At the proposal of the Director of the Department of Science and Technology,

The Minister of Information and Communications issues this Circular regulating the application of standards and technologies supporting people with disabilities to access and use information and communication products and services.

Article 1. Scope of Regulation

This Circular regulates the application of standards and technologies supporting people with disabilities to access and use information and communication products and services.

Article 2. Applicability

This Circular applies to:

1. Enterprises producing and distributing information and communication products and services, including hardware, software, and digital content.

2. State agencies, including Ministries, ministerial-level agencies, government agencies, People's Committees at all levels, and units funded by the state budget that design and build electronic information websites/government portals/e-government portals.

3. News agencies with permits for radio and television broadcasting; news agencies with electronic information websites/electronic newspapers.

4. Organizations providing public services and administrative public services.

Article 3. List of Standards

1. Standards supporting people with disabilities to access and use information and communication products and services are prescribed to be applied in two forms: mandatory application and recommended application. The form of application for each standard is specified in detail in the Appendix to this Circular.

2. Encourages organizations and enterprises to apply new versions of standards to support people with disabilities to access and use information and communication products and services.

3. The list of standards supporting people with disabilities to access and use information and communication products and services shall be reviewed and updated, revised, and supplemented periodically in accordance with practical circumstances.

Article 4. Provisions for news agencies with permits for radio and television broadcasting

1. News agencies with permits for radio and television broadcasting providing channels of television programs serving political tasks and essential national information dissemination have the responsibility to apply standards and technologies supporting people with disabilities to hear and access daily comprehensive political news programs on their channels.

2. Encourages news agencies with permits for radio and television broadcasting in provinces and centrally-administered cities to apply standards and technologies supporting people with hearing disabilities.

Article 5. Provisions for electronic information websites/government portals/e-government portals

1. Electronic information websites/government portals/e-government portals of agencies and organizations specified in Clause 2 and Clause 3, Article 2 of this Circular shall apply standards and technologies supporting people with disabilities to access and use information and communication products and services as specified in the Appendix to this Circular.

2. Encourages other organizations and individuals to apply standards and technologies supporting people with disabilities to access and use information and communication products and services as specified in the Appendix to this Circular for their electronic information websites/government portals.

Article 6. Implementation Provisions

1. This Circular takes effect from January 1, 2021 and replaces Circular No. 28/2009/TT-BTTTT dated September 14, 2009 of the Minister of Information and Communications on the application of standards and technologies supporting people with disabilities to access and use information technology and communication.

2. In cases where agencies and organizations specified in Clause 2, Clause 3, and Clause 4 of Article 2 of this Circular have not yet implemented upgrades to their electronic information websites/government portals/e-government portals to comply with the provisions in the Appendix to this Circular, within 12 months from the date this Circular takes effect, these agencies and organizations shall be responsible for applying, upgrading, and completing their electronic information websites/government portals/e-government portals to ensure compliance with the provisions of this Circular.

Article 7. Implementation Organization

1. The Heads of the Office, the Directors of the Department of Science and Technology, the Heads of agencies and units under the Ministry of Information and Communications, the Directors of Provincial Departments of Information and Communications, and related organizations and individuals are responsible for implementing this Circular.

2. During the implementation process, organizations and individuals are responsible for promptly reflecting difficulties and obstacles to the Ministry of Information and Communications (Department of Science and Technology) for consideration and resolution./.
