations against classified relics and natural landscapes within the conservation zones.

2. Based on the approved master plan, study and develop detailed plans for conservation zones, clearly demonstrating the relationship between relic conservation activities and socio-economic development to protect relics, enhance their value, while ensuring stable production and continuously improving people's living standards. In the short term, priority should be given to the special conservation zone, buffer zone, and classified associated relics.

3. Proceed with the construction of investment projects for the conservation, restoration, and enhancement of the value of the cluster of historical relics and technical infrastructure projects in the special conservation zone, and submit them for approval.

4. Based on the approved master plan, proceed to establish, review, and submit to competent authorities for approval of component projects in accordance with current regulations.

For each component project, it is necessary to reasonably determine the source of funding; the state budget should mainly focus on investing in technical infrastructure projects in the special conservation zone, buffer zone, and directly related relics to Tran Temple; measures should be taken to mobilize the public's contribution to the preservation, protection, investment, and enhancement of the value of the relic area.

5. Study and promulgate charters and regulations to manage investment construction activities and socio-economic-cultural activities throughout the entire heritage site area and in specific regions.

Article 3. Responsibilities of relevant ministries and sectors:

1. The Ministry of Culture, Sports and Tourism shall be responsible for monitoring and supervising the implementation of the master plan to ensure compliance with the set objectives; it shall be responsible for reviewing the technical aspects of related component projects, conservation, restoration, and enhancement of historical and cultural relics.

2. The Ministry of Planning and Investment and the Ministry of Finance, within their respective functions and duties, shall consider and balance the state budget capital for the implementation of approved investment projects within the scope of this Master Plan.

3. The Vietnam National Administration of Tourism shall take the lead and coordinate with relevant ministries, sectors, and localities to connect domestic tourism routes and enhance the value of this historical heritage site.

Relevant ministries and sectors shall be responsible for coordinating, monitoring, supervising, and providing support to ensure that the implementation of the master plan is consistent with sectoral plans on the territory of the Tran Dynasty cultural heritage site in Nam Dinh Province.

Article 4. This Decision takes effect fifteen days from the date of publication in the Official Gazette.

The Ministers of Planning and Investment, Finance, Culture, Sports and Tourism, Construction; the Chairman of the People's Committee of Nam Dinh Province; and the heads of relevant agencies shall be responsible for implementing this Decision./.
