Regarding the issuance of "Regulations on Functions, Tasks, Authorities, and Organizational Structure of District, Urban District, Town, and Provincial City Preventive Health Centers"

THE MINISTER OF HEALTH

Pursuant to Decree No. 49/2003/NĐ-CP dated May 15, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;

Pursuant to Decree No. 171/2004/NĐ-CP dated September 29, 2004 of the Government stipulating the organization of specialized agencies under the People's Committees of provinces and centrally governed cities;

Pursuant to Circular Joint Circular No. 11/2005/TTLT-BYT-BNV dated April 12, 2005, issued by the Ministry of Health and the Ministry of Home Affairs, guiding the functions, tasks, authorities, and organizational structure of specialized agencies assisting local People's Committees in managing state administrative affairs related to health;

At the proposal of the Director of the Organization and Cadres Department and the Director of the Vietnam Preventive Health Center under the Ministry of Health,

DECISION:

Article 1. The attached Decision issues "Regulations on Functions, Tasks, Authorities, and Organizational Structure of District, Urban District, Town, and Provincial City Preventive Health Centers."

Article 2. This Decision takes effect 15 days after its publication in the Official Gazette. All previous regulations that conflict with this Decision are hereby abolished.

Article 3. The following individuals are responsible for implementing this Decision: Heads of the Office, Directors of the Organization and Cadres Department, Directors of the Vietnam Preventive Health Center under the Ministry of Health, Directors of Health Departments of provinces and centrally governed cities, and heads of relevant units.

REGULATIONS

Functions, tasks, authorities, and organizational structure of

District, Urban District, Town, and Provincial City Preventive Health Centers

PART I

GENERAL PROVISIONS

Article 1. District, Urban District, Town, and Provincial City Preventive Health Centers (hereinafter referred to collectively as district centers) are public service units directly subordinate to the Health Department, subject to comprehensive management by the Health Department Director, state administration by the District People's Committee, and technical guidance by provincial-level preventive health centers and specialized centers.

Article 2. District Preventive Health Centers have the status of a legal entity, have their own headquarters, separate seals, and are authorized to open accounts at the State Treasury.

Chapter II

FUNCTIONS, TASKS, AND POWERS

Article 3. District Preventive Health Centers have the function of implementing professional technical tasks related to preventive healthcare, HIV/AIDS prevention and control, sexually transmitted disease prevention and control, food safety, reproductive health care, and health education and communication within their districts.

Article 4. District Preventive Health Centers have the following tasks and authorities:

1. Develop plans to implement professional technical tasks related to preventive healthcare, HIV/AIDS prevention and control, sexually transmitted disease prevention and control, food safety, reproductive health care, and health education and communication based on provincial plans and actual conditions in the district, and submit them for approval by competent authorities.

2. Organize the implementation of the following activities:

a) Implement professional technical activities related to disease prevention and control, HIV/AIDS, sexually transmitted diseases, accidents and injuries, occupational health, reproductive health, environmental health, school health, community nutrition, food safety, health education and communication according to assigned levels and legal provisions;

b) Provide professional technical guidance and supervision for activities under their responsibility to commune health stations, urban health stations, town health stations, and medical facilities within the district;

c) Participate in training, retraining, and capacity building for commune health workers, village health workers, and other staff in areas under their responsibility;

d) Conduct research and participate in scientific research and application of technological advancements in related fields;

đ) Manage and organize the implementation of national health target program projects and other projects assigned by the Health Department;

e) Implement personnel management, policies, rewards, and disciplinary measures for civil servants and employees, and manage financial and asset matters of the unit in accordance with legal provisions;

g) Implement statistical and reporting systems as prescribed by law;

h) Perform other tasks and authorities assigned by the Health Department Director and the District People's Committee.

Chapter III

ORGANIZATIONAL STRUCTURE

Article 5. Organizational Structure

1. Leadership of District Preventive Health Centers includes a Director and Deputy Directors;

2. Functional and operational departments include:

a) Administrative General Department;

b) Health Education and Communication Department.

3. Specialized departments include:

a) Disease Control and HIV/AIDS Department;

b) Food Safety Department;

c) Public Health Department;

d) Reproductive Health Care Department;

đ) Laboratory Department.

Article 6. Staffing and Labor Standards

Staffing and labor standards of District Preventive Health Centers are implemented in accordance with legal provisions.

Article 7. Operating Budget

1. Public Service Health Budget;

2. National Health Target Program Budget;

3. Fees collected in accordance with legal provisions;

4. Grants and other lawful sources of funding.

Article 8. Tasks of Departments and Divisions

1. Administrative General Department:

a) Develop monthly, quarterly, and annual plans for the center; organize mid-term and final reviews of plan implementation;

b) Organize the implementation of administrative and managerial tasks to support the center's operations;

c) Manage finances, assets, medicines, materials, chemicals, and equipment for professional work and center activities, and be responsible for settlement and finalization in accordance with legal provisions;

d) Manage organizational and personnel matters; implement policies, rewards, and disciplinary measures as prescribed by law;

đ) Implement comprehensive statistics, reports on center activities as prescribed.

2. Health Education and Communication Department:

a) Promote Party and State policies and guidelines in the field of health;

b) Be responsible for organizing and guiding health education and communication activities related to preventive healthcare, HIV/AIDS prevention and control, food safety, and reproductive health care within the district;

c) Provide health counseling services to residents and guide health counseling practices for medical facilities within the district.

3. Disease Control and HIV/AIDS Department:

a) Conduct regular surveillance and strict management of the situation of infectious diseases causing epidemics, sexually transmitted diseases, and HIV/AIDS within the district; organize the implementation of epidemic and disease prevention and control activities;

b) Conduct periodic investigations of the situation of infectious diseases causing epidemics, sexually transmitted diseases, and HIV/AIDS at medical facilities and in the community within the district;

c) Organize activities to prevent and control HIV/AIDS, guide management and care for HIV-infected individuals at home and in the community; coordinate with hospitals within the district in managing HIV/AIDS treatment work;

d) Strictly manage old epidemic foci, promptly detect new epidemic foci; implement professional and technical measures to prevent the emergence and spread of epidemics;

đ) Compile data, create maps and charts of various epidemic diseases, social diseases, and HIV/AIDS in the locality;

e) Implement the national health target program and related projects on preventive healthcare, social disease prevention, and HIV/AIDS control within the district;

4. Department of Food Safety and Hygiene:

a) Guide the implementation of laws and regulations on food safety and hygiene, and disseminate community nutrition knowledge to agencies and organizations within the district;

b) Supervise the compliance with food safety and hygiene conditions for food production and business establishments within the district;

c) Conduct food safety and hygiene inspections for street food service establishments and food production facilities within the district; investigate and implement preventive measures against food poisoning as prescribed;

d) Coordinate in implementing the "Month of Action for Food Safety and Hygiene Quality";

đ) Implement the national health target program and related projects on food safety and hygiene within the district;

5. Department of Public Health:

a) Be responsible for providing professional and technical guidance on occupational safety and health, school hygiene, accident and injury prevention, chemical pesticide poisoning prevention; construction, repair, and use of sanitation facilities; methods for handling waste within the district;

b) Monitor drinking water sources, occupational safety and health conditions, school hygiene conditions; compile, track, and evaluate the quality and effectiveness of compliance with professional and technical standards for facilities, agencies, and organizations within the district;

c) Establish occupational health records and organize regular health check-ups for workers;

d) Coordinate with functional agencies, departments, and mass organizations within the district in building healthy villages and safe community models, preventing accidents and injuries;

đ) Implement the national health target program and projects on environmental health, labor health, school health, accident and injury prevention, and occupational disease prevention within the district;

6. Department of Reproductive Health Care:

a) Manage reproductive health indicators and assess the current state of reproductive health in the district;

b) Supervise and provide professional and technical support to commune health centers in implementing national standard guidelines for reproductive health services;

c) Provide family planning services and prevent reproductive tract infections;

d) Implement the national health target program and projects on reproductive health care and child malnutrition prevention within the district;

7. Laboratory Department:

a) Carry out basic tests to support the professional work of the Center and commune health centers; collect and preserve samples for higher-level testing as prescribed;

b) Coordinate with the Diagnostic Departments of hospitals within the district to implement timely tests to support professional work;

c) Organize laboratory services within the scope regulated by the competent authority./.
