Circular No. 26/2018/TT-BYT stipulates on the organization and implementation of training programs according to occupational title standards for health sector civil servants in educational institutions and research facilities.

CIRCULAR

REGULATIONS ON THE ORGANIZATION AND IMPLEMENTATION OF TRAINING PROGRAMS IN ACCORDANCE WITH PROFESSIONAL RANK STANDARDS FOR HEALTH SPECIALISTS IN EDUCATIONAL AND RESEARCH INSTITUTIONS

On the basis of Law on Public Officials No. 58/2010/QH12 Decision No. 150/2020/NĐ-CP

Decree No. 101/2017/ND-CP dated September 1, 2017, of the Government on training and improving cadres, civil servants, and public officials;

Decree No. 75/2017/ND-CP dated June 20, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;

At the proposal of the Director of the Cadre and Civil Servant Department,

The Minister of Health issues this Circular to regulate the organization and implementation of training programs in accordance with professional rank standards for health specialists in educational and research institutions.

Article 1. Scope of Regulation and Applicability

1. This Circular regulates the organization and implementation of training programs in accordance with professional rank standards for health specialists, including:

a) Training programs organized at educational institutions;

b) Standards for lecturers, training materials, physical facilities, and experience in organizing training and development activities of educational institutions.

2. This Circular applies to educational and research institutions that are higher education institutions and colleges offering health-related programs; healthcare public service units with training and development functions; health worker training and development centers, population centers (hereinafter referred to as educational institutions), and related agencies, organizations, and individuals.

Article 2. Types of training programs organized at educational institutions

1. Higher education institutions offering health-related programs at bachelor's level or above and healthcare public service units of special class meeting the criteria set forth in Articles 3, 4, 5, and 6 of this Circular shall organize and implement training programs in accordance with professional rank standards for health specialists of ranks I, II, III, and IV.

2. Healthcare public service units of Class I and health worker training and development centers meeting the criteria set forth in Articles 3, 4, 5, and 6 of this Circular shall organize and implement training programs in accordance with professional rank standards for health specialists of ranks II, III, and IV.

3. Colleges offering health-related programs and healthcare public service units of Class II meeting the criteria set forth in Articles 3, 4, 5, and 6 of this Circular shall organize and implement training programs in accordance with professional rank standards for health specialists of ranks III and IV.

Article 3. Lecturer Standards

1. Lecturers must meet the lecturer standards for training and developing civil servants and public officials as stipulated in Article 34 of Government Decree No. 101/2017/NĐ-CP dated September 1, 2017 on the training and development of civil servants and public officials (hereinafter referred to as Decree No. 101/2017/NĐ-CP).

2. Invited guest lecturers must meet the following criteria:

a) Possessing appropriate professional expertise, management skills, and experience in line with the training program;

b) Guest lecturer standards as stipulated in Article 35 of Decree No. 101/2017/NĐ-CP.

3. Lecturers from educational institutions must be able to undertake at least 50% of the assigned training program.

Article 4. Training Material Standards

1. Educational institutions shall use one of the following training materials:

a) Materials compiled and approved by the educational institution in accordance with regulations;

b) Materials from another educational institution that have been reviewed and approved in accordance with regulations;

c) Materials approved by the Ministry of Health.

2. Training materials shall be regularly updated to align with the practical requirements of the professional rank standards being trained.

Article 5. Standards for physical infrastructure

1. Standards for classrooms and equipment: Ensure sufficient seating and appropriate equipment for teaching and learning activities.

2. Learning materials: Ensure adequate quantity and quality.

3. Information technology application: There must be an electronic information website providing and updating sufficient information on the list of lecturers, programs, and the list of materials for each training program, and having a database system to store information about courses and trainees.

Article 6. Standards for experience in organizing training and development

The training institution must have at least three years of experience in organizing training and development.

Article 7. Effective Date

This Circular takes effect from December 10, 2018.

Article 8. Reference Provisions

In case the legal normative documents and regulations cited in this Circular are amended, supplemented, or replaced, they shall be implemented according to the new legal normative documents.

Article 9. Responsibility for implementation

1. The Cadre and Civil Servant Department of the Ministry of Health shall take the lead in coordinating with relevant departments, bureaus, general administrations, and units:

a) To implement this Circular;

b) To inspect the compliance of training institutions with the standards stipulated in this Circular.

2. Agencies and organizations with advisory functions regarding training and development of health sector civil servants at ministries, ministerial-level agencies, government-affiliated agencies, central political-social organizations, and provincial People's Committees shall, based on the provisions of this Circular, submit to competent authorities tasks assigned to training institutions under their management to organize specific training programs according to the occupational title standards for health sector civil servants, and send lists to the Ministry of Health for consolidation and management.

3. Training institutions tasked with organizing development according to the occupational title standards for health sector civil servants shall be responsible for implementing this Circular; they shall report on implementation status to the Ministry of Health, the Ministry of Home Affairs, and the agency assigning the development task before November 30 each year.

4. The Director of the Ministry's Office, the Inspector General of the Ministry, the Heads of Departments, Bureau Chiefs, and General Administration Directors under the Ministry of Health, and other related agencies, organizations, and individuals shall be responsible for implementing this Circular.

During implementation, if there are difficulties or issues, agencies, organizations, and individuals shall reflect them to the Ministry of Health for consideration and resolution./.
