CIRCULAR

Detailed criteria for classifying risk zones for marine and island environmental pollution and guidelines for delineating risk zones for marine and island environmental pollution

Pursuant to the Law on Marine and Island Resources and Environment dated September 25, 6 2015;

Pursuant to Decree No. 21/2013/NĐ-CP dated March 4, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;

At the proposal of the Director General of the Vietnam Marine and Island Administration&& Nand the Head of the Legal Department,

The Minister of Natural Resources and Environment issues this Circular detailing the criteria for classifying risk zones for marine and island environmental pollution and guidelines for delineating risk zones for marine and island environmental pollution.

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

Article 1. This Circular details the criteria for classifying risk zones for marine and island environmental pollution and guidelines for delineating risk zones for marine and island environmental pollution.

Article 2. This Circular applies to agencies, organizations, and individuals related to the classification of risk zones for marine and island environmental pollution and the delineation of risk zones for marine and island environmental pollution.

Article 2. Interpretation of Terms

In this Circular, the following terms are understood as follows:

1. Criteria Risk zone classification criteria

2. Coastal cell refers to cells within the range from the mean high tide line to the lowest mean sea level line over many years.

3. Nearshore cell refers to cells within the nearshore marine area.

4. Offshore cell refers to cells outside the nearshore marine area.

5. Environmental risk index (ERI) is the ratio between the predicted concentration or calculated concentration of pollutants in the marine and island environment based on measured data and monitoring information, and the limit concentration of pollutants in the marine and island environment as prescribed or permitted by the competent authority.

6. Map of risk zone delineation for marine and island environmental pollution is a map showing the risk zone classification for marine and island environmental pollution according to coastal cells, nearshore cells, or offshore cells.

Article 3. Principles for classifying risk zones and delineating risk zones for marine and island environmental pollution

Clause 1. The classification of risk zones and delineation of risk zones for marine and island environmental pollution shall be carried out for each coastal cell, nearshore cell, and offshore cell.

Clause 2. The classification of risk zones for marine and island environmental pollution must be based on measured and monitored data of environmental components and utilize computational tools and models for pollutant emission, dispersion, transformation, and conversion processes in the marine and island environment.

Clause 3. The delineation of risk zones for marine and island environmental pollution must be based on the calculation and determination of values corresponding to the risk zone classification criteria for each cell, as shown on maps in accordance with the law on thematic map establishment.

Article 4. Division of cells for classifying risk zones and delineating risk zones for marine and island environmental pollution

Clause 1. The Vietnamese marine and island areas are divided into coastal cells, nearshore cells, and offshore cells; all cells have rectangular shapes.

Clause 2. The identification of coastal cells must be based on natural characteristics, geological, geomorphological conditions of the coastline, coastal land ecosystems, socio-economic activities in coastal areas; the length of the larger side of the cell should not exceed the distance from the mean high tide line to the lowest mean sea level line over many years.

Clause 3. The identification of nearshore cells must be based on hydrodynamic regimes, nearshore marine ecosystems, socio-economic activities in nearshore areas; the length of the larger side of the cell should not exceed six nautical miles.

Clause 4. The identification of offshore cells must be based on characteristics and properties of oceanographic conditions, marine resource exploitation and utilization activities; the length of the larger side of the cell should not exceed twelve nautical miles.

Chapter II

CRITERIA FOR CLASSIFYING RISK ZONES FOR MARINE AND ISLAND ENVIRONMENTAL POLLUTION

Article 5. Criteria for classifying risk zones for marine and island environmental pollution

1. Criteria for classifying risk zones for marine and island environmental pollution, including:

a) Criteria on the degree of pollution or risk of pollution to the marine and island environment, corresponding index is Imđ

b) Criteria on the scope of impact, corresponding index is Iahi

c) Criteria on the environmental sensitivity level; potential damage to human health, marine and island ecosystems, exploitation and utilization activities of marine and island resources, corresponding index is Ith

2. The level of risk of marine and island environmental pollution for coastal cells, near-coastal cells, and sea cells shall be determined based on the value of the classification index for the risk zone of marine and island environmental pollution of each cell, denoted as Iô

Article 6. Criteria for the degree of pollution or risk of pollution to the marine and island environment

The index for the degree of pollution or risk of pollution to the marine and island environment (Imđ) is based on the average environmental risk index (RQtb) of the cells, determined according to the table below:

The calculation of the average environmental risk index (RQtb) is stipulated in Clause 2, Article 11 of this Circular.

Article 7. Criteria for the scope of impact

The index for the scope of impact (Iah) is based on the extent of impact caused by marine and island environmental pollution of the cell on adjacent cells, determined according to the simulation model of the emission process, spread, transformation, and conversion of pollutants in the marine and island environment, as specified in the table below:

Article 8. Criteria for the degree of environmental sensitivity; potential damage to human health, marine and island ecosystems, exploitation and utilization activities of marine and island resources

1. The index for the degree of environmental sensitivity; potential damage to human health, marine and island ecosystems, exploitation and utilization activities of marine and island resources (Ith) is based on the indices of component criteria for the calculated cell, including:

a) Criteria on the degree of environmental sensitivity, corresponding index is Inc;

b) Criteria on the potential damage to human health, corresponding index is Isk;

c) Criteria on the potential damage to marine and island ecosystems, corresponding index is Ist;

d) Criteria on the potential damage to exploitation and utilization activities of marine and island resources, corresponding index is Isd.

The value of the index Ith is calculated according to the following formula:

The corresponding index for the criteria on the potential damage to human health of coastal cells is based on the area and type of activity that can cause environmental pollution, as specified in the table below:

Chapter III

GUIDELINES FOR ZONING ENVIRONMENTAL POLLUTION RISKS IN THE MARINE AND ISLAND ENVIRONMENT

Article 9. Risk zoning process for marine and island environmental pollution

Marine and island environmental pollution risk zoning includes activities prescribed in Clause 1, Article 48 of the Law on Marine and Island Resources and Environment, implemented in the following steps:

1. Calculating and determining the value of the risk zoning environmental pollution index for the sea and islands (Io).

2. Evaluating and determining the level of marine and island environmental pollution risk.

3. Preparing a map of marine and island environmental pollution risk zoning.

Article 10. Calculation and determination of the value of the risk zoning environmental pollution index for the sea and islands

1. The classification of risk zones for marine and island environmental pollution must be based on the calculation and determination of the value of the risk zoning environmental pollution index (Io) for the sea and islands based on monitoring, investigation, data collection, updating, surveillance, synthesis, and processing of information and data on the marine and island environment.

2. The calculation and determination of the value of the risk zoning environmental pollution index for the sea and islands shall be carried out as follows:

a) Dividing cells to calculate and determine the level of marine and island environmental pollution risk according to the provisions of Article 4 of this Circular;

b) Calculating and determining the values of the indices Io, lahs, Ish according to the provisions of Articles 6, 7, and 8 of this Circular;

c) Calculating and determining the value of the index Io according to the provisions of Clause 2, Article 5 of this Circular.

Article 11. Calculation and determination of the value of the index regarding the degree of pollution or pollution risk of the marine and island environment

1. The index of the degree of pollution or pollution risk of the marine and island environment must be determined based on the average environmental risk index (RQtb) value of each calculated cell.

2. The average environmental risk index (RQtb) value of each calculated cell is calculated as the average value of the environmental risk index (RQi) values at points within that cell according to the following formula:

RQi: the value of the environmental risk index at point i within the cell;

n: the number of points for assessing environmental quality within the cell, as stipulated in Clause 3 of the relevant provision.

3. The number of points and distribution of points within the calculated cell shall be carried out in accordance with the regulations on surveying, monitoring, and environmental quality assessment (from 20 to 25 points/1dm² map).

4. The environmental risk index RQ is calculated according to the following formula:

PEC: the predicted concentration of pollutant j in the environment determined based on applying a model simulating the dispersion, transformation, and metabolism of pollutants in the marine and island environment;

MEC: the concentration of pollutant j in the environment, calculated from monitoring data, ensuring compliance with current Vietnamese Standards and National Technical Regulations for environmental quality component and type of pollution assessment;

PNEC: the limit concentration of pollutant j in the environment according to current standards and technical regulations;

m: the total number of pollutants being considered and assessed;

Wi: the weight for calculating the environmental risk factor for pollutant j or pollution source, specified in the table below:

5. In cases where the predicted concentration of pollutants (PEC) is estimated, apply the model simulating the emission, dispersion, transformation, and metabolism processes of pollutants in the marine and island environment as prescribed in Article 12 of this Circular.

Article 12. Application of simulation models for the emission, spread, transformation, and conversion processes of pollutants in marine and island environments

1. Based on specific calculation requirements, simulation conditions, and practical information and data available, analyze and select a simulation model for the spread, transformation, and conversion processes of pollutants in marine and island environments.

2. Procedure for applying the model

a) Prepare information and data for calculations;

b) Process topographic materials to establish the model;

c) Construct computational domains and grids;

d) Set boundary conditions;

đ) Establish initial conditions;

e) Set basic parameters of the model;

g) Connect hydrodynamic dynamic models with the simulation model for the spread, transformation, and conversion processes of pollutants in marine and island environments;

h) Calibrate and determine the parameter set for the model;

i) Validate and assess the reliability of the model results;

k) Calculate and simulate scenarios;

l) Prepare a report on calculation results.

3. Evaluation of the accuracy and suitability of the model

The evaluation of the accuracy and suitability of the model must be conducted when calibrating and determining the parameter set for the model; validation and assessment of the reliability of the model results as specified in Points h and i of Clause 2 of this Article shall follow the following procedures:

a) Visual assessment through comparison of actual measurement data series and modeled simulation data series; compare the synchronization between the two data series;

b) Calculate and determine the correlation degree between the actual measurement data series and the modeled simulation data series;

c) Calculate the model efficiency coefficient according to the following formula:

E: model efficiency coefficient;

N: length of the characteristic data series calculated and simulated in the model;

O: actual measured value of the characteristic calculated and simulated in the model;

Otb: average value of the actual measurement data series;

S: calculated and simulated characteristic values.

d) Based on the results of visual assessment, quantitative assessment as stipulated in Points a, b, and c of this Clause, if the requirements are not met, change the values of the parameters to calibrate and determine the parameter set for the model or validate and assess the reliability of the model results as specified in Points h and i of Clause 2 of this Article;

đ) Conduct expert consultations before deciding to use the model in scenario calculations and simulations as specified in Point k of Clause 2 of this Article.

Article 13. Calculation and determination of values for indices corresponding to criteria regarding the scope of impact; environmental sensitivity, potential harm to human health, marine and island ecosystems, and activities related to exploitation and utilization of marine and island resources

1. The calculation and determination of values for indices corresponding to the scope of impact criteria are based on the assessment and calculation of the extent of impact caused by environmental pollution from the calculated cells on adjacent cells as stipulated in Article 7 of this Circular.

2. The calculation and determination of values for indices corresponding to environmental sensitivity criteria, potential harm to human health, marine and island ecosystems, and activities related to exploitation and utilization of marine and island resources are based on the corresponding index values for each cell as specified in Clause 1 of Article 8 of this Circular.

Article 14. Determination of the Risk Level of Marine and Island Environmental Pollution

1. The risk level of marine and island environmental pollution for each coastal cell, nearshore cell, and marine cell shall be determined based on the value of the corresponding indices (Io) according to the criteria for classifying the risk level of marine and island environmental pollution for each cell as stipulated in Clause 2, Article 5 of this Circular.

2. The color scale and color code representing the risk level of marine and island environmental pollution are specified in the table below:

Article 15. Preparation of Maps for Risk Zoning of Marine and Island Environmental Pollution

1. Maps for risk zoning of marine and island environmental pollution shall be established in the National Coordinate System and National Geographic Coordinate System VN2000.

2. Mathematical basis: coordinate system, projection grid, control points on the plane, and elevation.

3. Content of the geographic base, including:

a) Topography;

b) Hydrology;

c) Ecosystems;

d) Transportation;

đ) Population, socio-economic infrastructure, and related physical features;

e) Vegetation cover;

g) Boundaries and administrative divisions.

Details of the geographic base content shall comply with current relevant laws.

4. Special content, including:

a) Network of points for calculating environmental risk indices (RQ);

b) Representation of the concentration of parameters measured for seawater, sediment, and marine organisms;

c) Distribution of tidal ecosystems, seagrass beds, coral reefs, mangrove forests, inland wetlands adjacent to the coast, estuarine wetlands, and other marine and island ecosystems;

d) Distribution of marine protected areas, world heritage sites, biosphere reserves, wetland areas, national parks, special-use forests; areas of particular value for scientific research;

đ) Distribution of economic zones, industrial zones, export processing zones, urban areas, concentrated residential areas; port areas, fishing ports, and inland waterway ports within the port area; offshore oil and gas ports; important maritime routes; areas with tourism, sports, entertainment, aquaculture, and seafood processing activities; areas with dredging, reclamation, land reclamation, mineral extraction activities; areas with disposal activities;

e) Risk level of marine and island environmental pollution for each coastal cell, nearshore cell, and

IMPLEMENTING PROVISIONS

Article 16. Effective Date

This Circular takes effect from November 15, 2016.

Article 17. Responsibility for Implementation

1. The General Department of Sea and Islands of Vietnam shall be responsible for assisting the Ministry of Natural Resources and Environment in leading and coordinating with relevant ministries, agencies, and provincial people's committees directly under the central government that have a coastline to establish maps for risk zoning of marine and island environmental pollution.

2. Heads of relevant agencies, organizations, and individuals shall be responsible for implementing this Circular.

3. During implementation, if there are difficulties or obstacles, agencies, organizations, and individuals are requested to promptly report them to the Ministry of Natural Resources and Environment for study, consideration, and resolution./.
