THE MINISTER OF HEALTH

Pursuant to the Law on People's Health Protection dated July 11, 1989 and the Drug Prevention and Treatment Regulation issued together with Decree No. 23/HĐBT dated January 24, 1991 of the Council of Ministers.

Pursuant to Decree No. 68/CP dated October 11, 1993 of the Government stipulating the tasks, powers, and organizational structure of the Ministry of Health.

Pursuant to Decree No. 86/CP dated December 8, 1995 of the Prime Minister stipulating the division of responsibilities for state management over product quality.

Pursuant to Circular No. 07/TTLB dated July 1, 1996 jointly issued by the Ministry of Health, the Ministry of Science and Technology, and the Ministry of Environment guiding the implementation of Decree No. 86/CP dated December 8, 1995 of the Prime Minister.

Pursuant to Decision No. 2063/BYT-QĐ dated November 4, 1996 of the Minister of Health promulgating the list of cosmetic types required to register their quality.

At the proposal of the Director of the Vietnam Drug Administration.

Pursuant to …;

Article 1. Assign the Institute for Testing, Branch Institutes for Testing, Stations for Testing, and Provincial Centers for Pharmaceutical Testing under the central government to be responsible for organizing the implementation of quality checks on cosmetics that directly affect human health according to the annual list published by the Ministry of Health.

Article 2. The Institute for Testing and Branch Institutes for Testing shall be responsible for directing in terms of expertise, technology, and professional matters for the Stations for Pharmaceutical Testing and Provincial Centers for Pharmaceutical Testing in organizing the determination of the quality of cosmetics that directly affect human health as prescribed.

Article 3. The authority to conclude on the quality of cosmetics shall be exercised in accordance with the authority to conclude on the quality of drugs as stipulated in Article 39 of the Drug Prevention and Treatment Regulation issued together with Decree No. 23/HĐBT dated January 24, 1991 of the Council of Ministers.

Article 4. Directors of Health Departments of provinces and centrally-administered cities shall direct and create conditions for equipment and personnel for Centers and Stations for Pharmaceutical Testing to perform their functions of inspecting and supervising the quality of cosmetics according to the prescribed list.

Article 5. This Decision takes effect from January 1, 1997. All previous regulations contrary to this Decision are abolished.

Article 6. The Permanent Deputy Minister of Health, Director of the Vietnam Drug Administration, Directors of Health Departments of provinces and centrally-administered cities, Directors of the Institute for Testing, Directors of Branch Institutes for Testing under the Ministry of Health, Directors of Stations for Pharmaceutical Testing, and Directors of Provincial Centers for Pharmaceutical Testing are responsible for implementing this Decision.
