This Circular amends and supplements the provisions on reporting the results of vehicle inspection work for land and inland waterway transport means in Circulars No. 16/2014/TT-BGTVT, No. 30/2011/TT-BGTVT, No. 48/2015/TT-BGTVT, and No. 86/2014/TT-BGTVT of the Ministry of Transport. Specifically, it amends the content of reports, the entities responsible for implementation, the agencies receiving reports, methods of sending and receiving reports, deadlines for submitting reports, frequency of reporting, and time for finalizing report data. At the same time, it supplements Appendices specifying report forms.

CIRCULAR
Amending and supplementing certain provisions of Circulars on periodic reporting regimes in the field of vehicle inspection inspectors

Pursuant to Decree No. 12/2017/NĐ-CP dated February 10, 2017, issued by the Government on the functions, tasks, powers, and organizational structure of the Ministry of Transport;
Pursuant to Decree No. 09/2019/NĐ-CP dated January 24, 2019 of the Government stipulating the reporting system of administrative agencies;
At the proposal of the Director of the Ministry's Office and the Director of the Department for Vehicle Inspection hereby promulgates
The Minister of Transport issues this Circular to amend and supplement certain provisions of Circulars on periodic reporting regimes in the field of vehicle inspection.
Article 1. Amending and supplementing Clause 4 of Article 12 of Circular No. 59/2018/TT-BGTVT dated December 17, 2018 of the Minister of Transport guiding the labeling of energy consumption for motorcycles and motor vehicles produced, assembled, and imported.
"4. Periodic reports shall be made as follows:
a) Report name: Periodic report on energy label application;
b) Content required for the report: Report on the number of types of vehicles with energy labels applied; Report on average fuel consumption over one year for each production facility and/or importer;
c) Reporting entity: Production facilities and importers;
d) Receiving authority: Vietnam Motor Vehicle Registration Agency;
d) Method of submitting and receiving reports: Reports can be submitted in paper form or electronic format; they may be sent directly or through postal services or electronic means or other methods as prescribed by law;
e) Deadline for submission of reports: Before January 15 of the following year;
g) Frequency of reporting: Annual periodic reports;
h) Data closing period for reports: From January 1 to December 31 of the reporting year;
i) Reporting form templates: In accordance with Model No. 04 of the Appendix attached hereto."
1. Abolish Clause 6 of Article 12.
2. Amend Clause 4 of Article 13 as follows:
"4. Periodic reports shall be made as follows:
a) Report name: Design review work report for modified road transport vehicles;
b) Content required for the report: Report on the number of design review certificates issued; Report on the use of design review certificate blanks;
c) Reporting entity: Departments of Transport;
d) Receiving authority: Vietnam Motor Vehicle Registration Agency;
d) Method of submitting and receiving reports: Reports can be submitted in paper form or electronic format; they may be sent directly or through postal services or electronic means or other methods as prescribed by law;
e) Deadline for submission of reports: For the first six months' report, submit before July 20 of the reporting period; for the last six months' report, submit before January 20 of the following year;
g) Frequency of reporting: Semi-annual periodic report;
h) Data closing period for reports: For the first six months' report, from December 15 of the previous reporting period to June 14 of the current reporting period; for the last six months' report, from June 15 to December 14 of the current reporting period;
i) Report form: In accordance with Appendix X attached hereto."
3. Amend Clause 5 of Article 14 as follows:
"5. Periodic reports shall be made as follows:
a) Report name: Acceptance work report for modified road transport vehicles;
b) Content required for the report: Report on the number of quality and safety technical certificates and environmental protection certificates for modified road transport vehicles issued; Report on the use of quality and safety technical certificate and environmental protection certificate blanks for modified road transport vehicles;
c) Reporting entity: Vehicle inspection units;
d) Receiving Authority: Vietnam Vehicle Inspection Agency, Department of Transport;
d) Method of submitting and receiving reports: Reports can be submitted in paper form or electronic format; they may be sent directly or through postal services or electronic means or other methods as prescribed by law;
e) Deadline for submission of reports: For the first six months' report, submit before July 20 of the reporting period; for the last six months' report, submit before January 20 of the following year;
g) Frequency of reporting: Semi-annual periodic report;
h) Data closing period for reports: For the first six months' report, from December 15 of the previous reporting period to June 14 of the current reporting period; for the last six months' report, from June 15 to December 14 of the current reporting period;
i) Report form: In accordance with Appendix X attached hereto."
1. Amend Clause 1 of Article 14 as follows:
"1. Periodic reports shall be made as follows:
a) Report Name: Vehicle Circulation Inspection Report;
b) Content Required for Reporting: Report on the total number of inspections conducted, the total number of vehicles passing inspection, and the total number of vehicles failing inspection; Report on the usage of vehicle circulation certificate forms and circulation labels;
c) Reporting Entity: Inspection Units;
d) Receiving Authority: Vietnam Vehicle Inspection Agency, Department of Transport;
d) Method of submitting and receiving reports: Reports can be submitted in paper form or electronic format; they may be sent directly or through postal services or electronic means or other methods as prescribed by law;
e) Deadline for Submission: Before the 20th day of each month;
g) Frequency of Reporting: Monthly reports;
h) Data Collection Period: From the 15th day of the previous month to the 14th day of the current month;
i) Report form: In accordance with Appendix XII attached hereto."
2. Abolish Clause 4 of Article 20.
Article 4. 1. Amend and supplement Point d of Clause 2 of Article 24 as follows: Clause 8 of Article 17 of Circular No. 48/2015/TT-BGTVT dated September 22, 2015 of the Minister of Transport on inland waterway vessel inspection
"8. Implement storage regulations as prescribed and report on the implementation of vessel inspection work according to the following contents:
a) Report name: Technical supervision work for inland waterway vessels;
b) Content required for the report: Report on the number of inspections conducted, categorized by type;
c) Reporting entity: Inspection units;
d) Receiving authority: Vietnam Motor Vehicle Registration Agency;
d) Method of submitting and receiving reports: Reports can be submitted in paper form or electronic format; they may be sent directly or through postal services or electronic means or other methods as prescribed by law;
e) Deadline for submission of reports: Before the 28th of each month;
g) Frequency of reporting: Monthly periodic report or as required;
h) Data closing period for reports: From the 26th of the month prior to the reporting period to the 25th of the reporting month;
i) Report form: In accordance with Appendix XII attached hereto."

"1. Periodic reports shall be made as follows:
a) Report Name: Vehicle Circulation Inspection Report;
b) Content Required for Reporting: Report on the total number of inspections conducted, the total number of vehicles passing inspection, and the total number of vehicles failing inspection; Report on the usage of vehicle circulation certificate forms and circulation labels;
c) Reporting Entity: Inspection Units;
d) Receiving Authority: Vietnam Vehicle Inspection Agency, Department of Transport;
d) Method of submitting and receiving reports: Reports can be submitted in paper form or electronic format; they may be sent directly or through postal services or electronic means or other methods as prescribed by law;

2. Abolish Clause 4 of Article 24.
Article 6. Amend and supplement Clause 6 of Article 17 of Circular No. 30/2011/TT-BGTVT dated April 15, 2011, issued by the Minister of Transport, concerning quality and technical safety inspection and environmental protection during the production and assembly of motor vehicles.
“6. Implement periodic reporting as follows:
a) Report title: Report on the results of the implementation of quality and technical safety inspection and environmental protection for motor vehicles produced and assembled;
b) Content required for reporting: Summary of the results of the implementation of quality and technical safety inspection and environmental protection for motor vehicles produced and assembled;
c) Entity responsible for reporting: Vietnam Vehicle Inspection Agency;
d) Receiving authority: Ministry of Transport;
d) Method of submitting and receiving reports: Reports can be submitted in paper form or electronic format; they may be sent directly or through postal services or electronic means or other methods as prescribed by law;
e) Deadline for submission of report: Before December 31 each year;
g) Frequency of reporting: Annual periodic reports;
h) Period for finalizing data for reporting: From January 1 to November 30 of the reporting year;
i) Reporting form: In accordance with Appendix XI attached hereto.”
Article 7. Supplement Appendices specifying reporting forms
2. Supplement Appendix XII to Circular No. 48/2015/TT-BGTVT dated September 22, 2015, issued by the Minister of Transport, concerning inland waterway vessel inspection, corresponding to Appendix 2 attached hereto.
Article 8. Effective Date
1. This Circular takes effect from December 15, 2020.
2. The Director of the Ministry's Office, the Chief Inspector of the Ministry, the Heads of Departments, the Director of the Vietnam Registration Agency, the Heads of agencies, organizations, and individuals related to this matter are responsible for enforcing this Circular./.
