APPROVING THE PROGRAM ON THE DEVELOPMENT AND ISSUANCE OF LEGAL DOCUMENTS IN 2022 UNDER THE SCOPE OF MANAGEMENT OF THE MINISTRY OF NATURAL RESOURCES AND ENVIRONMENT

Pursuant to the Law on Legislative Regulatory Documents dated June 22, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Legislative Regulatory Documents dated June 18, 2020;
Pursuant to Decree No. 34/2016/ND-CP dated May 14, 2016 of the Government detailing some provisions and implementing mechanisms of the Law on Issuing Legal Documents; Decree No. 154/2020/ND-CP dated December 31, 2020 of the Government amending and supplementing certain articles of Decree No. 34/2016/ND- CP dated May 14, 2016 of the Government detailing some provisions and implementing mechanisms of the Law on Issuing Legal Documents;Pursuant to Circular No. 32/2016/TT-BTNMT dated November 7, 2016 of the Minister of Natural Resources and Environment stipulating the development and issuance of legal documents under the scope of management of the Ministry of Natural Resources and Environment;
On the basis of Decision No. 36/2017/NĐ-CP dated April 4, 2017, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;
Article 1. Approves the Program on the Development and Issuance of Legal Documents in 2022 under the scope of management of the Ministry of Natural Resources and Environment (hereinafter referred to as the Program), including:
At the proposal of the Director of the Legal Department.
DECISION:
1. The list of projects and draft legal documents submitted to the Government, detailed in Appendix 1 attached hereto
2. The list of draft legal documents within the authority of the Minister of Natural Resources and Environment to issue, detailed in Appendix 2 attached heretoArticle 2. Responsibilities of the Minister, Deputy Ministers, and Heads of Units in implementing the Program 1. The Minister and Deputy Ministers shall directly direct the development and submission for approval or issuance within their authority of legal documents within their assigned areas of responsibility..
2. The Head of a unit entrusted by the Minister to take the lead in drafting legal documents shall be responsible for: a) Serving as the Head of the Drafting Team for Circulars drafted by the unit taking the lead..
b) Adhering to the procedures and processes for developing legal documents as prescribed by law; ensuring timely completion and submission for issuance, and guaranteeing the quality of the legal documents assigned to be developed;
c) Being personally accountable to the Minister for the progress and quality of the legal documents assigned to be developed; in case of difficulties during implementation, promptly reporting to the Minister or Deputy Minister in charge to resolve issues to ensure compliance with deadlines and quality requirements.
3. The Director of the Department of Planning and Finance shall take the lead, in coordination with the Director of the Legal Department, to prioritize funding at the highest level to ensure the implementation and completion of the Program. The Director of the Legal Department shall urge, monitor, inspect, and report to the Minister on the progress of implementing the Program.
4. The Directors of the Departments of Legal Affairs, Science and Technology, and Planning and Finance shall be responsible for providing opinions and reviewing draft legal documents according to the provisions of the law.
5. The Directors of Provincial Departments of Natural Resources and Environment shall actively participate in drafting and providing comments on draft legal documents; organize solicitation of opinions from relevant organizations and individuals, and submit comments on draft legal documents when requested by the Ministry.
2. The Minister, Deputy Ministers, Director of the Legal Department, and Heads of units under the Ministry; Directors of Provincial Departments of Natural Resources and Environment shall be responsible for enforcing this Decision./.
