DECREE

NUMBER 259/SL ON NOVEMBER 19, 1948

PRESIDENT OF THE VIETNAM DEMOCRATIC REPUBLICIC GOVERNMENT

Pursuant to Decree No. 33 dated March 22, 1946 and Decree No. 71 dated May 22, 1946 organizing the National Army of Vietnam,

Pursuant to Decree No. 34 dated March 25, 1946 and Decree No. 35 dated March 19, 1947 organizing the Ministry of National Defense,

At the proposal of the Ministry of National Defense and in accordance with the decision of the Council of Ministers and the agreement of the Standing Committee of the National Assembly,

ISSUES THE DECREE:

Article 1

Each military personnel, regardless of rank or position, shall be entitled to a minimum daily subsistence allowance of six dong (6đ00). The method of calculating the monthly subsistence allowance on a rounded basis is no longer applicable.

Article 2

For military personnel stationed in expensive areas or difficult to supply, the daily subsistence allowance may temporarily be increased. The increase in the subsistence allowance shall be decided by the Minister of National Defense upon the recommendation of the Regional Commander, the regional administrative authority, the Chief of the Logistics Department, and the Director of the Personnel Department.

Article 3

In addition to the subsistence allowance, military personnel shall be entitled to a monthly rank allowance as follows:

Article 4

Military personnel who have served in the army for three years or more shall be entitled to a monthly seniority allowance as follows:

After three years 30đ00 per month

After five years 60,00 per month

and for each additional two-year period thereafter, an additional 30đ per month, regardless of rank or position.

Article 5

The rank allowance and seniority allowance shall be calculated monthly, starting from the month when the new rank is received or when the seniority allowance becomes due.

Article 6

Personnel holding ranks or military titles may apply for the benefits prescribed in this decree for military personnel.

Such personnel will no longer follow the civil service regulations and shall enjoy all material benefits provided for military personnel.

Once applying for military personnel status, it must be applied for at least for a period of one year.

The Ministers of Finance, Interior, and National Defense shall implement this decree.
