 Regulations on Command and Control of Road Traffic by Traffic Police

||| Pursuant to the Law on People's Police of Vietnam 2014;

BASED ON THE LAW ON TRAFFIC ON ROADS 2008;

Pursuant to the Law on Handling Administrative Violations 2012;

Pursuant to Decree No. 106/2014/NĐ-CP dated November 17, 2014, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

At the proposal of the Director of the Traffic Police Corps;

Article 1. Amending and supplementing some articles of Circular No. 21/2023/TT-BTTTT dated December 31, 2023 of the Ministry of Information and Communications on functions and technical features of the Administrative Procedure Handling Information System at the ministerial and provincial levels (hereinafter referred to as Circular No. 21/2023/TT-BTTTT) as follows: ||| The Ministry of Public Security promulgates this Circular stipulating on specialized agency under the People's Committee of the province/city.||| directing and controlling traffic on roads by Traffic Police..

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

||| This Circular stipulates requirements, standards, tasks, powers, equipment, means, weapons, and auxiliary tools; principles, methods, procedures for directing and controlling traffic and resolving specific cases while performing directing and controlling traffic duties on roads by Traffic Police.

Article 2. Applicability

This Circular applies to:

1. Officers and non-commissioned officers of traffic police performing command and control of road traffic (hereinafter referred to as traffic police commanding and controlling traffic).

2. Public security units and localities.

3. Agencies, organizations, and individuals related to road traffic activities within the territory of the Socialist Republic of Vietnam.

||| Article 3. Principles of directing and controlling traffic

||| 1. Adhering to the provisions of this Circular and other relevant laws.

||| 2. Ensuring that people and vehicles participating in traffic travel in order, safely, and smoothly. For sections with many vehicles, open the road first and allocate more time; for sections with fewer vehicles, open the road later and allocate less time; for sections with motor vehicles, open the road before sections with non-motorized vehicles. In case there are vehicles with priority rights, open the road for such vehicles first based on their order of priority.

||| 3. Ensuring consistency in organizing, directing, and managing traffic control activities based on specific division of responsibilities and powers; closely coordinating effectively to serve the professional work of the People's Police force.

||| 4. Ensuring compliance with the Regulations of the People's Police and democratic regulations in traffic order and safety assurance work.

||| 5. When encountering vehicles or convoys carrying high-ranking Party and State leaders and foreign guests escorted by Traffic Police, Traffic Police officers must salute according to the Regulations of the People's Police (model number 01 issued together with this Circular) unless they are currently performing traffic direction and control actions.

Article 4. Requirements and Standards for Traffic Police Commanding and Controlling Traffic

1. Requirements

||| a) Mastering and strictly implementing the provisions of this Circular and other relevant laws;

||| b) Fulfilling assigned tasks fully and responsibly; adhering to democratic regulations in traffic order and safety assurance work and the Regulations of the People's Police.

2. Standards

||| a) Having a College-level education in the People's Police or equivalent or higher. For officers and non-commissioned officers who graduated from non-People's Police institutions, they must have completed legal and police training courses as prescribed.

||| b) Having undergone traffic direction and control operations training according to the program and content of the Traffic Police Corps.

||| Article 5. Tasks, Powers of Traffic Police Directing and Controlling Traffic and Responsibilities of Other Police Forces

1. Tasks of Traffic Police Commanding and Controlling Traffic

||| a) Implementing directives of the Ministry of Public Security, the Traffic Police Corps, the Provincial Public Security Department; plans or schemes of the Traffic Control Room Head guiding traffic organization and escorting, the Highway-Railway Traffic Police Room Head, the Highway Traffic Police Room Head of the Provincial Public Security Department, the District Public Security Chief (hereinafter referred to as the District Public Security Chief).

||| b) Directing and controlling traffic, dividing routes, preventing and resolving traffic congestion, cooperating with competent agencies to ensure traffic order and safety on the assigned traffic route and area.

||| c) Promptly and strictly handling violations of traffic order and safety laws and other violations according to legal procedures and authority.

||| d) Protecting accident scenes, organizing emergency medical care for victims, and cooperating in resolving traffic accidents according to legal provisions.

||| đ) Cooperating with units and competent agencies to prevent and combat crimes operating on highway routes and highway vehicles according to legal provisions.

||| e) Identifying loopholes and shortcomings in state management of traffic order and safety and social security to propose timely measures to competent agencies for handling and rectification.

2. Powers of Traffic Police Commanding and Controlling Traffic

||| a) Temporarily suspending the movement of people and vehicles on certain sections of the road, reallocating routes, and parking areas when traffic congestion occurs or other necessary requirements for ensuring social security arise.

||| b) Within the assigned area or according to the plan or order of the authorized authority, stopping vehicles violating traffic laws for inspection and control of vehicle documents, driver documents, and personal identification documents of passengers (if they violate the law) according to legal provisions.

||| c) Imposing administrative penalties for violations in the field of road traffic, social security, and other administrative violations in state management fields according to legal provisions; applying preventive measures and ensuring the handling of administrative violations according to legal provisions.

||| d) Requesting agencies, units, organizations, and individuals to cooperate and support in resolving traffic accidents; traffic congestion, obstruction, or other situations causing disorder and insecurity in traffic.

đ) Use weapons, auxiliary tools, and technical equipment as prescribed by law;

e) Perform other powers as prescribed by law.

||| 3. Responsibilities of other police forces, village police, and related forces

||| a) Administrative Police, Mobile Police, Traffic Police, Quick Response Police, Ward Police, and Village Police forces are responsible for cooperating with Traffic Police to ensure traffic order and safety when requested.

b) Other police forces and related forces, when assigned tasks to coordinate with traffic police to ensure traffic order and safety at intersections and complex points regarding traffic order and safety, shall be responsible for directing, controlling traffic, and rerouting traffic according to the allocation of the traffic police command and control force;

 c) Investigation police, firefighting and rescue police, upon receiving notifications from the traffic police command and control force about traffic accidents indicating criminal offenses or incidents involving vehicle fires or explosions, must promptly arrive at the scene to handle the situation in accordance with the law;

Article 6. Equipment, weapons, and support tools of the traffic police command and control force

1. In addition to the uniforms, equipment, and means prescribed for traffic police, the traffic police command and control force shall be equipped with the following minimum items:

a) Whistle, traffic direction baton, white gloves; reflective vest; traffic police raincoat and rain boots;

b) Motorcycles, personal walkie-talkies; firearms, electric batons, handcuffs, handheld battery-powered loudspeakers, and paint cans for marking the scene;

c) Other technical equipment and devices as stipulated by the Ministry of Public Security;

2. The use of technical equipment and devices, weapons, and auxiliary tools must comply with legal provisions and regulations of the Ministry of Public Security;

3. The position of wearing weapons and support tools of the traffic police command and control force shall be implemented according to model number 02A, 02B, 02C issued together with this Circular.

4. Traffic control stand and sun/moisture shelter (the shape, size, and color of the stand and sun/moisture shelter according to model number 03A, 03B, 03C, 03D issued together with this Circular). The provision of traffic control stands and sun/moisture shelters at intersections shall be decided by the Director of the Provincial Police Department.

Article 7. Methods of operation of the traffic police command and control force

1. Command and control traffic at intersections.

2. Command and control traffic at a specific location or area on the road when traffic congestion occurs.

3. Command and control traffic in areas where events, festivals, or conferences are taking place.

Article 8. Forms in traffic command and control work

This Circular issues forms in traffic command and control work as follows:

1. Form of salutation gesture (Form No. 01).

2. Form of the position of wearing support tools of the traffic police command and control force (model number 02A, 02B, 02C).

3. Form of the shape, size, and color of the stand and sun/moisture shelter (model number 03A, 03B, 03C, 03D).

4. Form of the plan for arranging forces to perform traffic command and control duties; logbook reporting the results of traffic command and control operations (model number 04A, 04B).

5. Form of the action signal prohibiting traffic (model number 05A, 05B, 05C).

6. Form of the action signal allowing traffic (model number 06A, 06B, 06C).

7. Form of the action signal indicating the right lane should move faster (model number 07).

8. Form of the action signal indicating the left lane should move faster (model number 08).

9. Form of the action signal indicating the right lane should slow down (model number 09A, 09B).

10. Form of the action signal indicating the left lane should slow down (model number 10A, 10B).

11. Form of the action signal indicating the right lane should stop (model number 11).

12. Form of the action signal indicating the left lane should stop (model number 12).

13. Form of the action signal indicating vehicles should turn left through the intersection (model number 13A, 13B, 13C).

Chapter II

PROCEDURE FOR COMMAND AND CONTROL OF TRAFFIC

Article 9. Construction and Implementation of Command and Traffic Control Work Plans

1. Based on the plans from higher authorities and the actual situation regarding traffic order and safety, security, public order, and social safety at each locality, traffic police units shall develop work plans, allocate forces, and assign specific tasks to each traffic command and control officer (in accordance with Model No. 04A issued together with this Circular). The allocation of forces must be appropriate to the circumstances and characteristics at each specific intersection or traffic node. For intersections or nodes where two or more traffic command and control officers are assigned, one officer must be designated as the Team Leader, while the others serve as Team Members.

2. Before performing their duties, traffic command and control officers must thoroughly understand the content of the plan and the assigned positions; prepare and carefully check all equipment, weapons, support tools, record forms, related documents, and other devices necessary for traffic command and control work.

3. Traffic command and control officers must arrive at their duty positions ten minutes early to grasp the traffic order and safety situation and take over any ongoing cases or incidents handed over by the previous shift (if applicable); inspect and monitor the operation of traffic signal systems, and immediately report any abnormal operation of these systems to the unit commander or the Traffic Control Center for prompt resolution. When the end of the shift coincides with complex traffic situations (traffic congestion, traffic accidents...), they must report to the unit commander for guidance and continue to coordinate with the next shift's traffic command and control officers until normal traffic order and safety are restored.

4. At the end of the shift, the Team Leader or the traffic command and control officer (when there is only one officer) must compile the situation, report the results of the work (in accordance with Model No. 04B issued together with this Circular), and hand over equipment and case files to the unit commander or the duty officer.

Article 10. Allocation and Assignment of Specific Tasks for Traffic Command and Control Officers

1. Allocation of Forces at Intersections

a) Intersection with One Traffic Command and Control Officer

 In cases where traffic order and safety at the intersection are normal, the officer must stand in a position that facilitates observation and monitoring to guide participants in traffic to move safely and orderly according to regulations;

In cases where the intersection has complex developments, the officer must stand at the center of the intersection; if there is a platform, the officer must stand on it to command and control traffic.

b) Intersection with Two or More Traffic Command and Control Officers

The Team Leader is responsible for commanding and managing all activities of the Team and assigning specific positions to each Team Member.. When traffic signals are not functioning normally or when there is a high density of vehicles, the officer or the Team Member must stand at the center of the intersection, or on a platform if available, to command and control traffic; direct, inspect, and handle violations according to regulations; implement communication and reporting procedures with relevant agencies and superiors when necessary;

 The Team Member stands at the edge of the crosswalk or between the centerlines of the crosswalk (on the main road, where there is a high density of vehicles or complex traffic order and safety issues); when changing traffic light signals, the Team Member may move to the opposite direction based on the complexity of traffic conditions. The Team Member is responsible for directing and guiding traffic participants to move safely and orderly according to traffic light signals or commands from the central intersection or platform; detect and handle traffic order and safety violations and initially resolve cases of law violations or traffic accidents according to regulations; perform other tasks assigned by the Team Leader.

c) When performing traffic guidance, control, and diversion duties at intersections, the operational area of traffic command and control officers extends from the center of the intersection to stop lines or boundary lines of the intersection. In cases where incidents related to public order and safety or traffic congestion occur outside the intersection area, traffic command and control officers must cooperate with other forces such as patrol and traffic inspection police, public order police, 113 police, local police stations, etc., to resolve these incidents.

2. Allocation of Forces at a Single Location or Area on a Road During Traffic Congestion

Based on the extent and severity of the congestion, traffic command and control forces should be allocated at various points along the road. The allocation of forces follows the following rules:

a) Allocate forces at outermost diversion points towards the congestion. At these points, the assigned forces have the responsibility to guide and divert traffic or temporarily halt vehicles from afar according to preventive and congestion relief plans or directives from superiors to limit vehicles entering the congested area, thereby facilitating the exit of vehicles from the congested area.

b) Deploy forces along the route towards the congested area to control and guide traffic, preventing vehicles from encroaching on each other's lanes and quickly clearing congestion from the outside to the congested area, creating conditions for rescue and emergency response forces to rapidly approach the scene to resolve conflicts, obstacles, damaged vehicles, traffic accidents, and causes of congestion.

3. Allocation of Forces in Areas Where Events, Festivals, and Conferences Are Taking Place

On the basis of the actual situation regarding traffic order and safety, security requirements, the scale, nature, and level of importance of events, festivals, and conferences being organized, traffic police units conduct surveys and develop plans or schemes to arrange forces to guide, control traffic, reroute, and delineate areas at intersections, complex points concerning traffic order and safety within the event, festival, conference organization area, and surrounding roads to ensure orderly, safe, and smooth traffic.

Article 11. Use of horn signals for directing and controlling traffic

1. A long, strong horn signal is an order to stop.

2. A short, quick horn signal allows movement.

3. A long horn signal followed by a short horn signal allows turning left.

4. Two short, strong horn signals warn to slow down.

5. Three short, quick horn signals warn to speed up.

6. Continuous blowing of a single horn signal multiple times strongly indicates stopping for inspection or signaling a violation.

Horn signals are used in conjunction with directing and controlling traffic gestures.

Article 12. Gestures for directing and controlling traffic

1. Gesture indicating road closure (according to models 05A, 05B, 05C issued together with this Circular)

a) Stand at attention;

b) Blow one long, strong horn signal; simultaneously, the right hand holding the baton rotates slowly forward clockwise and raises straight up, palm facing forward above the head, baton vertical, left hand hanging straight along the seam of the trousers, this gesture prohibits all persons and vehicles participating in traffic from all directions;

In cases where persons and vehicles participating in traffic are still moving within the intersection, they are allowed to quickly leave the intersection. At intersections with designated stopping positions for persons and vehicles, they must stop at the designated position.

2. Gesture indicating road opening (according to models 06A, 06B, 06C issued together with this Circular)

After the road closure command (when all persons and vehicles participating in traffic within the intersection have passed through, except for intersections with designated stopping positions for persons and vehicles that must stop), the road opening command must be given, timing depending on traffic volume and conditions on all directions. The opening gesture commands persons and vehicles participating in traffic on the right and left sides of the traffic director to proceed, while those in front of and behind the traffic director must stop. The sequence of the opening gesture is as follows:

a) Road closure posture;

b) Blow one short, quick horn signal; simultaneously, the left hand slowly raises, the right hand holding the baton rotates slowly forward counterclockwise until both hands are stretched out horizontally at shoulder width, the right hand holding the baton forms a straight line parallel to the ground, palm facing down. When the traffic director completes the opening gesture, he may lower one hand.

3. Gesture indicating faster movement for the right side (according to model 07 issued together with this Circular)

From the opening posture, bend the right arm holding the baton from the elbow to the hand slowly towards the chest, the right arm and baton straight, then extend like the opening gesture, folding and extending the arm at least three times, each time combined with three short, quick horn signals, eyes looking to the right.

4. Gesture indicating faster movement for the left side (according to model 08 issued together with this Circular)

From the opening posture, bend the left arm from the elbow to the hand slowly towards the back of the neck, hand slightly tilted upwards, palm facing the neck, then extend like the opening gesture, folding and extending the arm at least three times, each time combined with three short, quick horn signals, eyes looking to the left.

5. Gesture indicating slower movement for the right side (according to models 09A, 09B issued together with this Circular)

From the opening posture, the right hand holding the baton pulls across the waist, baton hanging straight along the seam of the trousers, right palm facing down, lifting and lowering at least three times, each time combined with two short, strong horn signals, eyes looking to the right.

6. Gesture indicating slower movement for the left side (according to models 10A, 10B issued together with this Circular)

From the opening posture, the left hand pulls across the waist, palm facing down, lifting and lowering at least three times, each time combined with two short, strong horn signals, eyes looking to the left.

7. Gesture indicating stopping for the right side (according to model 11 issued together with this Circular)

From the opening posture, the right hand holding the baton slowly turns the wrist vertically perpendicular to the arm, combined with one long, strong horn signal, indicating that vehicles on the right should stop, eyes looking to the right.

8. Gesture indicating stopping for the left side (according to model 12 issued together with this Circular)

From the opening posture, the left palm faces the left side, combined with one long, strong horn signal, indicating that vehicles on the left should stop, eyes looking to the left.

9. Gesture indicating turning left for the right side (according to models 13A, 13B, 13C issued together with this Circular)

a) From the opening posture, the right hand holding the baton slowly extends forward, raised straight across the shoulders, palm facing down, combined with one long, strong horn signal. The left hand slowly extends forward, straight, palm facing down, gradually tilting to vertical, moving back and forth at least three times, each time combined with one short horn signal, eyes looking to the left, where vehicles are permitted to turn left;

b) With this posture, all types of vehicles and pedestrians from the right and rear of the traffic director must stop; in front, vehicles are allowed to turn right; on the left side of the traffic director, all types of vehicles are allowed to go in all directions.

 

Chapter III

IN PATROL AND SUPERVISION WORK

WHILE PERFORMING DUTIES OF DIRECTING AND CONTROLLING TRAFFIC

Article 13. Handling traffic congestion

1. Traffic police officers must be well-versed in preventive and resolution plans for traffic congestion at intersections and routes that have been approved by competent authorities.

2. In cases of non-severe traffic congestion at intersections or routes, measures should be taken based on actual conditions and preventive and resolution plans to reroute traffic, separate vehicle flows, and open lanes as appropriate. If the situation exceeds capacity and cannot be resolved independently, immediate reports should be made to unit commanders to reinforce personnel and implement remote rerouting to promptly resolve congestion without causing prolonged blockages.

3. In cases of severe traffic congestion involving multiple intersections, routes, or areas, the following actions shall be implemented:

a) Quickly identify the cause, location, time, and extent of the traffic congestion; report immediately to unit commanders to direct reinforcement of personnel and equipment, coordinate with relevant units to implement remote rerouting according to preventive and resolution plans.

b) Actively and quickly guide and control traffic, reroute, and adjust vehicle flows appropriately to minimize the extent of traffic congestion.

4. In cases of prolonged and widespread traffic congestion affecting adjacent localities, the Traffic Police Department where the incident occurs shall be responsible for reporting to the Provincial Public Security Director and directly notifying the adjacent Traffic Police Departments involved in the incident to arrange forces and equipment to implement remote rerouting, preventing vehicles from entering the congested area. At the same time, report to the General Traffic Police Department for unified direction along the entire route.

Article 14. Handling traffic accidents

1. Upon discovering a road traffic accident or receiving a report about a road traffic accident, traffic command and control police officers must immediately report to their direct unit commanders and notify the duty officer of the unit authorized to handle, investigate, and resolve the traffic accident.

2. Organize emergency rescue of victims, determine the scope of the scene to be protected, organize protection of the scene, mark the positions of victims, vehicles, and related traces; if the victim has died, leave them at the scene, if the death position obstructs traffic, quickly mark the position, move the victim to a suitable location, and cover carefully; simultaneously, move the vehicle to a suitable location not obstructing traffic.

3. Disperse people and vehicles gathering and obstructing traffic. If there is a large number of people and vehicles likely to cause prolonged and widespread traffic congestion beyond the capacity of traffic command and control police officers, immediately report to their direct unit commanders to reinforce personnel and organize remote rerouting.

4. Temporarily detain the driver's documents and related vehicles involved in the accident; temporarily detain and protect the accident-causing driver; assist the driver in protecting the vehicle and cargo; if the vehicle carries explosive, flammable, or hazardous substances, after marking the vehicle's position at the scene, request the driver or rescue unit to cooperate with traffic command and control police officers to quickly remove the vehicle from the accident site to a safe location.

5. Require the vehicle owner and driver to be present at the scene to provide basic information directly related to the accident; identify witnesses to invite for testimony, request them to write an incident report or record statements, if they cannot stay, request identification documents, record their names, addresses, phone numbers for contact when necessary.

6. When functional units arrive to handle the situation, traffic command and control police officers shall be responsible for exchanging information, handing over completed tasks, and cooperating in resolving the case (if required) according to their assigned functions and responsibilities.

7. In cases of traffic collisions, mark the positions of vehicles and related traces, require both parties to present relevant documents for persons and vehicles; carefully examine collision traces and damages; listen to both parties' explanations of the collision causes; determine the violation behavior and handle it according to the law.

Điều 15. Giải quyết trường hợp người vi phạm không chấp hành quyết định xử phạt của Cảnh sát chỉ huy, điều khiển giao thông; xe ô tô dừng, đỗ gây ùn tắc giao thông

1. Trường hợp người vi phạm không chấp hành quyết định xử phạt

b) If the violator does not comply, temporarily seize the relevant documents or vehicle, invite witnesses to sign the temporary seizure record, then invite the violator to the unit's headquarters for resolution or guide them on how to file a complaint according to the law.

b) Nếu người vi phạm không chấp hành thì tạm giữ giấy tờ, mời người vi phạm về trụ sở đơn vị để giải quyết hoặc hướng dẫn khiếu nại theo quy định của pháp luật.

2. Trường hợp xe ô tô dừng, đỗ gây ùn tắc giao thông

a) Yêu cầu lái xe xuất trình các giấy tờ có liên quan, đưa xe ra khỏi khu vực ùn tắc, lập biên bản và giải quyết theo quy định; đồng thời, tổ chức lực lượng hướng dẫn, điều khiển giao thông, giải tỏa ùn tắc giao thông;

b) Trường hợp lái xe đóng cửa bỏ đi hoặc không có mặt tại đó: ghi lại hình ảnh; báo cáo chỉ huy đơn vị điều động xe cẩu đến kéo xe đó ra khỏi khu vực ùn tắc, mời người làm chứng, dán niêm phong tại các vị trí cần thiết của xe và lập biên bản theo quy định; đồng thời, tổ chức lực lượng hướng dẫn, điều khiển giao thông, giải tỏa ùn tắc giao thông.

Điều 16. Giải quyết trường hợp xảy ra lũ, lụt, sự cố khác làm cản trở giao thông

a) Post temporary prohibitory signs, guide and control traffic, reroute and zone traffic to ensure orderly, safe, and smooth passage for people and vehicles;

a) Thông báo hoặc đặt biển báo hiệu cấm tạm thời, hướng dẫn, điều khiển giao thông, phân luồng, phân tuyến cho người và phương tiện đi lại trật tự, an toàn, thông suốt;

b) Thông báo ngay cho cơ quan có chức năng, như: đơn vị quản lý công trình đô thị, Ủy ban nhân dân nơi gần nhất; cơ quan quản lý giao thông đường bộ biết để có biện pháp giải quyết kịp thời; đồng thời, báo cáo chỉ huy đơn vị để xin ý kiến chỉ đạo.

2. Trường hợp xe đang lưu thông trên đường bị hỏng đột ngột hoặc có chướng ngại vật ở lòng đường gây cản trở giao thông, phải yêu cầu lái xe, người tham gia giao thông hỗ trợ hoặc phối hợp với các cơ quan chức năng di chuyển xe, chướng ngại vật đó ra khỏi lòng đường đưa vào vị trí thích hợp, bảo đảm cho phương tiện và người tham gia giao thông đi lại được an toàn, thông suốt.

Điều 17. Giải quyết trường hợp xảy ra vụ gây rối trật tự công cộng làm cản trở giao thông

1. Sử dụng các thiết bị kỹ thuật nghiệp vụ ghi nhận sự việc; đình chỉ ngay hành vi, thu hồi hung khí (nếu có), kiểm tra giấy tờ tùy thân của những người có liên quan, tổ chức cấp cứu người bị nạn (nếu có); phối hợp với các lực lượng chức năng áp dụng các biện pháp nghiệp vụ theo quy định, không để xảy ra tình huống phức tạp về an ninh, trật tự.

2. Disperse crowds (if present).

3. Prepare a record documenting the incident and require those involved to report to the nearest police station or local authority for resolution.

4. Trường hợp người vi phạm cố tình không chấp hành yêu cầu của Cảnh sát, dùng vũ lực hoặc đe dọa dùng vũ lực chống người thi hành công vụ thì thực hiện các biện pháp phòng ngừa, ngăn chặn và xử lý hành vi chống người thi hành công vụ theo quy định tại Nghị định số 208/2013/NĐ-CP ngày 17/12/2013 của Chính phủ quy định các biện pháp phòng ngừa, ngăn chặn và xử lý hành vi chống người thi hành công vụ. Nếu gây ùn tắc giao thông thì xử lý theo quy định tại Điều 13 Thông tư này. Trường hợp nghiêm trọng vượt quá khả năng giải quyết của mình, thì báo cáo ngay về chỉ huy đơn vị để chỉ đạo; đồng thời, thông báo kịp thời cho Công an, chính quyền địa phương nơi xảy ra vụ việc biết để phối hợp giải quyết。

Article 18. Resolution of certain other cases

In cases where the violator does not comply with the stop command, flees; the violator verbally abuses, threatens, obstructs or pushes law enforcement officers; the vehicle driver hits a person or the vehicle of a law enforcement officer; the crime is discovered on the spot or the driver's violation indicates criminal activity; explosives, weapons, or illegal goods are found on the vehicle or among the people present; in cases involving foreigners or vehicles of foreigners violating traffic regulations, traffic police shall implement according to the current regulations of the Ministry of Public Security regarding patrol, control, and administrative violations in road traffic.

Chapter IV

IMPLEMENTATION

Article 19. Effective Date

This Circular takes effect from October 10, 2017, and replaces Circular No. 28/2011/TT-BCA dated May 10, 2011, issued by the Minister of Public Security on the command and control of traffic by traffic police.

Article 20. Responsibility for Implementation

1. The Director of the Traffic Police Corps shall be responsible for:

a) Directing, monitoring, guiding, inspecting, and urging units and localities under the Ministry of Public Security to implement this Circular;

b) Directing the development of educational films, programs, plans, and training content for traffic command and control operations;

c) Organizing training for traffic command and control operations for officers and soldiers under the Traffic Police Corps and traffic police units nationwide.

2. The Provincial Public Security Director shall be responsible for organizing training for traffic command and control operations for traffic police officers and soldiers under their local management according to the training materials prepared by the Traffic Police Corps.

3. The Heads of the General Departments, heads of units directly under the Ministry of Public Security; Directors of academies, Principals of public security schools; Directors of provincial and centrally-administered city public security departments, fire prevention and firefighting police shall be responsible for implementing this Circular.

During implementation, if there are difficulties or obstacles, units and local public security agencies should report to the Ministry of Public Security (through the Traffic Police Corps) for timely guidance./.
