REGARDING THE ADJUSTMENT OF THE MINIMUM CAPITAL REQUIREMENT FOR PRIVATE ENTERPRISES, LIMITED LIABILITY COMPANIES, AND JOINT STOCK COMPANIES

Pursuant to the Government Organization Law dated September 30, 1992;
BASED ON THE LAW ON ENTERPRISES AND THE LAW ON PRIVATE ENTERPRISES OF DECEMBER 21, 1990;
At the proposal of the Minister of Finance,
DECREE:
Article 1. THE MINIMUM CAPITAL REQUIREMENTS APPLICABLE TO THE ESTABLISHMENT OF PRIVATE ENTERPRISES, LIMITED LIABILITY COMPANIES, AND JOINT STOCK COMPANIES ARE AS FOLLOWS:

THIS DECREE SHALL TAKE EFFECT 15 DAYS FROM THE DATE OF SIGNATURE AND SHALL REPLACE THE LIST OF MINIMUM CAPITAL REQUIREMENTS FOR EACH INDUSTRY ISSUED WITH DECREE NO. 221/HĐBT AND DECREE NO. 222/HĐBT OF JULY 23, 1991 BY THE STATE COUNCIL (NOW THE GOVERNMENT) TO SPECIFY CERTAIN PROVISIONS OF THE LAW ON PRIVATE ENTERPRISES AND THE LAW ON ENTERPRISES FOR THE ESTABLISHMENT OF NEW PRIVATE ENTERPRISES, LIMITED LIABILITY COMPANIES, AND JOINT STOCK COMPANIES. PREVIOUS PROVISIONS CONTRARY TO THIS DECREE SHALL BE ABROGATED.
Article 2. This Decree takes effect fifteen days after the date of signature, replacing the Statutory Capital List for each industry and profession issued together with Decree No. 221/HĐBT and Decree No. 222/HĐBT dated July 23, 1991, of the Council of Ministers (now the Government), which detailed certain provisions in the Law on Private Enterprises and the Law on Companies for the establishment of new private enterprises, limited liability companies, and joint-stock companies. All previous regulations that conflict with this Decree are hereby abolished.
Article 3. The Minister, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of People's Committees of provinces and centrally-administered cities are responsible for implementing this Decree./.
